Abstract The theory of social contract has played - and still plays - an important role in the central stage of political philosophy. The social contract answers the question of the origin of the society. The history of the theory originates in the ancient Greece political philosophy and extends to the recent years. However, the foundation of the theory resulted in the Renaissance period through the treatises of classical contractarians Hobbes, Locke and Rousseau. The manuscript describes the main arguments regarding the theory of social contract and suggests the main similarities and differences among them. Finally, the manuscript, according to the main description of the theories, suggests the main categorization of their results in legitimizing the political authority. In the final section, the article proposes the contribution of the theory of the social contract to the modern era and summarizes the positive aspects of its arguments to the legitimization of the political authority of modern states.

SOBERANIA E DEMOCRACIA EM TEMPOS MUNDIALIZADOS: ATUALIDADE DA FILOSOFIA POLÍTICA DE JEAN-JACQUES ROUSSEAU E OS LIMITES DO CONTRATO SOCIAL Resumo: este artigo visa a problematizar os (des)caminhos dos conceitos políticos e das práticas sociais e jurídicas em torno da soberania política do Estado Nacional e da democracia nos tempos de mundialização do Capital. Portanto, revisita e percorre uma breve arqueologia conceitual da Soberania, desde Isidoro de Sevilha até a clássica definição de Jean Bodin nos Seis Livros sobre a República (1576). O propósito é problematizar a filosofia política de Rousseau para, então, perceber e discutir seus limites suas virtualidades, bem como a atualidade de sua noção de Contrato Social e o papel da Filosofia Política na Era do Capital Global. Abstract: this paper casts doubt on the ways and shunts of political concepts and social and legal practices concerning political sovereignty of the Nation State and democracy at the time of Capital’s globalization. It revisits a brief conceptual archeology of Sovereignty, since Isidore of Seville to the classical definition by Jean Bodin in The Six Books on the Republic (1576). The purpose is casting doubt on the political philosophy of Rousseau, in order to discuss its limits and virtualities, and the topicality of his notion of social contract and the role of Political Philosophy at the Age of Global Capital. The Mir’at al-Ṭullāb written by al-Sinkīlī in the seventeenth century apparently did not mention the requirement of being male to become a head of state (sultan). This is interesting because the Shāfi‘ī school of fiqh which is used as a reference actually mentions this condition. Therefore, it is necessary to pay attention to the factors underlying it. Based on the literature studies and looking at the social history of the Acehnese people at that time, it can be found that the book was written when the Acehnese were polarized and there were conflicts between different religious and political groups. The conflict was very severe and was able to threaten the unity and power of the sultan at that time. The exclusion of being male as one of the requirements for public office (political authority or judge) is a manifestation of the application of Islamic jurisprudence by al-Sinkīlī which was introduced from the Qur’ān and the Sunnah so that it became legitimate (shar‘ī) while at the same time strengthening the position of the sultan, the idea of which was eventually able to reduce the political conflict in the community.

In this article the author problematizes Rousseau’s Discourse on Political Economy and his conception of government in the political community. Rousseau’s Discourse on Political Economy was chronologically written seven years before his major work The Social Contract or Principles of Political Right. Regardless of the fact that the Discourse on Political Economy was published earlier, it left a remarkable trace in Rousseau‘s philosophical opus. In this work, which was published as part of the fifth volume of Encyclopedia of the Enlightenment, Rousseau indicated his direction in political philosophy. This philosophical and political direction began with the Discourse on Political Economy and culminated in the philosophical and political conception of republicanism, elaborated in detail in The Social Contract. In this article the author uses critical analysis and reconstruction to establish Rousseau‘s fundamental ideas about his political philosophy present in the Discourse on Political Economy, with a focus on observing and studying the role of a sovereign and the public economy in the function of the government by general will within the political community.

A central problem of political philosophy is that of explaining how a state could have the moral authority to enforce laws, promulgate laws which citizens are thereby obliged to obey, give new duties to citizens and levy taxes. Many rival solutions to this problem of political authority have been offered by contemporary and recent philosophers but none has obtained wide acceptance. The current debate takes no cognisance of George Berkeley’s ‘Passive Obedience’, in which he defends the exceptionless duty of not using force to resist the state and offers a rule-consequentialist account of morality which indicates an explanation of political authority as grounded in the social connectedness of human beings. I expound, criticise and develop Berkeley’s explanation to provide a promising solution to the problem of political authority. The solution impugns the political authority of all existing states as well as the duty of passive obedience.

