The Legal Pluralism at the Heart of International Economic Governance

When considering international economic governance, observers often focus on the lack of clear lines of demarcation regarding which rules apply. Businesses may complain about being subject to conflicting regulatory regimes; those concerned with labor rights, consumer protection, and the environment worry about regulatory evasion; and those focused on the philosophy of governance emphasize the possibility that norms regulating behavior may be unmoored from what is seen as a legitimate governing authority or polity. All of these concerns, however, rest on the assumption that for every dispute there should be one prevailing authority. This chapter questions that assumption, arguing that there is often no conceptually satisfying way to dictate a single set of legal norms to apply to a dispute and that the effort to do so often skews our focus. Instead, by embracing the pluralism at the heart of international economic governance, we can turn our attention to developing workable procedures, institutions, and discursive practices for managing multiple jurisdictional assertions by state and nonstate actors alike. We may even find that the existence of multiple ports of entry for normative assertions opens space for contestation, resistance, and creative possibility.

This paper analyzes the challenges that the international community faces to build an effective and legitimate global economic governance. After exploring the normative case for international economic cooperation, as well as the obstacles to achieve it, it focuses in the achievements and challenges ahead for global economic governance in a number of economic issue areas. In order to do so, it analyzes the role of the G-20, an institution that has emerged since 2008 as the focal point for global economic coordination.

AbstractThe phenomenon of mass surveillance has confronted legal systems throughout the world with significant challenges to their fundamental norms and values. These dilemmas have been most extensively studied and discussed in relation to the kind of privacy cultures that exist in Europe and North America. Although mass surveillance creates the same kinds of challenges in Muslim countries, the phenomenon has rarely been discussed from the perspective of Shari’a. This article seeks to demonstrate that this neglect of mass surveillance and other similar phenomena by Shari’a scholars is unjustified. Firstly, the article will address objections that Shari’a does not contain legal norms that are relevant to the modern practice of state surveillance and that, if these exist, they are not binding on rulers and will also seek to show that, whatever terminology is employed, significant aspects of the protection of privacy and personal data that exists in other legal systems is also be found deeply-rooted in Shari’a. Secondly, it will assess the specific requirements that it makes in relation to such intrusion on private spaces and private conduct and how far it can benefit from an exception to the general prohibition on spying. Finally, it is concluded that mass surveillance is unlikely to meet these Shari’a requirements and that only targeted surveillance can generally do so.

