Abstract: Arizona (2015b) reported that in the last mid-2015, there were lots of local regulation products intended as instruments to recognize the rights of indigenous people. Eventhough 40% of these products contain arrangements of the area, lands and communal forests, in reality, total area that have been effectively possessed by local communities were insignificant. According to Arizona (2015a), this condition occurred because the advocacy agenda trapped by the complexity of the diversity of the subjects and objects of the indigenous rights to be recognized and protected. This article was not about to argue that conclusion. However, this paper believes that the trap of complexity and diversity of the subjects and objects of the recognition of indigenous rights was enabled by three factors. First, the stakeholders within those complexity of definition came from generic concepts; second, failed to approach subjects and objects of the rights as a socio-antrophology reality at field level; and third, this problem was worsen by the stakeholders that barely have a proven instrument in finding sociological-anthropological reality. This article aims to fill those gaps. Namun, meski 40% produk hukum daerah itu berisi pengaturan tentang wilayah, tanah dan hutan adat, di tingkat lapangan, total luas yang telah benar-benar efektif dikuasi masyarakat adat relatif sangat sedikit. Menurut Arizona (2015a), hal itu terjadi, antara lain, agenda advokasi terjebak oleh kerumitan keragaman subyek dan obyek hak-hak adat yang akan diakui dan dilindungi. Tulisan ini tak hendak membantah kesimpulan itu. Namun, tulisan ini percaya bahwa jebakan kerumitan keragaman subyek dan obyek pengakuan hak-hak masyarakat adat itu dimungkinkan oleh tiga hal. Pertama, para-pihak terjebak dengan perdebatan definisi dari beberapa konsep yang memang bersifat generik; kedua, alpa mendekati subyek dan obyek hak itu sebagai realitas sosio-antropologis di tingkat lapangan; dan ketiga, masalah ini diperumit oleh para-pihak nyaris tidak memiliki instrument yang teruji dalam menemukan realitas sosiologis-antropologi dimaskud. The conservation of environment and the protection of human rights are two of the most compelling needs of our time. Unfortunately, they are not always easy to combine and too often result in mutual harm. This book analyses the idea of biocultural rights as a proposal for harmonizing the needs of environmental and human rights. These rights, considered as a basket of group rights, are those deemed necessary to protect the stewardship role that certain indigenous peoples and local communities have played towards the environment. With a view to understanding the value and merits, as well as the threats that biocultural rights entail, the book critically assesses their foundations, content, and implications, and develops new perspectives and ideas concerning their potential applicability for promoting the socio-economic interests of indigenous people and local communities. It further explores the controversial relationship of interdependence and conflict between conservation of environment and protection of human rights.

Across the globe, community-oriented protected areas are increasingly recognised as an effective way to support the preservation and maintenance of the traditional biodiversity related knowledge of indigenous peoples and local communities. We argue that guaranteed land security and the ability of indigenous and local peoples to exercise their own governance structures is central to the success of community-oriented protected area programs. In particular, we examine the conservation and community development outcomes of the Indigenous Protected Area program in Australia, which is based on the premise that indigenous landowners exercise effective control over environmental governance, including management plans, within their jurisdiction (whether customary or state-based or a combination of elements of both), and have effective control of access to their lands, waters and resources. Key Words: community-oriented protected areas, Indigenous rights, conservation, Australia

Abstract This article analyses the impact of covid-19 on the rights of indigenous peoples, particularly in Brazil. It deals with the current situation of the Brazilian indigenous peoples, the impacts of the pandemic, the rights created on the adoption of protective sanitary measures for indigenous people and land rights in Brazil. Does the Brazilian government comply with international law, with constitutional rights of indigenous peoples in the current covid-19 crisis, particularly with the Brazilian Supreme Court decision on the adoption of protective sanitary measures for indigenous people? With a focus on the 2020 Report of the Special Rapporteur on the Rights of Indigenous Peoples, this paper will identify and examine the gaps in protection of the indigenous peoples rights by reason of the impact of the covid-19 crisis. This paper argues that the crisis is misused as an occasion for land invasions, deforestation, forest fires and the denial of basic indigenous rights. Especially in Brazil, a transformative change, an emergency support for indigenous peoples, and a still stand agreement on logging and extractive industries operating next to indigenous communities are needed. Brazilian ngo statements give guidelines as to how to manage the threats of the present pandemic on indigenous peoples of Brazil. The Inter-American Commission on Human Rights, the United Nations and the International Labour Organisation all offer further relevant suggestions as to how to address the serious impacts in the response to and the aftermath of this crisis.

