WAYS TO INCREASE THE EFFICIENCY OF PUBLIC ADMINISTRATION IN THE FIELD OF PROCUREMENT

The article analyzes ways to increase the efficiency of public administration in the field of procurement. The legal and regulatory conditions that affect the ability of the private sector to interact with the public sector in order to make a profit are described. The analysis of these conditions focuses on two key aspects: the procurement process, starting from the stage of formation of demand for goods, work, services and ending with the implementation of the state contract, and the mechanism for reviewing complaints in the system. The following indicators of system efficiency were used as indicators for these processes: needs assessment, invitation to participate in procurement; submission of applications; consideration, evaluation of applications, conclusion of a contract; content and management of the contract; warranty obligations; payment obligations; complaints submitted to the bodies of first instance; complaints filed with the bodies of second instance. It should be noted that this list of basic data is not exhaustive, but most significantly affects the final effect of the implementation of norms and rules of procurement in the country. Based on the results of the analysis of the World Bank research, recommendations have been developed for improving the organizational and administrative methods of managing the system of goods, works and services procurement. It is proved that the assessment of the economic efficiency of placing an order can be carried out in comparison with: the maximum possible indicators within the procedure completed by the time of analysis; with generalized results of the initial level using the same procedures; with positions planned by the customer, taking into account one or more indicators. The opinion on the need to analyze all the processes taking place in the public procurement system: from procurement planning to monitoring the progress of the contract. In addition, it is emphasized that when assessing the effectiveness of procurement, it is necessary to take into account not only the economic efficiency and effectiveness of the procedure, but also social efficiency, as one of the objectives of procurement is to meet customer needs.

Taking into account the very large sums being spent through the Romanian public procurement system (approximately 8% of the GDP), analysing the award criteria used in the procurement procedures is an important element that influences the achievement of the economic and social efficiency of procurement. The article describes the criteria for public procurement award in Romania, focusing on the most used criterion, namely the lowest price. It also presents the advantages and disadvantages of using this criterion, statistical situations at national and European level, the difficulties encountered in using this criterion by contracting authorities and the vulnerabilities of tenderers participating in the procurement procedures which use for the award the criterion under consideration.

A proper estimation of the value of the public contracts is of major importance of the contracting authority. First, value of contracts govers the regime of rules under which the proceedings will be conducted. Second the decision of the contracting authority concerning the application of specific procurement procedure depends whether the value of contract is below or above specific threshold. For multi year contracts or contracts with renewal option, the contracting Authority must provide clauses for the revision of prices in accordance with published official inflation. In case of goods the contracts through renting or leasing of these, the estimated value of the public contract shall be based on the monthly rent or fee multiplied by the number of months the contract will last. The contracting Authority is responsible for comparing the above mentioned elements with a cost analyses of the goods, services or works. European Union rules provided in Article 9 of the directive 2004/18/EC of the European Parliament and of the council of 31 March 2004 on the coordination of procedures for the award of public works, supply and services and in contain also more detailed rules concerning methods of estimation of contract value which should be applied in specific case. The priciple of the transparency of public procurement requires that all potential contractors have the same chances to compete for contracts being offeres by public administration. <p align="justify">Entre las reformas introducidas por la Ley estatal 34/2010 en el sistema de contratación pública figura la creación del Tribunal Administrativo Central de Recursos Contractuales, así como el mandato a las comunidades autónomas para el establecimiento de órganos análogos en distintos ámbitos dentro de su territorio. En su cumplimiento, la Comunidad Autónoma de Cataluña ha creado, mediante sendas leyes, el Tribunal de Recursos Contractuales del Parlamento de Cataluña y el Órgano Administrativo de Recursos Contractuales de Cataluña. Se trata de órganos especializados en materia de revisión de procedimientos de contratación, configurados con plena independencia funcional en el ejercicio de sus funciones, que son, principalmente, la resolución de los recursos especiales en materia de contratación y las cuestiones de nulidad correspondientes. La configuración de órganos administrativos independientes como esos supone un avance en el reforzamiento y protección del derecho a una buena administración.</p> <p align="justify"><b>The reforms introduced in the public procurement system under State Law 34/2010 include the creation of the Public Procurement Review Central Administrative Court, and the requirement imposed on the autonomous regions to establish similar authorities for different areas in their territory. In compliance with this requirement, the Autonomous Region of Catalonia has created, under the respective laws, the Public Procurement Review Court of the Parliament of Catalonia and the Public Procurement Review Administrative Authority of Catalonia. These bodies are specialised in reviewing public procurement procedures and are set up to carry out their functions with full independence. Their main functions are the settlement of special public procurement reviews and the respective issues of nullity. The creation of these independent administrative authorities is another step towards strengthening and protecting the right to a good public administration.</p>

The most important measures stimulating the increase of efficiency and effectiveness of budget expenditures on road construction are the improvement of pricing mechanisms and increasing efficiency of the procedures of government purchases of goods, works and services. The paper includes the analysis of main problems that arise in the process of government purchases and construction pricing with the reference to budget expenditure on road construction. It includes the review and analysis of international experience and possible measures of increasing the efficiency and effectiveness of government purchases and (road) construction pricing in Russia.

