The article describes the problematic issues of the federal framework regulation of the electoral rights of citizens at the present stage of development of Russia. The examples from domestic judicial practice reveal specific problems in the field of legal regulation of the organization and conduct of elections in the constituent entities of the Russian Federation and municipalities, the solution of which could be avoided by due legal regulation and institutionalization of the status participants in electoral legal relations.

The genesis of the essence and foundations of the legal regulation of financial control in Russia since the market reforms of the 1990s and to the present time has been considered. The current regulatory framework and general characteristics of the system of external state and municipal financial control in the Russian Federation have been introduced. The main provisions of the Federal law dated 7 February 2011 No 6-FZ «On general principles of organization and activity of control and accounting bodies of the Russian Federation and municipalities» have been considered. The main tasks, remaining at the present stage of development of the system of state financial control in the Russian Federation have been disclosed.

Introduction: the article considers problematic issues related to the work of management subjects (managers) and attestation commissions in situations when an employee of the penal system of the Russian Federation is dismissed due to the loss of trust. The aim of this study is to identify gaps in the current legislation on the service that arise when a measure of responsibility such as dismissal due to the loss of trust is applied; another aim consists in formulating proposals for improving legislation in this area. Methods: methodological basis of our study is represented by a set of methods of scientific cognition, among which the main place belongs to formal-logical, system-structural, and comparative-legal methods. Results: the study has shown that there are many problematic issues in the law enforcement practice regarding the dismissal of employees due to the loss of trust. The norms of the law do not clearly distinguish the components of corruption offenses for which an employee is subject to dismissal due to the loss of trust or may be brought to another type of liability. The issue regarding the status of the decision of the attestation commission remains unresolved; its decision is of an advisory nature, but at the same time, it is fundamental for making a decision by the employee’s superior. There is an ongoing discussion on the composition of the attestation commission; and options for the selection of independent experts are proposed. Discussion: dismissal due to the loss of trust is a specific type of disciplinary penalty, and its implementation is carried out by authorized management entities within the framework of disciplinary proceedings. The procedure for making a decision on the dismissal of employees of the penal system due to the loss of trust needs further improvement in its legal and organizational aspects, taking into account modern law enforcement and judicial practice.

Исследуются отдельные вопросы правового статуса коренных малочисленных народов Российской Федерации и примеры судебной практики оспаривания реализации правомочий представителями коренных народов. Автор приводит сравнительный анализ понятия «коренные народы» в международном праве, «коренные малочисленные народы», «коренные малочисленные народы Се-вера, Сибири и Дальнего Востока Российской Федерации» в российском праве, обосновывает необходимость применения Декларации Организации Объединенных Наций о правах коренных народов 2007 г. как акта непосредственного действия. В статье описана система правового регулирования статуса коренных малочисленных народов, сделан вывод о её многоуровневости и сложности. Автор отмечает практическую невозможность распространить действие названного международного акта на все коренные народы, населяющие территорию России. В работе исследуется судебная практика как судов общей юрисдикции, так и принятое в 2019 г. По-становление Конституционного Суда Российской Федерации № 21-П по делу гражданина Щукина Г. К. Автор делает вывод, что выведенный конституционно-правовой смысл статьи 19 Федерального закона «Об охоте и о сохранении охотничьих ресурсов», которая наряду с другими законами и подзаконными актами имеет значение для закрепления правового статуса коренных малочисленных народов, поможет не только единообразному применению названного закона, но и послужит образцом для распространения его на иные сферы традиционного природопользования общин коренных малочисленных народов, рыболовство, которые регулируются другими федеральными законами. Помимо проблем реализации правомочий, вытекающих из статуса коренных малочисленных народов, в судебном по-рядке зачастую устанавливается факт принадлежности к коренному народу в связи с отсутствием в Российской Федерации единого документа, подтверждающего национальность. В этой связи позитивным, по мнению автора, следует признать принятие 06.02.2020 изменений в Федеральный закон № 82-ФЗ «О гарантиях прав коренных малочисленных народов Российской Федерации», которые устанавливают централизованную систему учёта представителей коренных малочисленных народов РФ. Этот акт пока не вступил в силу, настоящая статья впервые описывает новеллы законодательства. The article explores certain issues of the legal status of the small indigenous peoples of the Russian Federation and examples of judicial practice in exercising indigenous rights. The author makes the comparative analysis of the concept «indigenous people» of international law, «indigenous small-numbered peoples», «indigenous small-numbered peoples of the North, Siberia and the Far East of the Russian Federation» in Russian law, proves the necessity of applying the United Nations Declaration on the rights of indigenous peoples of 2007 (UNDRIP) as the act of direct action. The article describes the system of the legal regulation of the status of small-numbered indigenous peoples, the author concludes about its complexity. The author notes the practical impossibility of extending the application of the said international act to all indigenous peoples who inhabit the territory of Russia. The work examines the judicial practice of both the courts of general jurisdiction and the Decision of the Constitutional Court of the Russian Federation No. 21-P of 2019 in the case of citizen Schukin G.K. The author concludes that the constitutional and legal meaning of article 19 of the Federal Law "On Hunting and Conservation of Hunting Resources," which, together with other laws and regulations, is relevant to the legal status of small-numbered indigenous peoples, not only will the uniform application of the Act, but it will also serve as a model for extending to other areas of traditional environmental management of small-numbered indigenous communi-ties, fisheries regulated by the other federal laws. In addition to the problems of exercising the powers arising from the status of small-numbered indigenous peoples, the fact of belonging to an indigenous people is often established in court, because of the absence of the unified document confirming the nationality in the Russian Federation. In this regard as positive, according to the author, it is necessary to recognize acceptance on the 6th of February 2020 changes in federal law No. 82-FZ "About guarantees of the rights", which install the centralized system of accounting of representatives of indigenous small-numbered peoples of the Russian Federation. This act has not yet entered into force, but this article for the first time describes the innovations of the legislation.

