Problem setting. The article is devoted to the study of the peculiarities of the legal regulation of foreign trade interms of doctrinal and legislative approaches. The author analyzes the basic concepts of foreign trade policy, identifies itsmain components, as well as describes the tools for regulating foreign trade, including customs tariffs. Analysis of recent research and publications. Both domestic and foreign representatives of legal and economicsciences, such as Bachylo I., Zadykhailo D., Kleshchova S., Karvatska N., Sarkisyan L., Stavytsky L. and others, devotedtheir works to the study of the legal regulation of foreign trade. Article’s main body. Presenting main material. CTD is carried out, as a rule, at the level of enterprises (sometimesthey are natural persons-entrepreneurs). The initial principle of the CTD is a commercial calculation based on economicand financial independence and self-payment. CTD – the sphere of entrepreneurship in the system of international exchangeof goods, services, works, information and results of intellectual activity, related to the preparation and implementationof foreign trade operations and agreements. Cross-border trade and free economic zones are considered as special regimesof the CTD. Each country of the world in the framework of participation in foreign economic relations (both directly and throughnational entities of the CTD) pursues foreign economic policy, including in the field of foreign trade. The foreign economicpolicy of the state is the activity of the state aimed at the development and regulation of economic relations with othercountries. The implementation of foreign economic policy involves defining the strategic goals of the state in foreigneconomic relations in general and with individual countries and groups of countries, as well as developing methods andtools to achieve the goals and preserve the results achieved later. Foreign economic policy is aimed at the whole set offoreign economic activity, the hallmark of which is the international purchase and sale of goods and services, as well asthe international movement of material, monetary, labor and intellectual resources. Foreign economic policy is inextricablylinked with the domestic economic policy of the state. Therefore, its content is due to the tasks of expanded reproduction, which the country solves within its national economy. It can be argued that the main task of the foreign economic policyof the state is to create favorable external economic conditions for expanded reproduction within the country. Within theframework of the general foreign economic policy the state carries out: a) foreign trade policy – is the state regulation of export and import operations; b) export promotion policy – a policy aimed at selling in foreign markets goods for which the country has economicadvantages, stimulating the competitiveness of domestic enterprises with foreign ones, increasing the serial productionof competitive products in order to expand its exports (to foreign markets); c) the policy of regulating the import and export of capital. A characteristic feature of capital movements at the presentstage is the inclusion of an increasing number of countries in the process of export and import of capital. At the same time, most countries of the world market economy simultaneously act as exporters and importers of investments. The influenceof developed countries on the movement of capital is carried out, for example, by stimulating the export-import of capitalat the national and interstate levels; d) monetary policy – aims to maintain economic stability and create a solid foundation for the development ofinternational economic relations by influencing the exchange rate and currency exchange operations; e) customs policy is a set of measures taken to ensure the most effective use of instruments of customs control andregulation of trade in the customs territory, participation in trade and policy tasks to protect the domestic market, stimulatethe national economy; f) free trade policy – a policy of minimal government intervention in foreign trade, which develops on the basis offree market forces of supply and demand. Conclusions and prospects for the development. The formation and implementation of state policy in the studyarea involves the possibility and necessity (not absolute) of state intervention in economic processes in order to create aneffective and efficient system of foreign trade. Fulfillment of this task is possible only under the condition of strategicplanning and conceptualization of the principles of state-administrative influence, which, in fact, is the content and essenceof state economic policy in general and state policy in the field of foreign economic activity in particular. Understanding this issue and further resolving these pressing issues at the doctrinal (hereinafter – legislative) levelswill allow the state to be an active participant in foreign trade relations, and thus – to provide national participants in theserelations with potential markets for goods, works and services, to compete effectively in these foreign markets.

The article analyzed the ways to improve the foreign trade policy of the Eurasian Economic Union (EAEU) in connection with the accession of Armenia and Kyrgyzstan to this integration association. To achieve this goal the obligations of Armenia and Kyrgyzstan in the framework of the WTO are compared with the Russia's ones. Such comparison is required because the EAEU implements its Treaty “On functioning of Customs Union within the framework of the Multilateral Trading System” as of May 19, 2011. Pursuant to Article 1 of this Treaty, the Russian obligations under the WTO serve as basis for the foreign trade policy pursued by the EAEU. Amid a variety of Russia’s, Armenia’s and Kyrgyzstan’s obligations the author stresses those concerning market access for goods. These obligations will be most meaningful in the mid-run from the perspective of economic development of the EAEU. The levels of applied duties, as well as the levels of bound duties were compared for the main groups of agricultural and non-agricultural products. The analysis of applied duties showed that the EAEC market at whole is better protected than the Armenian and Kyrgyz national markets with regard to an overwhelming majority of product groups. The EAEU has been particularly focused on the protection of the agricultural market, as well as on such product groups as textiles and clothing, wood and related products. At the same time, the analysis of the bound rates for the main groups of agricultural and non-agricultural products points to the fact that, if necessary, Armenia and Kyrgyzstan have certain room to increase the customs duties up to the bound levels. A conclusion has been drawn that the harmonization of the WTO obligations assumed by Russia, Armenia and Kyrgyzstan will lead to a certain weakening of tariff protection in the EAEC market. However, the weakening will be insignificant (the average level of the bound customs duties is expected to fall by 2-2.5 per cent points), following the global trend of trade liberalization.

