The purpose of this journal is to find out about the problem of the legal position of interfaith marriage which shows that interfaith marriage is prohibited or normatively not regulated and is not recognized by the state and cannot be registered based on positive law. Research method uses a normative juridical approach, secondary data types, data collection methods that are carried out by literature, and the internet. While the data analysis method was analyzed descriptively qualitatively. The research results obtained indicate that the legal provisions of marriage, either express or implicitly, do not regulate the granting of marriage between followers of different religions. This is because marriage is prohibited between two people who have a relationship which by their religion or other regulations prohibited from marriage does not mean that the provisions in Islam prohibit interfaith marriage, so interfaith marriage is prohibited so that marriages that are carried out under religious law are not legitimate.

AbstractThe purpose of this study is to discuss customary law in the Mirah and Golan areas precisely in Ponorogo district which has its own uniqueness, namely the existence of a marriage ban between the two regions. This ban by some people has become polemic as the times have begun to fade to recognize the existence of customary law. However, this customary rule is still recognized by both the Mirah and Golan communities. Therefore, legal analysis is needed, which is to compare traditional law with existing national law so that there is no gap between customary law and national law. This study has many differences with previous studies related to the prohibition of marriage. The prohibition of customary marriages in this study involved both the Mirah and Golan areas which became customary law that is believed up to now by indigenous peoples. This study uses empirical legal research that is studying and examining social phenomena in society related to marriage and then analyzed juridically. In the discussion it was stated that the customary law regarding the prohibition of marriage of the Mirah and Golan communities is a traditional tradition that has been traditionally implemented by the two regions to date. The development of an increasingly modern era becomes a polemic in addressing these problems. The data that was examined empirically was believed by the community as customary law, namely the Mirah and Golan communities were prohibited from conducting marriages. If this is violated, it will lead to negative sanctions in the form of mystical events that cannot be accepted by reason. The prohibition of marriage between the people in the two regions of Mirah and Golan has indeed taken place since their ancestors in the form of the words of Ki Hanggolono, which has become customary law adopted until now. The relevance of positive law to customary law is very close and complementary to each other, so that the legal position has the same recognition in indigenous communities as long as there is no legal gap.Keywords: custom; law; marriage   AbstrakTujuan penelitian ini adalah membahas tentang hukum adat di wilayah Mirah dan Golan tepatnya di kabupaten Ponorogo yang memiliki keunikan tersendiri yaitu adanya larangan perkawinan antara kedua wilayah tersebut. Larangan ini oleh sebagian masyarakat menjadi polemik seiring perkembangan jaman yang sudah mulai pudar untuk mengakui keberadaan hukum adat. Akan tetapi, aturan adat ini tetap diakui oleh kedua masyarakat Mirah dan Golan. Oleh sebab itu, dibutuhkan analisis hukum yaitu membandingkan antara hukum adat dengan hukum nasional yang telah ada sehingga hukum adat dan hukum nasional tidak ada kesenjangan. Penelitian ini banyak memiliki perbedaan dengan penelitian terdahulu terkait larangan perkawinan. Larangan perkawinan adat dalam penelitian ini melibatkan kedua wilayah Mirah dan Golan yang menjadi hukum adat yang diyakini sampai sekarang oleh masyarakat adat. Penelitian ini menggunakan penelitian hukum empiris yaitu mengkaji dan meneliti gejala sosial di dalam masyarakat terkait dengan perkawinan kemudian dianalisa secara yuridis. Pada pembahasan dikemukakan bahwa hukum adat tentang larangan perkawinan masyarakat Mirah dan Golan merupakan tradisi adat yang secara turun temurun dilaksanakan oleh kedua wilayah tersebut sampai saat ini. Perkembangan jaman yang semakin modern menjadi polemik dalam menyikapi permasalahan tersebut. Data yang dikaji secara empiris diyakini oleh masyarakat sebagai hukum adat yaitu masyarakat Mirah dan Golan dilarang melangsungkan perkawinan. Jika hal ini dilanggar, maka akan menimbulkan sanksi yang negatif berupa kejadian mistis yang tidak dapat diterima oleh akal. Larangan perkawinan antara masyarakat di kedua wilayah Mirah dan Golan memang sudah terjadi sejak nenek moyang mereka yang berupa Sabda Ki Hanggolono yang telah menjadi hukum adat yang diaptuhi hingga sekarang. Relevansi hukum positif dengan hukum adat sangat erat dan saling melengkapi satu sama lain, sehingga kedudukan hukum memiliki pengakuan yang sama di dalam masyarakat adat selama tidak terjadi kesenjangan hukum.Kata kunci: adat; hukum; perkawinan

