Abstract: This article discusses several aspects of sharia compliance framework in the operational of sharia banking in Indonesia. The aspects are institutional, banking products, liquidity management and financial instrument. From the perspective of legal history, it is discovered that sharia legal compliance evolved from speculative and simplistic to articulate and perfectionist. Institutionally, the arrangement is oriented on structural strengthening and display of sharia identity. There is a tension between the aspiration of institutional development and the decrease of sharia compliance into certain degrees. From the aspect of business activity, sharia compliance is comprehensive by formulating Islamic law which is a reference and transforms it to legal framework as well as elaborates supervisory institution. As to liquidity management and financial instrument, instruments which is compatible with sharia character is elaborated. Abstrak: Artikel ini membahas tentang kerangka yuridis kepatuhan syariah dalam operasional perbankan syariah di Indonesia dari beberapa aspek, yaitu kelembagaan, kegiatan usaha dan pengelolaan likuiditas serta instrumen keuangan. Dengan pendekatan sejarah perundang-undangan ditemukan bahwa kerangka yuridis kepatuhan syariah mengalami perkembangan dari semula bersifat spekulatif dan simplistik menjadi bersifat artikulatif dan perfeksionis. Secara kelembagaan, pengaturan diorientasikan kepada penguatan struktur dan penampilan identitas kesyariahan. Di sini terdapat ketegangan antara tujuan pengembangan kelembagaan dan penurunan tingkat kepatuhan syariah hingga derajat tertentu. Dalam aspek kegiatan usaha, kepatuhan syariah telah komprehensif dengan memformulasikan hukum Islam yang menjadi acuan dan mentransformasikannya menjadi bagian peraturan perundang-undangan, serta mengelaborasi lembaga pengawasan. Sedangkan dalam aspek pengelolaan likuiditas dan instrumen keuangan, telah dielaborasi instrumen-instrumen yang kompatibel dengan karakter kesyariahan bank syariah.

This article attempts to explore the Islamic interpretation within the legal framework of the Malayan indigenous sovereignty. The position of Islam within the country’s legal framework became important when the Court’s decision in Che Omar Che Soh vs the Public Prosecutor, made the sovereignty of the Malay Rulers as a parameter in interpreting Islam within the context of Article 3 of the Federal Constitution. This is a qualitative study applying the legal history design. The findings showed the indigenous sovereignty was sourced from the Islamic teachings which had not been dissolved despite the introduction of the doctrine of advice by the British. Besides, the agreement made between the Malay Rulers and the British retained the indigenous sovereignty despite of various policies introduced by the British throughout their interference in Malaya which was subjected to the old Malayan Constitution. In conclusion, the accurate interpretation of Islam should be based on the al-Qur'an and al-Sunnah because it is in line with the principle of the indigenous sovereignty inherited from the Malay Sultanate of Malacca.

