Although of little aesthetic significance, the song ˝Ostante se tutuna˝ šejh Hasan Kaimija has been the subject of various controversies in the Bosnian scientific community for a whole century. This paper aims to show how the poem, from its first publication until modern times, has been used as an “ally” to deny or support certain narratives. As the central theme of all the texts in the dispute throughout the 20th and the beginning of the 21st century, the “thesis of Bogumilism” was imposed, apropos whether Kaimija could have known about Bogumils in the 17th century. The text is mostly used as an “ally” in historiography, identity theory, economics, religion, and only to some extent in literary history. Also, the aim was to show how the poem figured in these discourses, and especially the “controversial verses”, but also what kind of interpretation and valorization poem had in different historical contexts.

Resumen:Nuestro estudio parte de un planteamiento educativo integral, donde todas las dimensiones de la persona, así como los valores que se relacionan con ellas, deben ser potenciadas, y en concreto las que se derivan de la concepción humana que propone el profesor Gervilla (2008, p. 64): “animal de inteligencia emocional, singular y libre en sus decisiones, de naturaleza abierta o relacional, en el espacio y en el tiempo”.Siendo esenciales los valores estéticos en relación con esta dimensión, resulta evidente que la educación literaria supone un aspecto fundamental en la formación del alumnado, sobre todo teniendo en cuenta su papel en el desarrollo de la creatividad, clave de la educación del mañana para pedagogos como Gerver o Robinson, responsables de las teorías más innovadoras del siglo XXI, cuyo desarrollo ha obtenido gran acogida entre la comunidad científica. La capacidad para crear y disfrutar de la belleza puede ser abordada también desde diversas disciplinas facilitadoras de valores estéticos, si bien estimamos que la literatura se erige en un medio privilegiado en el contexto escolar, al basarse en el lenguaje y en la comunicación verbal.Dadas estas consideraciones, puede afirmarse que la atención a los valores literarios, como parte de la formación de la creatividad, debe ser convenientemente considerada en la legislación vigente.Así pues, nuestra investigación se completa con un análisis axiológico de una realidad legislativa concreta, la andaluza, que nos lleva a concluir que los valores literarios no están suficientemente contenidos en ella, por lo que consideramos que dicha carencia debería ser objeto de reflexión y subsanación en próximas revisiones normativas.Our study is based on a comprehensive educational approach in which all the dimensions of a person, as well as the values related to them, must be strengthened, especially those concrete dimensions as proposed by Professor Gervilla (2008, p. 64): “animal de inteligencia emocional, singular y libre en sus decisiones, de naturaleza abierta o relacional, en el espacio y en el tiempo”.Because the aesthetic values are essential in relation to this dimension, it becomes quite evident that literary education plays a fundamental role in student formation, especially when one takes into account its role in the development of creativity. Creativity is the key for tomorrow’s education according to pedagogues such as Gerver or Robinson who are responsible for the 21st century´s most innovative theories, and the development of the latter has been well received among the scientific community. The ability to create and enjoy beauty can also be addressed from various guiding disciplines of aesthetic values if we perceive that literature is set up as a privileged means in the school context in relation to language and verbal communication.Given these circumstances, it can be argued that attention to literary values, as part of the formation of creativity, must be properly considered in the current legislation.Therefore, our research is completed with an axiological analysis of a concrete legislative reality, the Andalusian, which leads us to conclude that literary values are not sufficiently contained therein, and we believe that this deficiency should be the subject of reflection and correction in future regulatory reviews.

Intoxication as a ground to set aside a contract is not something that has proved to be easy for the law to regulate. This is perhaps not very surprising. Intoxication is a temporary condition of varying degrees of magnitude. Its presence does however raise questions of contractual autonomy and individual responsibility. Alcohol consumption is a common social activity and perceptions of intoxication and especially alcoholism have changed over time. Roman law is surprisingly quiet on the subject. In modern times the rules about intoxicated contracting in Scottish and English law is very similar. Rather more interestingly the law in these two jurisdictions has reached the current position in slightly different ways. This history can be traced through English Equity, the works of the Scottish Institutional writers, the rise of the Will Theory, and all leavened with a dose of judicial pragmatism.

