INCENTIVES AS A MEANS OF EDUCATIONAL INFLUENCE ON INMATES HELD IN PENAL INSTITUTIONS

В статье автор затронул вопросы совершенствования применяемых поощрительных мер, способных качественно повысить воспитательный процесс осужденных, содержащихся в пенитенциарных учреждениях. Несмотря на достаточно объемный перечень предусмотренных законодателем мер поощрения, отмечена необходимость переработки норм уголовно-исполнительного законодательства, регламентирующих поощрительные меры осужденных к лишению свободы в направлении обеспечения целостности данной системы, последовательности ее элементов, их большей дифференциации. Автор отмечает, что меры материальных поощрений, к которым относятся выплата денежной премии и награждение подарком, на практике являются не работающими, поскольку законодателем не урегулирован вопрос, из каких средств следует их производить. В настоящее время расходование денежных средств из федерального бюджета на это направление не предусмотрено. В целях максимального стимулирования осужденных к позитивному поведению целесообразно расширить действующий комплекс поощрений, направленных на поддержание социальных связей осужденных. На основании проведенного исследования предлагается ч. 1 ст. 113 УИК РФ дополнить поощрительными мерами в виде направления администрацией учреждения ИУ письма близким родственникам о примерном поведении осужденного; дополнительным дистанционным видеосвиданием посредством сети Интернет; представлением администрации ИУ в суд о сокращении срока отбывания наказания; краткосрочным отпуском до 15 суток с выездом за пределы ИУ. In the article, the author analyzed the issues of improving the used incentive measures that can qualitatively improve the educational process of convicts held in penitentiary institutions. Despite the rather lengthy list of incentives provided by the legislator, the need to revise the norms of criminal executive legislation governing incentive measures for prisoners sentenced to imprisonment in the direction of ensuring the integrity of this system, the sequence of its elements, and their greater differentiation was noted. The author notes that the measures of material incentives, which include the payment of a monetary bonus and rewarding with a gift, are not working in practice, since the legislator has not regulated the question from what means they should be produced. At present, the spending of funds from the federal budget in this direction is not provided. In order to maximize the stimulation of convicts to positive behavior, it is advisable to expand the existing set of incentives aimed at maintaining the social ties of convicts. Based on the study, it is proposed to part 1 of Art. 113 of the Penal Code of the Russian Federation to supplement incentive measures in the form of a letter from the administration of the penitentiary institution to close relatives about the exemplary behavior of the convict; additional remote video viewing via the Internet; the presentation of the administration of the penitentiary institution to the court on the reduction of the term of serving the sentence; short-term vacation up to 15 days with a trip outside the penitentiary.

COMMISION OF CRIMES AGAINST LIFE AND HEALTH BY PRISONERS IN PENAL INSTITUTIONS

В статье рассматриваются вопросы предупреждения преступлений против жизни и здоровья, совершаемых осужденными в исправительных учреждениях. Пенитенциарные преступления против жизни и здоровья составляют 20 % от всех совершаемых в исправительных учреждениях преступлений. Противодействие преступлениям в пенитенциарных учреждениях нашей страны в настоящее время осуществляется не на должном уровне, что обусловлено происходящими изменениями в социально-политической и экономической жизни страны, подверженной экономическим санкциям со стороны ряда мировых держав, отдельными недостатками реализации реформы уголовно-исполнительного законодательства и УИС в целом. В работе отмечается, что предупреждение преступлений против жизни и здоровья в пенитенциарных учреждениях должно осуществляться как на общем уровне (общая профилактика, охватывающая неограниченное число объектов профилактики), так и на индивидуальном уровне (индивидуальная профилактика, ориентированная на конкретное лицо или криминогенную ситуацию) с использованием методов дифференциации и индивидуализации профилактического воздействия. Объектами профилактического воздействия являются детерминанты преступности, личность преступника и микросреда, в которой он находится. Общесоциальное направление предупреждения пенитенциарной преступности отличается разнообразием мер воздействия на общественные отношения и включает в себя меры социального характера, экономические меры, меры культурно-воспитательного характера, организационно-управленческого характера. The article deals with the issues of preventing crimes against life and health committed by convicts in correctional institutions. Penitentiary crimes against life and health account for 20 % of all crimes committed in correctional institutions. Counteraction to crimes in penitentiary institutions of our country is currently not carried out at the proper level, which is due to the ongoing changes in the socio-political and economic life of the country, subject to economic sanctions from a number of world powers, certain shortcomings in the implementation of the reform of the penal legislation and the penal system as a whole. The work notes that the prevention of crimes against life and health in penitentiary institutions should be carried out both at the general level (general prevention, covering an unlimited number of prevention objects) and at the individual level (individual prevention, focused on a specific person or crime situation) using methods of differentiation and individualization of preventive action. The objects of preventive action are the determinants of crime, the personality of the offender and the microenvironment in which he finds himself. The general social direction of the prevention of penitentiary crime is distinguished by a variety of measures of influence on public relations and includes measures of a social nature, economic measures, measures of a cultural and educational nature, organizational and managerial nature.

