The State of Indonesia is a country based on law, this is as confirmed in Article 1 paragraph (3) of the 1945 Constitution, the State of Indonesia is a rule of law. Policy rules only function as part of the operational implementation of government tasks. This research used normative juridical research method, namely research in which the study refers to and bases on legal norms and rules. The statutory approach was used to look at the issue of the right to review policy rules. The conceptual approach was used to look at the conception of reviewing policy rules in the concept of rule of law. Policy rules are not a type of laws and regulations, the right to review laws and regulations cannot be applied to policy rules. The review of policy rules is more directed at doelmatigheid and the touchstone is the general principles of proper governance. The Supreme Court cannot review policy rules. Arrangements are needed to realize the protection for the parties who are harmed due to a policy rule, so that it can be in accordance with the concept of rule of law.

The Underwriting Rights Law stipulates that the date of the book of land liability is the seventh day after receipt. It raises problems if the Deed of Granting the Right of Entitlement (APHT) has been completed. This study analyzes the legal standing of the deed of giving rights of late registration at the Land Office and legal protection for debtors and creditors on deeds granting mortgage rights that are late in registering at the Land Office which cause losses to the parties. The research method used normative legal research while the problem approach was carried out using a legal approach and conceptual approach. The results of the study indicate that the legal position of the Deed of Granting Rights that is late registered with the Land Office is still valid because it has fulfilled the provisions of Article 13 UUHT. Legal protection for dabitur and creditor over the APHT that is late registered with the Land Office is found in Article 23 paragraph (2) UUHT which stipulates that the existence of administrative sanctions does not remove other sanctions in accordance with prevailing laws and regulations so that the aggrieved party can file compensation

Tujuan penelitian ini untuk mengetahui bagaimana pengaturan tentang penyelesaian tentang konflik norma antara peraturan menteri terhadap undang-undang dan unruk mengetahui bagaimana sifat putusan mahkamah agung dalam hak uji material. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Pengaturan tentang penyelesaian konflik norma antara Peraturan Menteri Terhadap Undang-Undang, metode penyelesaian konflik norma itu dengan digunakannya asas lex superior derogate lex inferior ini, yang digunakan dengan terjadinya konflik norma antara UU Peraturan Perundang-Undangan dengan Permenkumham Nomor 2 Tahun 2019 terkait pengaturan penyelesaian konflik norma antara peraturan menteri dengan Undang-Undang, maka berdasarkan asas tersebut yang digunakan adalah UU Peraturan Perundang-Undangan, sehingga Permenkumham Nomor 2 Tahun 2019 harus dikesampingkan. Maka, Pengaturan mengenai Penyelesaian Konflik Norma Antara Peraturan Menteri Terhadap Undang-Undang, menjadi kewenangan Mahkamah Agung berdasarkan Pasal 9 UU Peraturan Perundang-Undangan. Dan Sifat Putusan Mahkamah Agung dalam Hak Uji Materiil dalam memberikan putusannya yang pada prinsipnya yang memiliki konsekuensi hukum aturan tersebut apabila terbukti secara sah dan meyakinkan bertentangan dengan aturan di atasnya maka aturan tersebut akan menjadi tidak sah serta tidak berlaku, dan menjadi tanggungjawab instansi terkait untuk mencabutnya. The purpose of the study is to find how adjustment of the settlement of norm conflicts between Ministerial Regulations toward the Constitution and to find out how the nature of the Supreme Court decision in the right of judicial review. The method used was normative legal research method with the legislation approach and concept approach. Adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution, the method of resolving norms conflicts by using the principle of lex superior derogate lex inferior, which was used in the norm conflicts between the Constitution on Laws and Regulations with Minister of Law and Human Rights Regulation Number 2 of 2019 in relation to conflict resolution arrangements the norm between Ministerial Regulations and the Constitution, then based on the principle used was the Constitution on Laws and Regulations, so Minister of Law and Human Rights Regulation Number 2 of 2019 must be set aside. Thus, the adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution became authority of the Supreme Court based on Article 9 of the Constitution on Laws and Regulations. And the nature of the Supreme Court's Decision in the Right to Judge Material in providing its decision which in principle had legal consequences of the rule if it was proven legally and convincingly contrary to the rules above, the rule would be invalid and not applicable, and it was the responsibility of related agencies to revoke it.

