The method used in this study uses a type of normative legal research, with a statute approach and case approach, using primary legal materials by collecting data on a library research base, then analyzed using qualitative methods. In the first and second level decisions, the judge rejected the passenger's claim because according to the judge, the lawsuit that should have been filed was a default and not unlawful acts lawsuit, while in the Supreme Court's decision, the judge granted the passenger's claim that the lawsuit was unlawful acts. In this case, the Supreme Court had properly implemented the law in accordance with the consumer protection law and the aviation law.
