<p>The aim of this thesis is to provide a constitutional history of the mysterious years in the 80s B.C. when L. Cornelius Cinna was re-elected to the consulship on four consecutive occasions. Further irregularities abounded in this period, raising the question of how Rome’s annual elections were conducted in this period. A large amount of the surviving literature is either biased or uninformed on such matters. As a direct result, few have attempted to interpret the role of Rome’s comitia, its voting assemblies, in this period in any sufficient detail. This survey aims to fill this lacuna.  From close inspection of the scattered evidence, it may be argued that Rome’s comitia did indeed play a role in the so-called Cinnae dominatio, despite the hoarding of high magistracy by just a handful of individuals. There were laws designed to prevent this domination: men were theoretically allowed to hold the consulship once (at least within a ten-year period); continuatio was forbidden. This study sets out to investigate how Cinna’s continuatio came to be tolerated. Some scholars have attempted to explain away this irregularity as a simple product of the turbulent times. After all, electoral irregularities did indeed increase in frequency during times of existential crisis. But Cinna’s elections do not adequately harmonize with any precedent in Rome’s history.  This study begins with a survey of the Roman constitution in the years leading up to the Cinnae dominatio. The years 91 to 87 were marred by almost continuous warfare in Italy and abroad. However, despite attempts at attaining the consulship by a couple of theoretically ineligible candidates, Rome’s electoral restrictions remained robustly in place. All of this changed in late 87 when Cinna marched on Rome with a large army: many political opponents were murdered or exiled; Cinna assumed the consulship soon after. The process by which he became consul has been the subject of great controversy. Although it would seem that comitia were called, the process was irregular. These irregularities would continue even after Cinna died in 84, coming to an end in the years following Sulla’s restoration of the traditional republic after 81.</p>

Purpose – The purpose of this paper is to examine how the boundaries of rhetoric have excluded important theoretical and practical subjects and how these subjects are recuperated and extended since the twentieth century. Its purpose is to foster the awareness on emerging new trends of rhetoric. Design/methodology/approach – The methodology is based on an interpretation of the history of rhetoric and on the construction of a conceptual framework of the rhetoric of judgment, which is introduced in this paper. Findings – On the subject of the extension of rhetoric from public speeches to any kinds of persuasive situations, the paper emphasizes some stimulating relationships between the theory of communication and rhetoric. On the exclusion and recuperation of the subject of rhetorical arguments, it presents the changing relationships between rhetoric and dialectics and emphasizes the role of rhetoric in scientific research. On the introduction of rhetoric of judgment and meanings it creates a conceptual framework based on a re-examination of the concept of judgment and the phenomenological foundations of the interpretative methods of social sciences by Alfred Schutz, relating them to symbolic interactionism and theories of the self. Originality/value – The study on the changing boundaries of rhetoric and the introduction of the rhetoric of judgment offers a new view on the present theoretical and practical development of rhetoric, which opens new subjects of research and new fields of applications.

Kosovo’s Constitutional Court has played a role of paramount importance in the country’s recent history. The author uses a comparative analysis to discuss the role of the Court in light of the work and history of other European constitutional courts. This approach sheds light on the Court’s current role by analyzing Kosovo’s constitutional history, which shows that there has been a radical break with the past. This approach reveals the fact that Kosovo’s current Constitution does not reflect the material culture of the society of Kosovo. This radical break with the past is a result of the country’s tragic history, in which case the fight for constitutionalism means a fight for human dignity. In this battle for constitutionalism, the Court has been given very broad jurisdiction and a role to play in paving the way for Kosovo to move toward Euro-Atlantic integration in all spheres of life. Before reaching this conclusion, the author discusses the specificities of Kosovo’s transition, comparing it with other former communist countries. Among the specific features of constitutionalism in Kosovo are the role and position of the international community in the process of constitution-making and the overall design of constitutional justice in Kosovo. Throughout the article, a conclusion emerges that puts Kosovo’s Constitutional Court at the forefront of the fight for the rule of law and constitutionalism of liberal Western provenance.

