<p>Abstract<br />This article  discusses the ideal setting reconsideration after the Constitutional Court decision No. 34/PUU-XII/2013. This research is legal (judicial) normative, namely by reviewing library materials (literature study). Therefore, the data used in this research is secondary data, which includes the primary legal materials, secondary, and tertiary. The results of this study showed that realizing an ideal regulatory application for review should be conducted, first, the MA should retract SEMA 7 2014 it is necessary to avoid confusion law enforcement officials and people seeking justice so as to interfere with the judicial system. If want to make additional rules to facilitate the course of justice, the MA should be poured in the form of PERMA. Second, by accelerating the process of PK and execution. Thirdly, provision PK in the future submission must be adapted to the Constitutional Court decision No. 34/PUU-X/2013. That way the material truth and justice will actually be realized.</p><p>Keywords: Judicial Review; Justice; Rule of Law; Supreme Court Decisions.</p><p>Abstrak<br />Artikel ini meneliti tentang pengaturan ideal peninjauan kembali pasca putusan Mahkamah Konstitusi No. 34/PUU-XII/2013.Penelitian ini merupakan penelitian hukum (yuridis) normatif, yaitu dengan mengkaji bahan-bahan pustaka (studi kepustakaan). Karena itu, data yang digunakan dalam penelitian ini adalah data skunder, yang mencakup bahan hukum primer, skunder, dan tersier. Hasil Penelitian ini menunjukan bahwa, demi menwujudkan suatu peraturan yang ideal permohonan peninjauan kembali maka perlu dilakukan, pertama, MA harus menarik kembali SEMA No.7 Tahun 2014 hal ini ini diperlukan agar tidak terjadi kebingungan aparat penegak hukum dan masyarakat pencari keadilan sehingga dapat mengganggu sistem peradilan. Kedua, dengan mempercepat proses PK dan eksekusinya. Ketiga, ketentuan pengajuan PK kedepanya harus disesuaikan dengan putusan MK No. 34/PUU-XI/2013. Dengan begitu keadilan dan kebenaran materiil akan benar-benar dapat diwujudkan.<br />Kata kunci: Peninjauan Kembali, Keadilan, Kepastian Hukum, Putusan Mahkamah Agung</p>

Permasalahan dalam penelitian ini, pertama: makna Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra dan pasca dikeluarkannya Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Kedua, penerapan Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Ketiga, efek dikeluarkannya putusan Mahkamah Konstitusi tersebut dalam meminimalisir kriminalisasi perbuatan pegawai negeri sipil atau pejabat publik. Penelitian ini merupakan penelitian hukum dengan pendekatan yuridis normatif. Sebagai penelitian kualitatif maka data yang dipergunakan merupakan data sekunder yang terdiri dari data hukum primer, sekunder dan tertier yang diperoleh dari studi kepustakaan. Hasil penelitian menunjukkan bahwa putusan mahkamah konstitusi tersebut telah mengubah rumusan delik dari formil menjadi materiil yang menjadikan makna pasal tersebut semakin menjauh dari makna awalnya. Pada akhirnya, keluarnya putusan mahkamah konstitusi tersebut tidak dapat memecahkan permasalahan hukum yang telah ada sebelumnya bahkan putusan tersebut berpotensi menimbulkan permasalahan baru yang dapat menghambat proses penegakan hukum dalam pemberantasan tindak pidana korupsi di Indonesia.The problems on this research are, first: the meaning of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before and after Constitutional Court Decision Number 25/PUU-XIV/2016. Second, the application of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before Constitutional Court Decision Number 25/ PUU-XIV/2016. Third, the effects of Constitutional Court Decision in minimizing criminal actions conducted by civil servants and public officials. This research is a legal research using normative legal approach. As qualitative research, this research uses secondary data consist of primary, secondary, tertiary legal data collected from literature study. The results show that the constitutional court decision has changed the formulation of the offense from formal to material which makes the meaning of the article different from its original meaning. At last, the constitutional court deciasion could not solve the existing legal problem, but contrary it potentially creates a new problem which obstructs law enforcement process in combating corruption in Indonesia.

