The article is devoted to actual problems of the effectiveness of administrative legal regulation in the field of public administration. It is noted that administrative legal regulation is a dynamic and multifaceted process. The legal rules governing administrative legal relations require ordering and systematization, and their provisions may change. The essence of administrative legal regulation and the role of institutional insufficiency in improving its efficiency are considered. In the course of the research, the features of institutional insufficiency are considered as categories of administrative legal regulation and its characteristics. It is concluded that there is a need to study the institutes of administrative law and their institutional sufficiency, as a characteristic of high-quality institutional development, in the present time and their future development. The issues of institutional activity in field of administrative and legal regulation always attract considerable attention of the scientists and practicing lawyers, because such issues evidence the conditions of regulated relations and determine the requirements for the further improvements of the standards of legislative basis according to the changes taking place in the society and state. The aim of the article. To find out the nature and indications, which characterize the institutional insufficiency of administrative and legal regulation the necessity of its further studies in the conditions reformation processes and activity of state administration bodies, decentralization of its goals and required legal support for execution of their functions and tasks. Conclusions. Summing up the considered approaches to the investigation of the problem of institutional insufficiency of administrative legal regulation, it is worthwhile to note that the main attention in the article is focused on different aspects of the problem, such as terminology and correspondence between state regulation and state government, administrative and legal regulation as a legal standard of state regulation. Development and legal fixation of the behavior standards of the subjects of administrative legal relations should be considered as the basis of administrative and legal regulations. Doctrinal definition and development of institutional insufficiency as a legal phenomenon, as well as the category of administrative and legal regulation, permits to obtain the answer about the state of the law institute and the need for its further development according to the challenges arising at certain periods of the state and society development.

Legal coherence and predictable decision-making are the cornerstones of Finnish administrative law. The aim of this research is to analyze the factors that make administrative decisions unpredictable in Finland today. Why is the challenge so significant for the authorities? The factor analysis revealed six main features affecting predictability in the legal regulation of Finnish public governance: the increasing use of soft law, the devolution of government, deregulation, the changing role of the individual, the blurring of the division between the public and the private sector and the influence of international and EU-law.

Relevant issues of the administrative and legal status of subjects of special competence in relation to public administration in the field of intellectual property are considered. Main  content. A circle of specified subjects in the system of subjects of public administration is determined. The role of subjects of special competence in the fulfilment of tasks of public administration in the sphere of intellectual property is identified. Classification of subjects of special competence regarding public administration in this field is presented. Features of the administrative or legal status of each group of subjects of special competence in relation to public administration in the field of intellectual property are analyzed. Specifics of the influence of these subjects on legal relations arising in the sphere of intellectual property are characterized. Materials and methods research based on the analysis of documentary sources. the  basis  is  the  dialectical  method  of  cognition  of  the  facts  of  social  reality,  on  which  the  formal legal and comparative legal approaches are largely based. Conclusions are drawn about the place of subjects of special competence in relation to public administration in the field of intellectual property among other subjects. Klasifikasi mata pelajaran kompetensi khusus tentang administrasi publik di bidang ini disajikan. Fitur status administrasi atau hukum dari setiap kelompok mata pelajaran kompetensi khusus dalam kaitannya dengan administrasi publik di bidang kekayaan intelektual dianalisis. Spesifik pengaruh subjek ini pada hubungan hukum yang timbul di bidang kekayaan intelektual dicirikan. Bahan dan metode penelitian berdasarkan analisis sumber dokumenter. Basisnya adalah metode kognisi dialektis atas fakta-fakta realitas sosial, yang menjadi dasar sebagian besar pendekatan hukum formal dan hukum komparatif. Kesimpulan diambil tentang tempat mata pelajaran kompetensi khusus dalam kaitannya dengan administrasi publik di bidang kekayaan intelektual antara mata pelajaran lainnya. Основное содержание. Определен круг указанных субъектов в системе субъектов государственного управления. Выявлена роль субъектов специальной компетенции в выполнении задач государственного управления в сфере интеллектуальной собственности. Представлена классификация предметов особой компетенции государственного управления в этой области. Анализируются особенности административно-правового статуса каждой группы субъектов особой компетенции применительно к государственному управлению в сфере интеллектуальной собственности. Охарактеризована специфика влияния этих субъектов на правоотношения, возникающие в сфере интеллектуальной собственности. Материалы и методы исследования на основе анализа документальных источников. в основе лежит диалектический метод познания фактов социальной действительности, на котором в значительной степени базируются формально-правовой и сравнительно-правовой подходы. Сделаны выводы о месте субъектов особой компетенции по отношению к государственному управлению в сфере интеллектуальной собственности среди других субъектов. This chapter presents an analysis of Italy's administrative history. It looks at the historical development of Italian public administration and administrative law in Italy beginning from the nineteenth century. The chapter then proceeds to the first half of the twentieth century, focusing primarily on the policies of Prime Minister Giovanni Giolitti, which saw a marked rise in changes and developments within administrative law. Also of note during this period was the role of administrative law during the era of fascism in Italy. The latter half of the twentieth century would mark a departure from this period, focusing mainly on liberal administrative law and the Republic. Finally, the chapter turns to the features of administrative law in the twenty-first century, before closing with some concluding remarks on the features peculiar to Italian administrative law.