The goal of this article consists in demonstration of the impact of research in the field of history and theory of law alongside the hermeneutics of Emilio Betti impacted the vector of this philosophical thought. The subject of this article is the lectures read by Emilio Betti (prolusioni) in 1927 and 1948, as well as his writings of 1949 and 1962. Analysis is conducted on the succession of Betti's ideas in these works, which is traced despite the discrepancy in their theme (legal and philosophical). The author indicates &ldquo;legal&rdquo; origin of the canons of Bettis&rsquo; hermeneutics, namely the canon of autonomy of the object. Emphasis is placed on the problem of objectivity in Betti's theory, as well as on dialectical tension between the historicity of the interpreted subject and strangeness of the object that accompanies legal, as well as any other type of interpretation. The article reveals the key moment of Betti's criticism of Hans-Georg Gadamer. Regarding the question of historicity of the subject of interpretation. The conclusion is made that the origin of the general theory of interpretation lies in the approaches and methods developed and implemented by Betti back in legal hermeneutics and in studying history of law. &nbsp;&nbsp;Betti's philosophical theory was significantly affected by the idea on the role of modern legal dogma in interpretation of the history of law. Namely this idea that contains the principle of historicity of the subject of interpretation, which commenced&nbsp; the general hermeneutical theory of Emilio Betti, was realized in canon of the relevance of understanding in the lecture in 1948, and later in the &ldquo;general theory of interpretation&rdquo;. The author also underlines that the question of objectivity of understanding, which has crucial practical importance in legal hermeneutics, was transmitted into the philosophical works of E. Betti, finding reflection in dialectic of the subject and object of interpretation.

The paper attempts to deconstruct the leadership phenomenon, with emphasis on competencies needed by leaders to thrive in turbulent situations. Leadership has been a topic that has garnered a lot of interest from researchers over the years and as a result of this, there are significant number of literatures on the subject matter. However, there have been discrepancies in definition on the role of leaders, specifically on leadership styles and which style of leadership can be considered the best for all situations. While, there are several discussions amongst scholars on the most appropriate leadership style for all situations, the paper attempts to elucidate that one major thing scholars agree on is that leadership is involves inspiring followers to achieve organizational objectives specifically evaluating the role of leaders as organizational stewards and their ability to restore the balance between an organization and its environment in turbulent times.

In his Bibliotheca historica, Diodorus Siculus described a peculiar Egyptian custom of judging all the dead (including the pharaohs) before their burial. The Greek historian saw it as a guarantee of Egypt’s prosperity, since the fear of being deprived of the right to burial served as a moral imperative. This story of an Egyptian custom fascinated the early modern authors, from lawyers to novelists, who often retold it in their own manner. Their interpretations varied depending on the political context: from the traditional “lesson to sovereigns” to a reassessment of the role of the subject and the duties of the orator. This article traces several intellectual trajectories that show the use and misuse of this Egyptian custom from Montaigne to Bossuet and then to Rousseau—and finally its adaptation by Pushkin and Vyazemsky, who most likely became acquainted with it through the mediation of French literature. The article was written in the framework (and with the generous support) of the RANEPA (ШАГИ РАНХиГС) state assignment research program. Givenness is probably an odd term in methodology, but not in phenomenology. The long history of subjectivism in philosophy faces confrontations from Derrida's deconstruction. This history also results in a sort of mutual exclusion between philosophy and theology. The concept of the subject becomes a problem for both, but frequently it is safeguarded for the sake of a more universal 'objectivity'. The phenomenological tendency towards phenomenon, more than towards the experiencing subject and more than anything regarded as object, provokes some philosophical focus on the emancipation of the phenomena. Marion pushes phenomenology to its limits, to the extent that he is suspected of undermining the role of the subject in contemporary philosophical discourse. He reacts to Derrida's deconstruction, which was also criticised for not offering a way out of the labyrinth from the collapse of traditional thoughts. Marion is quite consistent with his phenomenology, namely in offering a way out for the subject to be a witness, and reminds that philosophy should be more appreciative of phenomena. The term saturated phenomenon represents his philosophical thinking that can be regarded as a methodological approach to respect, and not to dominate, reality. Being a witness is not the same as playing a critic on reality. This could be a useful stance for philosophers as well as theologians in the presence of the phenomena they cannot master, namely, the given phenomena.

Carlos Lechuga’s film Santa y Andrés (2016) has enjoyed worldwide acclaim as an intimate, dramatic portrayal of the unlikely friendship that develops in rural Cuba between Andrés, a gay dissident writer, and Santa, the militant citizen who has been sent to surveil him. Declared to be extreme and/or inaccurate in its historical depictions, the film was censored in Cuba and was the subject of intense controversy and public polemics surrounding its release in 2016. Debates about the film’s subject matter and its censorship extend ongoing disagreement over the role of art within the Cuban Revolution, and the changing nature of the Cuban film industry itself. This dossier brings together new scholarship on Santa y Andrés and is linked to an online archive of some of the original essays that have been written about the film by Cuban critics and filmmakers since 2016. The aim of this project is to create a starting point for researchers who wish to investigate Santa y Andrés, evaluating the film both for its contentious initial reception, and in terms of its enduring contribution to the history of Cuban cinema.

