Interference with Freedom of Expression

Established as a personal right, the right to free speech implies obligations and duties, which may generate possible restrictions. Freedom of expression works correctly in a legal framework when it comes to a legitimate aim in a state law. Article 10, paragraph 2, of the Convention explains the conditions under which the right to freedom of expression is justified by the need to protect certain public interests (such as those relating to national security, the territorial space of the state, public order, the prevention of crimes, the protection of health and social morals, the guarantee of authority and the impartiality of the judiciary) but also to protect certain private interests, such as reputation and the rights of others. persons or the need to prevent the publication of secret information. This paragraph basically authorizes states to take certain measures to protect those interests, which materialize through rules and normative rules of the right to conscience, opinion and freedom of expression States enjoy a margin of appreciation for establishing the need for such reactions in a state governed by the rule of law, but in the end it is also up to the European Court of Human Rights to rule on the compatibility of interference with the provisions of the Convention, assessing on a case-by-case basis if the interference arises as a result of the urgent social issues and whether it is fair.

Intellectual freedom and alternative priorities in library and information science research: A longitudinal study

This article presents a bibliometric analysis of the library and information science literature to trace the emphasis that intellectual freedom and neutrality have received relative to an index of alternative and possibly competing topics. Emphasis is captured longitudinally by recording the number of results for various search terms associated with intellectual freedom, neutrality, diversity, equity, and inclusion in Web of Science from 1993 through 2020 and Library, Information Science and Technology Abstracts from 1970 through 2020. The results show that the number of works mentioning intellectual freedom and neutrality has increased only slightly over the study period, in sharp contrast to many entries on the diversity, equity, and inclusion index. With research interests being partially indicative of personal beliefs and professional activity, the impact of this relative change in emphasis on professional practice is discussed. Public controversies regarding library neutrality, intellectual freedom, and freedom of expression in libraries are summarized.

Efektivitas Etika Digital Netizen Indonesia Terhadap Ujaran Kebencian di Instagram

This research is motivated by mass communication and retrieval of information on Instagram, creating hate speech on digital platforms. With the availability of social media as a means of disseminating the required information, the pattern of society has shifted, either implicitly or unseen, so that culture, ethics, and norms become biased and cause conflict. This study aims to identify hate speech on Instagram and test the effectiveness of digital ethics within the axiological analysis. The object of this research is hate speech used to comment with inappropriate words. This research method uses a literature review method. This research collects data from various journals and finds proof of hate speech on Instagram. The freedom of expression results in this literature study state that many social media users do not apply excellent and polite social media ethics. Besides that, axiological studies supported these results that do not help ethical skills related to moral and aesthetic values. In addition, many Indonesian netizens still spread hatred intentionally or unintentionally on social media. Therefore, there is a need for education and proactive action for Indonesian netizens to use social media.

Invisible or Powerful? Ageing in a Mediatised Society

In order to live your rights and achieve your goals, you need to be informed, have a voice and be listened to, and have the opportunity to engage in society, regardless of age. Freedom of expression and freedom of information are core human rights values that connect the concept of capability with the role of the media in society. The media can be a tool for enhancing a person’s capabilities, but it can also be seen as hindering a good life if technology and its applications are perceived as awkward and/or difficult to access.At a structural level, a wider discussion of media responsibility has the potential to contribute to enhancing people’s capabilities in later life. One critical issue is who should be held accountable and responsible for media content that lacks diverse stories about older people and their voices, possibly reinforcing ageism. Furthermore, where the responsibility lies for ensuring that older people have the technological means to act as digital citizens is somewhat unclear. In an increasingly mediatised environment, we might see a stronger relationship between media literacy, health and ageing, which in turn could emphasise the importance of the role of the media in enhancing capabilities.

Supporting and Facilitating Pedagogical Creativity With Gamification

Pedagogical creativity is an opportunity to innovate, create agency, and raise awareness of critical commentary on issues which are often regarded as being central to the concepts of social justice and identity within the context of transformative learning. This chapter provides an insight into the theoretical basis of gamification and its usefulness in explicating the meaning that others ascribe to their individual experiences of the world and how they interpret them. Higher education remains a central forum and situationally responsive focus to highlight those issues which remain topical, yet often unaddressed. This affords a lens of intellectual, rationale articulation of what matters – lives lived in a world still tainted with injustice and the lack of society's impetus and appetite for progressive change. Gamification is posited as a means of facilitating freedom of expression for individuals and collective communities, for whom voicing personal beliefs and standpoints has been a barrier for rationale debate on issues of oppression and the advocacy of agency in practice.

The Indonesian Electronic Information and Transactions Within Indonesia’s Broader Legal Regime: Urgency for Amendment?

Cyberspace is the interdependent network of information technology infrastructures such as the internet, telecommunications networks, and computer systems. Meanwhile, Indonesia’s Law Number 11 of 2008 and its amendment through Indonesian Law Number 19 of 2016 governing cyberspace have been viewed to contradict and infringe other areas of law, such as protection of press or freedom of expression. Hence, this study seeks to identify the controversies and problems regarding the law deemed urgent for amendment. Further, this study creates recommendations so the government may amend electronic information policy more fairly and efficiently. This study uses a judicial normative and comparative approach. This research tries to analyze the existing regulations and the implementation and compare Indonesia’s cyberspace regulation with other States’. This study finds that Articles 27(3) and 28(2) of the law criminalize defamation and hate speech in an overly broad manner and that Article 40(2)(b) allows the government to exercise problematic censorship. As a result, they have infringed the freedom of the press and general freedom of expression in practice. In response to this, this study compares similar provisions from other States and recommends amendment the articles to become narrower and more clearly defined.