This chapter explores, critically and systematically, contemporary public administration scholarship as it pertains to national administrative law. It aims to understand how contemporary public administration scholarship thinks about administrative law. The ‘bureau-centric’ studies reviewed here focus on the interaction of government agencies with politicians as well as with organized and unorganized constituencies. The chapter’s systematic literature review assesses the current distribution of this bureau-centric literature in leading international public administration outlets, learning four things from the exercise. First, the role of administrative law is to constrain particularistic behaviour of administrative officials as they interact with organized constituencies. Second, these studies tend to view the role of administrative law as shifting towards the promotion of a kind of pluralism as administrative officials interact with unorganized constituencies. Third, while the bureau-centric literature is robust within the confines of particular national administrative law systems, comparative studies are entirely absent from the important outlets surveyed. Fourth, the American case dominates the literature in leading international public administration outlets. The chapter concludes with an agenda for future research.

Introduction. The need to neutralize the threats to Ukraine's national security requires review of the priorities of public administration. Given the leading role of the budget as the imperative dominant of the system of state regulation of socio-economic development, the use of which is linked to the practical application of the budget mechanism of the socio-economic development of the state, the feasibility of modernizing the said mechanism is beyond doubt. The above circumstances determine the indisputable relevance of the study of the architecture of the budget mechanism and the search for ways to improve its structure, the integration of financial methods, forms, tools and instruments. Purposes. The purpose of the article is to formulate its own scientific approach to the structuring of the budget mechanism of the socio-economic development of the state, the characteristics of its elements and the relationship between them. Results.The result of the study proved that the optimal combination of elements of the budget mechanism allows the state to effectively influence the socio-economic processes, ensuring the functioning and development of the national economy, affordable and quality public services to the population, solving social problems and others. So in terms of transformation of budgetary relations and orientation of public finance to economic growth and improving public welfare scientific approaches to structuring the budget mechanism require revisionand clarification. Conclusion. Taking into account the directions of budget resources movement, the budget mechanism of the socio-economic development of the state proposes to distinguish two main subsystems: the mechanism of budget funds formation and the mechanism of using budget funds. In each of the subsystems, financial methods, forms, tools, levers are distinguished and characterized in the context of providing the architectural budget mechanism.

The article analyzes the system of methods of administrative and legal influence, identifies their essential features, which are determined by various criteria (implementation goals, scope of application (public administration), public relations (administrative and legal), subjects (authorized bodies and officials) and objects of influence (individuals, legal entities), types of administrative activities (administrative-managerial, administrative-jurisdictional and administrative-judicial)). We classify administrative methods on various grounds (scope of influence, orientation, form, content) and give a characteristic of the considered methods in the modern administrative legislation. We pay special attention to administrative and procedural methods, formulate possible ways of improving their legal regulation taking into account general trends in the development of the sphere of public administration in general and individual areas of administrative activity

The article deals with modern scientific approaches to the definition and understanding of the structure of administrative-legal support for state defense. The elements of the structure of the administrative-legal support of the state defense are explored. Under the administrative-legal support of the state should be understood as regulated by administrative-legal norms, the systemic activity of the subjects of defense, in the first place, the activities of the subjects of public administration, with regard to the administrative- legal regulation, implementation, protection of social relations in the sphere of defense, guaranteeing the rights and legitimate interests of all subjects of legal relations, aimed at creating the necessary conditions for the defense of the state in the event of armed aggression. At the same time, the structure of the administrative-legal support for the defense of the state will consist of the following elements: 1) the object of administrative-legal support of the state defense – social relations in the field of defense that penetrate practically all spheres of public life; 2) subjects of administrative-legal support for state defense – subjects of administrative legal relations are endowed with rights and duties in the field of defense; 3) norms of law (norms of administrative law) – administrative-legal norms which regulate public relations in the field of state defense; 4) administrative-legal relations in the field of state defense – legal relationships settled by administrative and legal regulations that arise, develop, and cease between the subjects of defense in the process of exercising powers in the field of state defense; 5) guarantees of administrative-legal support of state defense – conditions, means, methods, forms and methods by which the implementation of public relations in the field of state defense is provided. The administrative-legal support of the state defense will be carried out by authorized security entity within the limits of authority and administrative and legal means determined by the norms of administrative law.