The Constitutional Court is one of the branches of judicial power that has authority to adjudicate at the first and last level whose decision is final to test the law against the Constitution as regulated in Article 24C paragraph (1) of the 1945 Constitution. The final nature of  decision of the constitutional court is binding on the entire community since it was said in the Open Plenary Session. Therefore, decision of constitutional court that invalidates the validity of a law must be followed up by legislators in the cumulative list open to the national legislation program. But in practice there are 2 (two) decisions that have not been followed up, namely Constitutional Court Decision Number 31 / PUU-XI / 2013 and Constitutional Court Decision Number 30 / PUU-XVI / 2018. Based on this description, it will be examined regarding the legal implications of not implementing the Constitutional Court Decision in case of judicial review? The author examines the problem using the method of normative legal research with the statutory approach. From the results of this study, it was found that the non-follow-up of the two decisions had violated the principle of rule of law in concept of the rule of law, and caused the loss of the decision-making power, and was a form of neglect of principle of legal awareness. So it is necessary to make changes in stages of the Constitutional Court Law and the House of Representatives' Regulations on Rules of Procedure.

The absence of provisions regulating the substitution of criminal fines in the KUP Law, raises legal uncertainty for law enforcement officials, especially prosecutors in executing court decisions. Considering the recovery of state financial losses that can be resolved by the consistency of court decisions, so the provisions in the KUP Law must meet the legal principles in criminal fines in criminal taxation acts. By not clearly stipulated the substitution of criminal fines in the KUP Law raises legal uncertainty. While substituting criminal fines in the KUP Law is only in the form of imprisonment. In practice, there are several forms of court rulings, there are substituting criminal fines with imprisonment, substituting criminal fines with confiscation of assets then auctioned to pay underpayment taxes, substituting criminal fines with confiscation of assets then auctioned to pay underpayment taxes if the convicted person does not have property that is adequate then replaced with imprisonment. The formulation of the legal issues in this study are: (1) the philosophy of substituting criminal fines in criminal acts in the taxation field, (2) Characteristics of substitution of criminal fines in criminal acts in the taxation field. The results of this study are expected to have a conceptual and legal reforms related to substituting criminal fines in criminal acts in the taxation field, so as to ensure legal certainty, justice and benefit, then the replacement of criminal substitute fines in criminal acts in the taxation field must be included in court decisions and followed up with execution of court decision by the Prosecutor as the executor.

This article is the result of research on the heart article in the 3 Constitutional Court Decisions which canceled the entire contents of the law, namely the Constitutional Court Decision Number 001-021-022/PUU-I/2003 which canceled Law Number 20 of 2002 concerning Electricity, Constitutional Court Decision 006/PUU-IV/2006 which canceled Law 27 of 2004 concerning the Truth and Reconciliation Commission, Constitutional Court Decisions 11-14-21-126 and 136/PUU-VII/2009 which canceled the Law Number 9 of 2009 concerning Legal Education Entities, and the Constitutional Court Decision 85/PUU-XI/2013 which canceled Law Number 7 of 2004 concerning Water Resources. The term 'heart article' is the term coined by the Constitutional Court and used as the main reason for canceling the entire contents of the law. Unfortunately, in these decisions, the Constitutional Court did not elaborate further on the concept and characteristics of an article categorized as the heart article. Departing from this issue, this research aims to find out what are the concepts and characteristics of the "heart article" of a law that was completely canceled by the Constitutional Court? To help answer this question, this research employed a normative method intended to trace all legal materials, both of the Constitutional Court decisions, statutory regulations, to the literature supporting the research. The importance of this research is to give meaning to the concept of the heart article, which, in the development of legal science, is still rarely discussed. Moreover, it can serve as a reference for petitioners to conduct the judicial review and to identify whether the article being tested is the heart article.