Aceh is a special province in Indonesia and different from other Indonesian provinces especially in the context of Shari'ah related laws. Aceh was granted special autonomy and legal right by the Indonesian central government in 2001 to fully apply Islamic law in the province. Generally, Islamic law which is applicable to Muslims in Indonesia is limited to personal laws just as in Malaysia. However, with the passage of time, Islamic law has expanded to include Islamic banking and finance. Besides that, Islamic law in Aceh is also extended to govern criminal matters which are in line with the motto of Aceh Islamic government to apply Islamic law in total or kaffah. Since 1999, the legal administration of Aceh has begun to gradually put in place the institutional framework to ensure that Islamic law is properly administered and implemented. Equally important, such framework is also aimed to ensure that punishments are fairly executed. This paper attempts to analyse the extent of the applicability of Islamic criminal law in Aceh. It is divided into three major parts. The first part discusses the phases in making Aceh an Islamic province and the roles played by Dinas Syariat Islam Aceh as the policy maker in implementing Islamic law as well as educating and training the public about the religion of Islam. The second part gives an overview on the Islamic criminal law and punishment provided in Qanun Aceh No.6/2014 on Hukum Jinayat (hereinafter Qanun Hukum Jinayat or “QHJ”) as well as the criminal procedural law concerning the methods of proof codified in Qanun Aceh No.7/2013 on Hukum Acara Jinayat (hereinafter “QAJ”). The third part of this paper highlights the challenges in the application and implementation of Islamic criminal law in Aceh, and accordingly provides recommendations for the improvement of the provisions in the QHJ and QAJ. Inputs from the interviews with the drafters of QHJ, namely Prof. Dr. Hamid Sarong and Prof. Dr Al Yasa are utilized in preparing this paper. In addition, inputs gathered from nongovernmental organizations (NGOs), namely Indonesian Syarie Lawyers Association (APSI) and Jaringan Masyarakat Sipil Peduli Syariah (JMSPS) are employed. The findings of this research are important in providing an in-depth understanding on the framework of Islamic criminal law in Aceh as well as in recognizing the flaws in its application or practical aspects of the law in Aceh. Abstrak Aceh merupakan sebuah Wilayah Istimewa di Indonesia dibandingkan dengan wilayah-wilayah lain dari segi pelaksanaan undang-undang Islam. Aceh diberi status Wilayah Istimewa yang berautonomi oleh Pemerintah Pusat Indonesia pada tahun 2001 untuk melaksanakan undang-undang Islam secara menyeluruh. Pemakaian dan pelaksanaan undang-undang Islam di Aceh tidak terhad pada Undang-undang jenayah tetapi telah meliputi bidang perbankan dan kewangan Islam. Sejak tahun 1999, Pentadbiran Undang-undang Aceh telah merangka undang-undang bagi memastikan undang-undang Islam dapat ditadbir dan dilaksanakan dengan baik. Selain itu juga, undang-undang yang dirangka juga turut bertujuan untuk memastikan hukuman yang berasaskan undang-undang Islam dapat dilaksanakan secara adil. Oleh itu, kajian dalam kertas kerja ini dibuat uuntuk menganalisa sejauh mana undang-undang jenayah Islam dilaksanakan di Aceh. Kertas ini terbahagi kepada tiga bahagan utama, yang mana bahagian pertama membincangkan latas belakang awal kewujudan wilayah Islam Aceh dan peranan yang dimainkan oleh Dinas Syariat Islam Aceh sebagai mpembuat dasar dalam pelaksanaan undang-undang Islam, mendidik serta menyediakan latihan kepada masyarakat umum di Aceh mengenai Islam. Bahagian kedua menyediakan gambaran umum tentang undang-undang jenayah dan hukuman dalam Islam sebagaimana termaktub dalam Qanun Aceh No.6/2014 berkenaan Hukum Jinayat (“Qanun Hukum Jinayat” atau “QHJ”) serta undang-undang prosedur jenayah berkenaan cara pembuktiaan jenayah sebagaimana yag termaktub dalam Qanun Aceh No.7/2013 berkenaan Hukum Acara Jinayat (“QAJ”). Bahagian ketiga kertas ini menekankan masalah atau cabaran yang dihadapi daam pelaksanaan undang-undang jenayah Islam di Aceh, serta menyediakan cadangan-cadangan bagi penambahbaikan peruntukan-peruntukan yang ada dalam QHJ dan QAJ. Maklumat hasil dari temuramah dengan Prof. Dr. Hamid Sarong dan Prof. Dr Al Yasa telah digunakan bagi menyiapkan makalah ini. Selain itu, maklumat yang diperolehi daripada organisasi bukan kerajaan iaitu Indonesian Syarie Lawyers Association (APSI) dan Jaringan Masyarakat Sipil Peduli Syariah (JMSPS) turut dimanfaatkan. Dapatan dari kajian ini penting bagi menyediakan kefahaman terhadap kerangka undang-undang jenayah Islam di Aceh serta mengenal pasti masalah dalam aspek peruntukan undang-undang tersebut atau pelaksanaannya di Aceh. AbstractForensic evidence is an evolving science in the field of criminal investigation and prosecutions. It has been widely used in the administration of justice in the courts and the Western legal system, particularly in common law. Ia telah digunakan secara meluas dalam pentadbiran keadilan di mahkamah dan sistem undang-undang Barat, terutamanya dalam undang-undang common (common law). Untuk menampung kaedah pembuktian baru ini dalam undang-undang Islam, artikel ini, pertamanya, konseptualisasikan bukti forensik dalam undang-undang Islam. Kedua, ia menerokai rangka kerja undang-undang untuk penerimaannya dalam undang-undang Islam.Kata Kunci: Bukti Forensik, Rangka Kerja Guaman, Siasatan Jenayah, Sharīʿah.

A mutual insurance society is one of the basic forms of conducting insurance activity. It is characterized by a very wide range of options which its founders and subsequently entitled members have in order to choose the organizational and systemic model of operation, to change it in the course of business, to define the concept of membership, to create various categories of members and provide them with different rights and duties, to determine the powers of statutory bodies, and, above all, to apply the method of mutuality. The Insurance and Reinsurance Activity Act regulates the basic legal framework of mutual companies, while referring quite a number of issues to the Polish Commercial Partnerships and Companies Code. This does not alter the fundamental principle on which the company's activity is based, namely that its articles of association play an extremely important role, which is much greater than in the case of public limited liability companies, and that members of a mutual insurance society enjoy considerable freedom to conduct business and categorize its members, which is unparalleled for other legal forms of business activity.