During the last twenty or twenty-five years medieval historians have been much interested in the composition of the English episcopate. A number of studies of it have been published on periods ranging from the eleventh to the fifteenth and early sixteenth centuries. A further paper might well seem superfluous. My reason for offering one is that most previous writers have concentrated on analysing the professional circles from which the bishops were drawn, and suggesting the influences which their early careers as royal clerks, university masters and students, secular or regular clergy, may have had on their later work as bishops. They have shown comparatively little interest in their social background and provenance, except for those bishops who belonged to magnate families. Some years ago, when working on the political activities of Edward II's bishops, it seemed to me that social origins, family connexions and provenance might in a number of cases have had at least as much influence on a bishop's attitude to politics as his early career. I there fore collected information about the origins and provenance of these bishops. I now think that a rather more careful and complete study of this subject might throw further light not only on the political history of the reign, but on other problems connected with the character and work of the English episcopate. There is a general impression that in England in the later middle ages the bishops' ties with their dioceses were becoming less close, and that they were normally spending less time in diocesan work than their predecessors in the thirteenth century.

This article offers a ‘post-heritage’ reading of both iterations of Upstairs Downstairs: the LondonWeekend Television (LWT) series (1971–5) and its shortlived BBC revival (2010–12). Identifying elements of subversion and subjectivity allows scholarship on the LWT series to be reassessed, recognising occasions where it challenges rather than supports the social structures of the depicted Edwardian past. The BBC series also incorporates the post-heritage element of self-consciousness, acknowledging the parallel between its narrative and the production’s attempts to recreate the success of its 1970s predecessor. The article’s first section assesses the critical history of the LWT series, identifying areas that are open to further study or revised readings. The second section analyses the serialised war narrative of the fourth series of LWT’s Upstairs, Downstairs (1974), revealing its exploration of female identity across multiple episodes and challenging the notion that the series became more male and upstairs dominated as it progressed. The third section considers the BBC series’ revised concept, identifying the shifts in its main characters’ positions in society that allow the series’ narrative to question the past it evokes. This will be briefly contrasted with the heritage stability of Downton Abbey (ITV, 2010–15). The final section considers the household of 165 Eaton Place’s function as a studio space, which the BBC series self-consciously adopts in order to evoke the aesthetics of prior period dramas. The article concludes by suggesting that the barriers to recreating the past established in the BBC series’ narrative also contributed to its failure to match the success of its earlier iteration.

This book develops a novel multilevel social contract theory that, in contrast to existing theories in the liberal tradition, does not merely assume a restricted form of reasonable moral pluralism, but is tailored to the conditions of deeply morally pluralistic societies that may be populated by liberal moral agents, nonliberal moral agents, and, according to the traditional understanding of morality, nonmoral agents alike. To develop this theory, the book draws on the history of the social contract tradition, especially the work of Hobbes, Hume, Kant, Rawls, and Gauthier, as well as on the work of some of the critics of this tradition, such as Sen and Gaus. The two-level contractarian theory holds that morality in its best contractarian version for the conditions of deeply morally pluralistic societies entails Humean, Hobbesian, and Kantian moral features. The theory defines the minimal behavioral restrictions that are necessary to ensure, compared to violent conflict resolution, mutually beneficial peaceful long-term cooperation in deeply morally pluralistic societies. The theory minimizes the problem of compliance by maximally respecting the interests of all members of society. Despite its ideal nature, the theory is, in principle, applicable to the real world and, for the conditions described, most promising for securing mutually beneficial peaceful long-term cooperation in a world in which a fully just society, due to moral diversity, is unattainable. If Rawls’ intention was to carry the traditional social contract argument to a higher level of abstraction, then the two-level contractarian theory brings it back down to earth.

AbstractThis article provides a comparative analysis of four large towns in the Southern Low Countries between c. 1350 and c. 1550. Combining the data on Ghent, Bruges and Antwerp – each of which is discussed in greater detail in the articles in this special section – with recent research on Bruges, the authors argue against the historiographical trend in which the political history of late medieval towns is supposedly dominated by a trend towards oligarchy. Rather than a closure of the ruling class, the four towns show a high turnover in the social composition of the political elite, and a consistent trend towards aristocracy, in which an increasingly large number of aldermen enjoyed noble status. The intensity of these trends differed from town to town, and was tied to different institutional configurations as well as different economic and political developments in each of the four towns.

TheSŭngjŏngwŏn ilgi (Daily Records of the Royal Secretariat)is one of the major chronicles of the events of the Chosŏn Dynasty (1392–1910). Although the records prior to the year 1622 are no longer extant, the remaining records from the years 1623 to 1910 meticulously recount the daily activities of the reigning Chosŏn kings, including copious information on their physical and mental status. Because the king’s health was considered as important as other official affairs in many respects, detailed records were kept of royal ailments and how court doctors treated them. This article surveys the state of Korean-language scholarship on the medical content of theDaily Recordsand presents selected translations to demonstrate how this valuable historical source can shed light on both the social history of Chosŏn medicine and the political importance of kingly health at the Chosŏn court.