RESUMOEste artigo tem por objeto a Teoria dos Direitos Humanos em Michel Villey. Seu objetivo é apresentar uma contestação à alegação de Michel Villey de que os direitos humanos não podem ser considerados Direito. Para tanto, realiza uma apresentação da Teoria dos Direitos Humanos em Michel Villey, passando pela criação dos direitos humanos em Thomas Hobbes, a inversão de objetivos dos direitos humanos em John Locke e a expansão dos direitos humanos em Christian Wolff. Em seguida passa a apresentar a crítica de Michel Villey aos direitos humanos e as falhas deste autor ao realizar suas acusações, haja vista a possibilidade de solução das contradições (colisões) entre os direitos humanos, além de que não se pode confundir o critério de validade da norma com sua eficácia. O trabalho conclui pela juridicidade dos direitos humanos ao demonstrar que a suposta contradição não seria razão para retirar esta qualidade.PALAVRAS-CHAVEFilosofia do Direito. Direitos Humanos. Its purpose is to present a challenge to Michel Villeys’ claim that human rights are not legal norms. To do so, the text presents the General Theory of Human Rights in Michel Villey, including the creation of human rights by Thomas Hobbes, the changing perspective attributed to John Locke and the numerical expansion of human rights attributed to Christian Wolff. The text then presents Michel Villeys’ critics of human rights and the problems with those critics; specifically, that the given conflicts between norms aren’t sufficient to declare that they aren’t legal norms, other than that, the text points that in his critics Michel Villey confuses the concepts of validity of the norm with its effectiveness. <p><em>This study aims to describe first, the main factors causing the inability of the law to fulfill transportation accessibility rights for persons with disabilities in East Java, secondly, the legal review of consumer protection and maqashid sharia against non-fulfillment of transportation accessibility rights for persons with disabilities, third, legal solutions to compliance transportation accessibility rights of persons with disabilities in East Java. The research method used is empirical research with a sociological juridical approach that is related to the effectiveness of the law to fulfill the accessibility rights of persons with disabilities in the field of transportation, which relies on primary data obtained through guided free interviews from primary data sources as well: (1) Transportation Service of East Java Province , (2) Regional Representative Council of the East Java Highway Transport Organization (Organda), which is then analyzed descriptively by a deductive pattern. The results of this study, first, legal norms used to burden the obligation to fulfill the right of accessibility of persons with disabilities to business actors are mandatory norms not prohibitors, business actors do not have legal awareness because they do not know about these obligations and apparatuses also do not have legal norms this is because of ignorance of this obligation, second, in the perspective of legal consumer protection, accessibility is a consumer right specifically for persons with disabilities given Law No. 8 of 2016 and also the obligation of business actors provided by Law No. 22 of 2009, there is no realization of accessibility rights in transportation, business people have ignored consumer rights of disability as well as obligations that must be fulfilled by business actors, maqashid Syariah's perspective sees the implications of not achieving transportation accessibility rights can result in their limited mobility to find work which leads to acts requesting that this need collide with hifdz al-mal and al-'urd. Third, the solution for fulfilling the right of accessibility of persons with disabilities in the transportation sector is (1) Establishment of a National Disability Commission that can advocate for the neglect of the rights of persons with disabilities in macro, (2) legal literacy as a legal literacy media on the rights of persons with disabilities.</em></p><p><em> </em></p><em>Penelitian ini bertujuan untuk mendeskripsikan pertama,<strong> </strong>faktor utama penyebab tidak bisa bekerjanya hukum pemenuhan hak asesibilitas transportasi bagi penyandang disabilitas di Jawa Timur, kedua, tinjauan hukum perindungan konsumen dan maqashid syariah terhadap tidak terpenuhinya hak aksesibilitas transportasi bagi penyandang disabilitas, ketiga, solusi hukum terhadap pemenuhan hak aksesibilitas transportasi penyandang disabilitas di Jawa Timur. Metode penelitian yang digunakan adalah penelitian empiris dengan pendekatan yuridis sosiologis yaitu terkait dengan efektivitas hukum pemenuhan hak aksesibilitas penyandang disabilitas dibidang transportasi, yang bertumpuh kepada data primer yang didapat melalui wawancara bebas terpimpin dari sumber data primer pula yaitu: (1) Dinas Perhubungan Provinsi Jawa Timur, (2) Dewan Perwakilan Daerah Organisasi Angkutan Jalan Raya (Organda) Jawa Timur, yang kemudian dianalisis secara deskriptif analisis dengan pola deduktif. Adapun hasil penelitian ini, pertama, norma hukum yang digunakan untuk membebani kewajiban pemenuhan hak aksesibilitas penyandang disabilitas kepada pelaku usaha adalah norma mandatur bukan prohibitor, pelaku usaha tidak memiliki kesadaran hukum karena mereka tidak mengetahui tentang kewajiban ini dan apparat juga tidak memiliki keterikatan dengan norma hukum ini karena ketidaktahuan terhadap kewajiban ini, kedua, dalam perspektif hukum perlindungan konsumen, aksesibilitas merupakan hak konsumen khusus bagi penyandang disabilitas yang diberikan Undang-Undang No. 8 Tahun 2016 dan juga merupakan kewajiban pelaku usaha yang diberikan oleh Undang-Undang No. 22 Tahun 2009, tidak terealisasinya hak aksesibilitas dalam transportasi, pelaku usaha telah mengabaikan hak konsumen disabilitas sekaigus juga kewajiban yang harus dipenuhi oleh pelaku usaha, perspektif maqashid Syariah melihat implikasi tidak terwujudnya hak aksesibilitas transportasi dapat mengakibatkan sempitnya mobilitas mereka untuk mencari pekerjaan sehingga berujung pada perbuatan meminta minta yang terntunya ini berbenturan dengan hifdz al-mal dan al-‘urd. Ketiga, solusi agar hak aksesbilitas penyandang disabilitas di bidang transportasi terpenuhi adalah (1) Pembentukan Komisi Disabilitas Nasional yang bisa mengadvokasi pengabaian hak-hak penyandang disbailitas secara makro, (2) legal literacy sebagai media melek hukum tentang hak-hak penyandang disabilitas.</em>

