The local government is given authority by the constitution to establish local regulations. Problems are arise when there are local regulation that not compatible with the constitution. The next question that arises is who is authorized to examine local regulations that not compatible with the constitution. In contrary with those considerations, the substantial problems are formulated into two, regulations about examine local regulations with the constitution and  who is authorized to examine local regulations with the constitution. This legal research is normative legal research. This research used the statute approach and conceptual approach. Legal materials analysis techniques that are used in this research are description and interpretation techniques. There is no regulation about examine local regulations with the constitution. The way that can be done to examine local regulations with the constitution is lodge a judicial review to the Supreme Court and than lodge a constitutional review to the Constitutional Court. The other way to do is through a constitutional complaint, but this mechanism is not owned by the Constitutional Court. The establishment of examine local regulations with the constitution is important to provide legal certainty and the protection of constitutional rights to the citizens.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Jaminan konstitusi terkait hak konstitusional untuk mendapatkan pekerjaan dalam Pasal 28D ayat (2) UUD NRI 1945 dan hak konstitusional untuk membentuk keluarga dalam Pasal 28B ayat (1) UUD 1945 telah dibatasi dengan adanya ketentuan Pasal 153 ayat (1) huruf f Undang-Undang No 13 Tahun 2003 tentang Ketenagakerjaan. Keberadaan perjanjian kerja menghalangi hak pekerja untuk menikah dalam satu institusi karena pekerja harus mengalami pemutusan hubungan kerja untuk dapat melaksanakan haknya membentuk keluarga yang sebenarnya dijamin dalam konstitusi dan peraturan perundang- undangan. Pengujian Pasal 153 ayat (1) huruf f UU No 13 Tahun 2003 dalam Putusan Mahkamah Konstitusi Nomor 13/PUU-XV/2017 telah menyatakan frasa "kecuali telah diatur dalam perjanjian kerja, peraturan Perusahaan, atau perjanjian kerja bersama" bertentangan dengan UUD 1945. Artikel ini hendak menjawab kekuatan mengikat dan akibat hukum putusan, sekaligus Penegakan putusan dengan memetakan penyelesaian terkait peraturan perundang-undangan dan perjanjian kerja yang tidak tidak sesuai dengan putusan dan bertentangan dengan prinsip kebebasan berkontrak. Penelitian ini didasarkan pada penelitian kualitatif, dimana sumber analisis yakni Putusan MK terkait permasalahan yang diangkat, peraturan perundang-undangan, buku dan artikel ilmiah. Artikel ini hendak memetakan penyelesaian yang sesuai terkait kepada perjanjian kerja yang tidak menjamin hak pekerja yang dijamin dalam konstitusi, serta bertentangan dengan prinsip kebebasan berkontrak. yakni: pertama, penyelarasan peraturan perundang undangan di bawah Undang-undang judicial review di Mahkamah Agung, kedua, penyelesaian perselisihan hak melalui Pengadilan Hubungan Industrian yang akan menguji penegakan putusan dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama.The constitutional guarantee regarding constitutional rights to obtain employment in Article 28 D paragraph (2) of the 1945 Constitution of the Republic of Indonesia and the constitutional rights to form a family in Article 28 B paragraph (1) of the 1945 Constitution has been limited by the provisions of Article 153 paragraph (1) letter f Law No. 13 of 2003 concerning Labor. The existence of a work agreement prevents the right of workers to get married in one institution because workers must experience termination of employment to be able to exercise their rights to form a family which is actually guaranteed in the constitution and legislation. Testing Article 153 paragraph (1) letter f of Law No. 13 of 2003 in the Decision of the Constitutional Court Number 13/PUU-XV/2017 has stated the phrase "except as stipulated in work agreements, company regulations, or collective labor agreements" contrary to the 1945 Constitution. This article is about to answer the binding and consequent legal power of the decision, as well as Enforcement of decisions by mapping out solutions related to legislation and work agreements that are not incompatible with decisions and are contrary to the principle of freedom of contract. This research is based on qualitative research, where the source of analysis is the Constitutional Court Decision related to the issues raised, legislation, scientific books, and articles. This article intends to map appropriate solutions related to work agreements that do not guarantee workers’ rights guaranteed in the constitution, as well as contrary to the principle of freedom of contract. namely: first, alignment of legislation under the judicial review law in the Supreme Court, secondly, settlement of rights disputes through the Industrial Relations Court which will test enforcement of decisions in work agreements, company regulations, or collective labor agreements.