The rise of corruption cases certainly forces the government to prevent corrupt measures, the wiretapping in Indonesia by the KPK, also in terms of tackling other criminal acts. So of course there is Ethics, Ethics so far has not been touched by the KPK because in conducting wiretapping it is only limited to following the laws and regulations even though in regard to laws and regulations there should be ethics that must be maintained to guarantee the right to life of one's privacy. The research method used in this study is the qualitative research method with the type of library research library research, using the statutory approach, and theories (conceptual approach), and the Case Approach (doctrinal approach) which is examined through various literatures relating to the regulation of privacy rights, also relating to the regulation of wiretapping of the KPK.Keywords: Ethics, Wiretapping by the KPK, Wiretapping in the Human Rights PerspectiveMaraknya kasus korupsi tentu memaksa pemerintah terhadap langkah-langkah preventive koruptor, maka penyadapan di Indonesia yang dilakukan oleh KPK, juga dalam hal menanggulangi tindakan-tindakan kriminal lainnya. Maka tentu ada Etika, Etika selama ini belum tersentuh oleh KPK karena dalam melakukan penyadapan hanya sebatas mengikuti peraturan perundang-undangan, padahal berkenaan dengan peraturan perundang-undangan seharusnya ada etika yang harus dijaga untuk menjamin hak kehidupan privasi seseorang. Metode penelitian yang dilakukan dalam penelitian ini adalah dengan metode penelitian kualitatif dengan jenis penelitian kepustakaan ( library research), menggunakan Pendekatan Perundang-undangan (statutory approach), dan Teori-teori (conceptual approach), serta Pendekatan Kasus (doktrinal approach) yang diteliti melalui berbagai literatur yang berkaitan dengan pengaturan hak-hak privasi, juga berkaitan dengan pengaturan penyadapan KPK.  Kata Kunci :  Etika, Penyadapan oleh KPK, Penyadapan dalam Presfektif  HAM

The implementation of construction services must meet the principles of honesty and fairness, benefits, compatibility, balance, independency, openness, partnership and safety foremost in the interest of the community, nation and the state ( article 2 act no 18 years 1999 on construction services ).Then both users and providers services need to understand some of the stuff that fundamental i.e. the runway philosophical contractual relationship between providers of the construction services to the construction services and inspector construction services, the principle and legal norm the formation of legal construction contract, the principle and legal norm the implementation of legal construction contract . The legal research method in this journal uses a normative juridical research method with a statute approach that examines relevant laws and regulations and the conceptual approach that examines the theories and doctrines of experts in the field construction.

The state apparatus represents one of the fundamental elements of the development of contemporary society. While the right and law represents a basic understanding of the existence of the state power that performs in order to preserve a balance between the action which is accepted by society and other behaviors that by law are prohibited. The state actions principally are based on the rule of law, namely the legal system accepted or elected by people. Studying different legal systems, it shows that there are similarities more than the differences between them. Despite very different legal cultures, processing methods and institutions, different legal systems exhibit convergence in the treatment of different legal issues. As a result of these processes, many of the differences between common law and civil law now look more like nuances rather than as major differences. The differences are mostly pronounced in the styles of using legal argument, methodology, content and legal norms etc. Various legal systems, using different tools, aimed at the same purpose, and similar results are often taken from different justifications. Often it happens in practice that, despite the use of diverse tools and methods, they arrive at the same solutions or similar ones and it certainly that should not be surprising. So it can rightly be concluded that despite many changes, legal systems aim at achieving the same objective. While generally the target of the state is always and in any system the implementation of norms and rules set in advance, what the contemporary world tends to be considered as respect for the rule of law. In general, the objective of the state authorities in every system is the implementation of the norms and rules set in advance, that concept in the contemporary world tends to be considered as respect for the rule of law. Since Kosovo was part of the former Yugoslav federation and practically until the end of the war of 1999, in the absence of state sovereignty and subjectivity, people of Kosovo were not in a position to choose, like other sovereign nations which legal system will be applied on their lives. Without the will of the citizens, in Kosovo was applied a type of Continental legal system, with certain specific elements that were mostly common in other countries of former Eastern European Communist bloc. In the first years after liberation, until new legislation was passed through the legislative system, it was continued with the older system, through some minor changes. While at a later stage after the adoption of the new legislation, was introduced a large scale reform to the exciting system through the application of the combination of elements of Anglo-Saxon system, this reform which is to this day is in process as well.