The article examines the specifics of the philosophical and legal classification of crime in the conceptual positions of the theory of state and law. The categorical classification of the objects of the crime system as structured vertically and structured horizontally, which allowed distribution of crimes directly, kind, generic, general, was analyzed. It is shown that the general object of the crime is traditionally in the conceptual positions of the theory of state and law called the whole set of social relations, which are protected by criminal law. The generic object of the crime is a certain circle of homogeneous economic, social, political content of social relations, which, for some reason, should be protected by a single set of legal norms. It is made general that the specific object of a crime is a set of social relations within the generic object, which reflect the same interest of the participants in such relations or express though the nonidentical, but closely interrelated interests. The direct object of the crime is those specifically social relations, set by the legislator under the protection of a certain legal norm. It is shown that structured horizontal objects of crime are distributed directly to the main and directly additional. It is traced that under the direct object of the crime is understood those social relations, the violation of which is the social content of the crime and for the protection of which there is a legal norm, which implies responsibility for the commission of the crime. Under the direct additional object of the crime are those social relations, the encroachment on which does not constitute the content of the crime, but the commission of such a crime is always caused damage. It is concluded that the study of the concept of crime within the conceptual concepts of the theory of state and law is justified by the subject of its study. The fundamental questions in this context arose the problem of what exactly is the legal facts, which, depending on the result, can be classified categorically into legal, lawful, and law-stopping. It is proved that the most important is the distribution of legal facts by their individual connection with the participants in the legal relationship. Thus, according to the categorical regularity of concepts of the theory of state and law, wrongful actions are divided, first, into offenses, that is, crimes and misdemeanors; and secondly, on objectively unlawful acts.

The procurement of an apartment is strengthened by Sales and Purchase Agreement (PPJB) between the buyer and the developer, but the practice in the field are often found that developers does not handover the physical terms in accordance with the agreed time (default/breach of contract), and resulting in losses for the buyer. This study aims to determine the responsibility of the developer to the buyer due to default/breach pf contract matter and legal protection for the buyer in terms of buying Pluit Sea View apartments based on Sale and Purchase agreement. Research data were analyzed using descriptive-qualitative analysis methods which were tested with legal norms. The result of analysis shows that: 1. PT.  Binakarya Bangun Propertindo (as developer) does not fulfill their responsibilities as in agreement of the PPJB regarding the rights of consumers. 2. Weak of Consumer Protection Sarusun Belonging to Pluit View Sea , as consumer do not have bargaining positions.

This chapter looks at the effect of duress or undue influence on the making of a contract. The difficulty is identified of distinguishing hard bargaining from economic duress, when the ‘threat’ is to the economic interest of the party ‘threatened’. This raises the question of what amounts to an illegitimate threat; whether a threat which is not otherwise legally labelled as wrongful will suffice, and whether all threatened breaches of contract do so. The question also arises as to a test of a ‘reasonable’, or ‘practical’, alternative to agreeing. Undue influence is concerned with the surrender of decision making because of the relationship of the parties whether through domination or trust. The presumptions that arise in relation to undue influence, and when they arise, are examined. Consideration is given to the treatment of aggressive and misleading trade practices under the Consumer Protection from Unfair Trading Regulations (as amended by the Consumer Protection (Amendment) Regulations 2014).

Abstract It has become common to insist that contemporary international economic problems require a great increase in the extent of “global governance” of economic affairs. This desire, understandable as it may be, confronts a series of major obstacles. First, the normative case for global governance is more difficult to justify, and more complex, than is usually recognized, and requires consideration of both economic and political-economy principles. Second, in practice, the provision of governance at the supra-national level - that is, of international public goods - depends largely on support from powerful and concentrated interests. Third, this dynamic means that the types of international public goods provided, the way they are provided, and the governance structures erected around them are biased in favor of their strongest supporters, and are therefore likely to be a source of continuing controversy.