The Indonesian constitutional system contains a serious flaw that means that the constitutionality of a large number of laws cannot be determined by any court. Although the jurisdiction for the judicial review of laws is split between the Constitutional Court and the Supreme Court, neither can review the constitutionality of subordinate regulations. This is problematic because in Indonesia the real substance of statutes is often found in implementing regulations, of which there are very many. This paper argues that that is open to the Constitutional Court to reconsider its position on review of regulations in order to remedy this problem. It could do so by interpreting its power of judicial review of statutes to extend to laws below the level of statutes. The paper begins with a brief account of how Indonesia came to have a system of judicial constitutional review that is restricted to statutes. It then examines the experience of South Korea’s Constitutional Court, a court in an Asian civil law country with a split jurisdiction for judicial review of laws like Indonesia’s. Despite controversy, this court has been able to interpret its powers to constitutionally invalidate statutes in such a way as to extend them to subordinate regulations as well. This paper argues that Indonesia’s Constitutional Court should follow South Korea’s example, in order to prevent the possibility of constitutionalism being subverted by unconstitutional subordinate regulations.

AbstrakPenelitian ini membahas tentang penafsiran Mahkamah Konstitusi dalam pengujian Undang-Undang Nomor 8 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang putusannya mengabulkan sebagian permohonan pemohon berupa perubahan terhadap komposisi anggota Majelis Kehormatan Mahkamah Konstitusi, yakni Putusan Mahkamah Konstitusi No. 49/PUU-IX/2011. Ada dua permasalahan yang diteliti dalam penelitian ini, yaitu Pertama, apakah masuknya unsur DPR, Pemerintah dan Mahkamah Agung bertentangan dengan Pasal 1 ayat (3) dan Pasal 24 ayat (1) dan ayat (2) UUD 1945? Kedua, apakah implikasi putusan pembatalan Pasal 27A ayat (2) huruf C, D, dan E terhadap mekanisme saling kontrol (chekcs and balance) antar cabang kekuasaan negara (eksekutif, legislatif dan yudikatif) di Indonesia? Metode penelitian yang digunakan yakni penelitian yuridis normatif dengan menggunakan pendekatan konseptual, selain itu, dikaji dengan studi kasus yang berkaitan dengan materi yang dikaji. Hasil dari penelitian ini adalah, pertama: berdasarkan kajian Putusan Mahkamah Konstitusi No. 49/PUU-IX/2011 yang mengabulkan sebagian permohonan pengujian Undang-Undang Nomor 8 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Mahkamah Konstitusi menyatakan bahwa pembuat undang-undang telah membahayakan kemerdekaan kekuasaan kehakiman sebagaimana diatur dalam pasal 1 ayat (3) dan Pasal 24 ayat (1) dan ayat (2) UUD 1945 dengan memasukan unsur Pemerintah, DPR dan Mahkamah Agung dalam keanggotaan Majelis Kehormatan Mahkamah Konstitusi. Kedua, Putusan tersebut berimplikasi pada keanggotaan Majelis Kehormatan Mahkamah Konstitusi yang terdiri dan terbatas atas 2 (dua) unsur yaitu Mahkamah Konstitusi dan Komisi Yudisial. Karena itu utusan Mahkamah Konstitusi tersebut dianggap telah berhasil menjaga berlakunya asas check and balance antar 3 (tiga) cabang kekuasaan (eksekutif, legislatif dan yudikatif) dalam sistem ketatanegaraan indonesia.AbstractThis research elaborates the Constitutional Court interpretation within Decision No. 49/PUU-IX/2011 on judicial review of Law No. 8 of 2011 on amendments of Law No. 24 of 2003 on the Constitutional Court which its decision has granted mostly the petitioner’s petitions to change the Honorary Council of the Constitutional Court members composition. There are at least two examined issues in this study, they are: Firstly, does the addition of elements House of Representative, Government and the Supreme Court contradict Article 1 paragraph (3) and Article 24 paragraph (1) and (2) of the 1945 Constitution? And secondly, what is the implication of the decision to repeal Article 27A paragraph (2) letters C, D, and E for check and balance between three branches of state government (executive, legislative and judicial) in Indonesia? This research is normative legal research that uses a conceptual approach, also reviewed with case studies related to material research. The results show; Firstly, based on the study to Indonesian Constitutional Court Decision No. 49/PUU-IX/2011 which accepted most of the petitioner’s petitions on judicial review of Law No. 8 of 2011, the Constitutional Court stated that the addition of elements House of Representative, Government and the Supreme Court as members in the Honorary Council of the Constitutional Court then legislators have endangered the freedom of judicial power as regulated Article 1 paragraph (3) and Article 24 paragraph (1) and (2) the 1945 Constitution. Secondly, this decision has an impact on the members of the Honorary Council of the Constitutional Court which only consists of two elements, namely the constitutional court and the judicial commission. Therefore, the Constitutional Court Decision is considered successful in keeping the principle of check and balance between three branches of state government in the Indonesian constitutional state system.