One of the factors that determines the current lifestyle is technology, which persistently draws the world into competition for new means and practices. As the subject of these processes, our contemporary not only takes an active part in them, but also reflexes a lot about his/her own impact. Although technology is ambivalent and multivector in its development, the humanitarian role of protecting the history of human experience, as well as creating the updated versions of cultural practices is not alien to it. Inspired by the broad interpretation of the writing practices proposed by J. Derrida, the author of the article shows how important it is for the understanding of technology not to be overloaded with alarmism. Information technologies have a democratizing effect on social life by offering new tools and formats for the writing. In particular, they support on a personal level the freedom of self-realization, while on a public scale — sociocultural diversity and interaction.

The paper which I lay before the Society is an attempt to treat with sufficient osteological detail an extinct family of Ungulates which had an immense range of distribution and a great variety of forms in the two periods of the earth’s history which preceded our own. The fate this family has met with at the hands of palæontologists is a somewhat sad one, presenting a warning example of the unscientific method that was paramount in the palæontology of the Mammalia after the time of Cuvier. With the exception of England, where here the study of fossil Mammalia was founded on a sound basis, and some glorious exceptions on the continent, we have very few good palæontological memoirs in which the osteology of extinct mammals has been treated with sufficient detail and discrimination; and things have come to such a pass, that we know far better the osteology of South American, Australian, and Asiatic genera of fossil mammals than of those found in Europe. Nearly all fossil Mammalia which have been described in detail belong to genera that still exist on our globe, or whose differences from fossil forms are trifling. After the splendid osteological investigations of Cuvier had revealed to science a glimpse of a new mammalian world of wonderful richness, his successors have been bent rather on multiplying the diversity of this extinct creation, than on diligently studying the organization of the fossil forms that successively turned up under the zeal of amateurs and collectors. From the year 1828, and even before, when Laizer, Pomel, Croiset, and others began to give short notices on the Mammalia of Auvergne, mammalian genera and species from this locality have been multiplied at a prodigious rate, every private collector giving his own generic and specific names, with no better description than stating the real or supposed number of teeth, and some phrases as to the general resemblances of the fossil in question. Others substituted in their short notices other names, while the scientific work of description did not proceed further than the mere counting of the number of teeth. This process has given rise to such an utter confusion in the palæontology of the extinct Paridigitata, that even now (forty years after the date of the earliest notices) we are utterly ignorant of the true extent and organization of the Miocene mammalian fauna of Auvergne, for instance—though materials for a detailed study of the subject abound in all great public, and many private, collections, the fossils being very common. No palæontologist, even of the highest standing, could boast of knowing, in our own time what Dremotherium, Dorcatherium, Elaphotherium, Gelocus , and so on really are, what are the bones belonging to each set of teeth (as the names were mostly given to these last), whether they had horns or were hornless like the Tragulidæ , and so on. If we add that German authors described the genera of Paridigitates which were found and named in France under different names (as Palæomeryx , Microtherium , Hyotherium , and so on), when they came from German localities, the confusion may be guessed. Having no good descriptions and no figures of the genera noticed in France, the German authors almost necessarily fell into the mistake of renaming what was already named. Once named, the genus was allowed to go forth with the short and wholly insufficient characteristics given to it by the first describer, the impossibility of adding one’s name after the generic or specific designation seeming to take all interest from it. And this, moreover, is the best case; for frequently the same form was described by an other palæontologist under a different generic name, or, if this was Utterly impossible, a new species was made of it, founded on some difference in size or other trifling character. Happily, however, a reaction began to set in, one of the first to head it on the Continent being Rütimeyer, who did not confine his study merely to the teeth of fossil Mammalia, but aimed with brilliant success at a complete investigation of the osteology of the extinct genera and of their affinities with the living ones. Gaudry’s work on the fossils of Pikermi (the best palæontological work that has appeared in France since Cuvier’s 'Ossemens Fossiles’), Fraas’s 'Fauna von Steinheim,’ Alphonse Milne-Edwards’s 'Oiseaux Fossiles,’ and many others may be cited as examples to prove that the new tendency has fairly set in and will bear good fruit. The wide acceptance by thinking naturalists of Darwin’s theory has given a new life to palæontological research; the investigation of fossil forms has been elevated from a merely inquisitive study of what were deemed to be arbitrary acts of creation to a deep scientific investigation of forms allied naturally and in direct connexion with those now peopling the globe, and the knowledge of which will remain imperfect and incomplete without a thorough knowledge of all the forms that have preceded them in the past history of our globe.
