Beyond the Pomerium: Expansion and Legislative Authority in Archaic Rome

This chapter explores the principle of legislative authority in early Rome as it relates to the pomerium, the comitia curiata, the comitia tributa, and the traditional powers of patres familiarum. It argues for an ongoing negotiation between various entities within Rome during the first half of the fifth century BC over which held legal authority over which areas. It suggests that, visible in the legal disputes and tensions that mark the early ‘Struggle of the Orders’, there may be an authentic memory of Rome’s early legal evolution which saw the community, under the guise of the comitia tributa, attempting to extend its authority beyond the geographic boundary of the pomerium, which had bound the comitia curiata, and into the traditional sphere of influences of the patres familiarum. Although this early fifth century BC attempt was ultimately unsuccessful, it set the foundation for Rome’s later use of the tribes and comitia tributa as a mechanism to organize and control territory outside of the community’s normal boundaries.

<p>Democracy was established in the Greek cities in the fifth century B.C. It is a liberal western system. In this regard, various Islamic countries applied democracy as a political and legal system where the people elect their representatives in the legislative authority in order to put the legal regulations that organize the human behavior.</p>The research included a brief idea about liberal democracy, its history and objectives, the political and legal system in the Islamic state, the dispute among Muslim scholars on the application of democracy in the Islamic states; some Muslim scholars refuse to apply democracy since the legal system in Islam relies on the Holly Qor'an and the Prophet's speeches, which are a biding regulation for Muslims, while other authors believe that Islam accepts democracy and others think that Islam should have its special democracy that differs from the liberal democracy. This paper discussed the political and legal systems that were applied the Islamic state during the history of Islam. Finally the paper presented the most conclusions and recommendations reached by the researcher.

This article critically examines techniques employed by the Australian state to expand its control of refugees and asylum seekers living in Australia. In particular, it analyses the operation of Australia’s unique Asylum Seeker Code of Behaviour, which asylum seekers who arrive by boat must sign in order to be released from mandatory immigration detention, with reference to an original dataset of allegations made under the Code. We argue that the Code and the regime of visa cancellation and re-detention powers of which it forms a part are manifestations of what Beckett and Murakawa call the ‘shadow carceral state’, whereby punitive state power is extended beyond prison walls through the blurring of civil, administrative and criminal legal authority. The Code contributes to Australia’s apparatus of refugee deterrence by adding to it a brutal system of surveillance, visa cancellation and denial of services for asylum seekers living in the community.

Under the Government Organization Act of Korea, the following two issues could be raised in regards to the legal authority and status of the Korea Coast Guard: First, there is an issue involving a potential conflict of authority between the Korea Coast Guard and the Ministry of Public Safety and Security. Second, pursuant to the Government Organization Act, the Korea Coast Guard has characteristics of an advisory agency in providing assistance to the Minister of Public Safety and Security. However, the actual authority to direct and control local administrative government offices under the Korea Coast Guard belongs to the Coast Guard. This is a bifurcation between structure and actual work which can create gaps between jurisdictional duties and responsibilities.

The paper the original development of a device having the ability of data acquisition representing operating and control decisions from operation made by a automotive driver inside the cars cabin presents. The device is producing analogical and digital signals which can be interpreted and statistically processed to obtain information regarding emotional state or abilities of the driver, for example nervous state or his accuracy of the operations done in dynamic state when driving a certain car. The device is portable, it can be installed easily in the cars cabin without any physical intrusions in the structure of the vehicle and after installed it will acquire signals from acceleration, brake, gear shifter, clutch and the velocity of the vehicle. Evaluating the emotional state of the driver and the accuracy of the movements done by him during a driving session, the device can emit acoustic and visual output signals which in a certain manner will help to improve drivers skills. The human driver can interact with this device trough the touch screen display. If more of this devices having typical agents proprieties, are installed on vehicles, they can interact easily between them and communicate with an monitoring authority which is directing the traffics flow forming a SMA. The result of monitoring by a SMA of emotional states of the group of human drivers, as a second solution, complementary with the usage of the monitoring video cameras, can be useful to group leader (the detection of fatigue and exhaustion), or to the traffic flow legal authority (fluidization measures when detecting a growing of nervous state at a certain group in an area).