Observing the development of public acceptance of the substance of the laws that were generated in recent time, the right of judicial review of an option that can not be avoided for the 'correct' errors that might occur in a legal product to guarantee the protection of constitutional rights of citizens. The tendency in this direction can be seen from the desire of some community groups to apply for judicial review and claim that they are legal products containing controversial value both to the Supreme Court nor the Constitutional Court. If prior to the amendment of the 1945 Constitution, laws and regulations that can be petitioned for review of material just under the Act against the Constitution, but after the 1945 amendment, the legislation level as the Act was that the Act and also Perpu material can be petitioned for review to the Constitutional Court.

AbstractThe guarantee of citizens' constitutional rights is one of the conditions for realizing an excellent legal state. However, several studies show that there is no precise mechanism for filing constitutional complaints. Although since 2003, a Constitutional Court has been established. This article aims to describe the problems of filing a constitutional complaint in Indonesia. This article is based on doctrinal legal research with a statutory and conceptual approach. The results of this study indicate that there is no regulation that authorizes the handling of constitutional complaint cases to the Constitutional Court. Judges of the Constitutional Court are rigid in examining cases under their authority and have never exercised discretion over them. This condition has the potential to ignore the constitutional rights of citizens. So there is a need for an amendment to the 1945 Constitution and a revision to the Constitutional Court Law. However, this change requires political will from the authorities.Keywords: constitusional complaint; constitutional court; discretion.Abstrak Jaminan hak konstitusi warga negara merupakan salah satu syarat terwujudnya negara hukum yang baik. Namun, sejumlah riset menunjukkan bahwa belum ada mekanisme yang jelas pengajuan constitutional complain. Meskipun sejak tahun 2003 telah dibentuk Mahkamah Konsititusi. Artikel ini bertujuan mendeskripsikan problematika pengajuan constitutional complain di Indonesia. Artikel ini berdasarkan penelitian hukum doktrinal dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa belum ada regulasi yang memberikan kewenangan penanganan perkara constitutional complaint kepada Mahkamah Konsitusi. Hakim Mahkamah Konstitusi rigid dalam memeriksa perkara yang menjadi kewenangannya dan tidak pernah melakukan diskresi terhadapnya. Kondisi ini berpotensi mengabaikan hak-hak konstitusi warga negara. Sehingga perlu adanya amandemen Undang-Undang Dasar 1945 dan revisi terhadap Undang-Undang Mahkamah Konstitusi. Namun, perubahan ini membutuhkan political will dari penguasa.Kata Kunci: constitutional complaint; mahkamah konstitusi; diskresi.