In the Russian Federation, the problem of budget planning becomes especially relevant when the pace of economic development slows down. The article examines the features of the formation of regional budgets, using the example of the budget of the Republic of Dagestan. The analysis of incomes to the budget is carried out. The role of regional taxes in the formation of budget revenues of the Republic of Dagestan is revealed. According to the results of the study, it can be concluded that the budgetary policy of the regions at the present stage of development of the Russian economies does not contribute to a further increase in the rates of economic growth. The article offers recommendations for improving the regional budgetary policy of the Russian Federation and increasing the responsibility of regional authorities.

The subject of the research within the framework of the article is the criminal procedure institute for the detention of a person on suspicion of committing a crime. The legal nature of this institution is analyzed, and comments are given on the normative legal acts and judicial practice regulating the issues of detention. The theoretical basis of the research is based on the publications of the last two decades on this problem, in particular, reflecting the discussion of the process scientists S. A. Shafer, S. B. Rossinsky and A. A. Tarasov, the subject of which was the issue of the legal nature of a suspect detention in a criminal case. In the paper, the authors ask the following questions: What is the detention of a person on suspicion of committing a crime in accordance with the legislation of the Russian Federation? From what moment does the detained person acquire the status of a suspect? Is it possible to detain a person before initiating a criminal case? The study concludes that a person acquires the actual status of a suspect from the moment of direct detention, that is, before documenting this status and, as a result, before initiating a criminal case. Amendments to the articles of the Criminal Procedure Code of the Russian Federation are proposed, and the authors` versions of the definitions of the concepts «detention of a suspect», «the moment of actual detention» and «pre-trial proceedings» are given.

The article is devoted to the problems of constitutional control in the subjects of the Russian Federation. The article examines its origins related to the formation and functioning of constitutional (statutory) courts at this level, reveals the reasons that did not allow the constitutional justice of the subjects of the Russian Federation to become a full-fledged state legal institution for 30 years. It is shown how, as a result of the constitutional reform, these courts were abolished, and a recommendation of the federal legislator appeared on the creation of constitutional (statutory) councils under the legislative (representative) state authorities of the subjects of the Russian Federation instead of them. The article analyzes the legal regulation of the organization and activities of such bodies in domestic and foreign practice. Taking this into account and based on the existing constitutional and legal possibilities, proposals are formulated on the status of these councils (their nature, the procedure for their formation and work, powers and decisions), which allows them to be an effective body of constitutional (statutory) control in the subjects of the Russian Federation.

The paper presents a research of the new legal regulation for such an institute in relation to a regional and equal court, as the referral of a case received in accordance with part 4 of Article 39 of the Arbitration Procedure Code of the Russian Federation to a court of general jurisdiction, which is in jurisdiction to hear a case as it is assigned by law. The absence of procedural legal regulation of this action, which is, in author’s opinion, has an obvious procedural nature, and researched practice general jurisdiction courts demonstrate the uncertainty in implementation of the considered reform. The author analyzes the new procedural institution on the basis of his own vision of a number of procedural norms, as well as scholar works and historical experience. In particular, the author reasoning that the courts are to issue special rulings on the referral of cases received from arbitration to the courts of general jurisdiction. Moreover, the author considers the mechanism for adopting such a judicial act. The article presents a wide range of practical examples of the implementation of considered provision, as well as the difference in the approaches of the appellate courts to assess these implementation practice. In conclusion, the article presents the proposals for further improvement of the regulation of considered issue. Most likely such an improvement will be impossible without the universal approach established by the Supreme Court of the Russian Federation. Such improvements should result in uniform judicial practice, as well as further developments of procedural legislation.
