The article deals with issues related to the post-penitentiary resocialization of persons released from penal institutions, analyzes the concept of post-penitentiary resocialization, its legal basis, content and social necessity. They also analyzed the shortcomings in the relevant structures and areas of their activities that deal with issues related to the re-socialization of former convicts, the main problems faced by persons deprived of their liberty after serving their sentences in accordance with the procedure established by law, and presented some proposals for eliminating these problems and improving the post-penitentiary system.Keywords: penitentiary institution, person serving a sentence, re-socialization, penitentiary system, post-penitentiary system, crime prevention, housing problem, employment problem

Статья посвящена рассмотрению проблем профилактики преступлений оперативными подразделениями исправительных учреждений (далее - ИУ). Автор, раскрывая роль оперативных отделов ИУ в общей профилактике правонарушений, указывает на ее двоякость, поскольку, с одной стороны, рассматриваемые подразделения обладают значительным преимуществом перед другими службами учреждения в выявлении негативных факторов (негласный метод получения оперативно значимой информации), с другой стороны - далеко не все условия, которые способствуют совершению преступлений в ИУ, можно устранить оперативным путем. Изучение специальной литературы позволило выявить в деятельности начальников ИУ определенные проблемы, связанные с оценкой состояния оперативной обстановки в ИУ, сложившейся ситуации; с отсутствием прогноза развития криминогенной ситуации в ИУ, а также с профессиональной некомпетентностью руководителей, неумением объективно оценивать результаты деятельности структурных подразделений. Автор особое внимание уделяет анализу статистических данных о совершенных и предотвращенных преступлениях лицами, находящимися в местах лишения свободы. The article is devoted to the consideration of problems of crime prevention by operational units of correctional institutions (hereinafter referred to as IA). The author, revealing the role of the operational departments of the IA in the general prevention of offences, points to its twofold. On the one hand, the units under consideration have significant advantages over other services of the institution in identifying negative factors (these are tacit methods of obtaining promptly meaningful information). On the other hand, not all conditions conducive to the commission of crimes in IA can be eliminated by operational means: For example, shortcomings in the activities of other departments and services (security department, duty shift, etc.). The study of special literature has made it possible to identify problems in the activities of heads of correctional institutions in the sphere of implementation of solutions in case of lack of objective and complete information on the state of the operational situation in IA, the current situation, the results of the activities of structural subdivisions; No forecast of the development of the crime situation in IE; Professional incompetence of managers, inability to objectively assess the results of activities of structural subdivisions. The author pays particular attention to the analysis of statistics on crimes committed and prevented by persons in detention.

In the Bulgakov´s novel, "Master and Margarita", it is said that people are spoilt by the housing problem. But, probably, and in today´s society it is more than ever, and for most Russians the housing problem remains a major issue. Contrary to popular belief about the novelty of the mortgage, it has been around for a long time, since the time of the Archon Solon, who lived in the VI BC. But in Russia, the first mention of the so-called "mortgage" is dated XIII century. In XVIII-XIX centuries under Catherine II and Alexander II mortgage loans were most actively developed. However, at the beginning of the XX century, after the October Revolution of 1917, the concept of "mortgage" gradually disappeared from everyday life and considered as a "bourgeois phenomenon". The origin of the "new" Russian mortgage started in the early 90s of the twentieth century, but only by 2000, there have been real positive conditions and trends of its development. Mortgage as a form of solution of housing problem is widely discussed by legislators, society and the media. It is difficult to find legal or economic magazine or newspaper, which had not raised the issue of mortgage and related numerous problems. It happens that the opinions of authors on various issues differ, but one thing they are in agreement – it is necessary to develop the mortgage. The article deals with current issues of lending to households and features of home mortgages.