ABSTRACTIn 1946, the Ainu Association of Hokkaido was established by the Ainu to reclaim their lands. The 1970s and 80s saw that the association successfully put pressure on the Hokkaido Prefectural Government to take social welfare measures for the improvement of their life and make a new law counter to the Hokkaido Former Aborigines Protection Act. In 1997 the Japanese Government enacted the so-called New Ainu Law. However, it is totally different from the original draft made by the Ainu. The law does not designate the Ainu as indigenous people. Further, it is outstripped by the decision of Nibutani Dam Case that, for the first time in Japanese history, recognised Ainu right to culture and indigenousness in Japanese territory. In 2008 the Japanese Government finally recognised the Ainu as indigenous people in the wake of the UN Declaration of the Rights of Indigenous Peoples. However, the Ainu do not yet have any indigenous rights. This note chronologically outlines Japan's post-war Ainu policy, and moreover explores who and what has influenced Ainu policy and the law.

Recent statements by United Nations bodies point to free, prior and informed consent (FPIC) as a potential requirement in the development of engineered gene drive applications. As a concept developed in the context of protecting Indigenous rights to self-determination in land development scenarios, FPIC would need to be extended to apply to the context of ecological editing. Without an explicit framework of application, FPIC could be interpreted as a narrowly framed process of community consultation focused on the social implications of technology, and award little formal or advisory power in decision-making to Indigenous peoples and local communities. In this paper, we argue for an articulation of FPIC that attends to issues of transparency, iterative community-scale consent, and shared power through co-development among Indigenous peoples, local communities, researchers and technology developers. In realizing a comprehensive FPIC process, researchers and developers have an opportunity to incorporate enhanced participation and social guidance mechanisms into the design, development and implementation of engineered gene drive applications.

English Abstract:The indigenous people of Venezuela, long excluded from political participation, registered a whole set of rights within the new constitution in 1999. However, the proclamation of these rights did not ensure their full implementation and, a fortiori, their purpose to protect the survival of indigenous peoples. This article presents an analysis of the processes through which indigenous rights have been allocated but poorly implemented and even substantially withdrawn. In many Latin American states, the rights that promote autonomy and self-government are actively abandoned notwithstanding cultural, political, and economic contexts be they progressive or conservative. Through this analysis, this article proposes the concept of “proclamation-denial”. While this concept is relevant for numerous Latin American countries, this article highlights the specificities of the Venezuelan case.Spanish Abstract: Los pueblos indígenas de Venezuela, históricamente excluidos de la participación política, lograron que se registrara todo un conjunto de derechos particulares dentro de la nueva constitución en 1999. Sin embargo, la proclamación de estos derechos no garantizó su plena aplicación y, a fortiori, su propósito de proteger la supervivencia de los pueblos indígenas. Este artículo analiza los procesos por los cuales los derechos indígenas han sido legalmente asignados pero débilmente implementados, y hasta desconocidos sustancialmente. En muchos estados latinoamericanos, los derechos que promueven la autonomía y el autogobierno son activamente abandonados, y esto que el contexto cultural, político y económico sea progresista o conservador. A través de este análisis, este artículo propone el concepto de «proclamación-negación». The Nagoya Protocol on Access and Benefit Sharing (ABS) provides for the rights of Indigenous people and local communities in accordance with United Nations Declaration of Rights of Indigenous People. The Parties are obliged to take legislative, administrative and technical measures to recognize, respect and support/ensure the customary laws & institutions and community protocols of Indigenous peoples and local communities (ILCs). Within the ambit of contemporary debates encompassing Indigenous peoples’ right to self-determination, this paper examines the effectiveness of international law (i.e. Nagoya Protocol) to influence existing or evolving domestic laws, policies or administrative measures of Parties on access and benefit sharing. Through opinion surveys of Indigenous organizations and national authorities of CBD’s Parties, the findings indicate that the space, recognition and respect created in existing or evolving domestic ABS measures for rights of Indigenous communities are too inadequate to effectively implement the statutory provisions related to customary laws & institutions and community protocols, as envisaged in Nagoya Protocol. As the bio-cultural rights of Indigenous people are key to conservation and sustainable use of biodiversity, the domestic ABS laws need reorientation to be sufficiently effective in translating the spirit of international ABS laws into domestic policies.

