Resumen: Las ciudades como catalizadores de derechos humanos han asumido la tarea fundamental de proveer el bienestar esencial para los ciudadanos. La responsabilidad de garantizar el derecho a la ciudad se ha abordado sin tomar en cuenta las diferentes necesidades que cada grupo poblacional requiere, en específico se ha omitido la perspectiva de género como un elemento fundamental para las políticas públicas de las ciudades, haremos un breve recorrido por la forma tan distinta en que hombres y mujeres viven las ciudades, así como las grandes deudas que requiere asumir el derecho a la ciudad.Palabras clave: Derecho a la Ciudad, Perspectiva de Género, Empoderamiento, Mujer, Seguridad y Movilidad. Abstract: Cities as catalysts for human rights have assumed the fundamental task of providing essential well-being for citizens. The responsibility of guaranteeing the right to the city has been addressed without taking into account the different needs that each population group requires, specifically the gender perspective has been omitted as a fundamental element for the public policies of the cities, we will take a brief tour because of the very different way in which men and women live in cities, as well as the large debts required to assume the right to the city.Keywords: Right to the City, Gender Perspective, Empowerment, Women, Security and Mobility.

LABURPENA: Egonkortasuneko Mekanismo Europarrean (EME) baldintzapena nola aplikatzen den aztertuko dugu artikulu honetan, Europar Batasunaren esparruan aitortuta dauden oinarrizko eskubideen ikuspegitik. Horretarako, giza eskubideen alorrean nazioarteko hitzarmenak aplikatzearen alde egin duten jarrera doktrinalak hartu dira erreferentziatzat, Nazioarteko Diru Funtsak (NDF) eta nazioarteko beste finantza-erakunde batzuek garapen bidean diren herrialdeekiko operazioetan txertatu duten baldintzapenari muga jartzeko. Europar Batasunaren eremuan 2009-2010 urteetako zor publikoaren krisiari erantzuna emateko sortu diren organismoek eta, batez ere, EMEk (euro eremuan egonkortasuna ziurtatzeko organismoak,) ordea, egiturazko elementu gisa sartu dute baldintzapena haien operazioetan, NDFaren antzeko filosofia hartuta, hau da, zuhurtziaren bitartez lortu nahi dute hazkunde ekonomikoa, eta, horren ondorioz, oinarrizko eskubide batzuk ezin izan dira behar bezala gauzatu. Horrek mahai gainean jartzen du kontu bat, ea politika horiek bateragarri ote diren Europar Batasunaren helburu eta printzipioekin; hasiera batean «zuzenbidezko komunitatea» esamoldeaz definitu baitzuten EB, eta giza eskubideetan oinarrituta eraiki. Justizia Auzitegiak horri buruz idatzi zuen lehenengo epai —goiztiarrak— (Pringle epaiak), ordea, ez zuen zehaztu EMEren baldintzapenak Europar Batasunaren xede eta printzipioekin eta giza eskubideekiko errespetuarekin bat egiten ote duen. Hala ere, badirudi irizpide hori aldatzen ari dela, Ledra Advertising-en duela gutxi eman den epaiaren harira; izan ere, jabetzarako eskubideari dei egiteko atea ireki du, baldintzapena ezartzearen ondorioz eragindako kalteengatiko ordaina eskatzeari dagokionez. RESUMEN: El presente artículo analiza la aplicación de la condicionalidad en el Mecanismo Europeo de Estabilidad (MEDE) desde la perspectiva de los derechos fundamentales reconocidos en el ámbito de la Unión Europea. A tal efecto, se toman como referencia las posiciones doctrinales que han venido defendiendo la aplicación de los convenios internacionales en materia de derechos humanos como límite a la condicionalidad introducida por el FMI y otras instituciones financieras internacionales en sus operaciones con los países en desarrollo. Los organismos creados en el ámbito de la Unión Europea para dar respuesta a la crisis de la Deuda pública de 2009-10, y de modo singular el MEDE, organismo creado para garantizar la estabilidad de la zona euro, han introducido, sin embargo, la condicionalidad como un elemento estructural en sus operaciones, con una filosofía parecida a la del FMI, es decir, conseguir el crecimiento económico a partir de la austeridad, con lo que se ha visto perjudicado el ejercicio de diversos derechos fundamentales. Ello plantea la cuestión de la compatibilidad de tales políticas con los objetivos y principios de la Unión Europea, definida en su día como «Comunidad de Derecho» y fundada sobre los valores de los derechos humanos. La primera —y temprana— sentencia dictada al respecto por el Tribunal de Justicia (sentencia Pringle) dejó, sin embargo, en el aire la cuestión de la compatibilidad