Автором рассматривается проблема эффективности деятельности членов общественных наблюдательных комиссий в период эпидемии. Особое внимание уделяется правовой основе деятельности членов общественных наблюдательных комиссий в учреждениях уголовно-исполнительной системы с учетом имеющихся ограничений, связанных с эпидемией. Согласно ст. 85 УИК РФ возможно введение режима особых условий в исправительных учреждениях для противодействия и нейтрализации негативных последствий от стихийных бедствий, различных оснований введения чрезвычайного положения, указанных в ст. 3 ФКЗ Российской Федерации «О чрезвычайном положении», групповых неповиновений осужденных и пр. Режим особых условий предусматривает возможность введения дополнительных ограничений в отношении осужденных к лишению свободы и корректировку организации деятельности подразделений администрации исправительного учреждения (ч. 2 ст. 85 УИК РФ). В статье предлагается повторно изучить уже имеющийся опыт ряда пилотных проектов, которые реализовывались в исправительных учреждениях, и по мере необходимости внедрить их для повышения эффективности общественного пенитенциарного контроля за обеспечением прав осужденных. Формулируются также предложения по совершенствованию уголовно-исполнительного и иного законодательства в этой сфере. The article deals with the problem of the effectiveness activity of public monitoring commission members during the epidemic. Special attention is paid to the legal basis of the activities of public monitoring commissions members in the penal institutions, taking into account the existing restrictions associated with the epidemic. According to Article 85 of the Criminal Code of the Russian Federation, it is possible to introduce a regime of special conditions in correctional institutions to counteract and neutralize the negative consequences of natural disasters, various grounds for the introduction of a state of emergency specified in Article 3 of the Federal Criminal Code of the Russian Federation «On the State of Emergency», group disobedience of convicts, etc. The regime of special conditions provides for the possibility of introducing additional restrictions on persons sentenced to imprisonment and adjusting the organization of the departments activities of the penal administration (Part 2 of Article 85 of the Criminal Code of the Russian Federation). The article proposes to re-examine the existing experience of a number of pilot reform that were implemented in correctional institutions and, if necessary, to implement them to improve the effectiveness of public penitentiary control over the rights of convicts. Proposals are also formulated to improve the penal enforcement and other legislation in this area.

AbstractCooperation between authorities is a central part of present-day crime prevention in Sweden. At the same time, the idea of cooperation has an extensive heritage within Swedish welfare policy. The purpose of this article is to trace the trajectory of crime prevention and in particular the idea of cooperation as a crime policy solution. Dating back to the post-war decades, cooperation between authorities in an effort to tackle youth crime has also been in line with David Garland’s concept of penal welfarism. While Garland mainly focuses on penal institutions and penal law rather than prevention, cooperation in Sweden shares several characteristics with penal welfarism such as the optimistic belief in expert rule and individualized treatment. The professional expertise that colonized the field of criminal justice was an equally prominent feature of how schools would prevent crime. Against this background I also discuss whether or not the concept of the preventive turn is applicable to the trajectory of crime prevention in Sweden. My conclusion is that the development of crime prevention is best understood as a continuous process dating back to the post-war era’s focus on youth crime, as opposed to a break.

Countering political extremism is one of the main tasks of state policy in the field of crime prevention. During the period of electoral processes, the violation of the law particularly criminal law becomes frequent and unavoidable. The rules of law guarantee the legality and legitimacy of voters, candidates, electoral associations, electoral commissions and other electoral participants actions. In this article, the author focuses on the special relevance of authorized bodies activities to counter political extremism during an election in order to protect the foundations of the constitutional system and states security. The author reviewed the main sources that form the legal basis for tackling extremism during the election campaigns. The analysis of certain provisions of regulatory legal acts in the field of opposing of manifestations extremism including during the electoral period was done. In particular, the most strategic state policy for protecting society from destructive influence of extremism are discussed. Based on the analysis of some provisions of regulatory legal acts the author comes to the conclusion that it is necessary to improve legislation in this area.

Background: Suicide prevention is a major challenge for penal institutions in many countries. The traditional approach relies on the expertise of health professionals and is supplemented by the intervention of other professionals and the inmates themselves. New methods of suicide prevention based on peer support have been developed in recent years. Peer prevention programs rely on the ability of inmates to identify suicide risk. Aims: This study examines perceived suicide risk among inmates and explores possible explanations. Method: 54 inmates and 17 professionals working in prisons responded to a questionnaire. Results: The peer prevention program was found to change inmates’ expectations of support in the event of a suicide crisis. The study also found that the inmates involved in the program tended to underestimate the risk of suicide. The perception of the prevention program and the level of self-consciousness were found to account for the underestimation of suicide risk. Conclusions: Support for inmates involved in suicide prevention programs must take into account their isolation in prison. The training provided to inmates must also consider the biases affecting the assessment of risk.
