AbstractI will present a novel account of justification in terms of knowledge on which one is justified in believing p just in case one could know that p. My main aim is to unravel some of the formal properties that justification has in virtue of its connection to knowledge. Assuming that safety is at least a necessary condition for knowledge, I show that justification (1) doesn’t iterate trivially; (2) isn’t a luminous condition; (3) is closed under a certain kind of multi-premise closure principle, but; (4) surprisingly one can nevertheless believe with justification a set of claims that’s jointly inconsistent. This last feature allows for a rather satisfying solution to the preface paradox. Finally, I contrast my account with other knowledge-first accounts of justification.

Perhaps one of the chief objections to open future views is that they must deny a principle we may call “Retro-closure”: roughly, if something is the case, then it was the case that it would be the case. Certain theorists, however—supervaluationists and relativists—have attempted to maintain both the open future view, and Retro-closure. In this chapter, the author argues (with Brian Rabern) that this combination of views is untenable: we must take our pick between the open future and Retro-closure. They argue that this combination of views results either in an unacceptable form of changing the past, or instead implausibly rules out the (former) existence of an omniscient being. In the appendix to this chapter, Todd argues that we can plausibly do without the Retro-closure principle, and that the principle, while intuitive, is not nearly so obvious as many have seemed to suppose.

When people learn normative systems, they do so based on limited evidence. Many of the possible actions that are available to an agent have never been explicitly permitted or prohibited. But people will often need to figure out whether those unspecified actions are permitted or prohibited. How does a learner resolve this incompleteness? It seems that at least for many people in many contexts, there is an assumption that if an action-type is not expressly forbidden, then acts of that type are permitted. This “closure principle” is one of Liberty. But how might such a principle be acquired? This chapter argues that the statistical technique of pedagogical sampling provides an answer. If one is taught a rule system via a set of prohibitions, this provides reason to think that the set of actions in the domain that are not mentioned in the prohibitions are permitted.

AbstractI am concerned with epistemic closure—the phenomenon in which some knowledge requires other knowledge. In particular, I defend a version of the closure principle in terms of analyticity; if an agent S knows that p is true and that q is an analytic part of p, then S knows that q. After targeting the relevant notion of analyticity, I argue that this principle accommodates intuitive cases and possesses the theoretical resources to avoid the preface paradox.

Courts often look to existing social norms to resolve difficult questions in Fourth Amendment law. In theory, these norms can provide an objective basis for courts’ constitutional decisions, grounding Fourth Amendment law in familiar societal attitudes and beliefs. In reality, however, social norms can shift rapidly, are constantly being contested, and frequently reflect outmoded and discriminatory concepts. This Article draws on contemporary sociological literatures on norms and technology to reveal how courts’ reliance on norms leads to several identifiable errors in Fourth Amendment jurisprudence. Courts assessing social norms generally adopt what we call the closure principle, or the idea that social norms can be permanently settled. Meanwhile, courts confronting new technologies often adopt the nonintervention principle, or the idea that courts should refrain from addressing the Fourth Amendment implications of new surveillance practices until the relevant social norms become clear. Both approaches are flawed, and they have substantial negative effects for equality and privacy. By adopting norms perceived as closed, courts may embed antiquated norms in Fourth Amendment law—norms that often involve discrimination on the basis of race, gender, or class. By declining to intervene when norms are undeveloped, courts cede power over norm creation to companies that design new technologies based on data-extractive business models. Further, judicial norm reliance and nonintervention facilitate surveillance creep, the extension of familiar data-gathering infrastructures to new types of surveillance. This Article provides, for the first time, a full, critical account of the role of social norms in Fourth Amendment law. It details and challenges courts’ reliance on social norms in virtually every aspect of Fourth Amendment jurisprudence. And it explores potential new directions for Fourth Amendment law, including novel doctrinal paradigms, different conceptions of stare decisis in the Fourth Amendment context, and alternative institutional regimes for regulating government surveillance.

