There would hardly be be any walk of life which has gone unaffected by the Covid-19 pandemic. It’s effect of the performance of contracts has also attracted legal questions and practical balancing of interests. In deciding whether a sum stipulated to be paid in case of breach of contract is liquidated damages or penalty to secure performance of the contract, intention of party is an important factor in determining but not always controlling one. Substantially, remedies are given by actions in cases of performance of contracts. The nature of the contract determines the kind of remedies. The article demonstrates the structure of damages, penalty-default theory as derived from Hadley v. Baxendale. It also analyses the effects brought in by the Covid-19 pandemic over the award of damages. By this article, the authors aim to analyze the two most crucial aspects of the Indian Contract Act ie. Performace, frustration and award of damages. The article attempts to scrutinize the dimensions and ways in which these words can be interpreted and applied. In this paper, the author will rely on critical and comparative analysis. For certain empirical demands of the topic, already published data and information will be relied on and acknowledged.

Perceptions of a crisis communicator’s sincerity drive reactions to an organization’s response amidst a scandal. However, a spokesperson can nonverbally appear sincere while deceptively evading questions and can appear insincere while actually speaking sincere truths. Applying truth-default theory to crisis communication, we assess people’s reactions to a spokesperson varying in sincerity through demeanor and language. In an experiment ( N  =  801), adults from across the United States were randomly assigned to view one of four versions of a news interview. The stimuli present the spokesperson replying to questions with sincere or insincere demeanor and sincere language (conveying relevance and clarity) or insincere language (evasion and obfuscation). Results indicate that sincerity in demeanor and language interact to affect (a) account acceptance, (b) negative word-of-mouth intention, and (c) attribution of responsibility. But sincerity in language largely overrides behavioral impressions. Discussion concerns considering evasion and obfuscation as demeanor cues, when violations of relevance and clarity in language undercut a spokesperson’s believability.

Deception plays a critical role in the dissemination of information, and has important consequences on the functioning of cultural, market-based and democratic institutions. Deception has been widely studied within the fields of philosophy, psychology, economics and political science. Yet, we still lack an understanding of how deception emerges in a society under competitive (evolutionary) pressures. This paper begins to fill this gap by bridging evolutionary models of social good— public goods games (PGGs)—with ideas from interpersonal deception theory (Buller and Burgoon 1996 Commun. Theory 6 , 203–242. ( doi:10.1111/j.1468-2885.1996.tb00127.x )) and truth-default theory (Levine 2014 J. Lang. Soc. Psychol. 33 , 378–392. ( doi:10.1177/0261927X14535916 ); Levine 2019 Duped: truth-default theory and the social science of lying and deception . University of Alabama Press). This provides a well-founded analysis of the growth of deception in societies and the effectiveness of several approaches to reducing deception. Assuming that knowledge is a public good, we use extensive simulation studies to explore (i) how deception impacts the sharing and dissemination of knowledge in societies over time, (ii) how different types of knowledge sharing societies are affected by deception and (iii) what type of policing and regulation is needed to reduce the negative effects of deception in knowledge sharing. Our results indicate that cooperation in knowledge sharing can be re-established in systems by introducing institutions that investigate and regulate both defection and deception using a decentralized case-by-case strategy. This provides evidence for the adoption of methods for reducing the use of deception in the world around us in order to avoid a Tragedy of the Digital Commons (Greco and Floridi 2004 Ethics Inf. Objective To understand how aspects of vishing calls (phishing phone calls) influence perceived visher honesty. Background Little is understood about how targeted individuals behave during vishing attacks. According to truth-default theory, people assume others are being honest until something triggers their suspicion. We investigated whether that was true during vishing attacks. Methods Twenty-four participants read written descriptions of eight real-world vishing calls. Half included highly sensitive requests; the remainder included seemingly innocuous requests. Participants rated visher honesty at multiple points during conversations. Results Participants initially perceived vishers to be honest. Honesty ratings decreased before requests occurred. Honesty ratings decreased further in response to highly sensitive requests, but not seemingly innocuous requests. Honesty ratings recovered somewhat, but only after highly sensitive requests. Conclusions The present results revealed five important insights: (1) people begin vishing conversations in the truth-default state, (2) certain aspects of vishing conversations serve as triggers, (3) other aspects of vishing conversations do not serve as triggers, (4) in certain situations, people’s perceptions of visher honesty improve, and, more generally, (5) truth-default theory may be a useful tool for understanding how targeted individuals behave during vishing attacks. Application Those developing systems that help users deal with suspected vishing attacks or penetration testing plans should consider (1) targeted individuals’ truth-bias, (2) the influence of visher demeanor on the likelihood of deception detection, (3) the influence of fabricated situations surrounding vishing requests on the likelihood of deception detection, and (4) targeted individuals’ lack of concern about seemingly innocuous requests.

Truth-Default Theory (TDT) predicts that across countries and cultures, a few people tell most of the lies, while a majority of people lie less frequently than average. This prediction, referred to as “a few prolific liars,” is tested in Japan. The study further investigated the extent to which the Dark Triad personality traits predict the frequency of lying. University students (N = 305) reported how many times they lied in the past 24 hours and answered personality questions. Results indicate that the few prolific liars pattern is evident in Japan thereby advancing TDT. Results also show that Japanese frequent liars tend to have Dark Triad personality traits, but the nature of the findings may be unique to Japan. Results of the generalized linear model suggest that the Dark Triad components of Machiavellianism and psychopathy exacerbate lying behavior by reducing the guilt associated with lying. However, narcissism encourages guilt and therefore inhibits lying behavior with both direct and indirect effects. These narcissism findings appear to contradict prior studies but stem from use of a more appropriate statistical analysis or the Japanese context.

The Classical Theory of Education Crisis is the default theory utilised by educational theorists for understanding the constitution and explanation of education crises in contemporary society. Following a brief outline of the concept of crisis, and the histiography of the notion of education crisis from the Second World War to the neoliberal recession of 1980-82, there is an outline of The Classical Theory of Education Crisis as most fully expressed in Madan Sarup’s classic Education, State and Crisis: A Marxist Perspective (1982). The key aspect of the Classical Theory is that education crises are derivative of economic crises. This is followed by the main event: critique of the Classical Theory. Its reliance on structuralist thought (with associated determinism, functionalism and reductionism) and the inflow of economics imperialism are some of its key deficiencies. The Conclusion outlines ground still to be covered and the need to move beyond the Classical Theory of Education Crisis.
