Audiobook access for people with disabilities is very important. Access is the convenience that people get from a service. This study aims to analyze the legal certainty and legal protection of audiobook copyright access for blind people with disabilities. This study uses a normative legal research method with a statutory approach and comparative approach. This research found that access to audiobooks' works has been regulated in the Marrakech Treaty, Copyright Act Number 28 of 2014 and Government Regulation Number 27 of 2019. Akses karya cipta audiobook bagi disabilitas sangat penting. Aksesibilitas merupakan kemudahan yang didapat oleh orang terhadap suatu layanan. Penelitian ini bertujuan untuk menganalisis kepastian hukum serta perlindungan hukum akses karya cipta audiobook bagi disabilitas tuna netra. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan komparatif. Dalam penelitian ini menemukan bahwa akses karya cipta audiobook telah diatur dalam Traktat Marrakesh, UUHC 2014 serta Peraturan Pemerintah Nomor 27 Tahun 2019.

An auction is an activity of selling of goods in public by means of a verbal-bid to get the higher price or to get lower prices and the price quote can be done in a closed and written. This is done by the way of collecting the prospective buyers of the auction led by officials of the auction. In this case, the intended auction was the sale of goods that are held publicly. The auction, according to the regulations of security right, is when the debtor made a breach, the holder of the security rights have the right to sell the security rights’ objects over its own power through a public auction as well as taking payment of account receivable from the sale proceeds. An auction is an alternative to the sale of an undertaken asset by way of inviting prospective buyers at a particular time and place in which the last highest bidder in writing or orally is determined as the winner. The author used socio-legal research as his research method. To meet the forth standards set by the law, the auction should be widely announced to the public, either through printed file, electronic or visual. A legal certainty as a basis which concerned with propriety and justice is very closely related to the principle of auction sales in another. As the formulation of the problem of the form of identification of the problem, namely how the legal protection of the auction buyers encountered the obstacles as well as the solution.Keywords: Auction; Legal Protection; Mortgage Right

The most detrimental thing is the use of domain names on internet networks that often use company name, brand and services without permission from the brand owner. The position of the brand is very important in the world of advertising and marketing. That happens because consumers in choosing a product related to the reputation of a brand, based on a sense of trust in the experience in using products with that brand. Aside from being a differentiator of a product with other products, a brand is also a valuable and commercial asset that has moral rights and economic rights. This study aims to analyse the preventive and repressive legal protection of trademark rights holders in e-commerce transactions. This research was conducted using the normative legal research method. The results of this study indicate that the preventive legal protection of trademark rights holders in e-commerce transactions is to register the trademark. The emphasis on preventive protection in this research is related to guarantees of the exercise of rights for brand rights holders in e-commerce transactions. That the presence of the government by drafting the Electronic Commerce Act and conducting socialization related to the legal protection of the parties in e-commerce is expected to be able to provide legal certainty of legal protection. Repressive legal protection in resolving trademark disputes is expected to create a guarantee for the enforcement of the rights of registered trademark rights holders in e-commerce transactions. Settlement of trademark disputes in e-commerce transactions can be done in 2 (two) ways, namely litigation and non-litigation.

Research on legal certainty the amount of basic capital establishment of limited liability company based on the norms of conflict between article 32 paragraph (1) of the limted liability company law concerning "the limited liability company capital of at least Rp 50,000,000.00" with article 1 paragraph (3) of government regulations The limited liability of the company's capital of limited liability concerning "the founding capital of the company is determined by agreement”. 2 problem are formulated: (1) What is the form for deposit of stock capital on the provisions of article 33 of the limited liability company law, (2) How is the legal certainty of the number of basic capital of the limited liability After the validity of government regulation change of the limited liability company. This purpose research is finding form of the deposit of stock capital and the basic capital of the limited liability company before and after enforcement of government regulation of limited liability of the company. The legal research method used normative legal research method with statute approach and conceptual approach. Capital deposits of shares can be made in the form of money and other forms of immovable tangible objects such as land and intangible objects in the form of bill of Rights; and arrangements regarding the underlying capital applicable in the establishment of the limited liability company is Article 1 paragraph (3) of government regulation of the limited liability of the company.

The purpose of this study is to provide legal certainty and to resolve disputes over land rights ownership for buyers who are acting in good faith when purchasing and selling inheritance. The research method is normative juridical, employing both a statutory and case-based approach. According to the study's findings, buyers with good intentions receive legal protection in the form of compensation. However, when parties with bad intentions violate Article 1267 of the Civil Code, the legal consequences of buying and selling inherited land are null and void, as they contain elements of fraud, oversight, and ignorance. additional heirs. Keeping in mind that the property being traded is inheritance land that already possesses permanent legal standing and cannot be traded without the approval of other heirs.Keywords: Legal Protection; Good Faith Buyers; and Inheritance Land.

