Up to now, the law is still considered discriminatory and gender inequality. Though the law should be equal or sensitive to gender inequality to guarantee women’s rights. By following the principle of equality in all areas of the good men  and women have equal rights or opportunities to participate in every aspect of social life and state. so if there is discrimination against women, it is a violation of women’s rights. women’s rights violations occur due to many things, including the result of the legal system, where women are victims of the system. Reform Order is the most progressive period in the protection of human rights. Various laws and regulations come outin this period, including laws and regulations concerning women’s rights. Seen from the government’s efforts to eliminate discrimination based on sex are included in many  legislations.

This volume reframes the debate around Islam and women’s rights within a broader comparative literature. It examines the complex and contingent historical relationships between religion, secularism, democracy, law, and gender equality. Part I addresses the nexus of religion, law, gender, and democracy through different disciplinary perspectives (sociology, anthropology, political science, law). Part II localizes the implementation of this nexus between law, gender, and democracy, and provides contextualized responses to questions raised in Part I. The contributors explore the situation of Muslim women’s rights vis-à-vis human rights to shed light on gender politics in the modernization of the nation and to ponder over the role of Islam in gender inequality across different Muslim countries.

This book shows how a woman's desperate attempt at murder came to momentarily embody the anger and anxiety felt by many people at a time of economic and social upheaval and expanding expectations for equal rights. On the evening of November 1, 1843, a young household servant named Amelia Norman attacked Henry Ballard, a prosperous merchant, on the steps of the Astor House Hotel. Agitated and distraught, Norman had followed Ballard down Broadway before confronting him at the door to the hotel. Taking out a folding knife, she stabbed him. Ballard survived the attack, and the trial that followed created a sensation. Newspapers in New York and beyond followed the case eagerly, and crowds filled the courtroom every day. The prominent author and abolitionist Lydia Maria Child championed Norman and later included her story in her fiction and her writing on women's rights. Norman also attracted the support of politicians, journalists, and legal and moral reformers who saw her story as a vehicle to change the law as it related to “seduction” and to advocate for the rights of workers. This book describes how New Yorkers followed the trial for entertainment. Throughout all this, Norman gained sympathys, in particular the jury, which acquitted her in less than ten minutes. The book weaves together Norman's story to show how, in one violent moment, she expressed all the anger that the women of the emerging movement for women's rights would soon express in words.

the present time, the law is still considered discriminatory and not gender-just. Whereas the law should not regard gender to guarantee the fulfillment of women's rights. Women's rights are still not protected. Equality and elimination of discrimination against women are often the center of attention and a shared commitment to implement them. However, in social life, the achievement of equality of women's dignity still has not shown significant progress. So, if there is discrimination against women, it is a violation of women's rights. Women's rights violations occur because of many things, including the result of the legal system, where women become victims of the system. Many women's rights to work still have a lot of conflict about the role of women in the public sector. Today, discrimination against women is still very visible in the world of work. There are so many women who do not get the right to work. This research found that the structure of the company, rarely do we see women who get a place as a leader, in addition to the acceptance of female workers companies put many terms, such as looking attractive, not married, must stay in dormitory and so forth. Their salaries are sometimes different from male workers. Like male workers, women workers also have equal opportunities in the world of work. While there are many legislations governing the rights of women workers, it seems that many companies deliberately do not socialize it and even ignore the legislation just like that.

Chapter 8 concludes that the Nineteenth Amendment can be revitalized today, to more fully ensure women’s equality. It reviews new legal scholarship that suggests direct applications of the Nineteenth Amendment to today’s voting rights challenges. And it describes how some scholars suggest that the Nineteenth should be read together with the Fourteenth Amendment, as a normative matter, to provide a more capacious understanding of the Fourteenth, as applied to women’s rights, beyond voting. Given persistent gender inequality, and the uncertain status of the Equal Rights Amendment (ERA), the chapter concludes that it is worth revisiting the jurisprudential potential of the Nineteenth Amendment, at its centennial.