Tujuan penelitian menganalisis kemerdekaan hakim dan kemandirian kehakiman dalam konsep negara hukum. Metode Penelitian menggunakan penelitian hukum normative, Hasil penelitian bahwa Kemerdekaan Hakim  dan kemandirian Kekuasaan Kehakiman sebagai  penjelmaan konsep Negara Hukum sebagaimana diatur dalam Pasal 1 ayat 3 Undang Undang Dasar Negara Republik indonesia Tahun 1945  (hasil amandemen) beserta beberapa peraturan perundang undangan yang terkait seperti Undang Undang Kekuasaan Kehakiman, Undang Undang Mahkamah Agung, Undang Undang Komisi Yudisial  serta ketetapan MPR yang merupakan rujukan dalam pelaksanan Kemerdekaan Hakim, dan kemandirian personal, kemandirian substantive ,kemandirian internal serta kemandirian institusi. Rekomendasi mewujudkan konsep Negara Hukum perlu ditata peraturan perundang undangan yang menjamin kemerdekaan Hakim dan Kemandirian Kekuasaan. The research objective is to analyze the independence of judges and the independence of the judiciary in the concept of a rule of law. The research method uses normative legal research. The results show that the independence of judges and the independence of the judicial power as the embodiment of the concept of the rule of law as regulated in Article 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia (amendments) along with several related laws and regulations such as the Law Judicial Power, the Law on the Supreme Court, the Judicial Commission Law and the MPR decrees which are references in the implementation of Judges' Independence, and personal independence, substantive independence, internal independence and institutional independence. Recommendations to embody the concept of a rule of law need to put in place laws and regulations that guarantee the independence of judges and independence of power.

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Keywords: Metode, fatwa, istinbat, usul al-fiqh, maqasid al-shari’ah ABSTRAK Dalam disiplin penyelidikan hukum Islam, kekuatan pendalilan dan kaedah istinbat yang jelas merupakan tunggak utama dalam pembinaan hukum Islam berasaskan kepada aplikasi ilmu usul al-fiqh dan maqasid al-shari’ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. The right to adequate housing is a constitutional imperative which is contained in section 26 of the Constitution. The state is tasked with the progressive realisation of this right. The allocation of housing has been plagued with challenges which impact negatively on the allocation process. This note analyses Ekurhuleni Metropolitan Municipality v Various Occupiers, Eden Park Extension 51 which dealt with a situation where one of the main reasons provided by the Supreme Court of Appeal for refusing the eviction order was because the appellants subjected the unlawful occupiers to defective waiting lists and failed to engage with the community regarding the compilation of the lists and the criteria used to identify beneficiaries. This case brings to the fore the importance of a coherent (reasonable) waiting list in eviction proceedings. This note further analyses the impact of the waiting list system in eviction proceedings and makes recommendations regarding what would constitute a coherent (reasonable) waiting list for the purpose of section 26(2) of the Constitution.

Notary is a position or ordinary we call as general officials appointed by the State and work to serve the public interest. Not only that, a notary also in carrying out its duties and authority must comply fully with the prevailing laws and regulations in Indonesia. Each position certainly has an ethics in the profession which is called a code of ethics, as well as a notary who has a code of ethics in his profession. But out there masi no notaries who violate the code of ethics as mentioned in the law, In accordance with the title of the author of the adopted method of research used is the normative research method supported by interviews that are expected to help answer the problems of this study. The authors conducted interviews with the supervisory board, notaries, and legal experts. In this case the notary has been declared guilty by the Regional Supervisory Board (MPD) and will proceed the case to the level of sanction by the Regional Supervisory Board (MPW) and after receiving the sanction it will proceed to the next level of Central Assembly (MPP) to be sanctioned which has been granted by the level of the Regional Supervisory Board (MPW).
