Law, Gender and Religious Belief in Europe: Considerations from a Catholic Perspective

In the teaching of the Catholic Church, the institution of marriage derives directly from God, for common good and for the good of spouses and children. Human authorities are called upon not to transform its characteristics and to avoid any attempts to distort them. However, the Church is today confronted with a changing understanding of the notion of ‘gender’ and with new considerations about the meaning of ‘marriage’ on behalf of parts of society and of political institutions. Based on an overview of the recent legislative and political proposals concerning family issues at the European level, this article aims to assess what model of family the Member States of the European Union are developing, and how the traditional concept of marriage could be influenced by this evolution.

Starting from the assumption that the resurgence of the political influence of religion also affects the European continent, the article explores the interactions between the Roman Catholic Church and the European Union, focussing mainly on their mutual ideational influences. The study is divided into three parts: In the first, it analyses a substantial corpus of EU documents, trying to identify explicit references to Christianity and the religious inspiration of the integration process in them. Following from this, the second section identifies the key loci where the religious language used by the Church can be translated into the secular language used by EU policy-makers. In particular, we focus on the institutions which were set up specifically to foster the dialogue between the Church and the EU or to present the Church´s views to EU officials. Finally, after an analysis of the EU´s discourse on religion and the Catholic bodies dealing with the EU, we assess the overlap of the fundamental value-orientations of the two institutions. The main question the study addresses here is whether the discursive and institutional interactions between the RCC and the EU are supported by a deeper agreement between the Church´s and the Union´s fundamental values concerning the preferred political order.

The problem of research is very current for several reasons. Namely, the dominant approach on the basis of which are based all have developed and established theories of European integration, developing modern theories of international relations is a realistic basis. Neo-functionalism, inter-guvernmentalism, neo-liberalism, institutionalism (in most of its variants) as the most developed branches of the theory of European integration, despite differences in their settings to keep the basic premise that states are rational, unitary actors, whose interest stems from the assessment of their position in the system of states. For our study caused a special interest model of constructivism using Habermas theory of communicative action according to which entities in mutual interaction is open to other arguments and their validity appreciate having regard to the outgoing reasons and norms on which they are based, thereby seeking consensus as a common goal. Apply to the European Union, this approach allows European institutions were perceived as a place of discussion to reach consensus on solving common problems, rather than just the arena for bargaining. Functional adaptation to the numerous petitions which sets the European Union, requires thorough and integrated activities in the economic, institutional, administrative and legislative spheres. This process should be understood as a continuous, painstaking and long process, not a single radical surgery. Republic of Macedonia, as countries aspiring for membership in the European family must meet the political and economic criteria and to adapt political institutions in the country with those of the European Union and their needs and requirements. The aim of this paper is to perceive the key features and trends in the politics of enlargement and to make a comparison between the policy of expansion applied in the process of accession Central and Eastern Europe and the policy of expansion in the process of stabilization and association, with special emphasis on the Republic of Macedonia. Of course, previously been necessary to develop theoretical and practical approach to the concept of policy integration, development and its major elements and modalities.

This paper is about the ways that citizens perceive their place in the political world around them, through their political identities. Using a combination of comparative and quantitative methodologies, the study traces the pattern of citizens’ political identifications in the European Union and Canada between 1981 and 2003 and explains the mechanisms that shape these political identifications. The results of the paper show that in the EU and Canada identity formation is a process that involves the participation of both individuals and political institutions yet between the two, individuals play a greater role in identity construction than do political institutions. The paper argues that the main agents of political identification in the EU and Canada are citizens themselves: individuals choose their own political identifications, rather than acquiring identities that are pre-determined by historical or cultural precedence. The paper makes the case that this phenomenon is characteristic of a rise of ‘civic’ identities in the EU and Canada. In the European Union, this overarching ‘civic’ identity is in its infancy compared to Canada, yet, both reveal a new form of political identification when compared to the historical and enduring forms of cultural identities firmly entrenched in Europe. The rise of civic identities in both the EU and Canada is attributed to the active role that citizens play in their own identity constructions as they base their identifications on rational assessments of how well political institutions function, and whether their memberships in the community will benefit them, rather than on emotional factors rooted in religion or race. In the absence of strongly held emotional identifications, in the EU and Canada political institutions play a passive role in identity construction by making the community appear more entitative to its citizens. These findings offer new theoretical scope to the concept of civic communities and the political identities that underpin them. The most important finding presented in the paper is that although civic communities and identities are manufactured by institutions and political elites (politicians and bureaucrats), they require thinking citizens, not feeling ones, to be sustained.   Full text available at: https://doi.org/10.22215/rera.v2i4.179