The legal system or commonly referred to as the legal tradition, has a wealth of scientific treasures that can be examined in more depth through a holistic and comprehensive comparative process. Exactly, the comparison of the legal system must accommodate at least three legal systems that are widely used by countries in the world today. The three legal systems are the Continental European legal system, Anglo American and Islamic Law. The comparative study of the three types of legal systems found that the history of the Continental European legal system is divided into 6 phases, while Anglo American legal history began in the feudalistic era of England until it developed into America and continues to be studied until now. Meanwhile, the history of Islamic law is divided into 5 phases, starting from the Phase of the Prophet Muhammad to the Resurrection Phase (19th century until nowadays). In addition to history, the authors find that the Continental European legal system has the characteristic of anti-formalism thinking, while the Anglo American legal thinking characteristic tends to be formalism and is based on a relatively primitive mindset. While the thinking character of Islamic Law is much influenced by the thought of the fuqoha (fiqh experts) in determining the law to solve a problem, so relatively dynamic and moderate.

Scholars of Islamic law, gender, and Africa will be pleased with the arrival of two important new volumes that are bold in their bringing together of ethnographic data with legal history and analysis. Margot Badran's Gender and Islam in Africa: Rights, Sexuality, and Law, and Christina Jones-Pauly and Abir Dajanfi Tuqan's Women under Islam: Gender Justice and the Politics of Islamic Law collectively advance a movement in Islamic legal studies that focuses on interdisciplinary explorations into the ways particular constructions of Islamic law are foregrounded and reified in accordance with the existential impulses and demands of a particular society at a particular time, what we might call the “hermeneutic of experience.” I would argue that gender functions as the category that most regularly exposes the limitations of various historically situated concepts of orthodoxy, and these books bear out this claim.

Abstract A growing number of domestic and international legal issues are confronting biodiversity collections, which require immediate access to information documenting the legal aspects of specimen ownership and restrictions regarding use. The Nagoya Protocol, which entered into force in 2014, established a legal framework for access and benefit-sharing of genetic resources and has notable implications for collecting, researchers working with specimens, and biodiversity collections. Herein, we discuss how this international protocol mandates operating changes within US biodiversity collections. Given the new legal landscape, it is clear that digital solutions for tracking records at all stages of a specimen's life cycle are needed. We outline how the Harvard Museum of Comparative Zoology (MCZ) has made changes to its procedures and museum-wide database, MCZbase (an independent instance of the Arctos collections management system), linking legal compliance documentation to specimens and transactions (i.e., accessions, loans). We used permits, certificates, and agreements associated with MCZ specimens accessioned in 2018 as a means to assess a new module created to track compliance documentation, a controlled vocabulary categorizing these documents, and the automatic linkages established among documentation, specimens, and transactions. While the emphasis of this work was a single year test case, its successful implementation may be informative to policies and collection management systems at other institutions.

This paper analyses the right of Muslim adopted children to inherit from their deceased parents in terms of the laws of succession within the South African legal context. The status of adoption in South African and Islamic law is looked at first by way of an introduction. This is followed by looking at the rights of adopted Muslim children to inherit from their deceased parents (biological and adoptive) in terms of the South African and Islamic laws of intestate (compulsory) and then testate (optional) succession.1 The paper further looks at the possibility of applying relevant Islamic law of succession provisions applicable to enable adopted Muslim children to inherit from the estate of their deceased biological parents within the South African legal framework. The paper concludes with an analysis of the findings and makes a recommendation.


The sensitive nature of mobile network forensics requires careful organization of the investigative processes and procedures to ensure legal compliance and adequate privacy protection. Investigations in mobile networking environments can be conducted for two main purposes: (1) to reconstruct criminal activities facilitated by a use of a mobile service and (2) to attribute malicious attacks targeting the normal operation of the mobile infrastructure. In both cases, investigators need to know the concepts introduced in the previous chapters to operationalize any mobile network related investigation. This chapter elaborates the legal framework, the general investigative principles, and evidence types characteristic for investigations in mobile network infrastructures.

This chapter focuses on the murabaha structure, which is probably the most commonly used Islamic finance structure in modern Islamic banking. The simplicity of structure in its current application has promoted its use as a popular and flexible Islamic financing instrument. Indeed, the use of the murabaha has been extended beyond a widespread application as a standalone instrument to a composite component of Sukuk issuance in modern application. The murabaha contract is understood within the Islamic tradition to have a pre-Islamic origin evidenced in pre-Islamic literature and characterized as a fiduciary contract with the objective to assist less knowledgeable buyers in the determination of the fair price of unfamiliar goods. Today, murabaha is commonly used as a mode of finance, in its variant structures, for the acquisition of assets, commodities, and goods in the ordinary course of trade. The structure is also used as a corporate finance tool for working capital and liquidity management. The chapter then considers commodity murabaha (tawarruq) and its application.