Perkembangan pertumbuhan sistem ekonomi syariah, menuntut terhadap adanya penyesuaian-penyesuaian aturan hukum yang diberlakukan, khususnya terkait dengan penyelesaian sengketa yang terjadi. Baik secara litigasi maupun secara non litigasi. Termasuk bagian upaya penyelesaian ekonomi syariah, adalah melalui badan arbitrase syariah. Namun dalam perspektif yuridis, aturan mengenai kewenangan memberikan putusan eksekusi dan pembatalan terhadap putusan arbitrase syariah masih terjadi dualisme antara Peradilan Umum dan Peradilan Agama. Hal ini mencerminkan adanya ketidakpastian hukum dalam masalah tersebut. Melalui penelitian hukum normatif atau penelitian hukum doktrinal ini, penelitian ini bertujuan untuk menemukan jawaban-jawaban yang benar dengan melakukan pembuktian kebenaran yang dicari dari preskripsi-preskipsi hukum yang tertulis dalam kitab Undang-Undang serta sumber hukum lainnya. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan historis (historical approach). Penelitian ini difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma norma dalam hukum positif tentang kepastian hukum pelaksanaan eksekusi dan pembatalan putusan arbitrase syariah, khususnya pasca Putusan Mahkamah Konstitusi Nomor 93/PUU-X/2012. Pertentangan norma hukum tentang kewenangan pelaksanaan eksekusi dan pembatalan putusan arbitrase tersebut, meskipun secara yuridis terdapat pertentangan, namun  Mahkamah Agung telah melakukan langkah politik hukum untuk menyelesaikan dualisme kewenangan tersebut yang dapat menyelesaikan dalam jangka waktu pendek. Namun untuk penyelesaian jangka panjang, perlu adanya pembenahan terhadap peraturan perundang-undangan yang ada, guna menjamin kepastian hukum bagi para pencari keadilan.The development of the growth Islamic economic system requires the adjustments to the rule of law applied, particularly related to the settlements of disputes that occur, both litigation and non-litigation. One of the parts of  efforts to solve sharia economics is through Islamic arbitration bodies. But in a juridical perspective, the rules regarding the authority to give execution decisions and cancellation of sharia arbitration decisions still occur between the General Justice and the Religious Courts. This reflects the legal uncertainty for the case. Through normative legal research or doctrinal legal research, this study aims to find the correct answers by carrying out the verification of the truth sought from the legal prescriptions written in the law and other legal sources. By using statute approach and historical approach, this research is focused on examining the application of norms in positive law regarding legal certainty in the execution and cancellation of sharia arbitration decisions, especially after the Decision of the Constitutional Court Number 93/PUU-X/2012. Contradicting legal norms regarding the authority to carry out the execution and cancellation of the arbitration decision, even though there is a juridical conflict, the Supreme Court has taken legal political steps to resolve the dualism of authority which can be resolved in the short term. Yet for long-term solutions, it is necessary to reform existing laws and regulations to ensure legal certainty for justice seekers.

This research is intended to discuss the relevance of the application of presidential threshold and the implementation of simultaneous general elections in Indonesia. The concept of simultaneous general elections is the implementation of legislative and executive elections which are carried out simultaneously. The implementation of the first simultaneous general elections in Indonesia was motivated by a request for a judicial review of Law Number 42 Year 2008 concerning the Election of the President and Vice President. The Constitutional Court issued the Constitutional Court Decision Number 14/PUU-IX/2013 with the decision granting part of the request which later gave birth to the implementation of simultaneous elections in Indonesia starting in 2019. However, from the various articles that were reviewed, there was one article that was not decided by the Constitutional Court, namely regarding the presidential threshold. The Constitutional Court is of the opinion that the regulation regarding the presidential threshold is an open legal policy for the legislature. This paper is a normative legal research, with conceptual approach and statute approach to find answers to existing problems. The research source used is secondary data consisting of primary legal materials and secondary legal materials as explanation for primary legal materials. From the results of this research, it was found that the simultaneous elections and the presidential threshold were not compatible. On the one hand, the presidential threshold aims to simplify the number of parties.

Abstract This study aims to find out about the constitutional court as a guardian of democracy and the constitution especially in carrying out constitutional review. The research method used is normative legal research. The results of the study show that there are several limitations to the authority of the Constitutional Court as guardians of constitutional values and democracy, especially in conducting judicial review, these boundaries become a sign for the Constitutional Court to decide upon a judicial review so that it can produce decisions in line with the spirit of democracy Parameters or reference basis for the Constitutional Court to determine whether or not constitutional law is not only based on what is written in the constitution but also based on basic principles are not written, because the basic principles are not written and moral values ideal politics, also included in the unwritten constitution. Keywords: Constitutional Court, Democracy, Institutional Review. Abstrak Penelitian ini bertujuan utnuk mengetahui mahkamah konstitusi sebagai pengawal demokrasi dan konstitusi khususnya dalam menjalankan constitutional review. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukan bahwa Ada beberapa batasan atas kewenangan Mahkamah Konstitusi sebagai pengawal nilai-nilai konstitusi dan demokrasi, khususnya dalam melakukan judicial review , batasan-batasan tersebut menjadi rambu bagi Mahkamah Konstitusi untuk memutus permohonan atas judicial review sehingga dapat menghasilkan putusan yang sejalan dengan semangat demokrasi Parameter atau dasar rujukan bagi Mahkamah Konstitusi untuk menentukan konstitusional tidaknya suatu undang-undang tidak hanya didasarkan pada apa yang tertulis dalam undang-undang dasar tetapi juga didasarkan pada prinsip-prinsip dasar tidak tertulis, sebab prinsip-prinsip dasar tidak tertulis dan nilai-nilai moral politik yang ideal, juga termasuk dalam konstitusi tidak tertulis. Kata Kunci: Mahkamah Konstitusi, Demokrasi, Comtitutional Review.
