Water plays a central role in the life of society. However, factors such as population growth, pollution, and poor allocation and distribution mechanisms place severe pressures on adequate and equitable water supply. The aim of this chapter was to look into equitable water access in the Alfred Duma Local Municipality as well as the ecological governance framework that supports water access in local areas. The chapter also looked at the position of local municipality in water access and the impact of ecological scale on water provision. Many people are still unable to exercise their constitutional right to water in Alfred Duma Local Municipality, where most women feel disempowered, marginalized, and excluded from the process of making water access decisions. This brings challenges to disadvantaged and arginalized groups socially, economically, and environmentally where vulnerable and marginalised groups have no opportunity to equitably benefit from water access.

Economic affordability and access to water and waste services (WWS) are extensively studied topics in economic literature. However, most papers focus on social rights or the importance of water provision for equity and development. The impact of different regulatory and/or management models, the measurement of affordability and efficient pricing have all deserved the attention of researchers, but few studies assess the actual revenue impact of the existing social support mechanisms. For Portugal, while some preliminary data collection has taken place, a comprehensive review is still lacking. With this paper, the Water and Waste Services Regulation Authority (ERSAR) takes a first step towards filling that gap, by calculating the amount of subsidisation inherent in the adoption of social tariffs in mainland Portugal municipalities. Starting with an account of the current status quo, the article analyses different subsidisation situations, including a hypothetical framework where social tariffs are administered according to ERSAR's guidelines. Results indicate that, if ERSAR's Recommendation were fully applied, the number of social tariff beneficiaries could be above current figures, possibly translating into a disproportionate burden on the remaining WWS users through the application of higher bills. In the context of the severe economic crisis that is forcing families into increasing budgetary constraints, the article stresses issues of feasibility, drawing on the policy implications of the adoption of such discounts.

In South Africa, community members have the constitutional right to partake in local governance and the local municipal council has the constitutional mandate to facilitate community participation. Qualitative research was used to assess the impact of power relations on community participation in the Mahikeng Local Municipality. The study findings indicate that power differentials contributed to the abandonment of the legislative provisions in the Mahikeng Local Municipality in the North-West Province of South Africa. Among other things, this paper recommends finalisation of the draft public participation framework. The framework should clearly identify and define the roles of the community, elected councillors and traditional authorities. The paper recommends the development of a strategy that includes clear and comprehensive public participation guidelines, protocols and processes to facilitate implementation of the framework. In consultation with the community, a detailed community participation schedule must be developed, implemented and continuously monitored and evaluated.

AbstractDespite a constitutional right to water, challenges remain for access to sufficient water in South Africa. This article considers the degree to which current legal provisions perpetuate approaches that are antithetical to genuinely eco-socio-sustainable water access. Water in South Africa has largely been re-cast as a commodity, exposed to market rules, proving problematic for many and giving rise to various responses, including litigation. In the seminal case of Mazibuko, the Constitutional Court failed to provide robust protection to the right to water, providing impetus for the formation of “commons” strategies for water allocation. Indeed, “commoning” is beginning to represent not only an emerging conceptual strand in urban resource allocation, but also a dynamic, contemporary, eco-sensitive, socio-cultural phenomenon, driving innovative, interactive and inclusive forms of planning and social engagement. Against the backdrop of unequal water access, commoning offers glimpses of an empowering and enfranchising subaltern paradigm.

Development statistics for Bolivia reflect considerable inequalities among people, for instance, poverty rates are much higher in rural agricultural communities, where living conditions depend to a great extent on access to water resources. Many policy interventions ignore the principle of equality, and in some cases even exacerbate differences. In this paper, we examine water access for irrigation in an Andean community, integrating a perspective of equality based on data disaggregation. By analyzing the available data, we identified that tenure of rights and distribution priority are the main criteria that control water access in the community. Based on these criteria, water demand was disaggregated into 28 groups and the system was simulated using the Water Evaluation and Planning (WEAP) software, which allowed us to assess water demand coverage. Some groups receive less than 20% of their water demand, while others receive almost 100%. These inequalities are hidden in an aggregated model, which shows that the entire system never receives less than 60% of water demand. An evaluation of future climate change scenarios showed that water demand coverage could decline a further 15% in the dry season. The implementation of planned strategies, however, could counteract that decline by increasing supply and storage facilities; the model showed that implementing these strategies could raise water demand coverage up to 80% for some groups; however, others still face shortages. This study highlights methods and tools in planning that can strengthen existing equality approaches, and increase the efficiency in reducing poverty and inequality through water management.

