Pemberian bantuan hukum merupakan salah satu cara untuk mewujudkan access to law and justice bagi rakyat miskin yang diberikan oleh negara atas amanat dari konstitusi. Beberapa regulasi mengenai bantuan hukum telah dikeluarkan oleh negara melalui Undang-Undang dan peraturan pelaksananya maupun dari Mahkamah Agung ataupun Mahkamah Konstitusi melalui Peraturan Mahkamah Agung maupun putusan Mahkamah Konstitusi. Akan tetapi fakta di masyarakat, regulasi yang dibuat itu belum efektif dijalankan sehingga makna access to law and justice menjadi bias. Belum efektifnya penerapan dalam pembenrian bantuan hukum di Indonesia merupakan suatu legal issue yang menarik untuk dikaji lebih dalam agar dapat mengetahui permasalahan utama yang menyebabkan belum efektifnya pemberian bantuan hukum di Indonesia yang nantinya dicarikan solusi dari gagasan yang menjadi formulasi sebagai optimalisasi pemberian bantuan hukum di Indoensia. Legal Issue yang dicari yaitu persoalan-persoalan dalam penerapan pemberian bantuan hukum dan Formulasi bagaimana penerapan pemberian bantuan hukum dapat berjalan secara optimal. Artikel ini akan memaparkan secara sistematis dan ilmiah dengan menggunakan metode normatif-empiris yang mengambil lokasi di 5 daerah yaitu DKI Jakarta, Kabupaten Surakarta, Kabupaten Pekalongan, Kabupaten Wonosobo dan Kabupaten Banyumas (Purwokerto) dan purposive sample meliputi advokat, organisasi advokat, lembaga bantuan hukum, pengadilan negeri dan penerima bantuan hukum. Berdasarkan hasil penelitian terdapat beberapa persoalan-persoalan dalam penerapan pemberian bantuan hukum di masyarakat yang menjadikan pemberian bantuan hukum bagi rakyat miskin menjadi belum efektif, oleh sebab itu, diperlukan suatu optimalisasi pemberian bantuan hukum bagi rakyat miskin yang menjadi suatu gagasan untuk menjawab persoalan tersebut untuk mewujudkan access to law and justice bagi rakyat miskin.Legal Aid is a way to implementing access to law and justice for the poor which is Mandate from the State listed in the constitution. Some regulations concerning legal assistance have been issued by the state through the rule and implementing regulations and also from the Supreme Court through and Constitutional Court by the Supreme Court Regulation or Constitutional Decission. However, in fact the regulation has not been effectively implemented, so that the meaning of access to law and justice becomes refracted. The ineffectiveness of application in the provision of legal assistance in Indonesia is an interesting legal issue to be reviewed deeper to find out the main problems that have caused the ineffectiveness of providing legal assistance in Indonesia which will be sought solutions from ideas that become formulation as the optimization of legal assistance in Indonesia. Legal Issues sought are issues in the application of legal aid provision and Formulation how the application of legal assistance can applied optimally. This article will describe systematically and scientifically using the normative-empirical method that takes place in 5 areas, DKI Jakarta, Surakarta Regency, Pekalongan Regency, Wonosobo Regency and Banyumas Regency (Purwokerto) and purposive sample includes advocate, BAR organization, legal assistance organization, state courts and legal aid recipients. Based on the results of the study there are several problems in the implementation of providing legal aid in the community that makes the provision of legal aid for the poor is not effective, therefore required an optimization of legal aid for the poor who became an idea to answer the problem to realize access to law and justice for the poor.

Providing legal assistance to the poor continues by the government to realize legal access and justice for all levels of society. Several regulations regarding legal aid have been issued by the state through the law and implementing regulations, but the fact is that the provision of legal aid is not yet effective. This causes a lack of access to law and justice for the poor. The effectiveness of providing legal aid by the government needs to be assessed to see how effective the legal aid program provided by the government is to realize legal access and justice for the poor. Therefore, criticism and advice should be given to the government in order to optimize legal assistance in order to achieve legal access and justice for all levels of society.

The provision of legal aid is one way to realize access to law and justice for the poor people provided by the state on the mandate of the constitution. Several regulations regarding legal aid have been issued by the state through the Act and its implementing regulations as well as from the Supreme Court or the Constitutional Court through the Supreme Court Regulations and the Constitutional Court's decisions. Legal aid is the constitutional right of every citizen to guarantee legal protection and guarantee equality before the law stipulated in Law Number 16 of 2011, the State is responsible for recognizing and protecting the human rights of every individual without differing backgrounds so that everyone has the right to be treated equally before the law is contained in Article 28D of the 1945 Constitution of the Republic of Indonesia. For the poor who experience legal problems in the form of injustice, they can request legal assistance from legal aid institutions that are regulated in legislation. The purpose of providing legal aid is to guarantee and fulfill the right for Legal Aid Recipients to gain access to justice, to realize the constitutional rights of all citizens in accordance with the principle of equality in law, to ensure the certainty that the implementation of Legal Aid is carried out equally across the territory of the Republic of Indonesia. , and to create an effective, efficient and accountable court.

