Policy-based Implied Contractual Licences

This chapter assesses policy-based implied contractual licences, focusing on situations where there is a pre-existing contract and a policy-based licence is implied into such contract. To the extent that a contract exists, there is a certain voluntariness to the conduct of the copyright owner in entering into the contract. However, the copyright licence is implied into the contract to achieve a policy objective regardless of the consent of the copyright owner. The framework for implication underlying this chapter is inspired by the rules of implying a term by law into a contract, but made more transparent to acknowledge the role of policy as the basis of implication and the need for the policy to be identified. The chapter illustrates the arguments by examining the transfer of ownership of products incorporating copyright works and the possible licences that may need to be implied into such transfer. It also discusses the highly regulated industry of hazardous substances, and how the information flow in this sector can be explained using the framework proposed here for policy-based implied contractual licences.

Microbiological detoxification of hazardous organic pollutants is highly promising, but its reliable implementation requires a sophisticated understanding of several different substrate types and how they interact. This paper carefully defines the substrate types and explains how their interactions affect the bacteria's electron and energy flows, information flow, and degradative activity. For example, primary substrates, which are essential for growth and maintenance of the bacteria, also interact with degradation of specific hazardous pollutants by being inducers, inhibitors, and direct or indirect cosubstrates. The target contaminants, which often are secondary substrates, also have the interactive roles of self-inhibitor, inhibitor of primary-substrate utilization, inducer, and a part of an aggregate primary substrate.

Microplastics (MPs) are distributed in a wide range of aquatic and terrestrial ecosystems throughout the planet. They are known to adsorb hazardous substances and can transfer them across the trophic web. To eliminate MPs pollution in an environmentally friendly process, we propose using a photocatalytic process that can easily be implemented in wastewater treatment plants (WWTPs). As photocatalysis involves the formation of reactive species such as holes (h+), electrons (e−), hydroxyl (OH●), and superoxide ion (O2●−) radicals, it is imperative to determine the role of those species in the degradation process to design an effective photocatalytic system. However, for MPs, this information is limited in the literature. Therefore, we present such reactive species’ role in the degradation of high-density polyethylene (HDPE) MPs using C,N-TiO2. Tert-butanol, isopropyl alcohol (IPA), Tiron, and Cu(NO3)2 were confirmed as adequate OH●, h+, O2●− and e− scavengers. These results revealed for the first time that the formation of free OH● through the pathways involving the photogenerated e− plays an essential role in the MPs’ degradation. Furthermore, the degradation behaviors observed when h+ and O2●− were removed from the reaction system suggest that these species can also perform the initiating step of degradation.

Network science has long been recognized as a well-established discipline across many biological domains. In the particular case of cancer genomics, network discovery is challenged by the multitude of available high-dimensional heterogeneous views of data. Glioblastoma (GBM) is an example of such a complex and heterogeneous disease that can be tackled by network science. Identifying the architecture of molecular GBM networks is essential to understanding the information flow and better informing drug development and pre-clinical studies. Here, we review network-based strategies that have been used in the study of GBM, along with the available software implementations for reproducibility and further testing on newly coming datasets. Promising results have been obtained from both bulk and single-cell GBM data, placing network discovery at the forefront of developing a molecularly-informed-based personalized medicine.

As a response to increasing influences of transnational corporations (TNCs) over the lives of the poor, development NGOs have tried to promote their responsibility in cooperative ways: partnership in development projects and voluntary regulations. Notwithstanding some degree of success, these cooperative ways have failed to bring fundamental changes to TNCs. This article outlines the limitations of the mainstream corporate social responsibility (CSR) and the potential of grassroots social movements to make TNCs accountable. People in developing countries have been neglected in the CSR agenda; however, they have power to change corporations as labourers, consumers and citizens. Drawing on case studies, this article suggests that NGOs should support grassroots people in building global networks, constructing collective values and creating the information flow in order to overcome the current shortcomings of community-driven social movements. For these new roles as advocates and facilitators for grassroots movements, NGOs need to transform themselves by pursuing core values.

