The main focus of Orientalist thought is nothing but to reconstruct and influence Islamic civilization. Their enthusiasm to activate orientalism is increasingly challenged by the presence of Islam as a religion that has followers of most of the world's population. One of the actions of orientalism towards the Islamic world is to start a research movement on the Qur'an and al-Hadith which are the basis of the law and guidelines of Muslims. Not far from the critics of the Qur'an and al-Hadith, they also deconstructed aspects of the development of science, Islamic law, and even the originality of Islamic history. Some famous orientalism figures, one of them is Reinhart Dozy, a famous orientelism from the Netherlands with the concept of literacy in the history of Islamic civilization in Spain. Even though he received a lot of criticism and appreciation from both orientalists and Muslim thinkers, his literary work has had a great influence on Islamic civilization. The discussion steps of this study are entirely carried out using qualitative research that is library research. To be more useful and function properly, this paper is equipped with an explanation using the method of description, interpretation and analysis of data in each discussion. This is done, none other than to focus the discussion to produce a consistent and comprehensive understanding.

This paper is discusion the polygamy is still a controversial problem, although much discussed and examined. The difference of opinion among scholars make this problem continues to potentially raises the agree and disagree. Even though it has been regulated in Act Number 1 of 1974 concerning marriage and the compilation of Islamic law (KHI), this does not necessarily make the problem of polygamy is complete. Not a few perpetrators of polygamy choose married under the hand or by sirri. This research uses qualitative approach by implementing thematic interpretation method (maudhu'i) to obtain a comprehensive understanding about polygamy in the Qur'an. The Data obtained through the study of a library research by sharing the data that comes from the various verse of the Qur'an, hadith, book fiqh, research results, books and the news in various media outlets in order to complete the interpretation of the verses of polygamy. Based on the results of this research it is known that the verses of the Qur'an gives a very tight restrictions for those who want to in polygamy. Justice that the conditions of polygamy is not only were quantitative but also qualitative research. In the context of historical-socio, the command of polygamy is intended as a form of the solution to avoid injustice to orphans women. Even if polygamy still want to do, should the husband marrying the widows who have lighten the orphan.

As we know, Nidhamiyah madrasas have played an important role in the history of Islamic civilization to sustain the pace of development of Islamic education. This article aims to describe the history of the establishment of the Nidhamiyah madrasah as an educational institution and the chaotic establishment of this madrasa because it has rubbed off against political-ideological elements. This type of research is a qualitative research. In accordance with the object of the study of this article, this type of research is included in the category of library research. The result in this article is that the Nidhomiyah madrasa was founded in 447 H / 1055 M under the leadership of Tughril Bek from the Snowq dynasty. However, the main figure in the establishment of this madrasa was its vizier named Nizam al-Mulk. As an educational institution, of course this madrasah is the same as other madrasas in terms of management, educators, students, and learning methods. However, in terms of curriculum, this madrasah is a bit different because it contains Ashariyah theology material which is the main objective to defend the Sunni ideology of the Shia-Mu'tazilah ideology. After all, apart from having a role as an educational institution, this Nidhamiyah madrasah cannot be separated from the realm of the politics-ideology that underlies its birth.

Kedudukan dan fungsi bahasa sebagai alat komunikasi manusia mencakup seluruh bidang kehidupan termasuk ilmu pengetahuan antara lain terkait sejarah peradaban manusia; bagaimana manusia mempertahankan hidupnya, bagaimana manusia memperlakukan alam, bagaimana alam menyediakan segala kebutuhan manusia. Apa yang dilakukan manusia saat ini, saat lampau, dan apa yang dilakukan manusia jauh di masa prasejarah, bagaimana kondisi alam di masa-masa tersebut, apa perubahan dan perkembangannya, dapat didokumentasikan melalui bahasa, divisualisasikan kembali, lalu dipajang sebagai salah satu upaya konversai dan preservasi dalam satu institusi yang disebut museum. Penelitian ini membahas kedudukan dan fungsi bahasa dalam permuseuman. Bagaimana kedudukan dan fungsi bahasa dalam permuseuman baik dalam informasi yang disampaikan oleh pemandu wisata museumnya maupun yang terpajang menyertai benda-benda dan gambar-gambar merupakan tujuan dari penelitian ini. Metode penelitian yang digunakan adalah gabungan antara metode lapangan dan metode literatur. Hasil penelitian menunjukkan bahwa secara umum kedudukan bahasa Indonesia berada pada urutan pertama setelah Bahasa Inggris dan keberadaan kedua bahasa dalam permuseuman ini melibatkan dua fungsi utama bahasa, yakni fungsi komunikatif dan fungsi informatif.The existence and function of language  as a medium of communication covers all fields of human life including knowledge, one of them is the history of human civilization; how humans survived, how human utilized nature for their lives, and how nature provides all the necessities for humans. What humans have been doing now, what they have done in the past and far before that in the pre-history time, how the conditions of the nature at those times were and what changes as well as progresses occurred are documented using language, then re-visualized,  displayed as one of conservation and preservation acts in an institution called museum. This research discusess the existence and function of language in museums. How important the existence of a language in museums and what language functions used in museums both in informations given by the museum guides and on the displays accompanying objects and pictures are the aims of this research. The methods used are the combination between field research and library research. The results show that generally the existence of Indonesian language plays more important role than English and both languages have two main functions; communicative function and informative function.

