The article is devoted to the study of the role of the employment contract in the realization of therights and obligations of the parties to the employment relationship. The views of well-known scientistsconcerning the nature of the employment contract and labor relations are investigated. Attention is drawnto the fact that along with the fact that the employment contract is the basis for the emergence ofemployment relationships, it is also their regulator. The feasibility of the future Labor Code of Ukrainesubstantiates as fully as possible the rights and obligations of employees and employers, without reducingthe legal guarantees of labor rights of employees, provided for by the Labor Code of Ukraine. It is alsoproposed to approve at the level of the resolution of the Cabinet of Ministers of Ukraine a typical form ofan employment contract between an employee and an employer.

The article focuses on determining the prospects of expanding regulatory opportunities for homeworkers’ labour rights implementation in Ukraine. While analyzing critically the current labour legislation and drafts of laws on labour, we can conclude that most of norms, which regulate home-based work, are of the declarative character as they do not contain any mechanism of implementing standards and rules established by this act. The author proposes to supplement the current Labour Code of Ukraine by the specific Chapter “Atypical Employment”, which would include the Article “House-based Work and Homeworkers”. In this article it is advisable: to formulate a definition of the “house-based work” concept; to reinforce the warning about extending the labor rights of typical employees to homeworkers; to determine the role of an employment contract on home work in the emergence of labor relations with a homeworker; to outline the essential terms of an employment contract for house-based work; to determine what conditions of an employment contract for for house-based work may be additional; to resolve the issue of organizing the work process of the homeworker and checking the conformity of the living conditions of citizens who have expressed a desire to work at home; to settle the issues of use and depreciation of tools and means of the homeworker’s labor. Conclusions generalize the results of the research.

AbstractThis article examines the changes to and relations between labor policy and labor legislation in the context of China's market transition with a focus on the 1994 Labor Law and the 2007 Labor Contract Law. The initial impetus to labor policy change came from the unemployment crisis at the end of the 1970s and the early 1980s. Since then, the state has relaxed its control over labor mobility and job allocation. The last two decades of the last century witnessed the most important changes in China's labor policy, that is, the replacement of lifelong employment with contract-based employment and the replacement of government job assignment with the labor market. Such changes indicate the paradigmatic shifts of China's labor policy in the reform era. Under the new labor policy paradigm, the role of law has been strengthened in governing labor relations and other labor-related affairs. Within the policy context of promoting economic growth while maintaining social stability, both policy and law are coordinated and complementary in stabilizing labor relations and protecting labor rights. Given the socioeconomic circumstances and the underdevelopment of the rule of law in China, policy is still important during the period of market transition.