This paper deals with the role of wasi in the administration of minor’s property under the provision of codified Islamic law in Malaysia. The focus of the discussion is on the power of wasi in managing minor’s property under his legal authority. The question is: To what extent the provision of the Islamic law that is codified in Malaysia prescribes the duties and powers of wasi in relation to the management of minor’s property? Further, what is the safeguard that has been taken by the legal provisions in order to ensure that the minor’s property is well managed and is not infringed and embezzled by the wasi? The research adopts qualitative research methodology which focuses on an examination of the statutory provisions on the role of wasi, including his duties and powers and control in the administration of minor’s property. The paper also discusses the appointment of wasi, his position and his condition in administering minor’s property and the situation where the wasi is removed from his office. It is found that there is the inadequacy of the law in relation to the role of wasi in the administration of minor’s property. In addition to that, some provisions require further clarification and elaboration. Finally, the research found that there are still rooms for improvement with regards to codified Islamic law relating to the role of wasi in the administration of minor’s property.  Keywords: Wasi, Administration, Minor’s property, Islamic law, Malaysia.    Abstrak Kertas kerja ini adalah berkaitan dengan peranan wasi dalam pentadbiran harta kanak-kanak di bawah peruntukan undang-undang Islam yang dibukukan di Malaysia. Fokus perbincangan adalah tentang kuasa wasi dalam menguruskan harta kanak-kanak di bawah pengawasan undang-undang seorang wasi. Persoalannya, sejauh manakah peruntukan Undang-undang Islam yang telah dibukukan di Malaysia menggariskan tugas-tugas dan kuasa wasi berkaitan dengan pengurusan harta kanak-kanak. Seterusnya, apakah perlindungan yang diambil oleh peruntukan undang-undang untuk memastikan harta kanak-kanak diuruskan dengan baik dan tidak dilanggar dan diselewengkan oleh wasi. Penyelidikan ini menggunakan kaedah penyelidikan kualitatif yang memfokuskan kepada kajian peruntukan undang-undang tentang peranan wasi termasuklah tugas-tugas dan kuasa wasiserta pengawalannya di dalam pentadbiran harta kanak-kanak. Kertas kerja ini juga membincangkan tentang perlantikan wasi, kedudukan serta syarat-syarat dalam mentadbir harta kanak-kanak serta keadaan bilamana wasi dilucutkan dari jawatannya. Hasil penyelidikan mendapati bahawa peruntukan undang-undang yang ada adalah tidak mencukupi dalam mentadbir harta kanak-kanak. Sebagai tambahan, terdapat juga peruntukan undang-undang yang memerlukan penjelasan dan penerangan. Akhirnya, penyelidikan ini mendapati masih ada ruang untuk penambahbaikan bagi peruntukan undang-undang Islam yang telah dibukukan berkaitan dengan pentadbiran harta kanak-kanak. Electric fields have been applied across oxides growing on a high temperature alloy and control of the oxidation of the material has been demonstrated. At present, three-fold increases in the oxidation rate have been measured in accelerating fields and the oxidation process has been completely stopped in a retarding field.The experiments have been conducted with an iron-base alloy, Pe 25Cr 5A1 0.1Y, although, in principle, any alloy capable of forming an adherent aluminum oxide layer during oxidation can be used. A specimen is polished and oxidized to produce a thin, uniform insulating layer on one surface. Three platinum electrodes are sputtered on the oxide surface and the specimen is reoxidized.

The majority of blood vessels in the superior cervical ganglion possess a continuous endothelium with tight junctions. These same features have been associated with the blood brain barrier of the central nervous system and peripheral nerves. These vessels may perform a barrier function between the capillary circulation and the superior cervical ganglion. The permeability of the blood vessels in the superior cervical ganglion of the rat was tested by intravenous injection of horseradish peroxidase (HRP). Three experimental groups of four animals each were given intravenous HRP (Sigma Type II) in a dosage of.08 to.15 mg/gm body weight in.5 ml of.85% saline. The animals were sacrificed at five, ten or 15 minutes following administration of the tracer. Superior cervical ganglia were quickly removed and fixed by immersion in 2.5% glutaraldehyde in Sorenson's.1M phosphate buffer, pH 7.4. Three control animals received,5ml of saline without HRP. These were sacrificed on the same time schedule. Tissues from experimental and control animals were reacted for peroxidase activity and then processed for routine transmission electron microscopy.

It is well known that the rat adrenal zona glomerulosa steroidogenic activity is controlled by the renin-angiotensin system. The ultrastructural changes in the rat zona glomerulosa cells induced by renovascular hypertension were described previously, but as far as we are aware no correlated biochemical and morphometric investigations were performed.Twenty adult male albino rats were divided into 2 experimental groups. One group was subjected to restriction of blood flow to the left kidney by the application of a silver clip about the left renal artery. The other group was sham-operated and served as a control. Renovascular hypertension developed in about 10 days: sistolic blood pressure averaged 165 ± 6. 4 mmHg, whereas it was about 110 ± 3. 8 mmHg in the control animals. The hypertensive and control rats were sacrificed 20 days after the operation. The blood was collected and plasma renin activity was determined by radioimmunological methods. The aldosterone concentration was radioimmunologically assayed both in the plasma and in the homogenate of the left capsular adrenal gland.

Scanning electron beam lithography has been used for a number of years to write submicrometer linewidth patterns in radiation sensitive films (resist films) on substrates. On semi-infinite substrates, electron backscattering severely limits the exposure latitude and control of cross-sectional profile for patterns having fundamental spatial frequencies below about 4000 Å(l),Recently, STEM'S have been used to write patterns with linewidths below 100 Å. To avoid the detrimental effects of electron backscattering however, the substrates had to be carbon foils about 100 Å thick (2,3). X-ray lithography using the very soft radiation in the range 10 - 50 Å avoids the problem of backscattering and thus permits one to replicate on semi-infinite substrates patterns with linewidths of the order of 1000 Å and less, and in addition provides means for controlling cross-sectional profiles. X-radiation in the range 4-10 Å on the other hand is appropriate for replicating patterns in the linewidth range above about 3000 Å, and thus is most appropriate for microelectronic applications (4 - 6).

Previous research has revealed that passive (involuntary inhalation) tobacco smoking during gestation can have adverse effects upon the developing fetus. These prior investigations did not concentrate on changes in fetal morphology. This study was undertaken to delineate fetal neural abnormalities at the ultrastructural level in mice pups exposed in utero to passive maternal smoking.Pregnant study animals, housed in a special chamber, were subjected to cigarette smoke daily from conception until delivery. Blood tests for determination of carbon monoxide levels were run at 15-18 days gestation. Sciatic nerve tissue from experimental and control animals were obtained following spontaneous delivery and fixed in 2.5% gluteraldehyde in 0.1M cacodylate buffer pH 7.3. The samples were post-fixed in osmium ferrocyanide (1:1 mixture of 1.5% aqueous OSO4 and 2.5% K4 Fe(CN)6). Following dehydration, the tissues were infiltrated with and embedded in Spurr. Sections were stained with uranyl acetate and lead citrate.
