Translation involves ethical decision-making in challenging contexts. Codes of practice help professional translators identify ethical issues and formulate appropriate, justifiable responses. However, new and growing forms of community translation operate outside the professional realm, and substantial differences exist between the two approaches. How relevant, then, are professional codes in the new contexts? What alternative ‘codes’ (stated or implicit) have been developed by the new groups? The content of professional codes is compared here to a broad range of community approaches to identify themes common across both, and areas where the new community might be making an original contribution. This reveals different priorities in the professional and non-professional codes. Community translation initiatives have found novel solutions to some ethical problems and challenges, particularly in self-regulation and community policing, improved interpretation of code content, an emphasis on shared values rather than individual rights, and strong mentoring.

This chapter examines how ethical issues are approached differently by two prominent psychological associations, how they are encountered by psychologists, the formal complaints they give rise to, and how they can be approached systematically to avoid missteps. Included are basic assumptions about ethics; the unique approaches to developing a ethics code taken by the American Psychological Association (APA) and the Canadian Psychological Association (CPA), and what each of these two codes provides; empirical data about what ethical problems psychologists encounter and what formal complaints they face; four major sets of ethical issues that are particularly complex and challenging (confidentiality, informed consent, competence, and boundaries); an area of major controversy (clinical psychology and national security); steps in ethical decision-making; and four possible lines of future research.

AbstractThis paper contributes to the contemporary business ethics narrative by proposing an approach to corporate ethical decision making (EDM) which serves as an alternative to the imposition of codes and standards to address the ethical consequences of grand challenges, like COVID-19, which are impacting today’s society. Our alternative approach to EDM embraces the concept of reflexive thinking and ethical consciousness among the individual agents who collectively are the corporation and who make ethical decisions, often in isolation, removed from the collocated corporate setting. We draw on the teachings of the Canadian philosopher and theologian, Fr. Bernard Lonergan, to conceptualize an approach to EDM which focuses on the ethics of the corporate agent by nurturing the universal and invariant structure that is operational in all human beings. Embracing Lonergan’s dynamic cognitive structure of human knowing, and the structure of the human good, we advance a paradigm of EDM in business which emboldens authentic ethical thought, decision making, and action commensurate with virtuous living and germane to human flourishing. Lonergan’s philosophy guides us away from the imposition of over-arching corporate codes of ethics and inspires us, as individual agents, to attend to the data of our own consciousness in our ethical decision making. Such cognitional endowment leads us out of the ethics of the ‘timeless present’ (Islam and Greenwood in Journal of Business Ethics 170: 1–4, 2021) towards ethical authenticity in business, leaving us better placed to reflect upon and address the ethical issues emanating from grand challenges like COVID-19.

Confidentiality is a central ethical concern in occupational therapy practice and one that is emphasised in professional codes of ethics. This article examines the conceptual and moral basis of confidentiality, and relates it to the fundamental ethical principles of respect for autonomy, respect for persons and non-maleficence. The moral conflicts that may arise between the requirement of confidentiality on the one hand, and the need to safeguard the interests and welfare of others on the other hand, are explored with reference to the Tarasoff case. Both consequentialist (outcome-based) and deontological (duty-based) perspectives are examined. It is argued that confidentiality should be given a special status within the client-therapist relationship and, up to a certain critical threshold, should be protected from considerations of general welfare. It is argued that, whilst confidentiality may on occasions be breached in the interests of others, it Is rarely permissible to do so in the client's own Interest. In conclusion, occupational therapists are urged to give a high regard to confidentiality and to cultivate the virtue of discretion in their professional practice.

AbstractSoftware systems play an ever more important role in our lives and software engineers and their companies find themselves in a position where they are held responsible for ethical issues that may arise. In this paper, we try to disentangle ethical considerations that can be performed at the level of the software engineer from those that belong in the wider domain of business ethics. The handling of ethical problems that fall into the responsibility of the engineer has traditionally been addressed by the publication of Codes of Ethics and Conduct. We argue that these Codes are barely able to provide normative orientation in software development. The main contribution of this paper is, thus, to analyze the normative features of Codes of Ethics in software engineering and to explicate how their value-based approach might prevent their usefulness from a normative perspective. Codes of Conduct cannot replace ethical deliberation because they do not and cannot offer guidance because of their underdetermined nature. This lack of orientation, we argue, triggers reactive behavior such as “cherry-picking,” “risk of indifference,” “ex-post orientation,” and the “desire to rely on gut feeling.” In the light of this, we propose to implement ethical deliberation within software development teams as a way out.