In the European Union, the concern for sustainability has been legitimized by its politically and ecologically motivated discourse disseminated through recent policies of the European Commission and the local as well as international media. In the article, we question the very meaning of sustainability and examine the European Green Deal, the major political document issued by the EC in 2019. The main question pursued in the study is whether expectations verbalized in the Green Deal’s plans, programs, strategies, and developments hold up to the scrutiny of critical discourse analysis. We compare the Green Deal’s treatment of sustainability to how sustainability is presented in environmental and social science scholarship and point out that research, on the one hand, and the politically motivated discourse, on the other, do not correlate and often actually contradict each other. We conclude that sustainability discourse and its keywords, lexicon, and phraseology have become a channel through which political institutions in the EU such as the European Commission sideline crucial environmental issues and endorse their own presence. The Green Deal discourse shapes political and institutional power of the Commission and the EU.

Ranging from the denial of direct effect to WTO law by the Court of Justice to a WTO-friendly legislative culture currently booming in the EU's political institutions, different approaches towards WTO law have been adopted within the EU. This article classifies the different approaches into reactive, coactive, and proactive by drawing on their common characteristics. The principal aim is to explore the considerations shaping the development of the different approaches and to argue that these stem from the interaction between the judiciary and the legislature. In doing so, this article purports to provide a comprehensive view of the application of WTO law within the Community legal order.

Health technology assessment (HTA) has become increasingly important in the European Union as an aid to decision making. As agencies and programs have been established, there is increasing attention to coordination of HTA at the European level, especially considering the growing role of the European Union in public health in Europe. This series of papers describes and analyzes the situation with regard to HTA in the 15 members of the European Union, plus Switzerland. The final paper draws some conclusions, especially concerning the future involvement of the European Commission in HTA.

La relación política-economía a nivel europeo debe tener en cuenta dos coordenadas fundamentales. Por una parte, la consideración del orden constitucional europeo como un orden distinto al gestado bajo las coordenadas del constitucionalismo social. Por otra, la caracterización de la constitución económica europea como ámbito de materialización de las nuevas transformaciones que incorpora el proyecto de integración europeo. Fundamentalmente, porque la constitución económica europea representa la plataforma idónea desde la que dilucidar la nueva articulación del poder desde el espacio supranacional europeo. ABSTRACT: The aim of this paper is to analyse the impact of the new articula tion of power in the European Union in the Spanish state of autonomies. The relationship between politics and economy at European level must take into consideration two fundamental coordinates. On the one hand, the Euro pean constitucional system appears as a system opposite to that of social constitutionalism. Moreover, the characterization of the European economic constitution as a field of realization of the new transformations incorporated by the European project. Specially, because this represents the ideal platform in order to analyse the new articulation of power from European supranational space.

While abortion has been legal in most developed countries for many years, the topic remains controversial. A major area of controversy concerns women’s rights vis-a-vis the rights of health professionals to opt out of providing the service on conscience grounds. Although scholars from various disciplines have addressed this issue in the literature, there is a lack of empirical research on the topic. This paper provides a documentary analysis of three examples of conscientious objection on religious grounds to performing abortion-related care by midwives in different Member States of the European Union, two of which have resulted in legal action. These examples show that as well as the laws of the respective countries and the European Union, professional and church law each played a part in the decisions made. However, support from both professional and religious sources was inconsistent both within and between the examples. The authors conclude that there is a need for clear guidelines at both local and pan-European level for health professionals and recommend a European-wide forum to develop and test them.