She is mentally and physically weak through creation itself, but she express her feelings unexpectedly in the battle against her. She is even spoiled for that. A women’s picture is a central theme to literature writings around the globe. The writings of Anita Nair is concerned with man, females, nature, true life, and social convention. She explores the existential struggle of her protagonists in most of her novels. Nair describes particularly, how Indian women are exploited, abused, marginalized even in the modern times both by individuals and by the society. Apart from the society women are tossed even by her family members. Anita Nair emphasizes the need for creating awareness in women. Her female protagonists are conscious of the injustice in marriage brought to them.Probably, the protagonists of Nair’s novels denies to flow along the current.  They seem to be adamant or aggressive, but the fact is that they underwent much pain and suffering. Apart from the pain the protagonists are the losers of life, respect, family, dignity and everything. This paper is an effort to bring to light the pathetic conditions of the protagonists,and to study the social, family and economic picture of women's suffering in life. Though the protagonist characters are brave, they seem pathetic and losers of a common simple life, they dream to live. Anita Nair defines circumstances or occurrences that harm or kill characters due to the aggressive nature of characters in her novels.

This article examines the changing approach towards the representation of the senses in 17th-century Flemish painting. These changes are related to the cultural politics and courtly culture of the Spanish sovereigns of the Southern Netherlands, the Archdukes Albert and Isabella. The 1617–18 painting-series of the Five Senses by Jan Brueghel the Elder and Peter Paul Rubens as well as the pendant paintings on the subject are analyzed in relation to the iconography of the five senses, and in regard to Flemish genre themes. In this context, the excess of objects, paintings, scientific instruments, animals, and plants in the Five Senses are read as an expansion of the iconography of the senses as well as a reference to the courtly material culture of the Archdukes. Framing the senses as part of a cultural web of artifacts, Brueghel and Rubens refer both to elite lived experience and traditional iconography. The article examines the continuity between the iconography of the senses from 1600 onwards, as developed by Georg Pencz, Frans Floris, and Maerten de Vos, and the representation of the senses in the series. In addition, the article shows how certain elements in the paintings are influenced by genre paintings of the courtly company and collector’s cabinet, by Frans Francken, Lucas van Valckenborch and Louis de Caullery. Through the synthesis of these two traditions the subject of the five senses is reinvented in a courtly context

The subject of this article is the genesis of the professional culture of personnel management. The last decades of the 20th century were marked by various revolutions - scientific, technical, democratic, informational, sexual, etc. Their cumulative effect has been mostly reflected in the professional revolution that shapes the professional society around the world. This social revolution has global consequences. In addition to its extensive parameters, it also has intensive ones related to the deeply-rooted structural changes in the ways of working and thinking, as well as in the forms of its social organization. The professional revolutions in the history of Modern Times stem from this theory.Employees’ awareness and accountability shall be strengthened. The leader must be able to formulate and bring closer to the employees the vision of the organization and its future goal, to which all shall aspire. He should pay attention not to the "letter" but to the "spirit" of this approach.

Abstract Vom Untergang zur See zu handeln, führt in der westlichen Erzähltradition seit Homer auf kosmologische und existentielle, politische und ökonomische Belange. Will man von einem regelrechten ,,Schiffbruch-Narrativ“ sprechen, dann ist dieses nicht nur durch eine longue durée motivischer und struktureller Beständigkeit ausgezeichnet, sondern auch durch einen hohen Grad an sprachlich-formaler Selbstreflexivität und seit der Neuzeit durch die Engführung nautischer mit poetischen Innovationen. Wendepunkte markiert das Scheitern nunmehr in seefahrts- und auch literaturhistorischer Hinsicht, weshalb man, wie im Portugal der Entdeckerzeit, von einem maritimen ,,discurso“ sprechen kann.In the Western narrative tradition since Homer, relating to sea losses leads to cosmological and existential, political and economic concerns. The ,,shipwreck narrative“ is characterized by a long-lasting motivic and structural consistency. But furthermore, it exhibits a high degree of linguistic and formal self-reflexiveness, and since modern times, it brings together nautical with poetic innovations. The sinking now marks turning points in terms of maritime navigation as well as literary history, which is why, as in Portugal of the time of discovery, one can speak of a maritime ,,discurso“.