Introduction. One of the tasks of the general theory of law is the development of a categorical-conceptual apparatus. All the more, so when it comes to mutually consistent and mutually evolving categories. In our case it is “legal regulation”, “legal influence” and “legal support”. It is clear, that these categories are not synonymous, but it is also clear that they are interdependent in the context of the current regulatory processes. The aim of the article. The purpose of the article is to demonstrate the correlation of the categories of “legal regulation”, “legal influence” and “legal support”, to point out their non-identical, but interrelated nature. Results. Modern law in a democratic state is not only directly regulating certain social relations, by fixing in the norms their specific patterns of behavior, rights and obligations of their participants, etc., but also influences their further development, to a certain extent determines the trends of their evolution in the future, thereby ensuring the interests of the subjects of law and the possibility of foreseeing their prospects for their further activity. Legal regulation can be characterized as a special formalized method of state regulation of actions of legal entities in order to direct their behavior in accordance with the interests of citizens, society and the state, it requires a comprehensive study of the relevant constituents in their inseparable interaction, that is, as a coherent system, consisting of certain links that interact and each of them follows from the previous one. Any regulation at the same time is, certainly, a certain influence, but not any influence is a regulation, normalization of social life. Legal influence can be characterized as comprehensive and multifaceted (psychological, state-willed, formal, regulatory, etc.) action of law, and legal regulation is a special action of law, which differs in form and content, which is exercised through the subjective rights and obligations of the subjects of law acting as subjects of specific legal relations. The essence of the category “legal security” must be considered in view of the meaning of the term “security”, the multidimensional meaning of which organically follows from the verb “to provide”, that is, to provide sufficient means for something, to make something real workable, to create the necessary conditions for the implementation of something, to guarantee something. Legal support can be seen as a process that guarantees the effective fulfillment of the objectives of legal regulation; legal support includes not only the relevant legal components, but also specific social factors, circumstances, processes, etc., which mediate the effect of legal rules and constitute a link between law and certain social relations. Conclusions. Legal support includes: 1) legal regulation; 2) legal influence; 3) a set of measures and guarantees that ensure the reality and effectiveness of the implementation of legal rules. Legal support includes a certain set of phenomena accompanying it, which give legal regulation quality of real efficiency, achievement of the last socially useful and significant results. Legal support is impossible without legal regulation and legal influence, which are its original prerequisites or bases. However, legal regulation and legal influence often take place outside the context of legal support (for example, when formally certain relationships are regulated by law, but there is no effectiveness of legal regulation, so the socially beneficial effect to which it was directed is not achieved).

<p>A emergência do estado democrático de direito, o fenômeno do neoconstitucionalismo e a passagem do autoritarismo para a democracia no Brasil apontam para a necessidade de readequação da teoria do direito administrativo. É preciso criar todo um novo contexto pela democratização das bases do direito administrativo. Ainda se mantém viva a racionalidade autoritária que deu origem ao direito administrativo, montada numa estrutura patrimonial e autoritária de poder, com a administração na posição de supremacia. Isso permite à administração pública brasileira se valer de uma base teórica ultrapassada para fundamentar posturas autoritárias. Daí questionar-se qual o papel do direito administrativo na construção de uma administração pública democrática. Um modelo de administrar que sinalize uma maior inserção da democracia no direito administrativo e na administração pública é o desafio atual da disciplina.</p><p> </p><p>The emergence of the Democratic Rule of Law State, the phenomenon of the neoconstitutionalism and the passage from authoritarianism to democracy in Brazil point to the necessity of creating a new context of democratization of the basis of the administrative law. The authoritarian rationality that gave birth to the administrative law is still alive, with the administration taking a position of supremacy. This allows the Brazilian public administration to use a surpassed theory to justify authoritarian postures. Therefore question what the role of the Administrative Law in the construction of a democratic public administration is. A model of administration that signalizes with a wider insertion of democracy in the administrative law and in the public administration is the contemporary challenge of the discipline.</p>
