COMPARATIVE ANALYSIS OF LABOR ORGANIZATION AS A FACTOR OF CONVICTS` CORRECTION IN FOREIGN COUNTRIES

В статье рассмотрен такой инструмент исправления осужденных, как общественно полезный труд, который в Российской Федерации на законодательном уровне признан одним из эффективных инструментов исправления наряду с другими основными средствами исправительного воздействия. В работе в том числе рассматриваются проблемы принудительного труда осужденных. Авторы раскрыли порядок и условия организации привлечения к трудовой деятельности лиц, содержащихся в пенитенциарных учреждениях зарубежных стран. В статье проводится сравнительный анализ особенностей содержания, условий привлечения к труду осужденных в зависимости от вида пенитенциарного учреждения различных государств, организации работы осужденных, а именно оплаты труда, продолжительности трудовой деятельности, норм охраны труда, реализации права на отдых и социального обеспечения. Авторы помимо этого обобщают опыт трудовой дисциплины осужденных в пенитенциарных системах ряда развитых в экономическом и социальном плане государств. Изучая опыт зарубежных стран по привлечению заключенных к труду, представляется возможным перенять некоторые важные особенности, которые могут быть частично внедрены в отечественную уголовно-исполнительную систему. The article considers such a tool for the correction of convicts as socially useful work, which in the Russian Federation at the legislative level is recognized as one of the effective tools of correction along with other basic means of correctional influence. The article also deals with the problems of forced labor of convicts. The authors revealed the procedure and conditions for organizing the employment of persons held in places of forced isolation from the society of penitentiary institutions of foreign countries. The paper provides a comparative analysis of the features of the content, conditions for the employment of prisoners, depending on the type of penitentiary institution in different states, the working methods of prisoners, namely, remuneration, duration of work, labor protection standards, the exercise of the right to rest and social security. The authors also summarize the experience of labor discipline of prisoners in the penitentiary systems of a number of economically and socially developed countries. Studying the experience of foreign countries in attracting prisoners to work, it is possible to adopt some important features that can be partially implemented in the domestic penal system.

The relevance of the work is determined by the fact that the right to life belongs to the basic constitutional human rights, therefore, its observance and protection is the duty of the state. Despite its undeniable importance, today the right to life anywhere in the world is not really ensured in sufficient quantities. The constitutional consolidation of the right to life raises a number of issues related to the concept, nature, legislative and practical implementation of this right. It should be noted that various aspects of the human right to life were considered in the scientific works of G.B. Romanovsky, O.G. Selikhova, T.M. Fomichenko, A.B. Borisova, V.A. Ershov and other Russian authors. The aim of the study is to study and comparative analysis of the legal content of the constitutional norm that defines the right to life, to comprehend and identify possible problems of the implementation of this right. To achieve this goal, this article discusses relevant issues of ensuring the right to life, proclaimed by Article 20 of the Constitution of the Russian Federation and Article 27 of the Constitution of Azerbaijan Republic. The results of a comparative analysis of these constitutional norms and the relevant norms of industry law allow us to determine, that there is no contradiction between Article 20 of the Constitution of the Russian Federation and the norms of the criminal legislation of the Russian Federation, which imply the death penalty as an exceptional measure of punishment, because a moratorium has been imposed on the death penalty in the Russian Federation since April 16, 1997. However, after the abolition of the death penalty in the criminal legislation of the Republic of Azerbaijan in 1998, there was a discrepancy between parts II and III of Article 27 of the Constitution of the Republic of Azerbaijan and the criminal legislation of Azerbaijan Republic that requires the introduction of the necessary changes in the content of the analyzed constitutional norm. The value of the work is determined by the fact that the introduction of appropriate changes will contribute to the further improvement of the Constitution of the Republic of Azerbaijan and the effective implementation of the right to life of everyone.

Constitutionalists in Russia have disagreed on the possibility of specifying nationality of a citizen in the passport. It is believed that at present the indication of nationality in the passport is not made, but it turns out that this is not the case. Implicit declaration of nationality with the help of a special insert is possible for citizens living in the republics and for native speakers of non-Russian state languages of republics. This state of affairs creates inequality for residents of different types of constituent entities of the Russian Federation and for citizens of different nationalities. Nationality of Russians as a national majority is not expressed in the Russian Federation through the statehood itself and through the institution of citizenship as it is done in foreign countries where nationality is not indicated in the passport. The author substantiates an erroneous stance of the Constitutional Court of the Russian Federation on inadmissibility of specifying nationality of a citizen in his or her passport. It is concluded that it is desirable to restore indication of nationality in the passport for all citizens with the aim of the fullest implementation of the right to nationality in the context of the Russian Federation.