The problems examined in this study is wast are interfaith marriages in accordance with the philosophical values of Indonesian marriage law? and why is the validity of interfaith marriages still being disputed in Indonesian marriage law? Related to the principle of continuing legal conditions and public order, the implementation of registration marriage by registration is a form of acceptance of interfaith marriages and the community has accepted the phenomenon of interfaith marriages as a natural reality and is considered to be true. This research is normative legal research and quantitative sociological legal research. The study methodology is analyzed based on the principle of public order, law smuggling, and continuation of the legal situation or rights that have been obtained. From this research, it was concluded that interfaith marriages were considered incompatible with the philosophical values of Indonesian Marriage law which were based on religious law, and could injure the long struggle history of Indonesian marriage law legislation under the principle of public order. Therefore, the registrations carried out by the civil registry office are not authoritative, but merely administrative.

bstract: This study discusses legal analysis both from the perspective of Islamic law and positive law related to the law of attending walimatul ursy during the COVID-19 pandemic, this research will focus on the law of attending a wedding during the pandemic. The method used is literature study with a normative-comparative analysis approach, data analysis used is from qualitative data to secondary data. The results of the study found that the law of attending walimatul ursy during a pandemic, both Islamic and positive, is not mandatory, but permissible if those invited are in good health and are ready to carry out health protocols that have been set by the government, but if those invited are not healthy or confirmed. Corona virus, attendance is haram because it will cause greater fade if the person concerned is present.Abstrak: Penelitian ini membahas tentang analisis hukum baik dilihat dari segi hukum islam maupun hukum positif terkait dengan hukum menghadiri walimatul ursy saat pandemic covid 19, penelitian ini akan focus pada hukum menghadiri pesta pernikahan saat pandemic. Metode yang digunakan adalah studi pustaka dengan pendekatan analisis normatif-komparatif, analisis data yang digunakan adalah mulai dari data kualitatif sampai dengan data skunder. Hasil penelitian menemukan bahwa hukum menghadiri walimatul ursy saat pandemic baik secara hukum islam maupun positif tidak menjadi wajib melainkan di perbolehkan jika yang diundang dalam keadaan sehat serta siap melakukan protocol kesehatan yang sudah di tetapkan oleh pemerintah, namun apabila yang diundang dalam keadaan tidak sehat atau terkonfirmasi virus corona maka menghadirinya menjadi haram karena akan menimbulkan kemudaratan yang lebih besar jika yang bersangkutan hadir.

Fatwas in Malaysia seems to be existing without legal power and value since they are not mentioned literally in the Federal Constitution. Accordingly, there has been a perception of fatwa institutions issuing fatwas without legal authority to bind Muslims to certain legal decisions and views. Hence, this study is to clarify that fatwas are valid and recognized as part of the legal reference in Malaysia. More importantly, this paper refutes the claim that fatwa is unconstitutional in terms of its legal position. Additionally, this study intends to clarify that the philosophy of federalism practiced in Malaysia is solid evidence that fatwas are indeed an authoritative source of law in Malaysia. This study is conducted qualitatively using document analysis instruments with reference to the Federal Constitution and legal provisions practiced in Malaysia. Investigation of this study found that fatwa and its institutions in the country are valid according to Malaysian law. However, they are not mentioned literally in the Constitution, particularly fatwa authority that involves state jurisdiction in Islamic affairs. Moreover, this paper is highly significant to highlight the validity of fatwa from the Constitution perspective and further support the authority and credibility of its institutions according to Malaysian law.