AbstractOf the nine interpretations proposed for Rembraradt's history Painting of 1626 now at Leiden, none is really convincing. Il seems attractive to think of palamedes Condemned by Agamemncm as the subject because of its political significance in the year after the publication of Voredel's tragecty Palamedcs or Innocence Murdered, which denounced the execution of the Remonstrant leader Johan van Oldenbarnevelt in 1619. γet the scene depicted does not fit any episode frorn the Palamedes story. It appears rather to represent three young men appearing before a crowned figure who makes a pronouncement, probably one of magnanimity or clemency. It is conceivable that the subject was taken from Q. Curtius Rufus's Historiae Alexandri Magni Macedonis, ofwhich several editions, including translations into the vernacular, were published in Holland in the first decades of the 17th century. The episode in question was known to the young Rubens, but does not seem to have been illustrated by any other artist. At the beginning of the seventh book it is described how Alexander summoned before. him in the presence of the army two oj three brothers, who had been close friends of Philotas, a former, friend of his who had been executed for plotting against his life. The youngest brother, Poleinon, had panicked and fled but was caught and brought back at the very moment when Alexander had accused the brothers and the eldest, Amyntas, after having been released from his bonds and given a spear which he held in his left hand, had embarked on his szzccess ful defence. The appearance of Polemon infuriated the soldiers, but when he took the blame on himself and prrifessed his brothers' innocence, they were moved to tears. So too was Alexander who, prompted by their cries, absolved the brothers. This anecdote does at least explain some of the features of Rembrandt's scene. The young man standing on the right with his right hand raised as if swearing an oath would be the eloquent Amyntas with a spear in his left hand. Hidden behind him kneels the second brother, Simias, while Polemon, 'a young man just come to maturity and in the first bloom of his youth', has fallen on one knee in the foreground, underlining his emotional words with his right hand bressed to his heart. Alexander raises his sceptre in token of his absolution and some men in the background wave and shout from a socle they have climbed. Interpreted in this way, the scene coralains not a topical political allegory but, as would seem usual with history paintings, a message of a more general nature: the magnanimity of Alexander as an 'exemblum virtutis'.

Abstract Many fourteenth-century logicians took affirmative propositions to maintain that the subject term and the predicate term stand or supposit for the same. This is called the identity theory of predication by historians and praedicatio identica (or one form of praedicatio identica) by Paul of Venice and others. The identity theory of predication was an important part of early fourteenth-century Trinitarian discussions as well, but what was called praedicatio identica by Duns Scotus and his followers in this context was something different. After some remarks on Scotus’s view and its background, I shall analyse Adam Wodeham’s explanation of Scotus’s praedicatio identica and how he understood the assumptions pertaining to supposition in the Scotist approach. I also describe Wodeham’s own solution to Trinitarian sophisms, which did not deviate from the identity theory of predication.

How should one go about reading German 17th century poetry? Dirk Werle answers this question on the basis of a consistently historical understanding of both genre and epoch. In the seventeenth century, “poetry” had a decidedly different meaning from what we take it to be today, and there was no such thing as our term “Baroque”. For each of the chapter's introductory analyses, from which more general considerations and points of view are developed, poems have been selected that do not appear in relevant anthologies and therefore allow unbiased access to a fascinating field of literary history. The Author shows that 17th century poetry is characterized by a poetics of repetition, based on affinity to music and the principle of convivial play. It is a form of pop literature that does not directly refer to reality, but creates a poetic world all its own. To grasp this phenomenon, a “hermeneutics of simplicity” is called for, which is introduced and explained in this book.