ABSTRAK Kewenangan Mahkamah Agung terhadap uji materi Peraturan Komisi Pemilihan Umum nomor 20 tahun 2018 yang tertuang dalam putusan nomor 48 P/HUM/2018 telah memberi ruang bagi mantan koruptor (pelaku kejahatan luar biasa) untuk menjadi calon anggota legislatif. Penelitian menggunakan jenis penelitian hukum normatif empiris. Penelitian normatif membahas kaidah, doktrin dan asas hukum yang secara luas terdapat dalam ilmu hukum. Penelitian empiris dilakukan penulis sebagai dukungan terhadap pendekatan undang-undang yang umumnya bersifat normatif. Sehingga penelitian tidak menampilkan hukum dalam bentuk yang statis dan kontekstual, melainkan menyajikan fakta sebenarnya dalam penerapan hukum yang faktual. Data primer diperoleh langsung oleh penulis dari tempat yang menjadi objek penelitian. Sedangkan data sekunder diperoleh penulis dari kajian kepustakaan, bahan hukum primer, sekunder dan tersier. Analisis data bersifat deskriptif dengan menerapkan metode kualitatif. Hasil penelitian menunjukan bahwa: Pertama, hakim harus keluar dari kekakuan hukum yang cenderung legisme, serta penafsiran gramatikal tanpa memahami rasa keadilan masyarakat luas. Kedua, harus dilakukan perubahan norma dalam undang-undang nomor 24 tahun 2003 tentang Mahkamah Konstitusi, terutama pasal 55 dan perubahan terhadap undang-undang pemilu yang mengatur pembatasan bagi mantan narapidana kejahatan luar biasa seperti: korupsi, narkotika, kekerasan terhadap anak. Kata Kunci: Kewenangan, Mahkamah Agung, Uji Materi Calon LegislatifABSTRACT The authority of the Supreme Court on the judicial review of the Election Commission Regulation number 20 of 2018 as stipulated in decision number 48 P / HUM / 2018 has given space for former corruptors (extraordinary criminals) to become candidates for legislative members. This research uses empirical normative legal research. Normative research discusses the rules, doctrines and principles of law that are widely contained in the science of law. The author's empirical research as support for the law approach is generally normative in nature. So that research does not display the law in a static and contextual form, but presents the actual facts in the application of factual law. Primary data obtained directly by the writer from the place that is the object of research. Whereas the secondary data were obtained by the writer from the literature study, primary, secondary and tertiary legal materials. Data analysis is descriptive by applying qualitative methods. The results showed that: First, judges must get out of the rigidity of the law that tends to legism, and grammatical interpretation without understanding the sense of justice of the wider community. Second, changes must be made to norms in law number 24 of 2003 concerning the Constitutional Court, especially article 55 and changes to the electoral law which regulates restrictions on ex-convicts of extraordinary crimes such as: corruption, narcotics, violence against children. Artikel ini mengkaji mengenai independensi kekuasaan kehakiman yang ditinjau dari Putusan Mahkamah Konstitusi. Independensi kekuasaan