            This study describes Marshall G. Hodgson's thinking about the study of Islamic history studies in his work entitled The Venture of Islam. The research used in this study is analytical descriptive, which is a study that examines Marshall G.S Hodgson's thinking about Islamic history studies then parses and identifies the patterns of thought. According to Marshall G. S. Hodgson the history of Islam is the result of the ever-changing setting shaped by the Islamic tradition. In addition, it is also the result of a process of accomodation or acculturation from other pre-existing cultural traditions. Based on this view, and in the context of conversations about Islamic civilization, Marshall G. S. Hodgson emphasized the importance of seeing cultural continuity occurring at the level of religion, expressed by Muslims. Marshall G.S. Hudgson in seeing the reality of Islam in the world classifies in three forms of Islamic phenomena as the object of study. First, the phenomenon of Islam as a doctrine (Islamic), second, the phenomenon when the doctrine enters and processes in a cultural society (Islamicate) and manifests itself in a particular social and historical context. And thirdly, when Islam became a phenomenon of the political "world" in state institutions (Islamdom).

The study of Islamic history today may not have been regulated through literature, either in foreign languages or using Indonesian (translations or works of the nation's children). Many books have studied the history of Islam that we can get to fill our information, but no one book is so complete, one literature with another can complement each other to form knowledge of Islamic history. From the thought that no single work is perfect and on the contrary will complement each other, the author of this book aims to present the book Sejarah Peradaban Islam to be a reference and teaching material for the history of Islamic civilization course. The author hopes that this work will not only serve as a reference for students majoring in history at various universities, but has also become a public reading as an important contribution to reinventing Islamic civilization in the past, present, and future.Previously, this book entitled Sejarah Islam was only published in a limited edition (30 copies) by Rayhan Intermedia six years ago for student reading. After undergoing revisions in several parts as well as adjusting the curriculum and lecture materials, a book with the title Sejarah Peradaban Islam was presented. This book is intended for everyone, from all walks of life. Although it focuses on Islam, it can be read by anyone who wants to gain additional knowledge about Islamic history.The flow of study in the book does not follow the periodization of Islamic history as written by Harun Nasution, which is divided into the classical period (650-1250 AD), the middle period (1250-1800 AD), and the modern period (1800 AD). His presentation in the book is more based on the growth and development of Islamic civilization in various regions and the reign of a certain caliph or king, however, it does not ignore the characteristics of the times and the character of the period in which Islam grew and developed. In certain parts of the book, it also reviews the roots and implications of the social revolution, the glorious achievements of the rulers, and the peaks of the development of Islamic civilization in various parts of the world.The book of Sejarah Peradaban Islam from Ahmadin needs to be reviewed to know what is in the book, considering some of the previous things. In addition, also to find out what weaknesses and strengths are contained in the book, it is possible to recommend the book as additional reading for others.

Literary work is an inseparable part of human life. Literature appears along with the history of human existence. In fact, it can be said that from the literature produced, it reflected the support of human civilization. As a social institution, literature reflects the expression of appreciation and inner experience of the narrator or the author of certain authors or situations. Literature always experiences development along with changing times and the emergence of new thoughts in every aspect of life. This also applies in the world of literature. Parallel aspects will show a clear picture of literature from the past until now. Methodologically this research uses library research or library research. The object of the study in this study is Sufi literary works. The approach used in this study is descriptive qualitative, in which this study describes not intended to test certain hypotheses. Literary works with religious characteristics will be able to direct readers to make conscience more serious, pious and conscientious in inner consideration. So that religious works make the reader pensive and template.

Islamic law has stated that every person of different religion cannot inherit each other, both Muslims inherit for non-Muslims and from non-Muslims inherit for Muslims, but in practice, Judges at the Supreme Court level implement mandatory wills, this is required which has been decided in the Supreme Court Decision Number. 331 / K / AG / 2018 / MA. This study aims to examine how to implement the mandatory non-Muslim wills in the Supreme Court ruling Number. 331 / K / AG / 2018 / MA based on the provisions of the Compilation of Islamic Law (KHI), and what the Supreme Court Judges consider in implementing mandatory testaments against non-Muslims in the Supreme Court Decision Number. 331 / K / AG / 2018 / MA. This research is a normative legal research with the nature of qualitative research with the type of library research. Based on the studies that have been carried out, the Decision of the Supreme Court Number. 331 / K / AG / 2018 / MA does not include legal considerations in force in Indonesia concerning inheritance provisions and concerning the granting of an approved mandatory will set out in the Compilation of Islamic Law (KHI). The application of mandatory wills in the Supreme Court Decision is contrary to the provisions of Islamic Law and the provisions of the Compilation of Islamic Law (KHI). Article 209 paragraphs (1) and (2) concerning mandatory wills.