The interest in and understanding of ethics among translation scholars has changed dramatically since the publication of Andrew Chesterman’s proposal for a Hieronymic Oath (Chesterman, 2001). Early definitions of ethics based on equivalence (Newmark, 1991), faithfulness, loyalty (Nord, 1997) and trust have been put aside in favour of more recent notions of translator ethics grounded in accountability (Baker & Maier, 2011) and social responsibility (Drugan & Tipton, 2017). Practising translators who abide by codes of ethics/conduct are bound by principles of honesty, integrity, linguistic competence, confidentiality, and trust. This paper begins by presenting a brief literature review of the main developments in translation ethics from the early linguists to contemporary interpretations. There then follows an analysis and comparison of several professional codes of conduct from the main international associations of translators and interpreters with the benchmark, the Association of Translation and Interpreting Professionals (APTRAD). It is one of the more recent translator associations and has a code of conduct adopted in the last six years. The objective of this paper is to determine which theoretical definitions of ethics are reflected in the codes of conduct and to discuss their usefulness for translators in their daily practice. The paper ends with recommendations for changes to codes of conduct to make them more relevant to practising translators.

The purpose of this multiple case study was to explore the decision making processes of public school superintendents and to identify those factors that influenced decision making. Ethics education/training, professional experience and professional codes of ethics were considered as possible influencing factors. Thus, this study sought to answer how superintendents' perceive ethics education/training and professional experience influence their ethical decision making. This research further examined the use or non-use of professional codes of ethics by public school superintendents and the perceived impact these codes have on administrative decision making. This study collected data from 10 public school superintendents throughout nine regions in Missouri. Superintendents were recruited based on variety in school district size and type. Both male and female superintendents participated in the study. Research data was obtained via personal interview with the participants. Findings concluded that professional experience was by far the greatest perceived influence on study superintendents' decision making. In contrast, both ethics education/training and professional codes of ethics had little, if any, perceived impact on the ethical decision making processes of study superintendents.

Library and information science professional play an extremely important role in the society. However, in discharging their responsibilities and duties, core ethical principles are expected to be upheld by librarians and information workers as outlined in the professional codes of ethics. The aim of this paper is to appraise core ethical issues in library and information science profession in Nigeria. This paper discusses core ethical principle in library and information science profession such as universal access to information, intellectual property rights, intellectual freedom, copyright/fair use and privacy/confidentiality among others. This paper further identified ethical challenges confronting library and information science professionals in Nigeria. This paper concludes that regardless of the ethical challenges confronting library and information science professionals in Nigeria, the professional codes of ethics should be upheld.

Legal ethics theories give competing and exclusive accounts of the ethical foundations of the lawyer’s role. They disagree about the relationship between morality and law, about the content of the lawyer’s central ethical duties and about how specific ethical problems should be resolved. Each theoretical account asserts that the others are mistaken in some fundamental way. Yet all legal ethics theories are theories of action; legal ethics theorists do not seek merely to enlighten, they also seek to influence how lawyers and the legal profession respond to ethical issues. This creates a problem of disagreement: the problem created by the divergent but exclusive claims made by different ethical theories at the point when those theories are to be translated into action. This paper considers how, given the problem of disagreement, legal ethics theories can have any impact on individual ethical decision-making or public policy. Specifically, it considers how theories can have any impact given a) that they fundamentally disagree; and b) what experimental psychology tells us about how people make ethical decisions in fact, and the nature of lawyer regulation.

Purpose The purpose of this paper is to use Ferrell and Gresham (1985) contingency model to examine the impact of situational factors on decision-making behaviour related to ethical issues of Islamic banking practitioners. Design/methodology/approach A total of 262 samples are collected from Islamic banking practitioners in the United Arab Emirates (UAE) and data analysis is conducted using structural equation modelling (SEM) with a confirmatory approach. Findings The empirical findings indicate that decision-making behaviour related to ethical issues of Islamic banking practitioners is significantly influenced in the process of interacting with persons who are part of the organisation, and these influences are determined by the intra-organisational distance and legitimate authority between the individuals and the focal person. Further, it is also empirically verified that decision-making behaviour related to ethical issues of Islamic banking practitioners is significantly influenced by the presence and/or absence of the opportunity factors such as corporate policies, professional codes of ethics and rewards/punishment system that prevails in the organisation. Research limitations/implications Coverage of respondents in this study limited to single country, and the scope is limited to the model that adopted in the study. Practical implications It is recommended that respective authorities should have proper control over situational factors (i.e. significant others and opportunity factors) in organisations by encouraging ethical actions so that individuals are learned and influenced by each other and reviewing and improving existing corporate policies, professional codes of ethics and rewards/punishment system that limit the barrier and provide recompenses to the individuals in the organisation. Originality/value While the literature has presented the connection between ethics and Islamic banking, they failed to address ethical decision-making in Islamic financial institutions (IFIs). Hence, the empirical findings provide insights towards understanding organisational decision-making behaviour that to enhance governance.