In this study, we use a novel eye-tracking technology to determine how viewing behavior complies with Wertheimer’s descriptions of Gestalt principles of similarity, proximity, continuation, and closure. Our results show that viewers respond predictably to the most Gestalt principles, while discovering important nuances when it comes to our better understanding of the role of visual attention in closure principle and competing principles. In addition, our results revealed a fundamental distinction between visual attention and visual perception. By grasping this critical difference between attention and perception, designers may become more successful in applying Gestalt principles to their design.

The epistemic closure principle says that knowledge is closed under known entailment. The closure principle is deeply implicated in numerous core debates in contemporary epistemology. Closure’s opponents claim that there are good theoretical reasons to abandon it. Closure’s proponents claim that it is a defining feature of ordinary thought and talk and, thus, abandoning it is radically revisionary. But evidence for these claims about ordinary practice has thus far been anecdotal. In this paper, I report five studies on the status of epistemic closure in ordinary practice. Despite decades of widespread assumptions to the contrary in philosophy, ordinary practice is ambivalent about closure. Ordinary practice does not endorse an unqualified version of the epistemic closure principle, although it might endorse a source-relative version of the principle. In particular, whereas inferential knowledge is not viewed as closed under known entailment, perceptual knowledge might be.

Mental causation is vitally important to the integrated information theory (IIT), which says consciousness exists since it is causally efficacious. While it might not be directly apparent, metaphysical commitments have consequential entailments concerning the causal efficacy of consciousness. Commitments regarding the ontology of consciousness and the nature of causation determine which problem(s) a view of consciousness faces with respect to mental causation. Analysis of mental causation in contemporary philosophy of mind has brought several problems to the fore: the alleged lack of psychophysical laws, the causal exclusion problem, and the causal pairing problem. This article surveys the threat each problem poses to IIT based on the different metaphysical commitments IIT theorists might make. Distinctions are made between what I call reductive IIT, non-reductive IIT, and non-physicalist IIT, each of which make differing metaphysical commitments regarding the ontology of consciousness and nature of causation. Subsequently, each problem pertaining to mental causation is presented and its threat, or lack thereof, to each version of IIT is considered. While the lack of psychophysical laws appears unthreatening for all versions, reductive IIT and non-reductive IIT are seriously threatened by the exclusion problem, and it is difficult to see how they could overcome it while maintaining a commitment to the causal closure principle. Yet, non-physicalist IIT denies the principle but is therefore threatened by the pairing problem, to which I have elsewhere provided a response that is briefly outlined here. This problem also threatens non-reductive IIT, but unlike non-physicalist IIT it lacks an evident response. The ultimate aim of this survey is to provide a roadmap for IIT theorists through the maze of mental causation, by clarifying which commitments lead to which problems, and how they might or might not be overcome. Such a survey can aid IIT theorists as they further develop and hone the metaphysical commitments of IIT.

The Illusion of Doubt shows that radical scepticism is an illusion generated by a Cartesian picture of our evidential situation—the view that my epistemic grounds in both the ‘good’ and the ‘bad’ cases must be the same. It is this picture which issues both a standing invitation to radical scepticism and ensures that there is no way of getting out of it while agreeing to the sceptic’s terms. The sceptical problem cannot, therefore, be answered ‘directly’. Rather, the assumptions that give rise to it, need to be undermined. These include the notion that radical scepticism can be motivated by the ‘closure’ principle for knowledge, that the ‘Indistinguishability Argument’ renders the Cartesian conception compulsory, that the ‘New Evil Genius Thesis’ is coherent, and the demand for a ‘global validation’ of our epistemic practices makes sense. Once these dogmas are undermined, the path is clear for a ‘realism without empiricism’ that allows us to re-establish unmediated contact with the objects and persons in our environment which an illusion of doubt had threatened to put forever beyond our cognitive grasp.
