This book explores the interface between European data protection and the freedom of expression activities of traditional journalism, professional artists, and both academic and non-academic writers from both an empirical and normative perspective. It draws on an exhaustive examination of both historical and contemporary public domain material and a comprehensive questionnaire of European Data Protection Authorities (DPAs). Empirically it is found that, notwithstanding an often confusing statutory landscape, DPAs have sought to develop an approach to regulating the journalistic media based on contextual rights balancing. However, they have struggled to secure a clear and specified criterion of strictness as regards standard-setting or a consistent and reliable approach to enforcement. DPAs have appeared even more confused as regards other traditional publishers, largely abstaining from regulating most professional artists and writers but attempting to subject all academic disciplines to onerous statutory restrictions established for medical, scientific, and related research. From these findings, it is argued that balancing contextual rights has value and should be both generalized across all traditional publishers and systematically and sensitively developed through structured and robust co-regulation. Such co-regulation should adopt the new code of conduct and monitoring provisions included in the General Data Protection Regulation (GDPR) as a broad guideline. DPAs should accord strong deference to any codes and monitoring bodies which verifiably meet the accredited criteria but must engage more proactively when these are absent. In any case, DPAs should also intervene directly as regards particularly serious or systematic issues and have an increasingly important role in ensuring a joined-up approach between traditional publishing and new media activity.

The aim of this study was to synthesize the concepts from empirical studies and analyze, compare and interrelate them with normative ethics. The International Council of Nurses (ICN) and the Health and Medical Service Act are normative ethics. Five concepts were used in the analysis; three from the grounded theory studies and two from the theoretical framework on normative ethics. A simultaneous concept analysis resulted in five outcomes: interconnectedness, interdependence, corroboratedness, completeness and good care are all related to the empirical perspective of the nurse’s interaction with the older patient, and the normative perspective, i.e. that found in ICN code and SFS law. Empirical ethics and normative ethics are intertwined according to the findings of this study. Normative ethics influence the nurse’s practical performance and could be supporting documents for nurses as professionals.

This essay reviews Lucian A. Bebchuk and Jesse M. Fried's Pay without Performance: The Unfulfilled Promise of Executive Compensation. Bebchuk and Fried criticize the standard view of executive compensation, in which executives negotiate contracts with shareholders that provide incentives that motivate them to maximize the shareholders' welfare. In contrast, Bebchuk and Fried argue that executive compensation is more consistent with executives who control their own boards and who maximize their own compensation subject to an “outrage constraint.” They provide a host of evidence consistent with this alternative viewpoint. The book can be evaluated from both positive and normative perspectives. From a positive perspective, much of the evidence they present, especially about the camouflage and risk-taking aspects of executive compensation systems, is fairly persuasive. However, from a normative perspective, the book conveys the idea that policy changes can dramatically improve executive compensation systems and consequently overall corporate performance. It is unclear to me how effective potential reforms designed to achieve such changes are likely to be in practice.

ResuméI de seneste 30 år har pædagogprofession og pædagoguddannelse ændret sig på måder, der tilsyneladende har gjort faglig fordybelse for pædagoger og UC undervisere vanskeligere. I dette lys synes entreprenante pædagogiske ildsjæle at repræsentere en mulig modpol, i den forstand at ildsjæle ofte evner at stå værn om faglig kvalitet, fx med afsæt i fagområder som drama, musik eller billedkunst. Ligeledes formår entreprenører ofte at etablere værdifulde initiativer indenfor, udenfor eller på tværs af formelle institutioner og organisationer. I artiklen undersøges denne hypotese og problemstilling via et empirisk studie af tre pædagogiske entreprenante ildsjæle før/under/efter en række workshops, hvor ildsjælene arbejder med pædagogiske målgrupper. Tre forskere/undervisere og 50 pædagogstuderende på tre forskellige campusser foretager undersøgelsen. Studiet peger på, at faglig ekspertise og specialviden kan opnås både udenfor og inden for etablerede formelle institutioner, men at entreprenørskab giver nogle særlige muligheder i forhold til at fastholde ildsjælenes fokus på deres pædagogiske visioner og deres faglige ekspertise. I artiklen diskuteres afslutningsvist ulemper og fordele ved at anvende entreprenørskabs-modeller til at oparbejde og tilbyde specialviden på kanten af den pædagogiske profession og uddannelse. AbstractSocial entrepreneurs within the pedagogical profession: A study of entrepreneurship as a possible way to build up specialized pedagogical competence and environments. In Denmark, the pedagogical profession and the field of social education have changed radically over the last thirty years: pedagogues are expected to acquire both academic and practical competence, as well as have a broad set of knowledge within many different pedagogical subcategories. In consequence, educators and pedagogues have found it increasingly difficult to achieve and maintain specialized, rather than general, professional expertise. In this perspective, social entrepreneurship seems to represent a possible gateway, because entrepreneurs are often able to focus on a specific professional agenda and approach, e.g. within the field of drama, music, visual art, therapy, etc. In the current article, this hypothesis is investigated through a qualitative case study of three social entrepreneurs’ pedagogical careers, methods, approaches and visions. The study is conducted by three researchers/educators and fifty students across three different campuses. The study indicates that specialized knowledge and competence can be achieved and maintained both within and outside formal institutions. Still, entrepreneurship seems to offer unique possibilities when it comes to the establishment of specialized pedagogical environments with a continuous focus on specific visions and approaches. At the end of the article, entrepreneurship within the pedagogical profession is discussed from a normative perspective and essential pros and cons are highlighted.

According to the title, the subject of this article is the activity of Frontex (European Border and Coast Guard Agency) on the Western Balkan route during the migrant crisis, the escalation of which took place in mid-2015. The main part of the text has been divided into four parts. In the first part of the article, the author briefly described the genesis of Frontex and its current activity in the normative perspective. In the second part, the author characterised the determinants of the migrant crisis, focusing on the challenges for the European Union which the crisis generated. In the third part, the author described the course of the Western Balkan route and analysed statistical data on the population migrating that route. In the fourth and last part, the author analysed Frontex’s activity on the Western Balkan route, describing the determinants of the actions taken.

Neither of the major contemporary theorists most closely associated with the legacy of the Frankfurt School, Jürgen Habermas or Axel Honneth, has made systematic reflection on the paradoxes and challenges produced by the waves of de-colonization that characterized the latter half of the twentieth century a central focus of his work in critical theory, nor has either theorist engaged seriously with the by now substantial body of literature in post-colonial theory or studies. In this paper, Allen argues that this silence is motivated by the particular role that ideas of historical progress, development, social evolution, and socio-cultural learning play in justifying and grounding the normative perspective of contemporary Frankfurt school critical theory.