Bantuan hukum adalah salah satu upaya mengisi hak asasi manusia (HAM) terutama bagi lapisan masyarakat termiskin rakyat Indonesia. Bantuan hukum harus dimaknai dan dilaksanakan sebagai upaya perjuangan menegakkan HAM bagi si miskin. Tujuan bantuan hukum perlu diperluas, dak saja terbatas pada bantuan hukum individual, tetapi juga struktural dan juga jangan terbelenggu dengan jalur-jalur formal semata. Dengan diundangkan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum memunculkan permasalahan bagaimana pengaruh bantuan hukum terhadap masyarakat? Dengan menggunakan metode peneli an norma f dan dengan pendekatan data secara kualita f yang dianalisis deskrip f, didapatkan kesimpulan bahwa keberadaan Undang-Undang Bantuan Hukum belum maksimal memberikan pengaruh terhadap bantuan hukum bagi masyarakat miskin, karena bantuan hukum masih dalam jalur formalis k dan masih bersifat pasif. Pendanaan penyelenggaraan bantuan hukum yang digeser dari Mahkamah Agung, Kejaksaan Agung, dan Kepolisian kepada Menteri Hukum dan HAM dan dilaksanakan oleh Lembaga Bantuan Hukum atau Organisasi Kemasyarakatan agar dapat menyentuh orang atau kelompok orang miskin, tetapi besar anggaran perlu memper mbangkan proses peradilan yang berjalan, karena dikhawa rkan dapat menghambat orang miskin dan kelompok orang miskin untuk mengakses keadilan guna mewujudkan hak-hak kons tusional mereka.<p>Legal aid is an effort to fulfill human rights, especially for Indonesian poorest society. Legal aid should be interpreted and implemented as an effort of human rights enforcement for the poor. The purpose of legal aid should be expanded, not just limited to individual legal assistance, but also structural and not fe ered by mere formal channels. Dalam Surat Edaran Mahkamah Agung (SEMA) No. 10 Tahun 2010 mengamanahkan tentang pembentukan Pos Bantuan Hukum (Posbakum) di setiap pengadilan di bawah Mahkamah Agung (MA). Pengadilan Agama (PA) Sleman menjadi salah satu pilot project dalam pembentukan Posbakum, yang dimulai sejak 2011 dan berakhir 2012. Penyelenggaraan Posbakum di PA Sleman dirasakan sangat membantu masyarakat miskin dan bagi mereka yang tidak dapat memahami birokrasi pengadilan dan bagaimana memecahkan persoalan hukum. Namun, keberadaan Posbakum perlu diteli Ɵ mengenai bagaimana penyelenggaraan Posbakum di PA Sleman dan sejauhmana efek Ɵ fi tasnya dalam membantu masyarakat miskin untuk mengakses keadilan? Hasil penelitian menunjukkan bahwa penyelenggaraan Posbakum di PA Sleman selama 2011 hingga 2012 dapat berjalan dengan baik dan efek tif. Data dari DPW APSI DIY dan LSBH UIN Yogyakarta menunjukkan bahwa lebih dari 1000 orang (1.272 orang) yang datang ke Posbakum PA Sleman mendapatkan layanan jasa bantuan hukum yang mereka butuhkan. Penelitian ini merekomendasikan untuk penyediaan anggaran bantuan yang lebih besar yang digunakan Ɵ dak hanya sebatas pemberian advis dan pembuatan berkas gugatan/permohonan saja, tetapi juga pada pendampingan perkara terutama perkara-perkara tertentu yang urgen seperti Kekerasan Dalam Rumah Tangga dan Perlindungan Anak. Selain itu penyelenggaraan bantuan hukum harus ditunjang oleh aturan main yang jelas yang tidak membuka tafsir liar sehingga membuat potensi adanya pemberian bantuan hukum yang salah sasaran.<p>The mandate Seth forth in SEMA No. 10 Year 2010 is establishing legal aid centre (Posbakum) in any court which under the Supreme Court authority. Religious Court (PA) of Sleman becomes one of the pilot projects in the establishment POSBAKUM, which started since Year 2011 and ended in Year 2012. Implementation POSBAKUM in Religious Court Sleman is extremely helpful for poor society and those who could not understand how bureaucracy of court and how to resolve legal issues. Nevertheless, the existence of Posbakum needs to be researched as to how the implementation of Posbakum in PA Sleman and how far its effectiveness in helping the poor to access justice. The result of research showing that implementation of POSBAKUM at religious court Sleman during year 2011-2012 runs properly and effectively. Data from DPW APSI DIY and LSBH UIN Jogjakarta showing that more than 1000 people (1272 people) comes into POSBAKUM Religious court Sleman and obtain legal assistance services which they needed. This research recommends providing a larger aid budgets are used not only limited to giving advice and making the lawsuit/petition but also on mentoring cases, especially in certain ma Ʃ ers such as domestic violence which urgent and child protection. Besides, implementations of legal aid have to support by clear rules that do not open to multi interpretation so that make a potential misdirected for legal assistance.</p>

