The purpose of this study are: 1) Knowing the nature of the veil, 2) Knowing the history of the emergence of veils in the culture of Islamic society, 3) Knowing the perspective of Islamic law on the use of veils. This type of research is a literature study (Library Research), the object in this study is the concept of veil in the perspective of sharia based on the Qur'an and hadith, the veil controversy in the culture of society. Data is collected by quoting, analyzing using the legal and historical approach methods that occur regarding the use of veils in people's lives.So the veil is a part of sharia after Islam came which was brought by the Prophet Muhammad. And it is also a culture that has occurred for generations before the existence of Islam (jahiliyah period).

AbstractThis research discusses the history of isra'iliyyat in the tafsir book and what is the law of narrating isra'iliyyat. While in the isra'iliyyat narration there is difference whether it is permissible or not and how the isra'iliyyat narration is contained in the tafsir books. The method used in this research is qualitative literature study (Library Research). The results show that the history of Isra'iliyyat is in accordance with Islamic syari'at, then the truth of Israiliyyat can be recognized and allowed to narrate it. Otherwise if it is contrary to Islamic law, it considered unthrue and may not be narrated, but this is allowed if the position has been explained in the interpretation. On the other hand, if there is no information in the Islamic Sharia regarding the content of israiliyyat, then the step that must be chosen is tawaquf, which is not punishing whether it is true or not.   AbstrakPenelitian ini membahas tentang riwayat isra’iliyyat dalam kitab tafsir serta bagaimana hukum meriwayatkan isra’iliyyat. Dimana dalam periwayatan isra’iliyyat terdapat perbedaan apakah boleh atau tidak serta bagaimana periwayatan isra’iliyyat yang terdapat dalam kitab-kitab tafsir. Metode yang digunakan dalam penelitian ini adalah penelitian kualitatif studi pustaka (Library Researh). Adapun hasil penelitian menunjukan bahwa riwayat Isra’iliyyat tersebut sesuai dengan syari’at Islam, maka dapat diakui kebenarannya dan diizinkan untuk meriwayatkannya, sedangkan jika bertentangan dengan syari’at Islam maka didustakan dan tidak boleh diriwayatkan, namun diperbolehkan jika dijelaskan kedudukannya. Adapun jika belum ada keterangan sesuai atau tidaknya dengan Syari’at Islam maka tawaquf di dalamnya, yaitu tidak menghukumi benar atau tidaknya.Kata Kunci: Riwayat Israiliyyat, Tafsir al-Qur’an, Asal usul dan Hukumnya.

The main focus of Orientalist thought is nothing but to reconstruct and influence Islamic civilization. Their enthusiasm to activate orientalism is increasingly challenged by the presence of Islam as a religion that has followers of most of the world's population. One of the actions of orientalism towards the Islamic world is to start a research movement on the Qur'an and al-Hadith which are the basis of the law and guidelines of Muslims. Not far from the critics of the Qur'an and al-Hadith, they also deconstructed aspects of the development of science, Islamic law, and even the originality of Islamic history. Some famous orientalism figures, one of them is Reinhart Dozy, a famous orientelism from the Netherlands with the concept of literacy in the history of Islamic civilization in Spain. Even though he received a lot of criticism and appreciation from both orientalists and Muslim thinkers, his literary work has had a great influence on Islamic civilization. The discussion steps of this study are entirely carried out using qualitative research that is library research. To be more useful and function properly, this paper is equipped with an explanation using the method of description, interpretation and analysis of data in each discussion. This is done, none other than to focus the discussion to produce a consistent and comprehensive understanding.