A arte desenhada sobre papel simboliza os trabalhadores e as trabalhadoras, e suas constantes lutas sociais pela manutenção dos direitos trabalhistas no Brasil, conquistados na década de 1943, com a Consolidação das Leis Trabalhistas (CLT). Trata-se de um estatuto de Normas Regulamentadoras - NR de relações individuais e coletivas de trabalho para aqueles contratados formalmente com vínculo empregatício. Em 2017, o Governo aprova a Lei nº 13.467, reconhecida como Reforma Trabalhista, a qual exclui mais de cem artigos da CLT, reduz direitos e o papel do Estado em relação à proteção da dignidade do trabalhador. Posteriormente, a classe trabalhadora sofreu novo impacto em 2019, momento em que o Governo Federal promoveu a extinção do Ministério do Trabalho e Emprego (MTE), órgão responsável pela fiscalização e regulamentação das relações de trabalho no país. Isso gerou o fracionamento das atribuições das Leis de trabalho em três pastas ministeriais, fragilizando ainda mais as normas trabalhistas, dificultando a interlocução entre o trabalhador e empregadores e formalizando a precarização do trabalho. Nesse sentido, a imagem representa os desmontes que o trabalhador vem sofrendo, ao longo dos anos, em relação à legislação e aos direitos trabalhistas, mas também à saúde e à previdência social. A flexibilização das relações no ambiente laboral revela uma nova configuração do mundo do trabalho, uma realidade ainda mais perversa, pautada em um discurso neoliberalista de "menos direitos e mais liberdade para o trabalhador", porém, que carrega como consequências a redução do emprego digno, de saúde e segurança para os trabalhadores brasileiros. AbstractThe art drawn on paper symbolizes the workers and their constant social struggles for the maintenance of labor rights in Brazil, conquered in the 1943s by the Consolidation of Labor Laws (CLT). The CLT is a statute of the Regulatory Norms - NR about individual and collective labor relations for those formally hired with an employment relationship. In the year of 2017, the Government approved the Law 13.467 that implemented a Labor Reform, which excludes more than one hundred articles from CLT reducing many workers rights and the role of the State regarding the protection and dignity of the workers. Subsequently, the working class suffered a new impact in the year of 2019, when the Federal Government extinguished the Ministry of Labor and Employment (MTE), the institution responsible to monitor and regulate labor relations in Brazil. This fact caused a division of the attributions of the Labor Laws into Three Ministerial Portfolios, further weakening labor standards making it more difficult for workers and employers to communicate with each other, formalizing precarious work. Thus, this image represents the problems workers has been suffering, over the years, due to the lack of labor rights, health and social security. The flexibilization of labor relations reveals a new configuration for the labor society and provides an even more perverse reality based on a neoliberalist discourse that propagates the idea of "less rights and more freedom for the workers", reducing decent employment, health and safety for Brazilian workers.Keywords: Labor Legislation; Occupational Health; Occupational Therapy; Precarious Employment; Work. ResumenEl arte dibujado en papel simboliza a los trabajadores masculinos y femeninos, y sus constantes luchas sociales para el mantenimiento de los derechos laborales en Brasil, logrados en la década de 1943, con la Consolidación de las Leyes Laborales (CLT). Este es un estatuto de Normas Reguladoras - NR de relaciones trabajo individual y colectivo para aquellos formalmente contratados. En 2017, el Gobierno aprobó la Ley 13.467, reconocida como Reforma Laboral, que excluye más de cien artículos del CLT, reduce los derechos y el papel del Estado en relación con la protección de la dignidad de los trabajadores. Posteriormente, la clase trabajadora sufrió un nuevo impacto en 2019, cuando el Gobierno Federal promovió la extinción del Ministerio de Trabajo y Empleo (MTE), el organismo responsable de la inspección y regulación de las relaciones laborales en el país. Introduction: in this article the authors examine the complex issues related to certain contours of the future of labor law in the conditions of change. An analysis of contemporary Western and Russian literature on the stated topic is given. Methods: comparative legal, historical, system methods, as well as the modeling method and the formal-logical method. Analysis: particular attention is paid to the numerical growth of atypical labor relations, which are inherent in the postindustrial society. Their main characteristics associated with a deviation from the three classical cha- racteristics (personal, organizational and property), as well as from the model of the traditional «working» contract, are proposed. It stressed the importance of information, technological and social aspects of the new organization of work, discussed the problem of «living wage» and the prospects of its solution. Results: the authors proposed three options for further development of labor law, the most likely one was identified. According to the authors, this option is associated with a reduction in the scope of the mandatory legal regulation of labor relations and the total number of specialized regulatory legal acts, with an increase in the role of judicial law. Accordingly, the role of horizontal (individual-contractual and social-partner) regulation of labor relations increases. The article proposes the author’s periodization of the stages of labor organization. As the conclusions the basic characteristics inherent in labor law of the future are offered: 1) strengthening of flexibility in regulation of labor relations, expansion of the sphere of normative differentiation and contractual regulation; 2) the transformation of labor law towards a comprehensive legal education «human rights in the process of wor- king life», 3) the growing role of international labor law in connection with the process of globalization.

The article studies the problem of abuse of law in the context of the implementation of labor law. In this context, the abuse of labor rights should be understood as a special type of legal behavior consisting in the exercise by subjects of labor relations of their rights in an inappropriate way, that contradicts the purpose and principles of the branch of labor law, as a result of which legitimate interests are ignored and other subject of labor relations can be harmed. The concept of "abuse of rights" is closely linked to the principle of integrity. In exercising their rights and performing their duties, the subjects of the employment relationship must act in good faith. The principle of good faith in labor law should characterize the aspirations of the subjects in a proper and honest manner to exercise the granted labor rights and to fulfill their obligations. Specific forms of abuse of rights by employees are: 1) concealment of temporary disability; late notification of temporary disability at the time of dismissal; 2) concealing information about pregnancy; 3) concealing the fact of disability; 4) deliberate task of material harm to the employer by unfair acts - termination of the employment contract at will, and then appeal of dismissal; 5) deliberate delay in obtaining a work book or settlement upon dismissal and the like. Employers resort to abuse of rights mainly in the following cases: 1) when dismissing an employee; 2) when fulfilling the duties of creating an employee the necessary conditions for performing the work function; 3) in case of repeated renegotiation of fixed-term employment contracts with an employee; 4) when giving an employee guarantees in case of termination of the employment contract stipulated by the labor legislation, etc. It is proved that one of the main directions of further improvement of labor legislation is the need to establish the principle of good faith and the inadmissibility of abuse of law as one of the branch in the science of labor law, which should apply to all subjects of labor and related relations - workers, employers, trade unions, associations of employers.