Economic nationalism tended to dominate U.S. foreign trade policy throughout the long 19th century, from the end of the American Revolution to the beginning of World War I, owing to a pervasive American sense of economic and geopolitical insecurity and American fear of hostile powers, especially the British but also the French and Spanish and even the Barbary States. Following the U.S. Civil War, leading U.S. protectionist politicians sought to curtail European trade policies and to create a U.S.-dominated customs union in the Western Hemisphere. American proponents of trade liberalization increasingly found themselves outnumbered in the halls of Congress, as the “American System” of economic nationalism grew in popularity alongside the perceived need for foreign markets. Protectionist advocates in the United States viewed the American System as a panacea that not only promised to provide the federal government with revenue but also to artificially insulate American infant industries from undue foreign-market competition through high protective tariffs and subsidies, and to retaliate against real and perceived threats to U.S. trade. Throughout this period, the United States itself underwent a great struggle over foreign trade policy. By the late 19th century, the era’s boom-and-bust global economic system led to a growing perception that the United States needed more access to foreign markets as an outlet for the country’s surplus goods and capital. But whether the United States would obtain foreign market access through free trade or through protectionism led to a great debate over the proper course of U.S. foreign trade policy. By the time that the United States acquired a colonial empire from the Spanish in 1898, this same debate over U.S. foreign trade policy had effectively merged into debates over the course of U.S. imperial expansion. The country’s more expansionist-minded economic nationalists came out on top. The overwhelming 1896 victory of William McKinley—the Republican party’s “Napoleon of Protection”—marked the beginning of substantial expansion of U.S. foreign trade through a mixture of protectionism and imperialism in the years leading up to World War I.

Today, within the framework of the functioning of foreign trade policy, there are two main opposing models: protectionism and free trade. Recently, the situation is developing towards the dominance of the policy of protectionism over the policy of conducting free trade, since there is a continuous increase in the number of non-tariff measures and the manifestation of trade wars. This situation leads to the need for a policy of trade liberalization. Implementing a foreign trade policy aimed at eliminating trade barriers is not a quick process and requires a thoughtful scientific assessment. To analyze the criticality of the situation of the absence of a free trade policy and to reflect its validity, a very wide methodological toolkit is used to study various kinds of trade barriers, ranging from the calculation of the simplest indicators to the construction of complex econometric models. This study provides a comprehensive review of the main methodological approaches to determining the impact of tariff and non-tariff barriers on the international trade activities of countries. In the scientific review work, 4 domestic and 24 foreign sources, formed on the basis of 21 resources, were involved in the search for literature. The results of the review analysis of research papers showed that in the study of tariff and non-tariff barriers, researchers mainly use three econometric models, namely gravity model, partial equilibrium model and general equilibrium model. In addition, the study of non-tariff barriers can be carried out in the context of two other methods besides the econometric one: the implementation of the "price gap" method and the derivation of "incidence indicators".

The article is devoted to the study of the peculiarities of the formation of agri-food chains in foreign markets and the calculation of value added losses in export-import operations of agri-food. It is established that the share of the agricultural sector in the GDP of Ukraine is 10.2% at the lowest value added per employee 4801.4 dollars. USA. It is estimated that in 2010–2019, in the structure of Ukraine's exports, agricultural products provided 19% of foreign exchange earnings in 2011 and 40% in 2019, which is evidence of the strengthening of export positions of the studied sector of the economy in foreign markets. It was revealed that in 2019 the share of agri-food products was 44.3%, or 22.2 billion dollars. US, or increased by 19% compared to 2018, while total exports from the country during this period increased by only 6%. It is determined that in the structure of exports of agri-food products the share of plant products is 58%, and in the commodity structure of exports the largest share falls on cereals - 74%, as well as oilseeds - 20%. It is concluded that the export of agricultural food in 2010–2019 is formed by raw materials, while the value added of processed products - sunflower oil, poultry meat - is higher than that of grain. Threats to the functioning of agri-food supply chains to foreign markets caused by the COVID-19 pandemic and government actions of the world and Ukraine to ensure food security are systematized. It is substantiated that the structure of Ukraine's foreign trade is rational, as raw materials predominate in supplies to foreign markets, and technically complex products dominate in the structure of imports. It is estimated that the foreign trade balance of goods and services in 2019 is negative in the amount of 3.7 billion dollars, but improved by 2.5 billion dollars. relative to the 2018 figure. It is substantiated that in order to achieve a positive value of the foreign trade balance of Ukraine it is necessary to stimulate the development of food industries, ie products with high added value. It is analyzed that the increase in exports of agricultural raw materials leads to a shortfall in value added, and, consequently, the state budget loses significant revenues in the form of value added tax (processed agricultural products are subject to VAT on its exports), tax on profit, export duty (rate 18%, for the export of live farm animals). It was found that the value structure of agricultural imports is dominated by the group of "finished food products" (45%); the second position of agri-food imports is occupied by products of plant origin, the share of which is 31%; third - products of animal origin, whose share in the structure of imports is about 18%. It is suggested that state support instruments, such as VAT refunds, should only be used to stimulate high value-added industries. Key words: agri-food supply chains, export, import, foreign markets, value added.