ACCOUNTING OF INFORMATION ON CRIMINAL CASES INITIATED AGAINST PERSONS HELD IN PENAL INSTITUTIONS: CURRENT STATE AND PROSPECTS

В статье анализируются вопросы совершенствования сбора, учета, поиска и представления информации об уголовных делах, возбужденных в отношении лиц, содержащихся в учреждениях уголовно-исполнительной системы. Исследована структура электронной базы данных «Преступления, совершенные подозреваемыми, обвиняемыми, осужденными, содержащимися в учреждениях уголовно-исполнительной системы Российской Федерации», введенной в эксплуатацию в 2020 г. Для сравнения приводятся характеристики электронной базы данных, действующей с 2008 по 2020 г. В ходе анализа ведомственного нормативного акта, регулирующего рассматриваемую сферу деятельности, выявлены пробелы в отображении информации, имеющей значение для эффективного предупреждения пенитенциарных преступлений, и сформулированы соответствующие предложения по их устранению. Изучение материалов уголовных дел о преступлениях, совершаемых лицами в период нахождения в учреждениях, обеспечивающих изоляцию от общества, в статусе подозреваемого, обвиняемого, осужденного, позволило заключить, что последние при совершении таких преступлений, как побеги и мошенничества с использованием средств сотовой связи, применяют личный опыт преступной деятельности. Сделан вывод о том, что современные автоматизированные информационные системы, используемые в пенитенциарных учреждениях, не должны ограничиваться узкой задачей учета информации об уголовных делах, возбужденных в отношении лиц, содержащихся в учреждениях уголовно-исполнительной системы. Исследуемая электронная база данных дает широкие возможности для избирательного поиска и последующего анализ всего комплекса сведений, связанных с пенитенциарной преступностью. The article analyzes the issues of improving the collection, accounting, search and presentation of information about criminal cases initiated against persons held in penal institutions. The structure of the electronic database is investigated: «Crimes committed by suspects, accused, convicted persons held in institutions of the penal system of the Russian Federation», commissioned in 2020. For comparison, the characteristics of an electronic database operating from 2008 to 2020 are given. During the analysis of the departmental normative act regulating the sphere of activity under consideration, gaps in the display of information relevant for the effective prevention of penitentiary crimes were identified and appropriate proposals for their elimination were formulated. The study of the materials of criminal cases on crimes committed by persons during their stay in institutions providing isolation from society in the status of a suspect, accused, convicted allowed us to conclude that the latter, when committing crimes such as escapes and fraud using cellular communications, use personal experience of criminal activity. It is concluded that modern automated information systems used in penitentiary institutions should not be limited to the narrow task of recording information about criminal cases initiated against persons held in institutions of the penal system. The electronic database under study provides ample opportunities for selective search and subsequent analysis of the entire complex of information related to penitentiary crime.