The subject. The article deals with topical issues of ensuring the realization of the employee's right to healthy and safe working conditions.The purpose of the study is to identify the main directions of improvement of the Labor Code of the Russian Federation in the field of labor protection.The methodology includes formal-legal method, the analysis of the components of the right to healthy and safe working conditions, as well as the right to information and related rights.The main results. The author formulates proposals for amending a number of articles of the Labor Code, including those containing the most important branch principles, as well as those on termination of the employment contract and ensuring the right of an employee to a workplace that meets the requirements of labor protection.Examples from judicial practice show a low level of legal awareness of Russian employers and their disdainful attitude to labor legislation. This is expressed not only in violation of labor protection rules, but also in the absence of proper registration of an employee, when a written labor contract is not concluded with him. Thus, the relationship between the norms of different labor law institutions is expressed, expressed in their protective potential. The existing approach to understanding labor protection in a broad sense to a certain extent may be in demand even now. For example, by improving the norms on the conclu-sion, modification and termination of an employment contract, it is possible to achieve in parallel a certain improvement in working conditions for workers. This is due to the fact that legal registration of employment in most cases is associated with a higher level of security, since an employee without clearance does not actually exist for the state control and supervisory bodies.Conclusions. Understanding of labor protection as all-round protection of labor capacity of the person, being so widespread in Soviet time, looks quite justified nowadays too. The Labor Code of the Russian Federation, as the central regulatory legal act, should be considered as an instrument not only of legal regulation, but also of a powerful ideological impact on domestic employers, and changes and additions to labor legislation concerning labor protection should be made according to above-mentioned conclusion.

the article presents the consideration of topical issues of citizens ' participation in the protection of public order and ensuring public safety, regarded as one of the political rights of citizens enshrined in the Constitution of the Russian Federation, namely: freedom of association. A comparative analysis of the experience of involving the population in the protection of public order in the Russian Federation and certain foreign countries has been conducted. The forms of participation of citizens in the protection of public order, as well as the methods of motivation of citizens for this type of activity have been analyzed. The suggestions for improving regulatory, social, organizational measures aimed to attract citizens to the protection of public order have been presented.

This article analyzes the establishment of legal regulation of the court's activity in the consideration and resolution of the question of transferring foreign citizens sentenced by the court of the Russian Federation to serve their sentence in country of citizenship. The author offers periodization of the chronology of its evolution,  and draws attention to the gaps and inaccuracies in the current legislation and the need for amending normative legal framework, which is testified by the legal acts adopted by the state authorities of the Russian Federation, including those aimed at regulation of international legal relations in this sphere, as well as the works of the scholars-processualists. The conclusion is made that the corresponding court's activity acquires a special role. Compared to the Soviet period, national and international norms that regulate the court’s activity in this area have experiences significant changes, as the number of convicts transferred to their country of citizenship has increased considerably, the contractual practice of the Russian Federation has expanded, which is substantiated by the globalization processes and the need for the development and strengthening of international cooperation of the Russian Federation with foreign countries in the sphere of transferring foreign citizens. Examination of the chronology of changes experienced by the normative legal framework of the court’s activity in the course of its establishment and development, allows choosing the right direction for further improvements.

The subject. The article is devoted to problems of appointment some criminal punishments alternative to the deprivation of liberty by courts in Russian Federation. The author gives an answer to the question, why punishments not related to imprisonment in the Russian Federation, especially deprivation of the right to occupy certain positions or engage in cer-tain activities, corrective labor, restriction of freedom, forced labor, are rarely appointed by courts, and the most common alternative punishments are only fine and mandatory work.Methodology. Author uses such researching methods as analysis and synthesis, formally legal, comparative legal.Results. The author proposes some concrete measures, aimed at expanding the practice of appointment some criminal punishments alternative to the deprivation of liberty.It is necessary to reduce the size of the fine established in the Criminal Code of the Russian Federation. It is necessary to establish a penalty in the sanction of norms on crimes of small and medium gravity, committed for mercenary motives and connected with causing mate-rial damage.In order of more effective serving of punishments in the form of compulsory and corrective works, it is necessary to interest employers, it can be expressed in granting tax credit ben-efits. The searching of specific facilities for serving corrective labor should be assigned to employment centers.It seems expedient to introduce deprivation of the right to occupy certain positions or en-gage in certain activities as the main type of punishment to all sanctions of the norms about the responsibility for crimes of small or medium gravity related to the professional activities of the person. It is necessary to eliminate gaps in the legislative regulation of punishment in the form of restricted liberty and to solve the problem of electronic monitoring of convicts using elec-tronic bracelets.Conclusions. The punishment in the form of deprivation of liberty should be appointed by courts only in cases, when the crime is highly dangerous, the identity of the criminal is also characterized by a high degree of public danger. Serious changes are also needed in the legislative regulation of sentences not related to deprivation of liberty, and a number of other organizational measures aimed at expanding the practice of applying these punish-ments.

It is shown that the level of provision with tractors and energy supply of agricultural production in Russia is significantly lower than those in developed countries. It was found that the current annual level of purchase of tractors does not allow compensating for their disposal. Domestic production of tractors is significantly inferior to their import and the number of tractors to be assembled of tractor sets delivered from foreign countries on the territory of the Russian Federation. The theory of tractors with second-generation internal combustion engines is proposed, which makes it possible to create energy-intensive tractors with higher efficiency indicators.