This study aims to determine the consumer protection system containing legal certainty and transparency of information and access to information. This study is normative, a study that examines the legal provisions of positive law and legal principles. The data used are secondary data, data obtained through library research and research tools for obtaining secondary data obtained through the study of documents. The results show that the picture is not clear that information obtained by the public in the case of infant formula reflects that the system of consumer protection provisions contained in the Consumer Protection Act can’t be realized the government and the level of knowledge/education is uneven between urban communities and suburban/rural . As such, it needs continuous efforts in fostering a critical attitude to the public on the quality of food products so as to encourage the creation of an attitude of prudence consuming public in terms of food products, and the Government should have good communication skills with the public as consumers.

Future Package (FP) financing is one of the products of Bank Tabungan Pensiunan Nasional Syariah (BTPNS). This FP program is aimed specifically at women who want to develop or who want to start a business. Based on observations in the field, after the financing has been provided to customers, there are several customers who have arrears in installments. Thus, it raises discrepancies such as what is regulated in the fatwa of the National Sharia Council (DSN) No. 04/DSN-MUI/IV/2000 concerning Murabahah Contract Financing that the customer must pay the price of the goods agreed upon at a certain agreed period of time. The formulation of the research problems includes: (1) what are the criteria for FP financing for pre-prosperous families? (2) how is FP financing viewed from Islamic law? (3) what are the problems with the FP program? and (4) how does the bank cope with it? This research applies an empirical juridical problem approach in which the source of data is obtained by looking at the legal provisions that are connected with facts in the field. The data types consist of primary data from the field and secondary data from books and literature. Problems with non-current installment payments by some customers started with declining business incomes. Thus, banks must make regular collection efforts and the active role of groups. The suggestion from this research is that customers need to increase their sense of responsibility to pay installments on time.

<h1 align="center">ABSTRAK</h1><p>Pada lembaga perkawinan masyarakat dikenal adanya pencampuran harta perkawinan, sehingga tidak menutup kemungkinan adanya percampuran harta bersama dan harta bawaan. Dalam hukum positif hanya mengatur mengenai harta bawaan dan harta bersama secara terpisah, tetapi tidak diatur mengenai percampuran harta bersama dan harta bawaan. Permasalahan yang dibahas dalam penelitian ini adalah ketentuan hukum mengenai percampuran harta bersama dan harta bawaan dalam perkawinan menurut UU Nomor 1 Tahun 1974 dan Kompilasi Hukum Islam (KHI) dan implementasinya dalam perkawinan setelah adanya perceraian pada putusan Pengadilan Agama Nomor : 0189/Pdt.G/2017/ PA.Smg.</p><p>Untuk melakukan penelitian menggunakan metode pendekatan yuridis normatif, sehingga data yang digunakan data sekunder. Adapun teknik pengumpulan data dilakukan melalui studi kepustakaan sedangkan teknik analisis data menggunakan analisis kualitatif.</p><p>Hasil penelitian menunjukkan bahwa ketentuan hukum mengenai percampuran harta bersama dan harta bawaan dalam perkawinan diatur dalam Pasal 35 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Pasal 1 huruf f KHI yang pada intinya menyatakan bahwa bahwa harta benda yang diperoleh selama perkawinan menjadi harta bersama tanpa mempersoalkan terdaftar atas nama siapapun, meskipun di dalamnya terdapat harta bawaan. Implementasi percampuran harta bersama dan harta bawaan dalam perkawinan setelah adanya perceraian pada putusan Pengadilan Agama Nomor : 0189/Pdt.G/2017/PA.Smg adalah dalam hal pembagian harta bersama pihak istri mendapatkan bagian lebih besar dari pihak suami yaitu ¾ bagian sedangkan suami ¼ bagian. Hal tersebut mencerminkan keadilan distributif dimana  hakim  memberikan jatah kepada setiap orang berdasarkan jasanya atau memberikan kepada setiap orang apa yang menjadi haknya berdasarkan kepada azas keseimbangan atau memberikan hak kepada setiap orang berdasarkan prestasinya atau memberikan penghargaan kepada pihak yang berprestasi atau melindungi pihak yang berprestasi (pihak yang kuat).</p><p> </p><p align="center"><strong><em>ABSTRACT</em></strong></p><p><em>In marriage institution, the society knows a mixing of marital property, there is possibility of mixing of marital and individual property. Positive law only regulates the possessions and joint property separately, but it is not regulated about the mixing of marital and individual property. The problem discussed in this research is legal provisions concerning the mixing of marital and individual property in marriage according to Law Number 1 Year 1974 and Compilation of Islamic Law (KHI) and its implementation in marriage after the divorce on Religious Court decision Number: 0189/Pdt.G/2017/PA.Smg.</em></p><p><em>This research used normative juridical approach method, data used were secondary data. The technique of data collection was done through literature study while the data analysis technique was done by using qualitative analysis.</em></p><p><em>The results showed that the legal provisions concerning the mixing of marital and individual property in marriage are regulated in Article 35 of Law Number 1 Year 1974 concerning Marriage and Article 1 letter f KHI which in essence states that the property acquired during marriage becomes joint property without the questioning the name of being registered on behalf of, even if there is individual property. The implementation of mixing of marital and individual property in marriage after divorce on Religious Court's decision Number: 0189/Pdt.G/2017/PA.Smg is in the case of division of property together the wife gets bigger part than the husband that is ¾ whereas husband is only ¼. It reflects distributive justice in which the judge gives each person a share according to his or her services, or gives each person her/his rights are based on the principle of equilibrium or entitles each person on the basis of his/her performance or rewards the achievers or protect the achiever (the strong party).</em></p>