The COVID-19 pandemic amplified long-standing racial disparities in the United States criminal justice system

During the first year of the COVID-19 pandemic, the number of incarcerated people in the United States decreased by at least 16%---the largest, fastest reduction in prison population in American history. Using an original dataset curated from public sources on prison demographics across all 50 states and the District of Columbia, we show that incarcerated white people benefited disproportionately from this decrease in the U.S. prison population, and the fraction of incarcerated Black and Latino people sharply increased. This pattern deviates from a decade-long trend before 2020 and the onset of COVID-19, during which the proportion of incarcerated Black people was declining. Using case studies of select states, we explore and quantify mechanisms that could explain these disparities: temporary court closures that led to fewer prison admissions, changes in the frequency of police interactions, and state-level prison release policies that sought to de-densify congregate settings. These findings illuminate how systemic racism pervades juridical and penal institutions and is the engine of mass incarceration in America.

Ecological safety of penitentiary institutions in Russia

The work is devoted to the issues of ecological safety of production in penitentiary institutions in Russia. The production and economic activity of penitentiary institutions is analyzed from the point of view of its impact on the environment. The main sources of environmental pollution by institutions of the penitentiary system are listed and ways of their solution are proposed. The state and experience of solving problems of environmental safety in different territorial bodies are shown. The question is raised about the work of environmental structures in the activities of the penal system facilities. The authors analyze the powers of the structures under consideration and the problems arising in the implementation of their duties. The main problematic aspects of environmental safety are highlighted, including the absence in penitentiary institutions of Russia in the required means of measuring and monitoring the technical condition of environmental structures and equipment in penal institutions; ineffective operation of the existing treatment facilities due to their deterioration or congestion; presence at the enterprises of the penal system of hazardous waste, including highly toxic; insufficiently productive work on the development of environmental design documentation and obtaining permits for emissions of pollutants into the air, for discharges of untreated wastewater into water bodies, for licensing of hazardous waste management activities. As a result - a large number of sanctions for violation of environmental legislation. As measures to ensure environmental safety in the Russian penitentiary system, the authors, among other things, propose: the development and adoption of an order of the Ministry of Justice regulating environmental safety in the penal system; ensuring the attraction of investments for the timely implementation of environmental protection measures; establishment and organization of sanitary protection zones.

FUNDAMENTALS OF THE CONCEPT OF THE ESTABLISHMENT OF A UNIFIED PENAL SYSTEM (HYPOTHESIS): SPATIAL DEVELOPMENT, LEGISLATION, ENFORCEMENT

Раздел 8 Концепции развития уголовно-исполнительной системы Российской Федерации на период до 2030 года предусмотрел создание в структуре российской пенитенциарной системы учреждений уголовно-исполнительной системы объединенного типа. Первое такое учреждение начнет свою работу в 2024 г. Автором на уровне гипотезы предлагается рассмотреть основные вопросы, связанные со становлением и развитием учреждений уголовно-исполнительной системы объединенного типа. В связи с этим в настоящей статье рассмотрены три основополагающих направления развития данных учреждений: пространственное развитие, законодательство, правоприменение. Каждый из указанных аспектов проанализирован автором с точки зрения как проблем, так и предполагаемых путей их решения. Цель работы - на основе исследования географии исправительных учреждений, уголовно-исполнительного законодательства РФ и правоприменительной деятельности показать основные проблемы, связанные с развитием учреждений уголовно-исполнительной системы объединенного типа, и возможные пути их решения. Среди проблем показаны проблемы территориального (пространственного) размещения учреждений объединенного типа, законодательства и правоприменения вновь создаваемых учреждений. Методами исследования в научной статье явились универсальные методы (анализ и синтез, индукция и дедукция, аналогия и моделирование); эмпирические методы (обобщение, классификация); теоретические методы (идеализация, абстрагирование, гипотетико-дедуктивный метод) и др. Выводы и результаты работы определяются достижением ее целей. Section 8 of the Concept for the Development of the Penitentiary System of the Russian Federation for the Period up to 2030 provided for the creation of a unified type of penal institutions in the structure of the Penal System of Russia. The first institution such type will begin its work in 2024. The author at the hypothesis level analyses the main issues related to the formation and development of institutions of the unified penal system. In this regard, the author considers three fundamental areas of development of the institutions under consideration: spatial development, legislation, law enforcement. Each of these projects was analyzed by the author in terms of both problems and suggested ways to solve them. The purpose of the work is to show on the basis of a study of the geography of correctional institutions, penal enforcement legislation of the Russian Federation and law enforcement activities the main problems associated with the development of penal correction institutions of a unified type and possible ways to solve them. Among the problems are the problems of territorial (spatial) placement of institutions of a unified type, legislation and enforcement of newly created institutions. The research methods in the scientific article were universal methods (analysis and synthesis, induction and deduction, analogy and modeling); empirical methods (synthesis, classification); theoretical methods (idealization, abstraction, hypothetical-deductive method) and others. The conclusions and results of the work are determined by the achievement of its goals.

