ABSTRACT The Global Initiative for West, Central and Southern Africa (GI WACAF Project) is a partnership between the International Maritime Organization (IMO) and IPIECA - the global oil and gas industry association for environmental and social issues, to enhance the capacity of countries to prepare for and respond to marine oil spills. The GI WACAF Project was launched in 2006 and is jointly funded by IMO and eight oil company members in order to strengthen national oil spill response capability in 22 countries of West, Central and Southern Africa through the establishment of local partnerships between the oil industries and the national authorities in charge of oil spill preparedness and response at the national level. This paper will describe how the GI WACAF Project cooperates with local stakeholders in order to develop a structure for preparedness and response in the region, and to detail what are the challenges lying ahead in order to make this structure fully operational taking into account the changes in the region in terms of risk profiles, industry representation and national and regional governance. The analysis of the exercises organised under the umbrella of the GI WACAF Project in Congo, Nigeria (2011), Gabon (2012), Cameroon, and Mauritania (2012) emphasises the needs in terms of international cooperation, integration of response capabilities at the national and regional levels and the development of effective incident management structures. In conclusion, we will present how the GI WACAF Project has evolved in order to maintain its momentum for the continuous development of preparedness and response capabilities in the region.

IOSC 2017 Abstract: 2017-269 Abstract The picture today is one of intense oil and gas activity across West, Central and Southern Africa. This is illustrated by the significant increases in crude oil exports over the past fifteen years. This high level of activity has also coincided with, and contributed to, a large increase in the level of shipping in the region. Such level of oil exploration, production, and transportation, means that there exists a threat of oil spills occurring. In response to this risk, the Global Initiative for West, Central, and Southern Africa (GI WACAF) was launched in 2006, with the objective of raising standards of oil spill preparedness and response capability across the region. This paper will describe how the GI WACAF Project cooperates with local stakeholders in order to develop trans-boundary cooperation, and will detail what are the challenges lying ahead in order to make cross-border cooperation fully operational. The analysis of the trans-boundary exercises organised under the umbrella of the GI WACAF Project between Cameroon and Nigeria (2015) on the one hand, and between Gabon and Congo (2015) on the other hand, emphasises the needs in terms of international cooperation, improved communications, integration of response capabilities at the national and regional levels, and the development of effective incident management structures. This paper will show that significant steps have been taken to develop National Oil Spill Contingency Plans across the GI WACAF region and that advances in this area have meant countries are now looking beyond their borders and seeking to integrate national contingency plans with their closest neighbours. Information will be presented concerning the 2015 exercises, the key lessons learned and potential developments of trans-boundary cooperation in the future.

ABSTRACT In light of the Deepwater Horizon accident, the oil and gas industry has undertaken various national and global initiatives to advance our knowledge, understanding and approach to oil spill preparedness and response. Notable amongst these, are the IPIECAIOGP (International Association of Oil and Gas Producers) Oil Spill Response Joint Industry Project (OSR-JIP) and the American Petroleum Institute's Joint Industry Task Force (APIJITF). These alone represent million dollars of investment and the collective contribution of hundreds of subject matter experts from around the world. The above two initiatives have produced numerous technical reports, good practice guides and recommended practices that have offered significant advances in industry's oil spill preparedness and response capabilities. Additionally, the various research projects conducted primarily by API have greatly enhanced the understanding of the efficacy and fate and effects of selected response options with a focus on subsea dispersant injection. This paper provides an overview and assessment of the key outcomes of these programs as well as highlighting some of the key breakthrough projects including spill impact mitigation assessment (SIMA), incident management, tiered provision of response capability, wildlife response and dispersants. The authors also describe briefly how the industry has continued this legacy through ongoing API and IPIECA/IOGP programs, together with a brief exploration of the full extent of value which may be derived from these kinds of initiatives.

ABSTRACT After more than 20 years of work, the Southeast Asian region is poised to finalize a landmark Regional Oil Spill Contingency Plan (ROSCP), which will form a solid foundation for a new regional response regime. The development of a Regional Plan is a commitment made by the ten member states of ASEAN (Association of Southeast Asian Nations) and is currently undergoing internal approval by the ASEAN Maritime Transport Working Group (MTWG) prior to implementation. The ASEAN member states committed to supporting the Regional Plan when the Transport Ministers of each member country signed the Memorandum of Understanding (MoU) on the ASEAN Cooperation Mechanism for Joint Oil Spill Preparedness and Response on November 28, 2014. This MoU is the renewed and revitalized ASEAN Oil Spill Response Action Plan (OSRAP) that was signed in 1994 but was never implemented. The MoU is based on the principles of the International Convention on Oil Pollution Preparedness, Response and Cooperation (OPRC 1990), specifically Articles 5, 6, 7 and 10. The aim of this paper is to document the historical evolution of the Regional Plan, starting from the early days of ASEAN until 2015 where it was developed by the ten member states. More importantly, this paper will highlight the current status of oil spill preparedness and response regimes in the region and how these will likely integrate into the Regional Plan when it is finally adopted. This will offer a unique perspective on the dynamics of intergovernmental agreements and on the important role of the oil and gas industry in helping governments achieve their goals of preparedness and response through capacity building and other activities, including through the partnership between the International Maritime Organization (IMO) and the Global Oil and Gas Industry Association for Environmental and Social Issues (IPIECA) which manages the Global Initiative for Southeast Asia (GISEA) Programme.

