This research is done to see any risks that happened in Islamic bank, which can damage the bank. While it aims to find out the strategy used by Bank Muamalat Indonesia (BMI) to reduce the risk faced and often happened in the field. The research method uses a qualitative approach with a case study method. Data collecting was done by relating proposed questions and the conclusion made from the result of the interview with Branch Manager (BM), Relation Manager, and Remedial BMI of Branch Office of Mas Mansyur. The result of this research showed that BMI of Mas Mansyur Branch Office had done the process of risk management by identifying risk in the manner of finding out the existing risks which are financing risk; market risk; and ownership risk, measuring and monitoring the risks in the manner of doing measurement to find out and see any reason that causes those risks exist, and controlling and managing the existing risks in Musyarakah Mutanaqisah (MMQ) financing in the manner of ways that have already determined by BMI of Mas Mansyur Branch Office. The last is by monitoring the risks in MMQ financing at BMI of Mas Mansyur Branch Office.Keywords: Risk Management, Risk, Financing, Musyarakah Mutanaqisah, Bank Muamalat Indonesia

Sharia compliance is the main pillar that distinguishes between Islamic banks and conventional banks. Nevertheless, there is still debate among people who use the services of Islamic banking about sharia compliance regarding to the principles of sharia. This research aimed to investigate the customer’s perception of Islamic bank in the scope of Economic and Business Faculty Airlangga University students regarding to sharia compliance practice in Islamic bank which is seen from the concept and indicators of sharia compliance.This research used qualitative approach with a case study. Data collection technique in this research used a Focus Group Discussion (FGD) that consist of four group students of the Economic and Business Faculty Airlangga University from four majors: Economics, Management, Accounting, and Islamic Economics. This research was analyzed using domain and componential analysis.The result of this research showed that sharia compliance concept in Islamic bank that has been agreed by all of four student groups of Economic And Business Faculty of Airlangga University was sharia principles practice in Islamic bank operational system. There were four indicators of sharia compliance which had been agreed by all of four group students of Economic And Business Faculty of Airlangga University. They were akad as according to sharia, corporate culture as according to sharia, lending scheme as according to sharia, halal source of funds. Whereas the indicators which weren’t agreed yet by all of four groupstudents of Economic And Business Faculty of Airlangga University were the existence of Sharia Supervisory Board , financial statements which were reported as according to sharia accounting, and zakat funds.

The ultimate purpose of Sharia law is to protect the welfare of humans by bringing benefits for them and preventing harms from them. The jurists agree that the evidence of maslahah is the basis on which the provisions of financial and banking transactions are based regardless of their difference of opinions in terms of its conditions. The reality of Islamic banking transactions and the complexity of many of its issues make the existence of clear evidence from the Quran and Sunnah difficult, which necessitates for the researchers to make additional efforts in this field, and conduct ijtihad to use the evidence of maslahah with its legal conditions as a way to reveal the Shari`ah rulings by following the Companions and righteous scholars during their time. Therefore, the research will deal with the concept of maslahah and some issues related to considering it in financing with al-Qarḍ al-Ḥasan in the Islamic banks, and opinions of scholars about it. In addition, it explains the procedures of granting al-Qarḍ al-Ḥasan at Al Baraka Islamic Bank in Algeria and highlights the need of the Algerian youth to obtain al-Qarḍ al-Ḥasan which will be investigated through the distribution of questionnaires among them. The research follows the inductive approach to extrapolate the scholars' opinions, and analytic approach to analyze their views, and analyze the results of the questionnaires about al-Qarḍ al-Ḥasan. The research concludes that the Shari`ah ruling of some issues of al-Qarḍ al-Ḥasan is based on evidence of maslahah including all of its types which are considered, canceled and silenced ones.

Islamic bank, as an alternative financial institution, is now widely accepted and has been established in various countries. In Indonesia, Islamic bank was first established in 1992 along with the revival of Islam in the country. Previously, the establishment of Islamic bank in Indonesia was hindered not because of economical reason but because of a political stigma associated with Islam especially during the 1970s. The purpose of this article is to explore how the bank makes innovations to increase its performance that makes its legitimacy high on the eyes of its stakeholders. The article also discusses the various regulations and roles of central bank and the Indonesian government in ensuring control and good governance and subsequently into further developing the Islamic and shariah banking system in Indonesia.DOI: 10.15408/ajis.v16i1.2898
