The Constitutional Court of Republic of Indonesia is centralized judicial review institution which implements a posteriori and abstract control. Constitutional court decision often politically sensitive and involve important issues. On the one hand handing down strong decisions that uphold important constitutional principles can bring great benefits to citizens and can strengthen support for democracy but on the other hand, strong role of the court in judicial review tends to encroach increasingly on the territory of the law making institution. This article examines the decision of constitutional court in the framework of a tension between constitutionalism and democracy, especially from theoretical or conceptual approach. As result of examining its decisions, Indonesian Constitutional Court may reflect two characters; judicial activism as characterized by acting as law-maker and using policy in judicial decisions and/ or judicial self-restraint.  Recent  Indonesian experience shows that judicial review of legislation is not a simply of judicial control over law-making institution, as it brings  tension in the context of power relations in the scheme of separation of power. Relationship between the court and legislature, in respective of judicial review, will culminate in the philosophy of the judiciary. However, as constitutionalism and democracy are virtue, decisions of the Constitutional Court in judicial review should create mode of self-limitation within the framework of the principle of separation of powers.

The role of Constitutional Court as the protector of human rights related with the effort to guarantee the human rights also the worker’s rights with their decision. The decision in this study related with constitutionality of no-spouse employment norms. This study aims to examine the constitutionality aspects related with no-spouse employment policy related with human rightsor worker rights. This study is using statutory approach, conceptual approach and comparative studies concerning no-spouse employment policy. The results show that no-spouse employment policy is contrary with the Constitution and human rights legal instruments. Moreover, there is problem concerning the Decision of the Constitutional Court of Indonesia on the one hand is final and binding but non-executable automatically. This study to encourage the new paradigm to ensure the execution of the Decision of the Constitutional Court of Indonesia, in this context related with decision on the constitutionality no-spouse employment norms.

O presente artigo se propõe a analisar a deliberação interna e legitimidade das decisões do Supremo Tribunal Federal em sede de Controle de Constitucionalidade, observada uma conjuntura de revisão da Teoria da Separação dos Poderes e necessidade de criação de novos arranjos institucionais. Neste aspecto, tem-se como objetivo geral repensar o papel do Supremo Tribunal Federal em um modelo de controle de constitucionalidade, bem como sua legitimidade, justificação de suas decisões e deliberação interna, superando a dicotomia ativismo judicial/ deferência ao legislativo, tendo em vista a necessidade de readequação da Teoria da Separação dos Poderes, de modo que se leve a Constituição a sério e se responda ao anseio de desenvolvimento democrático-social brasileiro.Por fim, considera-se que a necessidade de que algum órgão delibere em sede de controle de constitucionalidade não significa que esta deva ser permanente ou que não possa haver alguma espécie de diálogo entre os poderes, concebendo assim, que Supremo Tribunal Federal não detém o monopólio da guarda da Constituição, havendo a possibilidade de um papel mais protagonista do legislativo, a partir da utilização dos mecanismos já existentes ou mesmo da criação de novos dispositivos que permitam diálogos institucionais.Palavras-chave: Ativismo judicial. In this respect, it has the general objective to rethink the role of the Supreme Court in a model of judicial review, as well as its legitimacy, justification of their decisions and internal deliberation, overcoming the dichotomy judicial activism /deference to the legislature, with a view the need to readjust the Theory of Separation of Powers, so that light the Constitution seriously and respond to the yearning of Brazilian democratic and social de-velopment. This research is intended to discuss the relevance of the application of presidential threshold and the implementation of simultaneous general elections in Indonesia. The concept of simultaneous general elections is the implementation of legislative and executive elections which are carried out simultaneously. The implementation of the first simultaneous general elections in Indonesia was motivated by a request for a judicial review of Law Number 42 Year 2008 concerning the Election of the President and Vice President. The Constitutional Court issued the Constitutional Court Decision Number 14/PUU-IX/2013 with the decision granting part of the request which later gave birth to the implementation of simultaneous elections in Indonesia starting in 2019. However, from the various articles that were reviewed, there was one article that was not decided by the Constitutional Court, namely regarding the presidential threshold. The Constitutional Court is of the opinion that the regulation regarding the presidential threshold is an open legal policy for the legislature. This paper is a normative legal research, with conceptual approach and statute approach to find answers to existing problems. The research source used is secondary data consisting of primary legal materials and secondary legal materials as explanation for primary legal materials. From the results of this research, it was found that the simultaneous elections and the presidential threshold were not compatible. On the one hand, the presidential threshold aims to simplify the number of parties.