ABSTRACT How can a process be flexible enough for use in any incident, yet rigid enough to provide the structure required in times where stress is high, and time is short? In 2014 the IPIECA-IOGP Joint Industry Project (JIP; an outcome of the 2010 Gulf of Mexico oil spill) recommended the implementation of a structured Incident Management System (IMS) in their publication of a Good Practice Guide (GPG): Incident Management System for the Oil and Gas Industry. Now, half a decade on from this publication, many oil companies have, or are in the process of implementing some form of IMS across their global operations. The GPG describes IMS as a “set of proven organizational and management principles.” It also states that it is based on ICS as it “is a version of IMS that is widely used by Industry”. As multiple IMS's exist globally, this paper explores whether the blanket adoption of a single existing system can be used when so many considerations, are required. Through observing and assisting their members in introducing (and maintaining) an IMS across various business units, Oil Spill Response Limited (OSRL) has seen how systems can be tailored that are flexible enough to meet the specific needs of the company concerned. Examples include introducing initial assessment procedures and customisation of documentation. Potential limitations of ICS possible evolutions of IMS are discussed. Incorporation of the organisational and management principles described by the JIP provides guidance when modifying/tailoring a system that can be used by businesses facing different scenarios in different environments and with differing levels of resources. The change in terminology from the Incident Command System to the Incident Management System allows for customisation of a proven system and increased flexibility whilst being based on tried and trusted foundations.

Since the beginning of the 19th century, we have assisted major proliferation of the oil and gas industry. This phenomenon of exponential growth is due to the fact that oil companies hold the world’s oil monopoly on the extraction, processing and commercialization. Therefore, as being one of the most influential sectors in the world, is crucial to strictly regulate how oil and gas contracts concerns the potential environmental and social impacts arising from the conduct of petroleum operations and how such behavior affects the human rights. As a matter of fact, the social issues field is an emerging area, and despite such importance, oil contracts do not often deal with them in great detail, corresponding to an actual emptiness of the human rights provisions. In terms of responsibly, oil companies, have an inalienable obligation to ensure that their actions do not violate human rights or contribute for their violation. This study aims to trace a detailed analysis of the impact of the oil and gas agreements in human rights. In order to fully comprehend the deep effects of this industry, we will examine, in detail, numerous of published oil and gas agreements, as well as, decode which are the real standards and practices accepted by this industry. We will use a deductive and speculative reasoning. We will try to demonstrate how incipient and short protection is given to human rights and what responsible conducts must urgently be developed.

Recently, there have been many reports of catastrophic accidents in the oil and gas (O&G) industry which led to huge financial losses and hazards to humans and the environment. Apart from the primary operational (technical) risks, there exist numerous non-technical risk factors such as workforce protection, climate change, ecosystem, biodiversity, health and safety, governing compliance, and other environmental, and social issues. These risks if left without intervention could affect the green growth and eco-friendly resilience of the O&G companies. Thus, this work offers a conceptual framework on how corporate sustainability practices along with risk management implementation are stimulating green growth in the O&G industry. The presented theoretical and conceptual framework underpinned by the stakeholder theory proposed in this paper provides a foundation for empirical validation of the intertwined relationship between the pertinent variables. The measurement of the variables such as corporate sustainability performance, enterprise risk management and green growth is proposed to be drawn from earlier research and developed frameworks and guidelines by prominent organizations. The significance of this paper is to lend guidance to Malaysian oil and gas players to embrace green growth through sustainability and risk management implementation.

Abstract 2017-161 Over the past four decades, the oil and gas industry has made significant advances in being able to detect, contain and clean up spills and mitigate the residual consequences in Arctic environments. Many of these advances were achieved through collaborative research programs involving industry, academic and government partners. The Arctic Oil Spill Response Technology - Joint Industry Programme (JIP), was launched in 2012 and completed in early 2017 with the objectives of building on an already extensive knowledge base to further improve Arctic spill response capabilities and better understand the environmental issues involved in selecting and implementing the most effective response strategies. The JIP was a collaboration of nine oil and gas companies (BP, Chevron, ConocoPhillips, Eni, ExxonMobil, North Caspian Operating Company, Shell, Statoil, and Total) and focused on six key areas of oil spill response: dispersants; environmental effects; trajectory modeling; remote sensing; mechanical recovery and in-situ burning. The JIP provided a vehicle for sharing knowledge among the participants and international research institutions and disseminating information to regulators, the public and stakeholders. The network of engaged scientists and government agencies increased opportunities to develop and test oil spill response technologies while raising awareness of industry efforts to advance the existing capabilities in Arctic oil spill response. The JIP consisted of two phases, the first included technical assessments and state of knowledge reviews resulting in a library of sixteen documents available on the JIP website. The majority of the JIP efforts focused on Phase 2, actual experiments, and included laboratory, small and medium scale tank tests, and field research experiments. Three large-scale field tests were conducted in the winter and spring months of 2014–2016 including recent participation of the JIP in the 2016 NOFO oil on water exercise off Norway. The JIP was the largest pan-industry programme dedicated to oil spill response in the Arctic, ever carried out. Twenty seven research projects were successfully and safely conducted by the world’s foremost experts on oil spill response from across industry, academia, and independent scientific institutions in ten countries. The overarching goal of the research was to address the differing aspects involved in oil spill response, including the methods used, and their applicability to the Arctic’s unique conditions. All research projects were conducted using established protocols and proven scientific technologies, some of which were especially adjusted for ice conditions. This paper describes the scope of the research conducted, results, and key findings. The JIP is committed to full transparency in disseminating the results through peer reviewed journal articles, and all JIP research reports are available free of charge at www.arcticresponsetechnology.org.