Syahadah or testimony is one of the strong evidence like an admission (iqrar) that should be resorted by fulfilling the strict conditions without ignoring the elements of justice and public interest. Syahadah as provided in the Malaysian Syariah Court Evidence Statutes (SCES) is derived from the results of a detailed study of the lawmakers on Syariah legal rulings and the books of fiqh on various mazhab to fit in SCES. This is in contrast with other provisions which was adapted from Malaysian Evidence Act 1950 like documentary evidence, examination of witnesses and qarinah through the process of modification of civil law with the principles of Islamic law of evidence. As syahadah in SCES was derived from Islamic law and the books of fiqh, the issue arises on the application of the present time when the conditions of syahadah seemed to be quite difficult to be fulfilled to be as admissible and original syahadah. Hence, most of the evidence tendered and testified in the Syariah court is only accepted as bayyinah by adopting the view of Ibn Qayyim al-Jawziyyah. This study attempts to analyze the foundation and source of codifying the relevant provisions of syahadah in SCES Malaysia which involves the definition, conditions, number of witnesses, examination of witnesses or tazkiyah al-shuhud (TS) and rules against hearsay. Based on interviews and library research as the main methods of collecting data, the authors found that the concept of syahadah under SCES refers basically to the Islamic legal rulings which mostly come from Shafi’i school of law (mazhab) which is also known as the main reference of Islamic law in Malaysia. However, by resorting the flexible approach of selecting views from various Islamic school of law (mazhab), to fit in SCES or other Islamic law in Malaysia, other’s views of fiqh are also acceptable in some situations such as the concept of bayyinah according to Ibn Qayyim al-Jawziyyah and the number of witnesses from the view of the Hanafi and Hambali schools. ABSTRAK Syahadah atau kesaksian menurut fiqh merupakan salah satu alat pembuktian yang kuat setaraf dengan iqrar (pengakuan) yang perlu dikendalikan dengan tegas tetapi pada masa yang sama mengambil kira aspek maslahah dan keadilan. Syahadah seperti yang diperuntukkan dalam statut keterangan mahkamah syariah (SKMS) di Malaysia adalah bersumberkan hukum syarak hasil dari kajian terperinci para penggubal undang-undang terhadap kitab-kitab fiqh pelbagai mazhab bagi memilih pandangan yang sesuai untuk dimuatkan dalam SKMS. Ini berbeza dengan kebanyakan peruntukan lain yang diadaptasi dari Akta Keterangan (AK) 1950 seperti keterangan dokumen dan pemeriksaan saksi atau pun yang melalui proses pengubahsuaian di antara peruntukan dalam AK 1950 dengan prinsip keterangan Islam seperti qarinah. Oleh kerana syahadah dalam SKMS diambil berasaskan hukum syarak dan kitab-kitab fiqh maka timbul isu dari aspek pemakaiannya pada masa kini apabila syarat-syarat syahadah yang diperuntukkan kelihatan masih agak sukar untuk dipenuhi bagi melayakkan keterangan seseorang saksi itu diterima sebagai syahadah. Implikasinya, kebanyakan keterangan yang dikemukakan di mahkamah syariah diterima sebagai bayyinah sahaja menggunapakai konsep keterangan yang diadaptasi dari pandangan Ibnu Qayyim al-Jawziyyah. Kajian ini cuba menganalisis asas dan sumber penggubalan bagi setiap peruntukan berkaitan syahadah dalam statut keterangan mahkamah syariah (SKMS) di Malaysia dengan perhatian khusus terhadap aspek-aspek syahadah setakat yang diperuntukkan yang hanya melibatkan definisi, syarat, bilangan, testimoni saksi atau tazkiyah al-shuhud (TS) serta keterangan dengar cakap. Berpandukan metode temubual dan kajian kepustakaan, penulis mendapati bahawa konsep syahadah dalam SKMS kebanyakannya berasaskan mazhab utama rujukan hukum syarak dalam sistem perundangan di Malaysia iaitu mazhab Shafi’i. Walau bagaimanapun, dengan sifat keterbukaan sumber hukum dalam SKMS seperti undang-undang Islam yang lain di Malaysia, pandangan fiqh dari sumber mazhab yang lain juga diterima dalam sesetengah situasi seperti penerimaan konsep bayyinah mengikut pandangan Ibnu Qayyim al-Jawziyyah danAL-IRSYAD: JOURNAL OF ISLAMIC AND CONTEMPORARY ISSUESPublished by Faculty of Islamic Civilization Studies, KUIS36bilangan saksi yang mengambil kira juga pandangan dari mazhab Hanafi dan Hambali.

Noah Feldman's 2008 book, The Fall and Rise of the Islamic State, provides a sweeping review of the constitutional history of the Islamic polity that connects the past to developments in the Middle East today. The Ottoman Empire is vital to his argument. This essay critically evaluates Feldman's treatment of the Ottoman period, within the larger context of Islamic history, and in so doing considers the understudied constitutional history of the empire. Without denying the importance of the ulema and the shari'a, it argues that the empire was a hybrid of many different traditions and the centrality of Islamic law should not be overstated.