Provision of Legal Aid is one of the ways the state can achieve access to law and justice for poor people in accordance with what has been mandated by the constitution. The principle of equality before the law in the Criminal Procedure Code (KUHAP) and Article 27 paragraph (1) of the 1945 Constitution tries to be realized by the state with this legal assistance so that the poor will experience justice in law enforcement in Indonesia. Justice is the right of all Indonesian people. Justice can be obtained by all people, this is contained in the Pancasila Values ​​especially in the 5th (five) precepts which read "Social Justice for All of Indonesia". For the poor who experience legal problems in the form of injustice, they can request legal assistance from legal aid institutions that are regulated in legislation. The purpose of providing legal aid is to guarantee and fulfill the right for Legal Aid Recipients to gain access to justice, to realize the constitutional rights of all citizens in accordance with the principle of equality in law, to ensure the certainty that the implementation of Legal Aid is carried out equally across the territory of the Republic of Indonesia, and to create an effective, efficient and accountable court. The community's right to get free legal assistance (pro-bono) is regulated in Law No. 16 of 2011 concerning Legal Aid. This law regulates the communities receiving legal assistance, grants, and funding as well as legal aid mechanisms.

<h1>The role of paralegals is needed to handle cases of non-litigation and litigation to fulfill the need for legal aid rights for the poor in facing the law, however, the provision of the role of paralegals in providing litigation legal assistance as stated in article 11 and article 12 Minister of Law and Human Rights of Republic of Indonesia number 1 of 2018 concerning paralegals in the provision of legal assistance based on the Supreme Court decision number 22 P / HUM / 2018 was declared contrary to the higher laws and regulations, namely Law Number 18 of 2003 concerning Advocates and hence not generally accepted. Thus, after the Supreme Court's ruling, paralegals can no longer provide legal litigation aid. Advocate are the only professions who are authorized to carry out legal aid in litigation and court</h1><p class="KataKunciInggris"> </p>

The establishment of the Regional Representative Council of the Republic of Indonesia so called Dewan Perwakilan Daerah (DPD-RI) at least has two objectives. The first is to enhance justice for the people in the region. Secondly, to expanding and increasing the participation of local communities in national life. The process to form this state institution is done by amending the 3rd amendment of the 1945 Constitution of the Republic Indonesia. However, in doing that  amendment there was an internal conflict within the body of DPD-RI involving the old and the new leaders of this institution last year. The length of leadership tenure which was initially made 5 years was amended to became 2.5 years. The different length of leadership tenure was then canceled by the Supreme Court and it was decided to be the same as other institution such as The People’s Consultative Assembly and The House of Representative in that the leadership tenure should be in accordance with the electoral cycle of 5 years. However, although the regulation of DPD-RI has been canceled, the Supreme Court keeps sending its representative to guide the oath of position of the new DPD-RI leadership. The only regulation that has been introduced by the state was regulation toward conflict between state institutions and this conflict can merely be resolved by the Constitutional Court. Therefore, there is an urgent need for the state to seek solution to solve this problem to prevent the same thing happened to other state institution in the future.

Penelitian ini bertujuan untuk menganalisis perbedaan hak bantuan hukum dalam konsep hukum Islam dan hukum nasional. Bantuan hukum dalam hukum nasional ditujukan bagi mereka yang tidak mampu membayar penasihat hukum. Penelitian ini menggunakan metode penelitian yuridis empiris. Berdasarkan hasil penelitian ditemukan bahwa pemberian hak bantuan hukum prodeo dalam hukum Islam dan hukum nasional mempunyai tujuan yang sama yaitu mewujudkan keadilan. Terdapat perbedaan pada sumber hukumnya. Hukum Islam bersumber pada al-Quran, Hadits, dan ijtihad. Sumber hukum nasional adalah UUD 1945, Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum. Sumber dana bantuan hukum dalam hukum Islam dari baital mal. Sedangkan dalam hukum Nasional bersumber dari anggaran Mahkamah Agung dan APBA. Letak perbedaan pada sumber hukum keduanya, sumber pembiayaan dari pemenuhan hak bantuan hukum prodeo dan dalam hal kategori orang-orang yang menerima bantuan hukum prodeo, namun mempunyai tujuan yang sama yaitu perwujudan keadilan. Prodeo Legal Aid in Islamic Law and National Law This study aims to analyze the differences between the legal aid rights in the concept of Islamic law and national law. Legal aid in national law is aimed at those who cannot afford legal counsel. This research uses empirical juridical research methods. The study found that the granting of prodeo legal aid in Islamic law and national law had the same goal of realizing justice. There is a difference in the legal source. Islamic law is based on the Al-qur’an, Hadith and ijtihad. However, national legal sources are the 1945 Constitution and Law Number 16/2011 concerning Legal Aid. The source of funding for legal aid in Islamic law comes from Baital Mall. Whereas in National law sourced from the budget of the Supreme Court and APBA. Although there are differences in legal sources, sources of financing and differences in the categories of people who receive prodeo legal assistance, both have the same goal of realizing justice.