The copyright in its infancy was provide protection only for the category of works of fine art but challenges followed by creations immediately should be undertaken measures regarding copyright during employment relationship. When authors of creations have seen the benefit of copyrights, they have risen their voice and acted to protect their creation. Therefore, it is very important that employers and employees with employment contract or agreement later make accurate determinations and clearly define their agreement. Law on Copyright in Kosovo almost every provision cited in this article has left open the possibility of defining many issues between parties, such as the expiration of period of rights to the employer, extra compensation etc. In the absence of clear contractual provisions shall apply copyright, and companies, that have invested heavily in a certain work, will lose right after the expiration of 10 years and all contracts that are associated with third parties, other-companies for allowing the use of a work after this deadline will be invalid because a party cannot achieve the right of copyright. This situation could cause many problems in the future for Kosovo companies which do not have much knowledge about the legislation in the field of copyright and do not take precautions to regulate the issue of transfer of rights to their employees. This Article discusses the idea ownership issue in the context of employment and independent contractor relationships. The paper recommends that since copyright is not familiar with the business regarding changing performance, therefore Kosovo laws should adequately support these circumstances of ownership in order for employees to give their best on his career. How employees could be owners of copyright. Which particular articles of Kosovo law on copyright should change?

The article analyzes the positions of experts in the field of labor law regarding the nature and types of hidden labor relations from the positions of positivism and the scientifically based concept of integrative law understanding. The author criticizes the conclusions of experts based on a positivist legal understanding according to which an employment relationship arises on the basis of the reclassification of a civil contract into an employment contract or a civil relationship into an employment relationship. Based on the analysis of labor law norms, law enforcement practice in labor disputes and scientific points of view of experts in the field of labor law, which is based on a scientifically based concept of integrative law understanding, the author comes to the conclusion that hidden labor relations are a type of labor relations, have signs of labor relations, are common in the judicial practice of labor disputes and are the most urgent problem of Russian labor law. The author analyzes two modern types of hidden labor relations from the position of a scientifically based concept of integrative law understanding: the conclusion of civil contracts instead of labor contracts and the actual admission of an employee to work by the employer or with the knowledge or on behalf of the employer or its authorized representative in the case when the labor contract was not properly executed, within three days and later after the actual admission of the employee to work. The author analyzes the ways of protection of labor rights and legal interests in the field of labor from the position of a scientifically grounded concept of integrative law understanding and formulates law-making proposals for changing the norms of labor law.

Resumo: O presente artigo é voltado ao estudo da necessidade de reconhecimento da relação empregatícia existente entre as profissionais do sexo e os estabelecimentos em que laboram, utilizando-se de uma visão jurídica e sociológica. O entendimento jurisprudencial trabalhista majoritário se volta no sentido do não reconhecimento dessa relação de emprego em virtude da ilicitude do objeto do contrato de emprego, retirando das trabalhadoras dessa categoria a proteção trabalhista e os direitos trabalhistas a que fariam jus. A prostituição como profissão existe desde as primeiras civilizações, subsistindo hodiernamente como uma atividade presente na grande maioria das cidades brasileiras. Apesar disso, as prostitutas sofrem com um processo de estigmatização que as remete à margem da sociedade, fato que é legitimado pelo não reconhecimento de sua condição de trabalhadores como os demais. As profissionais do sexo, conforme entrevistas realizadas, vêem a prostituição como uma profissão idêntica às demais, apesar de sofrerem preconceito por parte da sociedade em virtude de sua atividade. Cabe ao judiciário trabalhista reconhecer a profissão das profissionais do sexo e conferir a elas a mesma proteção dada aos demais trabalhadores como forma de efetivar seu papel de conferir aos obreiros seus direitos constitucionalmente assegurados e concretizar o princípio da dignidade da pessoa humana.Palavras-chave: Dignidade da pessoa humana. Relação de emprego. Abstract: This article is intended to study the need for recognition of employment relationship among sex workers and the establishments where they work, using a legal and sociological view. The major jurisprudential understanding turns towards non-recognition of this employment relationship due to the illegality of the object of the employment, removing the workers of this category from the labor protection and labor rights to which they would be entitled. Prostitution as a profession has existed since the earliest civilizations, existing in our times as an activity present in most Brazilian cities. Nevertheless, prostitutes suffer from a process of stigmatization that refers them to the margins of society, a fact that is legitimized by the non-recognition of their status as workers as the others. Sex workers, according to the interviews accomplished, see prostitution as a profession similar to the others, despite suffering prejudice from society due to their activity. It is necessary that the labor courts recognize the profession of sex workers and give them the same protection given to other workers as a way to accomplish their role of giving the workers their constitutionally guaranteed rights and implement the principle of human dignity.Keywords: Employment relationship.