kehakiman merupakan keharusan dalam sebuah negara hukum (rechtstaat). Negara  hukum baik dalam konsep Rule of Law ataupun Rechtstaat, menempatkan peradilan yang bebas dan tidak  memihak  (independence and impartiality of judiciary) sebagai salah satu cirinya. Akan tetapi, kemerdekaan tersebut bukanlah tanpa batasan sehingga dapat diterjemahkan dengan seluas-luasnya. Sering kali dalam praktiknya independensi didalilkan untuk berlindung atas suatu perbuatan yang tidak dapat dipertanggungjawabkan. Oleh karenanya, perlu dilakukan penggalian makna independensi kekuasaan kehakiman sebagaimana amanat Pasal 24 ayat (1) Undang-Undang Dasar 1945. Pasal 24 ayat (1) Undang-Undang Dasar 1945 menyatakan bahwa “kekuasaan kehakiman merupakan kekuasaan yang merdeka untuk menyelenggarakan peradilan guna menegakkan hukum dan keadilan”. Oleh karenanya, pertimbangan dari Mahkamah Konstitusi terkait putusan-putusan yang menjadikan Pasal 24 ayat (1) Undang-Undang Dasar 1945 sebagai batu uji dalam pengujian undang-undang layak untuk dikaji dan diangkat menjadi tafsiran mengenai makna independensi kekuasaan kehakiman. Tulisan ini menggali pandangan hakim dalam putusan Mahkamah Konstitusi yang memuat pertimbangan mengenai independensi kekuasaan kehakiman. Penulisan menggunakan metode yuridis normatif melalui pendekatan konseptual (conceptual approach) dan pendekatan kasus (case approach). Tulisan ini menggunakan data sekunder dengan bahan hukum primernya adalah Putusan Mahkamah Konstitusi. Data dianalisis menggunakan metode kualitatif.This article examines the independence of judiciary by reviewing the Constitutional Court Decisions. Independence of judiciary is an absolute fact in a state of law (rechtstaat). A state of law, in the concept of Rule of Law or Rechtstaat, lists independence and impartiality of judiciary as one of its characteristics. However,  independence is not as free as everybody can freely interpret the law. Often, in practice, independence is postulated so as to provide protection from an act that cannot be accounted for. Therefore, it is necessary to delve into the meaning of judicial power independency as mandated by Article 24 paragraph (1) of the 1945 Constitution. Article 24 paragraph (1) of the 1945 Constitution states that “judicial power is an independent power to administer judicial proceedings to enforce the law and justice”. For that reason, it is reasonable that the Constitutional Court’s reasoning in relation to the decisions that render Article 24 paragraph (1) of the 1945 Constitution a touchstone in the judicial review of the laws be investigated and regarded as an interpretation of the meaning of judicial power independence. This paper studies the views of the judges in the Constitutional Court decisions that contain the court’s reasoning regarding the judicial power independence. This paper was written by employing a juridical-normative method through a conceptual approach and a case approach. This paper uses secondary data with the Constitutional Court Decisions as the primary legal materials. The data were analyzed using a qualitative method.

