Thoughts on the Conflict Management Field after 30 Years

AbstractThis article surveys the emergence of conflict management from the academic and policy shadows into a far more prominent field of inquiry and practice. As the barriers to entry into third party roles collapsed at the end of the Cold War, the field of conflict management expanded, diversified, and fragmented into a range of practice areas (scholarly, policy-oriented, and operational). Four phases of this evolution are identified. An increasingly crowded field lacks gatekeepers or natural coherence, underscoring the need for leadership and sustained, coordinated efforts. The study of mediation has blossomed around the work of Zartman and others, while the policy community has swung back and forth in its enthusiasm for third party roles in an age where hard power and smart power vie for pride of place. Conflict management responses are increasingly spontaneous, ad hoc and case-specific. Debate is emerging over the pros and cons of engaging with armed non-state actors that are placed on proscribed lists in the struggle against terrorism. Post-conflict challenges continue to pose a severe test to practitioners of peacebuilding.

BackgroundPeaceful conflict resolution strategies have been identified as effective mechanisms for minimising the potential costs of group life in many gregarious species, especially in primates. The knowledge of conflict-management in orangutans, though, is still extremely limited. Given their semi-solitary lives in the wild, there seems to be barely a need for orangutans to apply conflict management strategies other than avoidance. However, because of the rapid loss of orangutan habitat due to deforestation, opportunities to prevent conflicts by dispersion are shrinking. Additionally, more and more orangutans are brought into rehabilitation centres where they are bound to live in close contact with conspecifics. This raises the questions of whether and how orangutans are able to cope with conflicts, which are inevitably connected with group life.MethodsObservational zoo-studies provide a valuable method to investigate such potential: in zoos, orangutans usually live in permanent groups and face the challenges of group life every day. Therefore, we observed a group of six socially-housed Sumatran orangutans at the Dortmund Zoo, Germany, both in their spacious outdoor enclosure in the summer and in the less spacious indoor enclosure in the winter. During 157.5 h of observation, we collected data on aggressive interactions, third-party interventions and post-conflict affiliations. We applied the post-conflict/matched-control observation (PC/MC) and the time rule method to investigate the occurrence of reconciliation and post-conflict third-party affiliations.ResultsWe recorded a total of 114 aggressive interactions (including conflicts in the context of weaning and of male sexual coercion). As expected, we found an increase of both open conflicts and peaceful conflict resolution under less spacious conditions. In accordance with previous reports, we observed interventions by initially uninvolved individuals. Whereas we found no clear evidence for post-conflict third-party affiliations, we were able to demonstrate the occurrence of reconciliation among orangutans.DiscussionNotwithstanding the small sample size and the explorative character of our study, we found evidence that orangutans possess a potential for prosocial conflict resolution. When living in groups and under conditions in which dispersion is no longer an option, orangutans are capable to flexibly apply strategies of conflict resolution to cease open conflicts and to repair the potential social damage of aggressive interactions. These strategies are similar to those of other great apes.

This book is the first to theorize third party mediation in crises between regional nuclear powers. Its relevance flows from two of the most significant international developments since the end of the Cold War: the emergence of regional nuclear rivalries; and the shift from the Cold War’s bipolar context to today’s unipolar international setting. Moving away from the traditional bilateral deterrence models, the book conceptualizes crisis behavior as “brokered bargaining”: a three-way bargaining framework where the regional rivals and the ‘third party’ seek to influence each other to behave in line with their crisis objectives and in so doing, affect each other’s crisis behavior. The book tests brokered bargaining theory by examining U.S.-led crisis management in South Asia, analyzing three major crises between India and Pakistan: the Kargil conflict, 1999; the 2001-02 nuclear standoff; and the Mumbai crisis, 2008. The case studies find strong evidence of behavior predicted by the brokered bargaining framework. They also shed light on several risks of misperceptions and inadvertence due to the challenges inherent in signaling to multiple audiences simultaneously. Traditional explanations rooted in bilateral deterrence models do not account for these, leaving a void with serious practical consequences, which the introduction of brokered bargaining seeks to fill. The book’s findings also offer lessons for crises on the Korean peninsula, between China and India, and between potential nuclear rivals in the Middle East.