In both the United States and Canada, bankruptcy preferential transfer avoidance provisions are aimed at creating equality of distribution among similarly situated creditors. However, there is a key difference in the way each jurisdiction’s regime treats the notion of intent. An analysis of each regime, using examples, illustrates the way in which Canada’s regime effectually does violence to the distributive equality policy objective, while the US regime adheres to it.

Abstract Mass communication has become a daily feature of our technological civilisation. This is as true of cross-cultural or intercultural encounters as it is of intra-cultural communication, and mass media have facilitated effective international information flow. Bilingual editing becomes an important medium of mass communication. The effectiveness of such communication rests upon the grammatical, lexical, sociolinguistic, socio-cultural, discourse and strategic competence of participants (editors, writers, translators and readers). It rests upon their ability to use creatively and to respond sensitively to language. In this dynamic process of communication, a bilingual editor not only plays the role of translator but also acts as a mediator; as Hatim and Mason (1990:223) suggest, s/he "has not only a bilingual ability but also a bi-cultural vision". In view of the diversity of usage of bilingual editing in the media, this research delves into the bilingual editing of magazines in Hong Kong. The study focuses on translation only from English and Chinese, or vice versa. Inasmuch as there is very little academic attention to bilingual editing and its nature, processes and techniques, or to the role of translation in bilingual editing, it is believed that this research will help facilitate cross-cultural communication between Westerners and Chinese. Résumé Dans notre civilisation, marquée par le seau de la technologie, la communication de masse relève du quotidien. Cette remarque est valable tant en ce qui concerne les rencontres interculturelles que la communication intraculturelle. De plus, la communication de masse favorise l'échange efficace des informations à l'échelon international. Les publications bilingues sont devenues un important support de la communication de masse. L'efficacité de cette communication repose sur le discours grammatical, lexical, socio-linguistique, socio-culturel et sur la compétence stratégique de ceux qui y participent (rédacteurs, écrivains, traducteurs et lecteurs). Elle repose sur leur faculté d'utiliser le langage avec créativité et d'y réagir avec sensibilité. Dans ce processus de communication dynamique, le rédacteur bilingue joue non seulement le rôle de traducteur mais aussi de médiateur, comme le suggèrent Hatim et Mason (1990:223): il ou elle "dispose non seulement d'une capacité de bilinguisme mais aussi d'une vision biculturelle". Au vu de la diversité d'emploi de la rédaction bilingue dans les médias, cette recherche fouille dans l'univers de l'édition de magazines bilingues à Hong Kong. L'étude se concentre uniquement sur la traduction de l'anglais et du chinois et vice-versa. Dans la mesure où dans les milieux académiques, on attache très peu d'importance à l'édition bilingue, à sa nature, à ses processus et techniques, ou au rôle de la traduction dans le monde de l'édition bilingue, l'auteur estime que cette recherche facilitera la communication interculturelle entre les Occidentaux et les Chinois.

The Sustainability value parity framework is proposed to deepen the understanding of the importance of ‘inter-relatedness' of water-energy-waste with the goal of balancing water usage, aligning energy intensity and optimizing waste utilization. Generic waste that is burgeoning is a deterrent to the practice of sustainability that aligns water, energy, infrastructure, health, food, and lifestyle (Sachs, 2007). This chapter delineates the gap between globalization at the macro-level and global citizenry at the grassroots-base and posits a value bridge assessed by appropriate thresholds of water - energy - waste. The emergent need to strengthen climate resilience and to usher into the sustainable pathway of climate-proofed development needs tuning of processes, lifestyle, hazardous substances and consumption. Climate change manifests as an over-arching risk that is strewn with unpredictability, multiple dimensions, uncertainties, spikes, imbalances leading to inequity.

This article introduces a new method to discover the role of influential people in online social networks and presents an algorithm that recognizes influential users to reach a target in the network, in order to provide a strategic advantage for organizations to direct the scope of their digital marketing strategies. Social links among friends play an important role in dictating their behavior in online social networks, these social links determine the flow of information in form of wall posts via shares, likes, re-tweets, mentions, etc., which determines the influence of a node. This article initially identities the correlated nodes in large data sets using customized divide-and-conquer algorithm and then measures the influence of each of these nodes using a linear function. Furthermore, the empirical results show that users who have the highest influence are those whose total number of friends are closer to the total number of friends of each node divided by the total number of nodes in the network.
