In the face of the recent backlashes against homosexual persons in Africa, on the ground that the phenomenon is un-African and/or threat to procreation and marital values, it is pertinent to review the discourse in the light of how ancient Africans perceived the reality. This is imperative given the lack of consensus on the part of scientists to disinter a conclusive finding on what causes homosexual behaviours among humans. In this research, I employ traditional Yorùbá philosophy to provide a plausible justification for homosexuality among the people. In the face of this justification via Yorùbá folklore, I find that there is no documented evidence among the ancient Yorùbá that is suggestive of discrimination and stigmatization of homosexuals and inter-sex persons. As homosexual persons were respected but not criminalized, this study recommends the regurgitation of this outlook in the contemporaneous dealings with homosexual persons, beginning with the repealing of the Same-Sex Marriage Prohibition Act of 2014 in Nigeria, which is inconsistent with African values and outlooks on the subject.

AbstractHong Kong recently amended its Domestic Violence Ordinance (“DVO”). During the deliberations, the issue of whether protection under the DVO ought to be extended to same-sex couples arose for discussion and has since been the subject of extensive debate. Religious and conservative groups have argued that including these groups within the DVO risks overhauling the traditional meaning of “family” and could implicitly legitimize same-sex marriage whilst others have insisted that failing to provide equivalent civil remedies under the DVO to such groups amounts to sexual orientation discrimination and is contrary to Hong Kong's international human rights commitments. This paper reviews the various arguments that have been raised against the inclusion of same-sex couples within the DVO and argues that Hong Kong's international and constitutional commitments to the principles of equality and non-discrimination require that samesex couples be brought within the purview of this legislation.

AbstractThis paper by-passes the various public tropes, such as “marriage equality”, and concentrates on determining whether or not a same-sex marriage law would be sophistically effective in Australia. It revives the ancient Greek sophistical rhetorical skill of proposing a law, and applies it as a critical context to the topic of legislating for same-sex marriage. The objective is to assess whether or not a same-sex marriage law will be effective in its legislative objects. It proposes to discuss whether the parliament could introduce such a law so that the law’s objects were achieved effectively in the public mind. Argument will try to show that introducing a law to create same-sex marriage would fail because of subsisting priestly legislation on the subject of marriage. Its two hypotheses are that the canon law and other English priestly legislation restrict the scope of marriage regulation, and marriage could not be re-defined to cover same-sex marriage. Sections of the paper examining the law historically employ the historiographical method of identifying underlying norms, the effect of which is occasional reverse chronologies. The article’s conclusion will assert that a statute for legal and duly registered same-sex marriage likely would be, according to sophistical rhetorical reasoning, a fiction misrepresenting the truth of the subsisting legal and social institutions of marriage.

THIS PAPER ARGUES that the call to teach ought to be conceptualized not so much in terms of subject matter (‘what’) or teaching method (‘how’) but with respect to the subjectivity of the people involved – that is, of the one who teaches and of the one who is taught. Building explicitly on the work of Emmanuel Levinas, the essay develops the idea of a responsible subject as the condition that makes visible the distinctiveness about the call to teach, suggesting that God's call to teach manifests itself through the face of the student, in the asymmetric relation between the teacher and the student as the other. In doing so, the teacher becomes a responsible subject for and to the student, instead of merely for the subject matter and the methods of teaching. Familiar tensions in teaching illustrate this call to responsibility.

LANGUAGE NOTE | Document text in Chinese; abstract in English only.As the cornerstone of today’s pro-same-sex-marriage rhetoric, Western Liberalism is often placed in opposition to Christianity and Confucianism. Under a fashionable preference for liberal values, Christianity and Confucianism’s adaptation to the modern value of gender equality has been under-valued. Gender neutrality remains controversial in Christianity and Confucianism because distinct gender roles serve to maintain morality. Further, the shortcomings of liberally oriented family values and the danger of favoringindividuality over social norms are often undiscussed. This article aims to remind readers that rights ought to be balanced with morality, and that traditional values can still serve our present age, even in the face of change.DOWNLOAD HISTORY | This article has been downloaded 351 times in Digital Commons before migrating into this platform.

This article examines the political style and rhetoric of the Manif pour tous (MPT), the main organization opposing same-sex marriage in France, from summer 2013 to the present. It exposes how the MPT’s style and rhetoric differ from those of their American counterparts, and what this tells us about the different strategies of political movements in France and the United States generally. It is based on an analysis of the language used by activists whom I interviewed in 2014 and 2015 and on a discourse analysis of the MPT’s website, Facebook page, Twitter feed, and press releases since 2013. This analysis of the distinctive features of the MPT brings to light underlying concerns about French identity in the face of globalization. In other words, for the MPT and its members, what is at stake is not just same-sex marriage but the very definition of Frenchness.

In the 2nd century of the Hijri calendar, when various believer groups emerged, the fact that Abu Hanifa, one of the first representatives of rational religious discourse, spoke about the subject of religious issues, means laying the foundations of the Sunni understanding of theology afterwards. Indeed, Selefîlik, Asaira and Maturidite maintained his views. During his lifetime, he drew attention with his different methodological approach to Islamic issues. The fact that Abu Hanifa is one of the prominent names in the rationale of religion and that he maintains his identity/stance in the face of ideas and opinions that can be evaluated as ‘taassup’ once again appears in the issue of “the takfir of the people of the Qiblah.” At this point, his position should be seen as standing in a rather moderate line as the name that first introduced the principle of “not declaring the people of the Qiblah,” which is a surrounding principle for believers. In the context of the debates on the Iman-Amel relationship, the examination of the issue of ‘takfir’ in the center of the ‘takfir of the people of the Qiblah’ obliges the researchers to evaluate it in a separate position. The main purpose of the article is to reveal the identity of the people of Qibla with reference to Abu Hanifa and to discuss who this refers to while focusing on the subject of “Takfir.”