de la condicionalidad del MEDE con los objetivos y principios de la Unión Europea y el respeto de los derechos humanos. Parece, no obstante, que este criterio tiende a modificarse a partir del reciente fallo en Ledra Advertising, que ha abierto la puerta a invocar el derecho de propiedad para ser indemnizado por los daños causados por la aplicación de la condicionalidad. Con todo, será a partir de la transformación del MEDE en el Fondo Monetario Europeo, si éste se constituye como institución comunitaria, como puede hacerse efectiva la invocación de los derechos fundamentales para frenar o mitigar los efectos perjudiciales de la condicionalidad. Más aún, el control judicial de la condicionalidad en el FME podría servir como referente para otras instituciones financieras internacionales. ABSTRACT: This article analyses the application of conditionality within the European Stability Mechanism (ESM) from the perspective of the fundamental rights recognized within the EU. To this end, we take as a reference the doctrinal positions that have been defending the application of international conventions on human rights as a limit to the conditionality introduced by the IMF and another financial international institutions in their operations with developing countries. The public agencies created within the EU in order to meet the demands of the public debt crisis of 2009-10, and specifically the ESM, a body created to guarantee the Euro zone’s stability, have nonetheless introduced the conditionality as a structural element in their operations, with a philosophy comparable to that of the IMF, i.e. to achieve economic growth from austerity, thus impairing the exercise of several fundamental rights. That raises the question of compatibility of those policies with the objectives and principles of the EU, defined one day as a «community of law» and founded upon the values of fundamental rights. The first —and early— judgement delivered on this ground by the European Court of Justice (Pringle case) left nevertheless in the air the compatibility of the conditionality of ESM with the objectives and principles of the EU and with the respect to human rights. It seems however that this criteria tends to be modified by the recent judgment Ledra Advertising that opened the door to invoke the right to property in order to be compensated by damages caused as a consequence of conditionality. Even so, it will be after the transformation of the ESM into an European Monetary Fund, if this is constituted as a Community institution, that invoking fundamental rights shall be effective in order to stop or mitigate the adverse effects of conditionality. What is more, the judicial control over conditionality within the EMF might serve as a reference for other international financial institutions.

La alimentación adecuada constituye un derecho humano. Así lo han reconocido oficialmente la gran mayoría de los Tratados Internacionales sobre derechos humanos. Pero existe una gran diferencia entre que un Estado reconozca oficialmente la alimentación como un derecho fundamental en su constitución, o lo haga como un principio rector, puesto que ello dotará al derecho a la alimentación adecuada de una mayor protección, o lo convertirá en un principio de actuación de los poderes públicos. Se puede exigir a los gobiernos garantizar el ejercicio efectivo del derecho a la alimentación de conformidad con las disposiciones constitucionales para otros derechos humanos. Pero, la capacidad de la invocación indirecta de otros derechos humanos para lograr la protección efectiva del derecho a la alimentación en el plano nacional dependerá, en definitiva, de la interpretación jurídica que se haga de la Constitución.Adequate food is a human right. Thus the vast majority of treaties have officially recognized it human rights. But there is a big difference between that a State officially recognizes food as a fundamental right in the Constitution, or do it as a guiding principle, since this will provide the right to adequate food of greater protection, or the It will become a principle of action of the public authorities. You may require Governments to ensuring the effective exercise of the right to food in accordance with the constitutional provisions for other human rights. But the indirect invocation of other human rights capacity to achieve effective protection of the right to food at the national level will depend, ultimately, of the legal interpretation that is made of the Constitution.