This chapter seeks to focus on ‘peacebuilding’ as a construct of peace among groups that have previously been in conflict. This calls for moving beyond peacemaking and conflict resolution to consider the longer-term efforts at establishing sustainable peace. Notwithstanding the longstanding efforts of UNEP’s Post-Conflict and Disaster Management Branch, there has been very limited development of international normative and institutional structures targeting the process of post-conflict sustainable peacebuilding. How far the current international environmental governance (IEG) regimes are responsive to the specific challenges to post-conflict situations? It seeks to briefly consider four key aspects of IEG regimes: (i) Ad- hoc and subject specific (ii) Incremental and facilitative (iii) Degree of reciprocity and (iv) Science-based.

While United Nations peacekeeping missions were created to keep peace and perform post-conflict activities, since the end of the Cold War peacekeepers are more often deployed to active conflicts. Yet, we know little about their ability to manage ongoing violence. This article provides the first broad empirical examination of UN peacekeeping effectiveness in reducing battlefield violence in civil wars. We analyze how the number of UN peacekeeping personnel deployed influences the amount of battlefield deaths in all civil wars in Africa from 1992 to 2011. The analyses show that increasing numbers of armed military troops are associated with reduced battlefield deaths, while police and observers are not. Considering that the UN is often criticized for ineffectiveness, these results have important implications: if appropriately composed, UN peacekeeping missions reduce violent conflict.

AbstractThis article argues that Liberia owes a duty under both international humanitarian and human rights law to investigate and prosecute the heinous crimes, including torture, rape and extra-judicial killings of innocent civilians, committed in that country by the warring parties in the course of fourteen years of brutal conflict. Assuming that Liberia owes a duty to punish the grave crimes committed on its territory, the article then evaluates the options for prosecution, starting with the possible use of Liberian courts. The authors argue that Liberian courts are unable, even if willing, to render credible justice that protects the due process rights of the accused given the collapse of legal institutions and the paucity of financial, human and material resources in post-conflict Liberia. The authors then examine the possibility of using international accountability mechanisms, including the International Criminal Court, an ad hoc international criminal tribunal as well as a hybrid court for Liberia. For various legal and political reasons, the authors conclude that all of these options are not viable. As an alternative, they suggest that because the Special Court for Sierra Leone has already started the accountability process for Liberia with the indictment of Charles Taylor in 2003, and given the close links between the Liberian and Sierra Leonean conflicts, the Special Court would be a more appropriate forum for international prosecutions of those who perpetrated gross humanitarian and human rights law violations in Liberia.

The end of the Cold War witnessed the resurgence of ethnic conflicts in Africa, which necessitated the deployment of peacekeeping missions in many crisis contexts. The risk of HIV transmission increases in post-conflict environments where peacekeepers are at risk of contracting and spreading HIV/AIDS. In response, UN Security Council Resolution 1308 (2000) stressed the need for the UN to incorporate HIV/AIDS prevention awareness skills and advice in its training for peacekeepers. However, troops in peacekeeping missions remain under national command, thus limiting the UN prerogatives. This article discusses the risk of peacekeepers contracting or transmitting HIV/AIDS, as well as the role of peacekeeping missions in controlling the spread of the disease, and offers an account of the steps taken within UN peacekeeping missions and African regional peacekeeping initiatives to tackle the challenges of HIV/AIDS. While HIV/AIDS remains a scourge that could weaken peacekeeping in Africa, it seems that inertia has set in, making it even more difficult to tackle the complexity of this phenomenon.

I explore whether international organizations (IOs) promote peaceful conflict management. Using territorial claims data, I find that organizations with interventionist capabilities encourage disputing members to attempt peaceful conflict resolution. Then, to more fully uncover the causal relationship between IOs and conflict management, I investigate the influence of IOs on bilateral dispute settlement separately from third party settlement.The analyses reveal that institutions do not promote bilateral negotiations between members, indicating that the socialization and trust-building capabilities of IOs are limited. However, institutions foster multilateral talks, demonstrating that IOs broker bargaining with third party diplomatic intervention.