ABSTRACT Brazil has performed an important role in the oil and gas industry mainly because its offshore E&P activities. The volume of oil produced in offshore fields had increased 88% in the last decade and correspond to more than 90% of national production. The maritime Exploration and Production (E&P) operations in Brazil started in the middle of the 1970's. In 1981 a law was promulgated to establish a compulsory environmental permit to many activities, including oil and gas exploration and production activities. Although this regulation has existed for over 25 years, only in 1999 was it effectively brought into force to the E&P sector, with the creation of the oil and gas specialized office integrated to the Intituto Brasileiro de Meio Ambiente e Recursos Naturais Renováveis – IBAMA (Brazilian Federal Environmental Agency). On January 2000 Brazil faced one its worst oil spills, in Guanabara Bay. A broken pipeline owned and operated by Petrobras spilt 1300 tone of bunker fuel into Guanabara Bay, Rio de Janeiro. At that time, Brazil had no clear environmental scenario regarding the oil industry in Brazil: uncoordinated environmental regulations, debilitated environmental agencies and a relapse industry took part in the scenario. As a result of the repercussion of the disaster, in the same year was enacted the Federal Law 9966/2000, the so called “Oil Law”, on the prevention, control and inspection of pollution caused by the releasing of oil and other harmful substances in waters under national jurisdiction. The provisions of the Law 9966 included, among other things, the requirement for the notification to the competent environmental authority, the maritime authority and the oil regulating agency, of any incident which might cause water pollution. Although IBAMA receives the oil spill communications since 2001, only in 2010 the Agency began to include this information in a database. This paper discusses the offshore oil spill data received between 2010 and 2012.

Oil and gas industry shows the danger of this kind of industry, including from the environmental point of view. Entering the waters of marginal seas and ocean significantly aggravated the situation, moving a significant part of the emergency situations related to hydrocarbon production, the level of regional and global. The use of new technologies in the production of shale hydrocarbons added new problems - the total probability of contamination of large amounts of geological space highly toxic chemicals. Tracking down of a new perspective mineral energy source - gas hydrates - allows to plan only while possible passing dangers, but shows, that the ecological risk can many times more. For opposition to threat of occurrence of emergencies in connection with growth of extraction of hydrocarbons expediently creation at a national level of special structures of the control and fast reaction. Such structures can be if necessary opened for the international cooperation, and are entered into jurisdiction of the United Nations Organization.

ABSTRACT In April 2002, the Brazilian National Environment Council (CONAMA) enacted Resolution 293, which defines the contents and requirements for oil spill response plans for ports, terminals, pipelines and oil platforms. CONAMA Resolution 293 was undoubtedly a landmark in the history of Brazilian planning and preparedness for oil spill accidents as long as it provided a technically consistent reference for elaboration of oil spill response plans based on the identification of spill sources, vulnerability analysis of potentially affected areas, and adequate response organization, procedures and resources. A clause of the Resolution required its review in 5 years after entering into force. To accomplish this requirement, the Ministry of Environment (MMA) opened a public hearing process to collect comments and suggestions for changes. One main contributor in this hearing process was the Brazilian Petroleum and Gas Institute (IBP), which represents the oil and gas industry. IBP created an internal workgroup which discussed proposals for changes in CONAMA Resolution 293 that were subsequently sent to MMA. After the public hearing process, MMA invited a number of institutions to join a workgroup to discuss the received comments and proposed changes. In general, these institutions were mostly the same which participated in the CONAMA Resolution 293 workgroup five years before: IBAMA (federal environmental agency), Maritime Authority, Ministry of Transportation, Ministry of Mines and Energy, AN? (oil & gas activities regulatory agency), IBP and some state environmental agencies. Proposed changes to CONAMA Resolution 293 were sent from the workgroup to one of the CONAMA technical chambers, which approved the proposal with minor amendments. The aim of this paper is to present and discuss the relevant changes in this regulation that will affect facility oil spill response plans in Brazil.