SPECIAL ASPECTS OF ACCEPTANCE, BOOKING AND CONTROLING OF CRIME REPORTS AND INCIDENTS WITHIN THE PENAL INSTITUTIONS

Актуальность изучения стадии возбуждения уголовного дела в общем и проверки сообщений о преступлениях и происшествиях в частности не вызывает сомнений, поскольку именно на этом этапе закладываются основы принятия процессуального решения о возбуждении уголовного дела или об отказе в его возбуждении, что соответствует принципу законности. В учреждениях уголовно-исполнительной системы процессуальная деятельность является специфичной, поскольку связана с особым режимом функционирования учреждений и социальной средой, детерминированной криминальной субкультурой. Статья посвящена исследованию понятия, сущности и значения проверки сообщений о преступлениях и происшествиях в учреждениях уголовно-исполнительной системы. Рассмотрены наиболее распространенные способы проверки сообщений о преступлениях: получение объяснений, производство осмотра места происшествия. Рассматриваемая деятельность не лишена проблем. Проанализированы отдельные из них, касающиеся полноты изложения информации в рапорте об обнаружении признаков преступления и получения объяснений от осужденных, и пути их решения. Для соблюдения законности процессуальной деятельности в учреждениях и органах уголовно-исполнительной системы при рассмотрении сообщений о преступлениях и происшествиях предлагается разработать методические рекомендации, содержащие уголовно-процессуальные и криминалистические аспекты рассматриваемой деятельности, которыми обеспечить все подведомственные органы и учреждения. The relevance of studying the stage of initiating a criminal case, in general, and checking reports of crimes and incidents, in particular, is not in doubt, since it is at this stage that the foundations are laid for making a procedural decision to initiate a criminal case or to refuse to initiate it, which meets the principle of legality. In the institutions of the penitentiary system, procedural activity is specific, since it is associated with a special mode of functioning of institutions and the social environment, determined by the criminal subculture. The article is devoted to the study of the concept, essence and meaning of checking reports on crimes and incidents in the institutions of the penitentiary system. The most common methods of checking reports of crimes such as obtaining explanations, conducting an inspection of the scene of the incident are considered. The activity under consideration is not without problems. Some of them are analyzed, concerning the completeness of the information in the report on the detection of signs of a crime and obtaining explanations from convicted persons and the way to solve them. In order to comply with the legality of procedural activities in institutions and bodies of the penitentiary system when considering reports of crimes and incidents, it is proposed to develop methodological recommendations containing criminal procedural and criminalistic aspects of the activity under consideration which should be provided to all subordinate bodies and institutions.

