This chapter discusses how the reclamation of citizenship, the restitution of property, and negotiations for reparations stretched across postwar Europe, with some activities continuing into the twenty-first century. In western and central Europe, Jews quickly regained citizenship. France, Italy, and Holland abrogated Nazi decrees to restore Jews' citizenship; Germany granted citizenship irrespective of religion. In east-central and eastern Europe, in contrast, Jews struggled to regain or retain rights. Stalin's and Khrushchev's governments discriminated against Jews throughout Soviet society; they effectively turned Jews into second-class citizens. In Hungary, Jews experienced a second “reverse emancipation.” Romania purged the state apparatus and arranged for Israel to ransom Jews for hard currency. Poland gave Jews citizenship de jure yet began to discriminate against them. Meanwhile, the governments of Holland, Belgium, Czechoslovakia, and France laid the legal foundation for restitution during the war by declaring Nazi expropriations illegal. Eighteen governments signed a declaration to restore property.

Civil society has been widely celebrated as instrumental in democratization, but in some countries it remains poorly developed. Such was the case in Turkey, but many hoped that the 1999 earthquakes would lead to an invigoration of civil society and subsequent political liberalization. Examining this claim shows that Turkish civil society has not been able to sustain the energy it enjoyed immediately after the earthquake because of factors within civil society itself and the attitude of the state. This relative failure is then contrasted with the more positive experience of civil society in East-Central Europe. The comparisons reveal some limits to the utility of a civil society approach to democratization. I conclude by assessing the ability of other actors and factors to fashion political reform in Turkey today.

Abstract In East-Central Europe, the past has always been a determining factor as a framework for interpretation: the social construction of the past often serves (served) current political purposes. It is no wonder that in the countries of the region, often different, sometimes contradictory interpretations of the past have emerged. In today’s European situation, however, the countries of Central and Eastern Europe are perhaps most keenly faced by the transformation of Europe, with unclear, chaotic ideas dominating political and intellectual markets instead of previous (accepted) values – in the tension between old and new, Europe’s future is at stake. The question is: what role the states of Central and Eastern Europe play/can play, to what extent they will be able to place the neighbourhood policy alongside (perhaps in front of) the policy of remembrance and seek common answers to Europe’s great dilemmas.

Few events have drawn as much interest from the academic community as the breakdown of Soviet-style socialism in Central and Eastern Europe and the subsequent disintegration of the Soviet Union itself in the late 1980s and early 1990s. This paper might be classified as yet another in a continuous flow of scientific contributions, inspired by the collapse of communism. And this is indeed the case, but only in an oblique way.

This chapter explains the process of peaceful change in Central and Eastern Europe following the demise of the Soviet system. It also explains the failure of peaceful change in the Balkans and some post-Soviet countries, such as the Ukrainian conflict in 2014. The chapter accounts for the conditions for peaceful change and for the variation between peaceful and violent change by the state-to-nation theory. The two independent variables suggested by the theory are the level of state capacity and congruence—namely the compatibility between state borders and the national identities of the countries at stake. Moreover, according to the theory, great-power engagement serves as an intervening variable and in some conditions, as explained in the chapter, may help with peaceful change.

Secular law remained largely customary and uncodified in east central Europe. While much of south-eastern Europe had remained Christian ever since Roman times, most of east central Europe was Christianized during the high Middle Ages. The Baltic region came later, Lithuania only being converted after 1387. South-eastern Europe was influenced first by Byzantine and then Italian law. In much of east central Europe secular law was based on Slavic customs, later influenced by canon law and German law. The Sachsenspiegel, Schwabenspiegel, and German town law spread to the whole region alongside the German colonization of east central Europe. Towns functioned as conduits of German and learned law. Certain territorial rulers actively promoted Roman law and (partial) codification, while the local nobility preferred uncodified customary law. In addition to foreign university studies, the fourteenth-century universities of Prague and Krakow, cathedral chapters, and notaries helped disseminate the ius commune into the region.
