The Role of the Joint Procurement Agreement during the COVID-19 Pandemic: Assessing Its Usefulness and Discussing Its Potential to Support a European Health Union

In 2014, the European Joint Procurement Agreement (JPA) was introduced as an innovative instrument to organise the procurement of vaccines and medications in preparation for pandemics. An overriding purpose of the JPA is to secure equitable and cost-effective access to medical supplies for participating EU Member States during serious health crises. This article aims to understand the current use of the JPA in response to the COVID-19 pandemic. Post-analysis of the recent use of the JPA, the article will discuss how the regional procurement mechanism can be strengthened to support the development of a European Health Union. In particular, the article will firstly question whether the four recent JPA procurement actions facilitated equitable access to medical supplies and services. Secondly, it will ask whether the centralised procurement actions preserved the integrity of the Internal Market. The importance and originality of this study are that it addresses an instrument, the JPA, which has been largely overlooked by legal scholars, and it explores how the provisions for the joint procurement of medical countermeasures as included in Article 5 of Decision 1082/2013/EU on serious cross-border threats to health could be extended to support the functioning of a European Health Union.

SOLVIT is an informal out-of-court dispute-resolution tool between the EU Member States and Norway, Lichtenstein and Iceland to practically help citizens and businesses when encountering problems in cross-border situations with their rights enshrined in EU legislation. In light of the recently adopted Commission Communication on the reinforcement of SOLVIT, 1 the authors analyse its key characteristics and challenges. The authors concludes that an enhanced role of SOLVIT can efficiently promote a culture of compliance and smart enforcement of EU law in the Single Market together with the Member States.

The analysis moves on to consider exceptions and limitations under the InfoSoc Directive. In particular, attention focuses on three areas—parody, quotation, and private copying—which serve to outline how the application of certain key standards, notably (1) the one according to which concepts in EU directives that make no reference to the laws of individual EU Member States should be intended as autonomous concepts of EU law that must be given uniform application throughout the EU, (2) strict interpretation of exceptions and limitations, but also (3) effectiveness of exceptions and limitations and (4) achieving a fair balance in the protection of contrasting rights, have allowed the creation of an EU system of exceptions and limitations. In this sense, the role of the Court has been pivotal in strengthening, at least in part, the admittedly weak harmonizing force of the InfoSoc Directive. This chapter also discusses the nature and function of the three-step test as found in Article 5(5) of that directive.

Over the decades Europe has received many and diverse flows of people from around the world. Migrants coming from outside the EU along intra-European migrants have changed the landscape of migrations with their diverse mobility projects. At the same time European citizens residing in their countries of origin are mobile in multiple ways when they engage in travel and consumption across the borders or they connect to family and friends based in other countries. In this chapter I will argue that while European citizens themselves have become more mobile engaging in cross-border exchanges and interactions, these processes have also brought about the change in their thinking about mobility of others who migrate from other EU Member States and beyond. Using the Eurobarometer data I illustrate how attitudes towards intra- and extra-European migration differ, with largely positive sentiments towards migrants coming from within the EU and predominantly negative attitudes towards migrants from outside the EU. However, determinants of these attitudes remain similar, irrespectively if they are directed at European movers or third country nationals. Among examined determinants of sentiments, engagement in cross-border practices seems to coincide with more positive opinions about migration.

The “Coronavirus disease 19 (COVID-19)” is caused by “Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-CoV-2)”, a newly discovered member of the Coronaviridae family of viruses which is a highly communicable. There is no effective medical treatment till date for Coronavirus disease hence prevention is the best way to keep disease away. Rasayana proved to be highly efficacious and cost effective for the Prevention and Control of viral infections when vaccines and standard therapies are lacking. Rasayana Chikitsa is one of the eight branches of Ashtanga Ayurveda which helps to maintain healthy life style. Rasayana improves immunity and performs many vital functions of human body. Vyadhikshamatva that is immune mechanism of the body is involved in Prevention of the occurrence of a new disease and it also decreases the virulence and progression of an existing disease. In COVID-19 the Respiratory system mainly get affected which is evident from its symptoms like cold, cough and breathlessness. Here the drugs help in enhancing immune system and strengthening functions of Respiratory system can be useful. For this purpose, the Rasayana like Chyavanprasha, Agastya Haritaki, Pippali Rasayana, Guduchi, Yashtimadhu, Haridra, Ashwagandha, Tulsi are used. Rasayana working on Respiratory system are best for Prevention of Coronavirus and boosting immune system. Rasayana Chikitsa can be effective in the Prevention as well as reducing symptoms of COVID-19.

The article is devoted to the study of the implementation of territorial cohesion policy in the European Union in order to achieve a secure regional coexistence. In particular, the regulatory and institutional origins of territorial cohesion policy in the EU are considered. The evolution of ontological models of cohesion policy has been outlined. Specifically, the emphasis is placed on the key objective of political geography – effectively combining the need for "territorialization" and the growing importance of networking. The role of urbanization processes in the context of cohesion policy is highlighted. Cross-border dimensions of cohesion policy in the context of interregional cooperation are explored. Particular emphasis is placed on the features of integrated sustainable development strategies.

Increased concern regarding water quality impacts from combined sewer overflows (CSOs) in the U.S. and elsewhere has emphasized the role of computermodeling in analyzing CSO impacts and in planning abatement measures. These measures often involve the construction of very large and costly facilities, and computer simulation during plan development is essential to cost-effective facility sizing. An effective approach to CSO system modeling focuses on detailed hydraulic simulation of the interceptor sewers in conjunction with continuous simulation of the combined sewer system to characterize CSOs and explore storage-treatment tradeoffs in planning abatement facilities. Recent advances in microcomputer hardware and software have made possible a number of new techniques which facilitate the use of computer models in CSO abatement planning.

Background:: Synthesis of metallic nanoparticles has attracted extensive vitality in numerous research areas such as drug delivery, biomedicine, catalysis etc. where continuous efforts are being made by scientists and engineers to investigate new dimensions for both technological and industrial advancements. Amongst numerous metallic nanoparticles, silver nanoparticle (AgNPs) is a novel metal species with low toxicity, higher stability and significant chemical, physical and biological properties. Methods:: In this, various methods for the fabrication of AgNPs are summarized. Importantly, we concentrated on the role of reducing agents of different plants parts, various working conditions such as AgNO3 concentration; ratio of AgNO3/extract; incubation time; centrifugal conditions, size and shapes. Results:: This study suggested that eco-friendly and non toxic biomolecules present in the extracts (e.g. leaf, stem and root) of plants are used as reducing and capping agents for silver nanoparticles fabrication. This method of fabrication of silver nanoparticles using plants extracts is comparatively cost-effective and simple. A silver salt is simply reduced by biomolecules present in the extracts of these plants. In this review, we have emphasized the synthesis and antibacterial potential of silver nanoparticles using various plant extracts. Conclusion:: Fabrication of silver nanoparticles using plant extracts have advantage over the other physical methods, as it is safe, eco-friendly and simple to use. Plants have huge potential for the fabrication of silver nanoparticles of wide potential of applications with desired shape and size.