Given the specifics of constitutional proceedings, the question of the peculiarities of evidence in a constitutional trial is becoming increasingly important. With the adoption of the Law of Ukraine ‘On the Constitutional Court of Ukraine’, for the sake of completeness of the trial, amicus curiae play a significant role in proving – experts and specialists who, by giving opinions on written requests of the judge-rapporteur in the case, reveal the peculiarities of socio-political discussion on complex issues arising in the course of constitutional justice. The purpose of this work is to study the amicus curiae institute, the features of its legal regulation in Ukraine and abroad, as well as to investigate the role of the institute in the constitutional process of Ukraine. The object of the research is the amicus curiae institute in the constitutional process of Ukraine. By examining the amicus curiae institute in the constitutional process of Ukraine, we can conclude that it plays an important role in the completeness of the judicial review of the case. On the one hand, the ‘friend of the court’ is a lobbyist who, thanks to his conclusions, seeks the necessary judicial decision. On the other hand, thanks to the amicus curiae institute, when considering cases that may affect an indeterminate number of persons, civil society (such as NGOs, etc.) can help ensure that the judgment is given in the light of all the circumstances relevant to the cases. However, despite the legislative consolidation of the research institute in the constitutional process of Ukraine, some procedural provisions require further refinement with the use of international experience and advanced scientific works.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

RESUMOO artigo tem por objetivo analisar a efetividade da jurisdição constitucional como mecanismo de emancipação social de determinados grupos a partir de decisões da Corte Constitucional colombiana. Nesse sentido, busca-se compreender a tutela dos direitos sociais, conforme o disposto na Constituição Colombiana de 1991, e os desafios de implementação dos direitos previstos, bem como o contexto de desenvolvimento de um protagonismo mais acentuado da Corte Constitucional colombiana. This chapter evaluates the so called 'transitional constitution' of South Africa and the 'permanent constitution' of Colombia. Through a comparative approach, it contends that constitutions are better understood in terms of their resilience rather than either being transitional or permanent, and that a 'resilient constitution' is the one capable of springing back even after being subjected to extreme pressure, as long as leaders maintain their commitment to governing within the limits of the law. In this sense, the differences between the Colombian transitional justice and the South African case do not stem primarily from the 'permanence' of its Constitution, but rather from the difficulties and tensions inherent to any transitional justice process, because it derives from some of the very rights it is designed to promote. The chapter then details how the jurisprudence of the Colombian Constitutional Court on transitional matters can be understood as having moved from an understanding of the Constitution as permanent, to one of resilience that does not represent a new power grabbed by the Court. Rather than that, it signals an understanding of the role of the Court in maintaining a constitutional order even in the face of existential threats to it.

This chapter looks at Brazilian judicial review. Judicial review in Brazil originated because it was borrowed from the U.S. Constitution. It emerged in amplified form in Brazil’s 1988 Constitution because, by 1988, the normative appeal of judicial review was widely appreciated all over the world. Moreover, the Hybrid Model of judicial review in Brazil, whereby the Supreme Federal Tribunal is both, at the apex of a diffuse system of judicial review, and is also a Constitutional Court, reflects widespread appreciation for the value of a system like the German Constitutional Court in a civil law jurisdiction. The power of such a court to issue rulings with erga omnes effect is especially important in civil law countries like Brazil, which lack systems of stare decisis. First, judicial review emerged in Brazil as the result of borrowing. Second, it emerged as a rights from wrongs reaction to abuses of power during Fascism and during the military dictatorship, which ruled Brazil for 1964 until 1984. Third, judicial review is necessary in Brazil for both federalism and separation of powers umpiring reasons. Fourth, judicial review in Brazil also emerged because the constitution-writing elite wanted to entrench its liberal and socialist values to forestall the emergence of yet another military government in the country. And, fifth, the Brazilian Constitution divides and allocates power among so many federal and state entities that the Supreme Federal Tribunal has the political space it needs to play a really big role in governing the country.

This study aimed to compare the profile and authority of the Constitutional Court of South Korea with the Constitutional Court of the Republic of Indonesia, which is granted by its Constitution and related laws. The aim is to see how far the role of the Constitutional Court of the Republic of Indonesia as an institution of judicial review, so that it can also note the advantages and disadvantages in its function as the guardian of the constitution. Penelitian ini bertujuan untuk membandingkan profil dan kewenangan Mahkamah Konstitusi Korea Selatan dengan Mahkamah Konstitusi Republik Indonesia, yang diberikan oleh Undang-Undang Dasar serta Undang-Undang terkait. Tujuannya adalah untuk melihat seberapa jauh peran Mahkamah Konstitusi Republik Indonesia sebagai Lembaga Judicial Review Undang-undang terhadap Undang-Undang Dasar, sehingga dapat dilihat kelebihanan dan kekurangannya masing-masing dalam fungsinya sebagai lembaga pengawal konstitusi.