Law of inheritance in Indonesia up to now in a plurality, consisting of Islamic inheritance law, western inheritance law in the Civil Code and customary inheritance law. The plurality will have implications for various things. Religious differences are seen to be a factor preventing a child from obtaining inheritance rights from parents. In Islamic law, children from different religions and their parents will prevent from receiving inheritance, not in line with civil law that one barrier to receiving inheritance is religious different. This study analyzing the legal implications of the implementation of interfaith marriage for the heirs and how the legal protection of the rights of heirs born from interfaith marriages. The research methodology that the uses is normative by conducting analysis. The settlement of the issue children born from different religions of each party is subject to different laws based on religious law or customary law. There are similarities and differences in the implications of the provisions of Article 832 of the Civil Code and Article 171 of the Compilation of Islamic Law. However, protection for children born of different religions can obtain asset from their parents through grants, wills and gifts with the principle of justice.

The aim of this study is to investigate how the African novelists have domesticated the English language to suit their environments, experience and purpose. Specifically, the literary pieces – The Last of the Strong Ones (Strong Ones), House of Symbols (symbols), Children of the Eagle (Children) and the Trafficked of Akachi Adimora-Ezeigbo were x-rayed. This exploration adopted the Hallidian Systemic Functional Linguistics, which highlights how language is used. The textual method of data analysis, the primary and secondary data collection methods were employed and the results showed that the African literary artists in general and the Igbo Nigerian novelists in particular have taken on a unique style of writing in the African vernacular style. For that reason, the speeches of the characters are laced with dignified local appositives, high profile Igbo songs and tales, studded local proverbs, lexical transfers, ritzy transliterations and so on; and these have given African rhythm to the English language. This notwithstanding, the aura, glamour and credibility of the English language as the medium of communication are retained.

The purpose of this study was to decide the elements of performance at PT. General Takaful Insurance, to find out how to measure performance using the scorecard approach that is by measuring process performance and results performance, and interpreting in the form of conclusions. In this study, researchers tested apply maslahah at PT. General Takaful Insurance with a case study design. This research is a type of quantitative and qualitative research because it uses measurement data through formulas and if interpretative qualitative, and the data used are primary and secondary data. Data collection methods used are observation, interviews and documentation. The results showed that PT. General Takaful Insurance received a value of the performance benefit process of 0.7 which indicates that the company simply applied benefits in terms of process performance. And behave the benefit of PT. General Takaful Insurance got a value of 0.89 which shows that the company is quite good in providing benefits to stakeholders and shareholders.
