The article analyzes ways to increase the efficiency of public administration in the field of procurement. The legal and regulatory conditions that affect the ability of the private sector to interact with the public sector in order to make a profit are described. The analysis of these conditions focuses on two key aspects: the procurement process, starting from the stage of formation of demand for goods, work, services and ending with the implementation of the state contract, and the mechanism for reviewing complaints in the system. The following indicators of system efficiency were used as indicators for these processes: needs assessment, invitation to participate in procurement; submission of applications; consideration, evaluation of applications, conclusion of a contract; content and management of the contract; warranty obligations; payment obligations; complaints submitted to the bodies of first instance; complaints filed with the bodies of second instance. It should be noted that this list of basic data is not exhaustive, but most significantly affects the final effect of the implementation of norms and rules of procurement in the country. Based on the results of the analysis of the World Bank research, recommendations have been developed for improving the organizational and administrative methods of managing the system of goods, works and services procurement. It is proved that the assessment of the economic efficiency of placing an order can be carried out in comparison with: the maximum possible indicators within the procedure completed by the time of analysis; with generalized results of the initial level using the same procedures; with positions planned by the customer, taking into account one or more indicators. The opinion on the need to analyze all the processes taking place in the public procurement system: from procurement planning to monitoring the progress of the contract. In addition, it is emphasized that when assessing the effectiveness of procurement, it is necessary to take into account not only the economic efficiency and effectiveness of the procedure, but also social efficiency, as one of the objectives of procurement is to meet customer needs.

The construction industry faces a lack of compliance with policy that in Uganda public road construction projects affects the attainment of Government goals and disrupts infrastructure project delivery. For decades, public entities have been known for a lack of compliance that manifest in: poor performance, poor personnel management, poor resource utilization and unprofessionalism. In Uganda, this has resulted in several restructures aimed at improving service delivery. Despite this, compliance remains an issue. The purpose of this study is to establish factors affecting compliance within a public procurement regulatory framework in public road construction projects and foster economic development. A cross-sectional research design including a structured self-administered questionnaire survey and PLS-SEM data analysis by SmartPLS3 was conducted. The research reveals that three factors positively affect compliance with a regulatory framework that govern public road construction projects; sanctions on staff, inefficiency of the public procurement regulatory framework and contractors’ resistance to non-compliance. While a further three factors have little positive effect on compliance; familiarity, monitoring activities and professionalism. Hence, the research contributes to construction management by showing that sanctions, perceived inefficiency and contractors’ resistance significantly enhance compliance within a public procurement regulatory framework.

Public procurement, the government’s purchase of goods and services, is an important tool to advance sustainability objectives. Since government is the largest consumer in the economy, it can have a sizable impact on the market by purchasing sustainably. However, its sustainability impact (both environmental and social) is undermined because the public procurement’s size is underestimated. Previous estimates of public procurement only consider contract-based purchases or non-defense purchases. In other instances, data are too limited to estimate government purchases appropriately. These factors lead to underestimations of the extent to which government purchasing can be leveraged to advance sustainability objectives. To understand the true impact of government purchases, we estimated the size of public procurement by considering all aspects of public procurement. We used this estimation to assess whether current measurement processes misrepresent the size of public procurement and identify key elements that may be missing from the current public procurement measures. We applied our estimate to four OECD countries, the U.S., the U.K., Italy, and the Netherlands for two years (2017 and 2018). Our results showed that that across all levels of government, public procurement as a percentage of GDP in the U.S., the U.K., Italy, and the Netherlands ranged between 19–24%, 13–56%, 3–10%, and 12–38%, respectively. Our findings revealed that governments have substantially greater market power than previously estimated, which can be leveraged to pursue sustainability goals. Our findings also illustrate systemic data challenges to how public procurement data are collected and analyzed.

MUNICIPAL ENTITIES IN PUBLIC PROCUREMENT LAWIn the implementation of public tasks in the form of commissioning construction works, services, deliveries by way of a paid contract, municipal entities act as awarding entities — entities awarding a public contract. Municipal entities may also act as economic operators — entities applying for the implementation of the contract in question. In both situations they are subject to the public procurement law regime.

The COVID-19 epidemic does not stop investment processes. Moreover, the stimulation of the economy will consist, inter alia, in the strong stimulation of the public investment sector. Therefore, entrepreneurs who currently meet the challenges will not cease to fulfill their obligations and will meet the contractual conditions have a chance to implement further contracts - otherwise, they risk being excluded from future proceedings.

AbstractParticular diligence in the preparation of documentation and conducting a tender procedure for construction works must be made by public contracting entities, who are subject to additional restrictions. In Poland, the largest public contracting entities are the sectoral ones. These are the entities (defined in Art. 3 of the Public Procurement Law Act) operating in the sectors of water management, energy, transport and postal services. The paper presents the analysis of tender offers for the execution of construction works or design and execution of construction works related to the reconstruction, construction and revitalization of railway lines, announced after the amendment to the Public Procurement Law on June 22, 2016. The considered examples are selected tender procedures covering the scope of construction and assembly works on railway lines throughout the country. The authors paid particular attention to the tender criteria applied and the requirements for the potential contractors for works in the field of railway infrastructure

To achieve this goal, three tasks have been performed: 1) Preventive and corrective mechanisms for protection of public expenditures are presented; 2) The organization of the control mechanisms regarding the public procurements and the imposition of financial corrections in Bulgaria is revealed and 3) the contribution of two international organizations to the topic is outlined - the Organization for Economic Cooperation and Development and the World Bank. The research methods used are historical-logical analysis and content analysis. The result of the research is a critical analysis and summary, which complement the Bulgarian analytical literature in the field.