Abstract The Nile, one of the longest rivers in the world, has not been subjected to a uniform legal regime yet, despite the pressing needs. The hitherto proposals presented by the riparian states of the lower and upper reaches have not been unanimously accepted. Egypt and Sudan face particular difficult situation since the Nile river is their main source of water supply. It is argued that the lack of necessary coordination among all the States in the basin may in the future lead to significant damage and consequences both in terms of access to water and its quality. This short study critically examines past and present initiatives undertaken to solve one of the most controversial aspects of international law in Africa.

This paper has three key issues. The first issue discusses the arguments constructed by applicant of judicial review (JR) to assess the constitutional rights’ violations caused by the application of Article 2 (1) UUP. The second issue discusses on how the Constitutional Court (MK) seated position of state associated marital affairs in the rejection of JR. The third issue discusses model of freedom of ijtihad (legal thought) on interfaith marriage as the impact of MK’s Decision. Based on    the discussion, regarding to the first issue, the applicant of JR assess the application of Article 2 (1) UUP has legitimized the state as the sole interpreters of religious teachings for a requirement validity of the marriage. According to the applicant,  the role is used by the state (The Office for Religious Affairs/KUA) to not accept interfaith marriage. This refusal led to the violation of some other constitutional rights. Furthermore, as the findings of the second issue, MK’s decision has placed   the real position of state not as interpreters of religious teachings, but merely to accommodate the results of religious scholars’s ijtihad regarding marriage into the state law. Thus, it is not true that the state has violated the constitutional right to more intervene the religious life of citizens. Last findings as the third issue, MK’s decision has affected the model of ijtihad freedom on interfaith marriage. Actually interfaith marriage can still be served through the Civil Registry Office (KCS). KCS could be an alternative way to facilitate the interfaith marriages for all religions in Indonesia. Special for KUA, the institution reject to record interfaith marriage.   In this way, it only accommodates freedom of ijtihad within the limits of ijtihad jama’i. KUA just accomodates ijtihad by institutions such as the Majelis Ulama Indonesia, Nahdlatul Ulama, Muhammadiyah and other similar institutions that reject interfaith marriage. Special for marriage in muslim community, ijtihad jama’i is better than ijtihad fardiy because the second could trigger the liberalization of marriage laws (temporary marriages, polygamy more than four, underage marriages and denial of recording).

While governments and development partners focus on improving community and utility-managed water supplies to ensure access for all, hundreds of millions of people are taking actions to supply their own water. In the WASH sector household investment in construction and improvement of facilities is widely employed in sanitation but in water similar efforts are ignored. Recognition of the contribution of self-supply towards universal access to water and its full potential, is hampered by a lack of data, analysis and guidance. This well-reasoned source book highlights the magnitude of the contribution of self-supply to urban and rural water provision world-wide, and the gains that are possible when governments recognise and support household-led supply development and up-grading. With limited public finances in low- (and many middle-) income countries, self-supply can fill gaps in public provision, especially amongst low-density rural populations. The book focuses on sub-Saharan Africa as the region with the greatest predicted shortfall in achieving the 2030 Sustainable Development Goal for water. Household supplies can be created, or accelerated to basic or safely managed levels, through approaches that build on the investment and actions of families, with the availability of technology options and cost-effective support from the private and public sectors. The role of self-supply needs greater recognition and a change in mindset of governments, development partners and practitioners if water services are to be extended to all and no-one is to be left behind.

The failure of the conventional public and private (market-based) water policies to improve urban water access in the global South has prompted growing interest in alternative models such as community–state co-production. However, there is little evidence of whether co-production can improve water service delivery in the informal settlements of sub-Saharan Africa where a disproportionately high percentage of the urban poor lives. This paper uses household surveys, key informant interviews, and focus groups to examine the impact of co-production on household water access and service delivery in the informal settlements of Lilongwe, Malawi. Co-production increased water accessibility, reduced the cost of water, increased the number of community water kiosks, and resulted in more effective financial management and accountability. However, challenges related to poor infrastructure and limited community capacity threaten the long-term sustainability of the co-production model. Urban informal residents lamented worsening water-supply interruptions and longer waiting times after co-production, challenges that require state intervention.