Taxes make a major contribution to the source of state revenue which is used to finance development in Indonesia. However, there are still many taxpayers / tax insurer who are not compliant in paying taxes. The problems in this study are why the government uses tax hostages in collecting tax debts, how hostages are used as a means of force in collecting tax debts and how hostage-taking is viewed from a juridical aspect. The research method used in this research is normative legal research method. The result of the research is that there are several factors that become the reasons for tax hostage taking. The government (fiskus) in collecting tax debt with tax hostages has been carried out in accordance with the provisions of the law. Based on the aspect of legal certainty, tax hostages in Indonesia already have a legal umbrella, namely Law no. 9 of 2000 and several other regulations. From the aspect of justice, legal protection is provided to taxpayers / tax insurer who are subject to tax hostages. From the benefit aspect, the application of tax hostages is beneficial in increasing taxpayer compliance.

Tujuan penelitian ini untuk menganalisis perlindungan hukum terhadap produk wine salak desa sibetan berdasarkan Peraturan Pemerintah No 51 tahun 2007 tentang Indikasi Geogerafis. Tulisan ini menggunakan metode penelitian hukum empiris. Pendekatan yang digunakan dalam penelitian ini yakni pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa perlindungan hukum terhadap wine salak produksi desa Sibetan, kecamatan Bebandem kabupaten karangasem ditinjau dari Peraturan Pemerintah Nomor 51 Tahun 2007 tentang Indikasi-Geografis belum mampu meningkatkan perekonomian masyarakat setempat terbukti belum terdaftarnya sebagai indikasi geografis dan hal ini berdampak pada nilai jual wine tersebut yang terbilang murah seukuran produksi wine serta pemasarannya belum luas hanya sebatas wisatawan yang berkunjung saja. The purpose of this study was to analyze the legal protection of salak wine products in the Sibetan village based on Government Regulation No. 51 of 2007 concerning Geographical Indications. This paper uses an empirical legal research method. The approach used in this research is the statute approach and the conceptual approach. The results showed that the legal protection of salak wine produced in Sibetan village, Bebandem sub-district, Karangasem district in terms of Government Regulation Number 51 of 2007 concerning Geographical Indications has not been able to improve the local economy, it is proven that it has not been registered as a geographical indication and this has an impact on the selling value of the wine. which is relatively inexpensive about the size of wine production and its marketing is not extensive, only limited to visiting tourists.

Islam allows the marriage of more than one partner, provided that the husband can be fair and get permission from the first wife. As a result of polygamous marriages, there is legal uncertainty about joint assets, both in the first, second, third and fourth wives. The purpose of this paper is to find out the legal certainty of shared assets in polygamous marriages. The method used is a normative legal research method, using a regulatory approach, both Islamic law, Law Number 1 of 1974 and KHI. As a result, there is legal uncertainty especially for the first wife based on the Compilation of Islamic Law, specifically legal protection for the property with the wife brought in by her husband’s second marriage. According to Law No. 1 of 1974, each wife gets a second share, whereas according to Islamic law the status of a woman’s property does not change with the marriage. Keywords: polygamy, shared assets