This research discusses about the role and effectiveness of UN Women as the real implementation of the Feminist paradigm and as an International Organization that upholds women's right in solving important issues related to women's rights, like violence against women and gender inequality. To analyse the issue on this journal, authors uses gender concept and feminist securitical approach. It also gives a stand point about the two main paradigms of International Relations, Realist and Liberalist, and its relation to Feminists regarding gender inequality and violence on women. The result of this research is that UN Women is quite effective in dealing with Feminist issues although it has not experienced significant improvement. However, UN Women's efforts should be appreciated for fighting for women's rights.   Keywords: UN Women, Feminist, Violence against Women, Gender Inequality     Abstrak   Penelitian ini membahas tentang peran dan efektivitas UN Women sebagai implementasi nyata dari paradigma Feminis dan merupakan Organisasi Internasional yang menjunjung tinggi hak perempuan dalam menyelesaikan isu-isu penting terkait dengan perempuan yaitu kekerasan terhadap perempuan dan ketimpangan gender. Dalam menganalisis isu pada jurnal ini, penulis menggunakan konsep gender dan pendekatan keamanan feminis. Penelitian ini juga memberikan kritik terhadap dua paradigma utama Hubungan Internasional yaitu Realis dan Liberalis dalam keterkaitannya dengan Feminis terkait ketimpangan gender dan kekerasan terhadap perempuan. Hasil dari penelitian ini adalah UN Women cukup efektif dalam menangani isu-isu Feminis walaupun belum mengalami peningkatan yang signifikan. Patriarchism’s Islam is not a form of accusation that Islam is a patriarchal  religion. Patriarchism’s Islam here is a way of interpretation by certain circles, because of its cultural, political, social and historical role of specific, resulting in the claim that Islam is a religion that favor the ideology of patriarchy. This patriarchal ideology that considers women as inferior beings position than men. This forms a negative paradigm to the framers of the law in particular is the law. No. 1 Year 1974 About Marriage. As a result of the UUP, women in Indonesia, suffered discrimination and injustice, this is certainly a violation of human rights. The protection of women's rights is the duty of the government of Indonesia. Therefore, reform/amendment UUP is a necessity that should be done, in order of justice, equality and protection of human rights, especially as indigenous efforts in Indonesia.

There is a stereotype with regard to the rights of the Balinese women on inheriting under the Balinese tradi-tional customary law. It is generally assumed that the law discriminates Balinese women as well as against the human rights principle of equality. This article analyzes the contemporary problems of such issue and would demonstrate the actual principles, rules and practices, including the essential concept of the rights under the Balinese traditional customary law of inheritance. This issue has been explored under a normative legal approach where the resources are primarily taken from the relevant national legal instruments and court decisions, instead of textbooks and journals. An interview has also been commenced for clarifying some aspects of the issue. This article concludes that there has been a generally misleading on viewing the Balinese customary law as discriminating women on an inheritance issue, as in fact, the law also provides rules for supporting women’s rights for inheriting. The law in a certain way has properly preserved the right of women for inheriting in which women under the law have also enjoyed rights for inheriting, especially the daughter and widow. In contrast, the Balinese men that are generally perceived as the ultimate gender enjoying privileges rights to inherit, in the practice of inheritance in the traditional community are also subject to some discrimination. The law has provided a set of rule of inheritance both for men and women where they are subject to certain equal rule and condition. The law also clarifies that both genders are enjoying equal rights on inheritance in a certain portion and situation binding under the principle of balancing between rights and obligation for each side.

Man has always tried  to determine  and tamper the image of woman and especially her identity is manipulated and orchestrated. Whenever a woman is spoken of, it is always in the relation to man; she is presented as a wife , mother, daughter and even as a lover but never as a woman  a human being- a separate entity. Her entire life is idealized and her fundamental rights and especially her behaviour is engineered by the adherents of patriarchal society. Commenting  on the Man-woman relationship in a marital bond Simone de Beauvoir wrote in her epoch-making book entitled The Second Sex(1949): "It has been said that marriage diminishes man,  which is often true , but almost always it annihilates women". Feminist movement advocates the equal rights and equal opportunities for women. The true spirit of feminism is into look at women and men as human beings. There should not be gender bias or discrimination in familial and social life. To secure gender justice and gender equity is the key aspects of feminist movement. In India, women writers have come forward to voice their feminist approach to life and the patriarchal family set up. They believe that the very notion of gender is not only biotic and biologic episode but it has a social construction.


The existing literature on women’s rights and Islam falls short of addressing the relationship between the religious debate on women’s rights and the existing rules of law in Muslim-majority countries. This chapter will bridge this gap by analyzing the status of women in the legal systems of Egypt, Turkey, and Morocco. It will evaluate the influence of Islam on the shaping of these laws, compared to other factors like culture, socioeconomic development, and education. Except in marginal cases like Saudi Arabia or Afghanistan under the Taliban, women’s rights in politics, the economy, and education have advanced in all Muslim countries. But there are some limitations placed upon women’s rights using religious arguments. Everywhere, personal rights about family life, sexuality, and dress code remain discriminatory against women. In this regard, the woman’s body has become the main site of the politicization of Islam, by state and non-state actors alike.