THE CONTENT AND SOCIAL NECESSITY OF POSTPENITENTIARY RESOCIALIZATION

The article deals with issues related to the post-penitentiary resocialization of persons released from penal institutions, analyzes the concept of post-penitentiary resocialization, its legal basis, content and social necessity. They also analyzed the shortcomings in the relevant structures and areas of their activities that deal with issues related to the re-socialization of former convicts, the main problems faced by persons deprived of their liberty after serving their sentences in accordance with the procedure established by law, and presented some proposals for eliminating these problems and improving the post-penitentiary system.Keywords: penitentiary institution, person serving a sentence, re-socialization, penitentiary system, post-penitentiary system, crime prevention, housing problem, employment problem

THE ANALYSYS OF LEVEL OF BLOOD-BORNE AND SEXUALLY TRANSMITTED VIRUSES INFECTIONS OF THE PRISONERS IN THE CONTEXT OF HBV PREVENTION

The aim of the article is to analyze the level of viral infections transmitted through sexual contact and blood-borne infections in Polish penal institutions and detention centers. The description of the issue presented in the study is primarily aimed at signaling the issue and at trying to indicate possible preventive solutions. It seems inevitable to confront the actual living conditions and situations in the prison environment with the scale of the problem of HIV and HBV/HCV infections. Therefore, the authors consider it necessary to monitor the situation and familiarize the interested specialists in the field of probation with the problem in order to encourage reflection on the possible introduction of preventive measures.

EXPERIENCE OF TERRITORIAL BODIES OF THE FEDERAL PENITENTIARY SERVICE OF RUSSIA IN IDENTIFYING AND REVIEWING CHANNELS OF PENETRATION OF PROHIBITED ITEMS AND SUBSTANCES INTO THE RESTRICTED TERRITORIES OF THE PENAL INSTITUTIONS

Статья посвящена изучению направлений работы, проводимой сотрудниками исправительных учреждений уголовно-исполнительной системы Российской Федерации в вопросах выявления каналов несанкционированного проникновения запрещенных предметов и веществ на режимные территории исправительных учреждений. В частности, анализируется опыт исправительных учреждений уголовно-исполнительной системы в вопросах предупреждения проникновения к осужденным запрещенных предметов и веществ. В статье рассматриваются способы поступления запрещенных предметов и веществ, а также наиболее уязвимые места исправительного учреждения для поступления запрещенных предметов и веществ на режимные территории. Рассмотрены меры уголовно-исполнительного и административного характера, позволяющие своевременно выявлять и перекрывать каналы поступления запрещенных предметов и веществ на режимные территории учреждений уголовно-исполнительной системы. Определены категории лиц, которые чаще всего привлекаются за несанкционированную поставку запрещенных предметов и веществ на охраняемую территорию. В статье отмечается, что общественная опасность проникновения запрещенных предметов состоит не только в нарушении нормальной деятельности исправительных учреждений, но и в снижении эффективности применения к осужденным мер исправительного воздействия. В заключение отмечено , что правильная организация и своевременное проведение режимных мероприятий, административно-процессуальных действий приведет к снижению потока поступающих в исправительные учреждения запрещенных предметов и веществ и, как следствие, улучшению правоотношений, складывающихся в процессе исполнения уголовного наказания в виде лишения свободы. The article is devoted to the study of the directions of work carried out by employees of correctional institutions of the penitentiary system in identifying channels of unauthorized entry of prohibited items and substances into the restricted territories of correctional institutions. In particular, the article analyzes the experience of correctional institutions of the penitentiary system in preventing the penetration of prohibited items and substances to convicts. The article deals with the ways of receiving prohibited items and substances, as well as the most vulnerable places of a correctional institution for receiving prohibited items and substances on restricted territories. Considered measures of criminal-executive and administrative nature, allowing time to identify and block the channels of receipt of prohibited items and substances on the restricted territory of the penitentiary system. The categories of persons who are most often involved in the unauthorized supply of prohibited items and substances to the protected area are identified. The article notes that the public danger of penetration of prohibited items is not only a violation of the normal activities of correctional institutions, but also a decrease in the effectiveness of applying corrective measures to convicts. In conclusion it was said that proper organization and promp-person implementation of security measures, administrative-procedural actions will reduce flow to correctional facilities of prohibited items and substances and, consequently, improved relations, developing in the process of execution of criminal punishment in form of imprisonment.