Based on Article 88 of Law Number 13 of 2003 concerning Manpower, it states that a decent wage for humanity is a right for every worker. In Article 18 of Government Regulation Number 78 of 2015 concerning Wages states that employers are required to pay wages to workers at the agreed time between employers and workers, but in fact there are often delays in payment of wages to workers which of course affect the welfare of workers and his family. then Based on Article 95 number 2 of Law Number 13 of 2003 concerning Labor, states that if the entrepreneur who is due to his intentions or negligence resulting in delays in payment of wages, is subject to a fine. This writing aims to find out how the form of legal protection for workers in the event of late payment of wages and the need for an explanation of the penalties. The research method used in this study is normative legal research. The conclusion in this study is preventive protection (prevention) should companies be able to avoid delay in payment of wages to workers. It is good by the way the company manages the company's finances carefully so that late payment of wages to workers does not occur. Then repressive legal protection (after the dispute) is in accordance with Government Regulation Number 78 of 2015 concerning Wages that companies that delay payment of wages to workers do not only pay wages that are late to be paid, but also pay late fines regulated in this Government Regulations. Berdasarkan Pasal 88 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan menyatakan bahwa upah yang layak bagi kemanusiaan merupakan hak bagi setiap pekerja. Dalam Pasal 18 Peraturan Pemerintah Nomor 78 Tahun 2015 Tentang Pengupahan menyatakan bahwa pengusaha diwajibkan untuk membayarkan upah kepada para pekerja pada ketentuan waktu yang sudah diperjanjikan antara pengusaha dan pekerja, namun dalam kenyataanya kerap terjadi keterlambatan pembayaran upah terhadap para pekerja yang tentu saja mempengaruhi kesejahteraan dari para pekerja dan keluarganya. kemudian Berdasarkan Pasal 95 angka 2 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan menyebutkan bahwa apabila pengusaha yang dengan kelalaiannya atau kesengajaannya sehingga menyebabkan keterlambatan dalam pembayaran upah, dikenai sanksi denda. Penulisan ini memiliki tujuan untuk mengetahui bagaimanakah bentuk perlindungan hukum yang dapat diberikan kepada para pekerja dalam hal terjadinya keterlambatan pembayaran upah dan perlu adanya penjelasan mengenai sanksi denda tersebut. Penelitian hukum normatif dipilih untuk digunakan dalam penyusunan penulisan ini Kesimpulan dalam penelitian ini adalah perlindungan secara prefentif (pencegahan) seharusnya perusahaan dapat menghindari terjadinya keterlambatan pembayaran upah kepada para pekerja. Baik dengan cara perusahaan mengatur keuangan perusahaan dengan seksama sehingga keterlambatan pembayaran upah kepada pekerja tidak terjadi. Kemudian perlindungan hukum secara represif (setelah adanya sengketa) yaitu sesuai dengan Peraturan Pemerintah Nomor 78 Tahun 2015 Tentang Pengupahan bahwa perusahaan yang melakukan keterlambatan pembayaran upah kepada para pekerja tidak hanya membayar upah yang terlambat dibayarkan tersebut, melainkan juga membayar denda yang telat diatur dalam Peraturan Pemerintah ini.

The legal certainty for micro, small and medium enterprises in a partnership scheme is as a franchisee. Economic growth is so fast and advanced that many regulations by the central government and regional governments issue policies that cannot be implemented and result in no guarantee of legal certainty for the community. The purpose of this paper is to review the regulation of the minister of trade regarding franchising in 2019 related to legal certainty for micro, small and medium enterprises in the framework of a franchise business. The method used in this paper is a normative legal research method by analyzing the provisions of statutory regulations. The results of this study explain that based on the principle of lex superior derogate legi inferiori, the law with a higher position removes the laws that are under it, namely in the MSME partnership pattern in the franchise business, it should still use the rules in Government Regulation No. 17 of 2013 concerning the Implementation of Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises. Kepastian hukum usaha mikro, kecil dan menengah dalam pola kemitraan adalah sebagai penerima waralaba. Pertumbuhan ekonomi yang demikian cepat dan maju, menyebabkan banyak regulasi oleh pemerintah pusat maupun pemerintah daerah menerbitkan kebijakan–kebijakan yang belum dapat dilaksanakan dan berakibat tidak adanya jaminan kepastian hukum yang berkeadilan bagi masyarakat. Tujuan dari penulisan ini, untuk mengkaji peraturan menteri perdagangan tentang waralaba tahun 2019 terkait kepastian hukum bagi usaha mikro, kecil dan menengah dalam rangka bisnis waralaba. Metode yang digunakan dalam tulisan ini metode penelitian hukum normatif dengan menganalisa dari ketentuan peraturan perundang–undangan. Hasil penelitian ini menjelaskan bahwa  berdasarkan asas lex superior derogate legi inferiori mengakibatkan hukum yang kedudukannya lebih tinggi menghapus hukum yang ada di bawahnya yaitu dalam pola kemitraan UMKM dalam bisnis waralaba sudah seharusnya tetap menggunakan aturan dalam Peraturan Pemerintah No. 17 Tahun 2013 Tentang Pelaksanaan Undang-Undang Nomor 20 Tahun 2008 Tentang Usaha Mikro, Kecil dan Menengah.

At present, there are cases of persons with disabilities being employed in a retail company in the Bali area. The Manpower Act provides provisions for companies to employ people with disabilities. Therefore, companies are required to provide accessibility. This research was conducted with the aim of describing the implementation of legal protection for workers with disabilities at PT. Sumber Alfaria Trijaya based on Law Number 13 2003 and the factors that become obstacles in the application of legal protection for workers with disabilities at PT. Source Alfaria Trijaya. The research method used is an empirical legal research method with a factual approach and a statutory approach. Based on the results of data analysis, the implementation of legal protection provided by PT. Sumber Alfaria Trijaya towards workers with disabilities has not been fulfilled, namely in terms of providing qualified accessibility. Several factors inhibiting the implementation of legal protection efforts for workers with disabilities, namely the law enforcement factor itself and the community factor. So the government is expected to further optimize the supervision of companies that have not implemented the mandate of the law and provide socialization and guidance to companies and workers on the importance of rights and obligations.