Subject. The article deals with the analysis of suppliers in the public procurement system based on reasonable prequalification parameters. Objectives. The aim is to test the hypothesis about strong reputation characteristics of the winners in the public procurement system and develop a methodology for assessing the reputation of suppliers for prequalification purposes. Methods. We employ general scientific principles and methods of research, like abstraction, generalization of approaches used by domestic and foreign authors for prequalification and assessment of reputation of public procurement participants. Results. To test the hypothesis, we calculated four groups of indicators on corporate, financial, market, and social components of reputation. The methodology was tested on the data obtained from SPARK-Interfax and SPARK-Marketing information resources. Conclusions. The study revealed that not all reputational characteristics of public procurement winners can be regarded as high level. In terms of the corporate component, it is the low level of share capital, indicating the mistrust on the part of owners and their reluctance to invest in the business, and the low percentage of non-current assets. In terms of the market component, it is a low sales growth rate, as well as low return on sales. As to the financial component, it is a low capitalization of winners, low share of long-term debt capital and low credit limit. With respect to the social component, it is a below-average tax burden.

The relevance of this research topic lies in the fact that public procurement requires in-depth consideration and comprehensive analysis, including the scientific and methodological level of analysis. The use of special legal documents in public procurement and the specific procedure for the execution of these documents is not a factor in the full understanding of this direction, including the economic assessment of the entire process. An economic and statistical approach using system analysis is required, which was used by the authors of the scientific article as the proposed research methodology. One of the main parts of the progressive process of commodity exchange in the economies of the analyzed countries is the mechanism for building public procurement. Currently, the problem of material and technical support of public needs in developed countries is solved as a result of logistics processes in the system of public procurement through the acquisition and supply of goods, works, and services, tangible and intangible resources. The article submits a review of foreign experience in building a public procurement system with special features characteristic of this region of the world, presented as an object of research. Country aspects in the object under study and allowed the authors to formulate the relevant main results and conclusions concerning various parties in the public procurement system, which determined the further strategy to improve the procurement system of the government and international integration union. Saudi Arabia has had many issues in delivering mega construction projects, such as delays, high costs, and low customer satisfaction. Some studies show that around 70% of public projects in Saudi Arabia are delayed. One factor that might be causing these performance issues is the traditional low bid contracting system in Saudi Arabia, or the Saudi procurement system. In Saudi Arabia, owners select contractors based only upon the lowest price. This paper researched ways to modify the current Saudi procurement system and show quick and simple modifications that can be done to improve the low performance. This research proposes that by adding the clarification phase from the Performance Information Procurement System (PIPS) to the Saudi traditional procurement process could greatly improve construction performance. The clarification phase requires the selected contractor to submit a project scope, detailed and milestone schedule, potential risks that they do not control, and performance measurement before a contract is awarded. The PIPS system is one of the most successful systems around the world, which shows success rate of 98% in six different countries with risk and cost reduction up to 30%. The clarification phase has been identified as the most important step in the PIPS to ensuring a successful project. This paper conducted a survey among construction professionals in Saudi Arabia, including 157 engineers, 33 consultants 9 owners, 5 vendors, 13 academics, and 28 architects, in order to develop the public procurement system in Saudi Arabia. The participants work in government sectors with an interest in the Saudi Arabian procurement system. The survey confirmed that professionals in the Saudi construction industry believe that the procurement system should be changed and that the inclusion of the clarification phase to the procurement system is a way to improve the procurement system.

E-government services have become a vital tool to provide citizens with more accessible, accurate and high-quality services and information. E-government system provides an efficient dissemination of information to people and eases people to communicate directly with government services. The utilization of ICT through e-government enhancing efficiency and effectiveness of service delivery in the public sector. The system is regarded as one of the vital elements to be a developed country. The application of e-government indicates the readiness and ability of the nation utilizing technology within public administration periscope. Although the Malaysian government has introduced e-government for many years, its acceptance still not very high. Therefore, this paper studies the key factors of Malaysian citizens’ in Sintok, Kedah, a semi- rural area on approval on e-government services based on the Unified Theory of Acceptance and the Use of Technology (UTAUT Model). The survey data was collected from 83% respondents to measure people understanding and awareness toward e-government system. The results show that there is an excellent understanding among Malaysian towards e-government system.