The research is concerning the implementation of verdict stating conditionally constitutional, conditionally unconstitutional and and the verdicts that contain new norm decided by Constitutional Court in the case of judicial review of laws againts the 1945 Constitutions of The Republic of Indonesia. This is a juridical-normative research using secondary data in the form of primary law materials, namely the court decisions which are issued throughout the year 2003 up to the year 2012 that have been collected in previous research. This research aims to know the choice of form of law taken by the addressee of the Constitutional Court verdict in following up the three variant of verdicts mentioned above. The research found that the choice of the form of law in implementing the three variants of Constitutional Court verdict is very diverse. Referring to the form and substance of the implementing rules and regulations of the three variants of verdict, there are still some incoherence with  the Constitutional Court verdict which is characterized by the presence of rejudicial review of norms that had been interpreted by the court. To address this problem,  the Constitutional Court must be provided with legal instruments, among other, judicial order that enable the Constitutional Court to order by force the addressee  to implement the Constitutional Court verdict. In addition, in order that to ensure the harmonization of legislation either vertically or horizontally as a result of the Constitutional Court verdict, then it is worth putting into consideration to expand the authority of the Constitutional Court to review all rules and legislation.

Abstract:The Constitutional Court's Decision is a product of the Judicial Review that was submitted to test the validity of the law against the Constitution of the Republic of Indonesia. In the implementation there are two models of the system of testing the law, namely centralized or decentralized system. Both have fundamental differences because the decentralized review system is not Erga Omnes, while the centralized system has the binding nature of Erga Omnes. The research method uses normative juridical methods, using secondary data obtained through literature study and analyzed qualitatively. The results and discussion of this research are that the Constitutional Court has provided much better direction for Indonesian legal politics, as seen from its objective decisions.Keywords: Erga Ormes, Constitutional Court, Statutory Regulations. Abstrak:Putusan Mahkamah Konstitusi merupakan produk dari Judicial Review yang diajukan untuk menguji keabsahan undang-undang terhadap Undang-Undang Dasar Negara Republik Indonesia. Dalam pelaksanaannya ada dua model sistem pengujian undang-undang yaitu centralized atau decentralized system. Keduanya memiliki perbedaan yang mendasar karena system desentralisasi review tidak bersifat Erga Omnes, sedang system centralized memiliki sifat mengikat Erga Omnes. Metode penelitian menggunakan metode yuridis normatif, dengan menggunakan data sekunder yang diperoleh melalui studi pustaka dan dianalisis secara kualitatif. Hasil dan diskusi dari penelitian ini adalah bahwa Mahkamah Konstitusi telah banyak memberikan arah politik hukum Indonesia yang lebih baik, terlihat dari putusan-putusannya yang bersifat objektif.Kata Kunci: Erga Ormes, Mahkamah Konstitusi, Peraturan Perundang-Undangan

The potential for environmental problems that can have a major impact on the preservation of nature and human health raises awareness of the need to regulate environmental issues with legal instruments. The mechanism for enforcing environmental crimes in Indonesia is contained in Law Number 32 of 2009 concerning Environmental Protection and Management and the Decision of the Constitutional Court Number 18/PUU-XII/2014 dated January 21, 2015, which is carried out in an integrated manner. Nevertheless, there are problems in implementation, namely due to the unclear model of the application in terms of coordination between lemabaga, resulting in law enforcement in an integrated manner less efficient and effective implementation of this research is library researchusing methods Juridical Empirical and manifold qualitative by examining various kinds of primary and secondary data and will describe how the implementation of integrated law enforcement in environmental crimes based on Law Number 32 of 2009 concerning Environmental Protection and Management and Constitutional Court Decision Number 18/PUU-XII/2014 Date January 21, 2015. Support for environmental criminal law enforcement contained in UUPPLH is the existence of environmental Civil Servant Investigators (PPNS) (Article 94) who have the authority to conduct investigations in cases of environmental pollution and or destruction. Therefore, to inhibit the rate of pollution and environmental destruction, in particular, it is necessary to enforce environmental laws in an integrated manner. Enforcement of environmental law is closely related to the ability of the apparatus and the compliance of citizens with laws and regulations. Seeing the courts decision in this study, it is suspected that environmental law enforcement officials have not made much progress and do not understand the environmental law enforcement system, which should be carried out in an integrated manner.

Constitutional Court is one of the conductors in Indonesia’s judicial power as regulated by Article 24 (2) and Article 24C (1) through (6) of the 1945 Constitution of the Republic of Indonesia, that adjudicates at the first and last levels whose decision is final including in the context of judicial review in the Constitutional Court. The provisions of H.I.R. and R.Bg. firmly reflect one of the principles in the civil procedural law, namely ultra petita, that represent judges prohibition from making decisions beyond what is requested. However, the practice in the Constitutional Court found several Constitutional Court Decisions classified as ultra petita decisions so that there is an academic step to justify the existence of Constitutional Court ruling that determine as ultra petita decisions. This study aims to find the justification of the Constitutional Court in deciding ultra petita through a philosophical, theoretical and legal dogmatic perspective. This study used a normative legal method with the conceptual approach, case studies approach, and legislation or statutory approach. This study shows that based on characteristics of cases under the authority of the Constitutional Court, it cannot be said that the prohibition of ultra petita can be applied to justice in the Constitutional Court, both from a philosophical, theoretical, and legal dogmatic based on several Constitutional Court Decision.