AbstractThis study examines the role of religious courts in the construction of Islamic inheritance law. Its urgency is to open the dimensions of birth and the growth of inheritance law in the development period of religious courts. In addition, it opens up concrete reasons for the existence of the inheritance law bill that has yet to reach a climax. The methodology in this study is a narrative literature study, with a historical approach by observing juridical aspects in the growth of inheritance law.The findings in this study show that Islamic law existed since the era of the sultanate and was used as an applied law in society, including inheritance law that has been embedded in Islamic law. The authority of the religious judiciary in the field of inheritance became disoriented when the colonialists entered the colonies by applying the receptiveness theory as outlined in the form of the Staatsblad. The climax of the authority of the religious courts is the unification of the judiciary (one roof system) and its independence as the executor of judicial power. The challenge for religious courts in the field of inheritance is the unavailability of material law and the inheritance law bill which creates uncertainty.Keywords: Dynamics; Inheritance law; Religious Courts.

The paper highlights the socio-economic aspects of the concept of hijra or migration in the Islamic tradition. The paper argues that the conception of migration in the Islamic tradition has been shaped by not only religious and ethical values, but also social and economic motivations and consequences ever since the first migrations to Abyssinia and Medina. The paper addresses the notion and practice of hijra in Islamic history by highlighting its ethical and religious value as well as its nature and evolution into a socio-economic activity motivated by different forms of oppression, including social and political oppression as well as economic deprivation. The study draws on the history of Islam and the Islamic society, the sources of Islamic law and doctrines, and the thought of scholars in relation to the changes in approaches to migration, and the conceptualization of hijra as an activity motivated by oppression and economic hardship.

Negara Brunei Darussalam is known as a country that strongly adhere and follow the Syafi‘ite School of Islamic law (madhhab). Both in daily practice of its Islamic society as well as in the Islamic legal pronouncements (fatwa) that have been issued. Hence, this study aims to demonstrate the existence of opinion from madhhabs other than the Syafi‘ite in the justifications of the State Mufti of Brunei for issuing fatwa. Therefore, library research was conducted to gather suitable fatwas, while content analysis method was performed to identify fatwas that comprised the opinion of madhhabs other than the Syafi‘ite. As a result of this study, those opinions that were brought up in the fatwas are caused by several factors. Namely to show the similarities and differences of opinion between those madhhab and the Syafi‘ite, to meet the demand of the one seeking fatwa (al-mustafti) and when the State Mufti was giving guidance (irsyad) at the end of his fatwa. Abstrak Negara Brunei Darussalam dikenali dengan negara yang berpegang kuat dengan mazhab Syafi‘I sama ada dalam amalan seharian masyarakat Islamnya mahupun dalam keputusan-keputusan fatwa yang dikeluarkan. Justeru kajian ini bertujuan untuk memperlihatkan kewujudan pendapat mazhab selain Syafi‘I dalam hujah-hujah Mufti Kerajaan Brunei bagi mengeluarkan fatwa. Kaedah perpustakaan dijalankan untuk mengumpul fatwa yang dikaji dan kaedah analisis kandungan digunakan untuk mengenal pasti fatwa yang terdapat di dalamnya pendapat dari luar mazhab Syafi‘i. Hasil kajian mendapati pendapat-pendapat mazhab selain Syafi‘I yang dikemukakan dalam fatwa-fatwa tersebut adalah disebabkan oleh beberapa faktor iaitu bagi menunjukkan persamaan dan perbezaan pendapat, bagi memenuhi permintaan orang yang bertanya dan apabila Mufti Kerajaan Brunei mengemukakan irsyad di hujung teks fatwanya. This paper outlines the phases after the Islamic law in Indonesia, so in this paper the focus of the main problem is how to transform Islamic law into positive law in Indonesia. To answer this main issue, it will be divided into sub-headings about the period of acceptance of Islamic law in Indonesia, the bleak period of Islamic law in Indonesia, and the period of enlightenment of Islamic law to make part of the main alternatives in national law. Islamic law came to bring justice and benefit. The law of jahiliah in some cases were corrected but not removed, so this also strengthened the understanding that the sharia Law of the previous people were originated from Allah who were improved, corrected, and adjusted. This study aimed to provide an explanation and knowledge concerning the law of jahiliah that were corrected by Islamic law without being removed. The research method used was the literature study with normative approach and was supported by a historical approach. The result shows that it is clear that Islamic justice did not necessarily eradicate some of the laws of jahiliah, such as: Polygamy, dowry, and the period of idah. On the contrary, Islam eliminates the technical that are unjust and still consider that law as part of Islamic law.

