Some tactical features of the initial stage of detection and investigation of crimes related to incitement to suicide via the internet

In this paper, we consider the tactical features associated with the planning and preparation of the initial investigative actions in cases related to the inducement to commit suicide via the Internet. Special attention is paid to the preparation of the operational investigation team when receiving a report of a suicide, as well as conducting such investigative actions as an inspection of the scene of the incident and a search. The authors pay special attention to the specifics of digital data, the need to attract a specialist for their detection, recording and seizure in the cases under consideration. The authors point to the need for international legal cooperation, which justifies the extraterritoriality of digital data.

PROBLEMS OF INVESTIGATING MURDERS COMMITTED IN INSTITUTIONS THAT PROVIDE ISOLATION FROM SOCIETY

В статье анализируются вопросы организации расследования убийств, совершаемых в условиях учреждений, обеспечивающих изоляцию от общества. Рассмотрены элементы криминалистической характеристики данных преступлений. Изучены и проанализированы наиболее распространенные способы совершения пенитенциарных убийств, типичные следы и обстановка преступного события. Особое внимание уделено вопросам исследования психологического портрета личности пенитенциарного преступника. Сделан вывод о том, что тактические особенности расследования убийств в местах лишения свободы в значительной степени обусловлены спецификой исправительного учреждения. Исследованы правовые и организационные аспекты привлечения специалистов к участию в следственных действиях, вопросы организации деятельности судебно-медицинского эксперта. Указано на особое значение неотложности проведения осмотра места происшествия в условиях учреждения уголовно-исполнительной системы. Предложено производство осмотра силами данного учреждения, что позволит предотвратить возможную утрату доказательственной информации. Дана оценка использованию свидетельских показаний осужденных в судебном разбирательстве в качестве доказательств по делам о пенитенциарных убийствах. На основе обобщения опыта работы органов и учреждений ФСИН России выделены основные направления деятельности, в наибольшей степени влияющие на расследование убийств, совершенных осужденными и лицами, содержащимися под стражей. The article analyzes the issues of organizing the investigation of murders committed in institutions that provide isolation from society. The elements of the criminalistic characteristics of these crimes are considered. The most common methods of committing penitentiary murders, typical traces and the situation of a criminal event are studied and analyzed. Special attention is paid to the study of the psychological portrait of the personality of the penitentiary criminal. It is concluded that the tactical features of the investigation of murders in places of deprivation of liberty are largely determined by the specifics of the correctional institution. The legal and organizational aspects of attracting specialists to participate in investigative actions, issues of organizing the activities of a forensic medical expert are investigated. The special importance of the urgency of conducting an inspection of the scene of the incident in the conditions of the institution of the penitentiary system is indicated. It is proposed to conduct an inspection by the forces of this institution, which will prevent the possible loss of evidentiary information. The article evaluates the use of the testimony of convicted persons in court proceedings as evidence in cases of penitentiary murders. Based on the generalization of the experience of the bodies and institutions of the Federal Penitentiary Service, the main areas of activity that most affect the investigation of murders committed by convicts and persons in custody are identified.

SPECIAL ASPECTS OF ACCEPTANCE, BOOKING AND CONTROLING OF CRIME REPORTS AND INCIDENTS WITHIN THE PENAL INSTITUTIONS

Актуальность изучения стадии возбуждения уголовного дела в общем и проверки сообщений о преступлениях и происшествиях в частности не вызывает сомнений, поскольку именно на этом этапе закладываются основы принятия процессуального решения о возбуждении уголовного дела или об отказе в его возбуждении, что соответствует принципу законности. В учреждениях уголовно-исполнительной системы процессуальная деятельность является специфичной, поскольку связана с особым режимом функционирования учреждений и социальной средой, детерминированной криминальной субкультурой. Статья посвящена исследованию понятия, сущности и значения проверки сообщений о преступлениях и происшествиях в учреждениях уголовно-исполнительной системы. Рассмотрены наиболее распространенные способы проверки сообщений о преступлениях: получение объяснений, производство осмотра места происшествия. Рассматриваемая деятельность не лишена проблем. Проанализированы отдельные из них, касающиеся полноты изложения информации в рапорте об обнаружении признаков преступления и получения объяснений от осужденных, и пути их решения. Для соблюдения законности процессуальной деятельности в учреждениях и органах уголовно-исполнительной системы при рассмотрении сообщений о преступлениях и происшествиях предлагается разработать методические рекомендации, содержащие уголовно-процессуальные и криминалистические аспекты рассматриваемой деятельности, которыми обеспечить все подведомственные органы и учреждения. The relevance of studying the stage of initiating a criminal case, in general, and checking reports of crimes and incidents, in particular, is not in doubt, since it is at this stage that the foundations are laid for making a procedural decision to initiate a criminal case or to refuse to initiate it, which meets the principle of legality. In the institutions of the penitentiary system, procedural activity is specific, since it is associated with a special mode of functioning of institutions and the social environment, determined by the criminal subculture. The article is devoted to the study of the concept, essence and meaning of checking reports on crimes and incidents in the institutions of the penitentiary system. The most common methods of checking reports of crimes such as obtaining explanations, conducting an inspection of the scene of the incident are considered. The activity under consideration is not without problems. Some of them are analyzed, concerning the completeness of the information in the report on the detection of signs of a crime and obtaining explanations from convicted persons and the way to solve them. In order to comply with the legality of procedural activities in institutions and bodies of the penitentiary system when considering reports of crimes and incidents, it is proposed to develop methodological recommendations containing criminal procedural and criminalistic aspects of the activity under consideration which should be provided to all subordinate bodies and institutions.

INSPECTION OF THE SCENE DURING THE INVESTIGATION OF PENITENTIARY CRIMES: PROBLEMS OF EFFECTIVENESS, ATTITUDES OF THE SUBJECTS OF INVESTIGATION (SOME EMPIRICAL RESEARCH)

В статье обозначается значимость осмотра места происшествия при расследовании пенитенциарных преступлений, указываются недостатки и причины низкого качества его производства, даются отдельные рекомендации по повышению эффективности его проведения. The article indicates the significance of the inspection of the scene of the incident in the investigation of penitentiary crimes, indicates the shortcomings and reasons for the poor quality of its production, give some recommendations to improve its effectiveness.

Some features of work with traces of crimes committed with using unmanned aerial vehicles in the territories of correctional institutions

The article is devoted to such an investigative action as an inspection of the scene of the incident as part of the investigation of crimes committed when using unmanned aerial vehicles in the territories of correctional institutions. The necessity of attracting specialists from various fields of science, technology and craft is substantiated in order to identify a larger number of traces and prevent their loss. The list of objects and traces that can potentially be found during the inspection of the scene is presented. An algorithm for conducting an inspection of the scene is given taking into account the specifics of the commission of a crime using an unmanned aerial device. Effective ways of preserving traces for the subsequent appointment of forensic enquiries are proposed
