Provocatal abortion is the result of expulsion of conception before its time less than 20 weeks which is done deliberately by using drugs or medical devices. Currently, provocatus abortion is rife with adolescents who are involved in promiscuity and adult women who are married. In carrying out the act of abortion provocatus, some are done by themselves using drugs, traditional ingredients or massage, and some are assisted by medical doctors and midwives. that is done illegally. This study aims to determine the legal arrangements governing the act of legally abortion provocatus, and to determine the criminal responsibility of midwives who help treat provocatus abortion legally. This research uses a type of normative legal research, by examining the 1945 Constitution of the Republic of Indonesia, Law No. 36 of 2009 and the Criminal Code as a basis for knowing criminal liability to midwives who help deal with illegal abortion provocatus. The results of this study indicate that the legal arrangements regarding provocatus abortion are legally regulated in Article 75 paragraph (2) of the Health Law, which states that the prohibition on abortion can be lifted if it is carried out on a pregnant woman whose womb experiences symptoms of a medical emergency that endangers her life / fetus being conceived is suffering from genetic diseases or congenital defects that do not allow it to be cured so that it has the potential to make it difficult for the baby to lead a normal life. Then, the criminal liability for a midwife who helps handle provocatus abortion illegally has different sanctions from the criminal responsibility of the main perpetrator (doctor).

The falling birth rate in 1948 became a political problem, and all demographic data were made secret thereafter. V. N. Starovskii, the head of the Central Statistical Administration, suggested that the rising number of illegal abortions was the primary cause of the declining birth rate. Saddled with this allegation, the medical and legal professions undertook comprehensive study of both legal and illegal abortion, including a survey of illegal abortion, compiled through interviews with hundreds of women hospitalized after botched abortions. The results led to a shift in reformist focus from prosecution to prevention, and a new understanding of the causes underlying Soviet women’s reproductive decisions.

Freedom in abortion has been packaged to cover up the real facts, meaning that few people know about the dangers of abortion, but places selling illegal abortion drugs can still flap their wings to sell in the world of online commerce. This dedication discusses the decision making in having an abortion by women aged 20-30 years. The crisis of knowledge about sexual education makes abortion perpetrators less aware of the dangers of abortion, meaning that the community does not really understand whether or not they can have an abortion. Abortion is done not only because of intention or desire. The process of making decisions about abortion perpetrators is also different, making decisions that make doubts when pregnant are difficult, lack of knowledge and falling into difficult choices make people do things that shouldn't be done, how is the process of making decisions about abortion perpetrators. Therefore, this study uses a dedication method and uses the theory of decision making as a knife of analysis in decision making in performing abortion by women aged 20-30 years. This case was taken considering that the rate of abortion in Indonesia is very high, and maternal mortality due to abortion is a concern. So that this service approach uses a phenomenological approach to determine the decision making in carrying out abortion by women aged 20-30 years. Phenomenology tries to identify a meaning behind the way the abortion perpetrator takes decisions, so that what is highlighted is the abortion perpetrator's decision-making process.

AbstractMedicine in silent film has a long history. Although the silent era in cinema was dominated by burlesques (using escaped “lunatics”) a number of themes emerged after systematic review. The cinematic representation of medicine coincided with the discovery of X-rays. During this “roentgenomania”, short films were produced showing groundbreaking X-ray images, which fitted perfectly into needs of dramatic cinema. But soon the “cinema of narration” evolved: Starting just after the turn of the century, the short film “The Country Doctor” was able to address complex interplay between duties and limitations of the medical profession. This was followed by numerous feature films on infectious diseases, which often used tuberculosis as a centerpiece of its story. Directors often took advantage of the well-known stereotype of the omnipotent physician. But in certain medical fields, such as psychiatry or surgery, a more ambivalent figure of the doctor was portrayed, f. e. in “Hands of Orlac” (1924). Silent cinema also offered interesting ideas on the healing powers of the medium itself: in “The Mystery of the Kador Cliffs” (1912) a film screening could cure the patient of fears after reenactment. Finally, a closer look at the early era of film echoes how social conflicts where dramatized, especially in the case of nationwide birth control. How illegal abortion kept the society on its edge, was most clearly shown in the adaption of the scandalous play “Cyankali” (1930).In addition to discussing various topics in the cinematic representation of medicine, this brief overview shows that silent movies were a new and true art form, representing an exceptional resource for historians of film and medicine.

In this paper, the goal aimed was to bring out consequences that go along with illegal and unsafe abortion and benefits attached to legal and safe abortion in order to urge countries with restrictive abortion laws to reform their legislations so as to save women’s lives from higher morbidity and mortality resulting from unsafe abortion and to protect their health and human rights. In fact, a large number of scholars have established the relationships between developing countries and restrictive abortion laws, restrictive abortion grounds and illegal abortion, illegal abortion and unsafe abortion, unsafe abortion and higher maternal morbidity and mortality. From that, it has been stressed that most of developing countries have restrictive abortion legislation, which fosters a large amount of illicit and unsafe abortions, responsible of such consequences as higher maternal morbidity and mortality. Since restrictive laws, instead of decreasing illegal abortion and its consequences, only increase them and make women run a great risk, it has been demonstrated that legalizing and granting access to safe abortion is the most effective prevention of criminal and unsafe abortions.

<p>Pregnancy occurs and unwanted frequently bring a big issue for women, pregnancy backgrounds were varies, there is for having sex outside marriage, incest, or pregnancy due to the factor of sex crimes such as rape and others. For a pregnant woman in a<br />state of not having a partner is certainly not easy to survive, therefore often thought to abort appears and choose the easiest way, which is not to the doctor because it will find a variety of procedures. Then choose to go to a clinic that serves the practice of illegal abortions, such as a police case reports in February 2020 that uncovered the practice of illegal abortions in a clinic in the area of Central Jakarta. In terms of the application of positive law in Indonesia, the problem was raised again, namely how the supervision and application of criminal law against illegal abortion business? When people are free to choose, the consequences will increase the maternal mortality rate itself. Should the birth of regulations governing therapeutic abortion, safe abortion will be the answer to the fate of women in the future.</p>