This paper aims to explore the emergence, continuity and shifting of the meaning of maqāṣid al-sharī’ah. Initially, maqāṣid al-sharī’ah entered into the study of uṣūl al-fiqh and later became an independent scientific discipline. Historically, the journey of maqāṣid al-sharī’ah has four periods, namely, the pre-codification era, the first development era, the second development era, and the maturation era as a scientific discipline. This paper is qualitative with a descriptive-analytic method, namely exploring the concept of maqāṣid al-sharī’ah in various literature. The findings in this paper are, first, the history of the emergence and development of maqāṣid al-sharī’ah is closely related to the enforcement of Islamic law. Second, the continuity of maqāṣid al-sharī'ah is an ideological concept because it is based on the prevailing paradigm

<p class="IABSSS">Law will always evolve and dialectic with social dynamics. Coulson see that the dynamics of the Islamic law occurs through the efforts of reinterpretation of Islamic sources when there is a gap between theory and practice. With a historical approach, Coulson mapped the development of Islamic law so that he made six dialectic formulation of Islamic law which is an in-depth reading in seeing the historical development of Islamic law. According to Coulson, Islamic law is idealistic and away from social reality. Islamic law is determined by social facts and reduced as a man-made law. Coulson’s propositions departed from empirical studies of the historical development of Islamic law. Coulson formulas can be used to understand further the reality of the development of Islamic law, so Muslims can understand what really happened in the history of Islamic law and scientific perspective. It can be used to perform introspection for Muslims to develop further the Islamic legal thought and in accordance with the existing social development. Dengan pendekatan historis Coulson memetakan perkembangan hukum Islam sehingga ia membuat enam rumusan dialektika hukum Islam yang merupakan sebuah pembacaan yang mendalam dalam melihat sejarah perkembangan hukum Islam. Menurut Coulson hukum Islam bersifat idealistik dan jauh dari realitas sosial dan apa yang ia inginkan adalah hukum Islam ditentukan oleh fakta-fakta sosial dan direduksi sebagai hukum buatan manusia. Proposisi-proposisi Coulson berangkat dari penelitian empiris mengenai sejarah perkembangan hukum Islam. Rumusan-rumusan Coulson dapat digunakan untuk lebih memahami realitas perkembangan hukum Islam, sehingga umat Islam bisa memahami apa yang sebenarnya terjadi dalam sejarah perkembangan hukum Islam dan perspektif keilmuan. Hal itu bisa dipergunakan untuk melakukan introspeksi bagi umat Islam untuk mengembangkan pemikiran hukum Islam lebih lanjut dan sesuai dengan perkembangan sosial yang ada. Istihsan is one of the ijtihad methods disputed by the scholars ushul fiqh, although in reality, all scholars use it practically. The establishment of the law by istihsan method is widely carried out by scholars among the Hanafiyyah and Malikiyyah so that in the history of ushul fiqh, the Hanafiyyah are known as the group that uses istihsan as one of the methods of istinbâth al-ahkâm (determination of the law). Imam Shafi'i is a cleric who rejects istihsan as a method of determining Islamic law. But in practice Imam Shafi'i also uses istihsan as a method of determining Islamic law. The science of ushul fikih has a significant role in contributing to the existence of Islamic law, especially in the field of Sharia economic law. Research method conducted based on normative juridical approach, The specification of research used is analytical descriptive, The type of data used in this research, namely secondary data, data collection method used is literature study and analysis of secondary data that is qualitative. The results showed that istihsan is one of the methods of istinbâth al-ahkâm, which can be used as an argument and a proof of syara' and serves in determining the validity of an agreement / transaction in the field of Sharia economic law.