How to assess the issue of indigenous land rights in the face of man-m⁠a⁠d⁠e climate change and Amazon fires? How to classify the EU free trade agreement „Mercosur“ and relevant climate, environmental and indigenous rights? What are legal opportunities for indigenous people(s) on the international, inter-American and EU level, to prevent the loss of land and forests, and to protect themselves from climate change? On the basis of indigenous land and environmental rights in Brazil and reactions to the Amazon fires, environmental regulations of the "Mercosur Pact" as well as concerned human and indigenous rights are discussed. Further, this article deals with relevant inter-American law (individual indigenous land rights) and international law (collective land rights). Environmental and climate law provide legal and political options for indigenous people(s), for instance in Brasil. Negative impacts of climate actions on indigenous peoples, the competition between environmental protection areas and indigenous territories, the inclusion of indigenous knowledge in sustainable environmental protection and the allocation of Global Public Goods are discussed. There are various interactions between climate and biodiversity protection, human rights, indigenous peoples rights, and free trade between the EU and South America. While protecting forests as a carbon sink, negative environmental or social consequences must be avoided. Like trade agreements, environmental standards for the protection of the Brazilian Amazon rain forest should be enforceable. To reduce deforestation and to confine the effects of climate change, indigenous peoples rights have to be strengthened. The free, prior, and informed consent of indigenous peoples to projects that may affect their territories is essential. It requires effective, coordinated solutions to protect human rights and indigenous land rights, and it needs a sustainable preservation of climate and forests - nationally and internationally. A collapse of the Amazon forest ecosystem would have global climate effects. In Brazil, alternatives to deforestation and destruction are: strengthening the rule of law and agro-ecology, and to defend indigenous territories.

O presente trabalho tem como objetivo discorrer sobre algumas experiências vividas durante o desenvolvimento das atividades de secretaria do curso de Formação Intercultural Para Educadores Indígenas, no que se refere ao atendimento aos estudantes, aos docentes e ao público em geral. Serão apresentados alguns desafios do processo de institucionalização do curso assim como da inserção e aceitação do estudante indígena pela comunidade universitária. Observa-se que os indígenas buscam fortalecer suas identidades na interação com os não indígenas e mesmo entre indígenas. Há também um esforço por parte dos professores e outros profissionais mais próximos deles no curso de que os mesmos tenham seus direitos assegurados. A inserção dos povos indígenas na universidade demonstra o quão importante e necessário é a troca de experiências entre os dois mundos: indígena e não indígena. Aponta também para a necessidade de que se promova o debate e reflexão sobre os povos indígenas e suas demandas. Nesse sentido, considera-se que a reflexão sobre o dia a dia da secretaria poderá contribuir para o aprimoramento da inserção indígena na universidade uma vez que neste espaço o exercício de compreensão do mundo indígena para atendimento às suas demandas é potencializado.Palavras-chave: Povos indígenas; Direitos; Ensino Superior. ABSTRACT: The present work aims to discuss some experiences during the development of the activities of secretariat of the course of Intercultural Training for Indigenous Educators, regarding the attendance to students, teachers and the public in general. It will present some challenges of the process of institutionalization of the course as well as the insertion and acceptance of the indigenous student by the university community. It is observed that indigenous peoples seek to strengthen their identities in interaction with non-indigenous people and even among indigenous peoples. There is also an effort on the part of teachers and other professionals who are closest to them in the course that they have their rights guaranteed. The insertion of indigenous peoples in the university demonstrates how important and necessary is the exchange of experiences between the two worlds: indigenous and non-indigenous. It also points to the need to promote debate and reflection on indigenous peoples and their demands. In this sense, it is considered that the reflection on the day-to-day work of the secretariat can contribute to the improvement of the indigenous insertion in the university since in this space the exercise of understanding of the indigenous world to attend to their demands is enhanced.Keywords: Indigenous people; Indigenous rights; Higher Education.