Resumo Este artigo propõe uma análise dos aspectos políticos e jurídicos do Direito à Cidade sob a perspectiva do conceito de esfera pública. O Direito à Cidade é interpretado como um elo dinâmico entre a mobilização política, a democratização das relações sociais e do aparato institucional do Estado e a garantia de melhores condições materiais de existência no espaço urbano. A partir da revisão bibliográfica sobre o tema das lutas sociais urbanas no Brasil e na cidade de São Paulo, pretende-se demonstrar que o Direito à Cidade é exercido pela população a partir dos embates na esfera pública responsáveis por impulsionar a renovação da ordem jurídica e atribuir novos sentidos ao Direito existente.

This paper considers, following David Harvey (1973), how to produce a genuinely humanizing smart urbanism. It does so through utilising a future-orientated lens to sketch out the kinds of work required to reimagine, reframe and remake smart cities. I argue that, on the one hand, there is a need to produce an alternative ‘future present’ that shifts the anticipatory logics of smart cities to that of addressing persistent inequalities, prejudice, and discrimination, and is rooted in notions of fairness, equity, ethics and democracy. On the other hand, there is a need to disrupt the ‘present future’ of neoliberal smart urbanism, moving beyond minimal politics to enact sustained strategic, public-led interventions designed to create more-inclusive smart city initiatives. Both tactics require producing a deeply normative vision for smart cities that is rooted in ideas of citizenship, social justice, the public good, and the right to the city that needs to be developed in conjunction with citizens.

This paper explores the implications of state land tenure modernization and urbanization-promotion initiatives for human rights in Cameroon. The aim is to promote understanding of the implications of these initiatives for the right-to-the-city of indigenous urban residents. It is argued that the implications are more severe in politico-administrative headquarters than elsewhere in the country. Three different cities have served, at some point, as national politico-administrative headquarters in Cameroon, the study’s empirical referent. The designation of any city as a politico-administrative headquarters invariably creates a land scarcity problem in that city. The problem is aggravated for the city’s indigenous population by colonial and post-colonial planning policies. For this reason, the policies are said to be in violation of basic human rights as stipulated by the UN Declaration of Universal Human Rights as well as the African Charter.

While artistic interventions in urban space multiply continuously, there seems to be a lack of knowledge about what is really happening in and with public spaces in such processes. David Harvey’s proposition that “the right to the city” means the “right to change ourselves” begs the question: Who is producing the city, and in turn, what new ways of living together are they producing? Artistic productions in urban environments produce new modes of engaging with public spaces and initiate a process in which a city’s inhabitants and users make and remake the public sphere.

Religius teachings that are considered to have long oppressed womenthe teachings that have been domination by men have been used as a justification for community perception that are very detrimental to women.however,this criticism of gender inequality in discusseions with human rights does not only return to the misperception of the people.feminists also maintain a great deal about the concept of humen rights it self.fundamental criticism by questioning the return of international law to its maker. The qur’an has the principle that men and women are the same as servants, because men and women are created from the same subtance (kholifatullah fiilardh),and the same obligations ( liya’budun) however,in the matter of reconciliation,the ulama’ agree that reconciliation is an absolute right of the husband. In the gender perspective if you see some possible understanding that women can submit referals as their right to their husband by conducting a new analysis of  the issue of referral rights’ which so far has been suggested to be dominated by men ( husband) by redeeming the rights of husband who was given to him. And with the khulu’ also the wife also has the right to the right of reconciliation to the husband who has dropped divorce on him.