The article of Volodymyr Moroz ―Normative character of the principles of Social doctrine of Catholic Church: an evolutional way of formation - is devoted to the analysis of Catholic Church’s Teaching over the human dignity. Author explores also the process of settling of the principles of common good, subsidiarity and solidarity in the Teaching of Catholic Church. Mentioned principles are investigated in the case of orientation to provide a reverence to transcendent human dignity. Author sums up that all three principles have normative character. That is to say the principles are called to guarantee certain coordination between the social reality and the verities, which were declared by the Social doctrine of the Church.

Summary. Religious differences may rise and actually historically rose tensions and even wars. In the history, Christians also caused wars and were a threat to social integration and peace, despite the fact that Christianity is a religion of peace. God in Christians’ vision is a God of peace, and the birth of Son of God was to give peace «among men in whom he is well pleased»  (Lk 2,14b). Although Christians themselves caused wars, died in them, were murdered and had to fight, the social doctrine of Christianity is focused on peace. Also the social thought of the Roman Catholic Church strives to build peace. Over the years, the social teaching of the Roman Catholic Church was formed, which sees the conditions and foundations for peace. These are: the dignity of the human person, the natural law, human rights, common good, truth, freedom, love and social justice. The development of the Roman Catholic Church’s teaching on peace was contributed by popes of XX century: Pius XI (1922–1939), Pius XII (1939–1958), with high impact – John XXIII (1958–1963), Paul VI (1963–1978), Pope John Paul II (1978–2005) and Pope Benedict XVI (2005–2013). After Pope Benedict XVI’s resignation, the most important role of the preceptor in the Church of Rome fulfills Francis – the pope from Argentina. Although his pontificate is not long, and teaching is not complete, but you can tell that he continues to build the social doctrine of the Roman Church in matters of peace through the development of so-called «culture of encounter». Based on selected speeches and letters of two years’ pontificate of Francis, the first figure of «culture of encounter» can be lined out as a way of preventing and resolving tensions in the contemporary world.  Fundamentals of the concept of dialogue Francis created in the days of being a Jesuit priest and professor at Jesuit universities. He based it on the concept of Romano Guardini’s dialogue. Foundations of the look at the dialogue – in terms of Jorge Mario Bergoglio are strictly theological: God enters into dialogue with man, what enables man to «leaving himself» and enter into dialogue with others. Bergoglio dealt with various aspects of the dialogue: the Church and the world, culture and faith, dialogue between religions and cultures, dialogue inter-social and inter-national, dialogue rising solidarity and co-creating the common good. According to him the dialogue is a continuous task, not a single event; is overcoming widespread «culture of effacement» and  «culture of fight» towards a «culture of encounter»; it releases from autism, isolation, gives strength and meaning of life, renews the ability to listen, lets looking at community in the perspective of the whole and not just selected units. As Bishop of Rome Jorge Mario Bergoglio continues and develops his idea of «a culture of dialogue and encounter». In promoting dialogue, he sees his own mission and permanent commitment imposed on him. He promotes the atmosphere – a kind of «music» – of dialogue, by basing it on emotions, respect, intuition, lack of threat and on trust. The dialogue in this sense sees a partner in each person, values the exchange always positively, and as a result it leads to making life ethical, bringing back respect for life and rights of every human being, granting the world a more human face. «Culture of encounter» has the power of social integration: it removes marginalization, the man is the goal not the means of actions, it does not allow a man to be reduced to a mere object, tools for profit or authority, but includes him into a community that is created by people and for their benefit. Society integrated in this way, constantly following «culture of encounter» rule, renews itself all the time and continually builds peace. All people are called to such building: believers and those who do not believe, all of good will. Also, the heads of state have in this effort of breaking the spiral of violence and a «culture of conflict» – both in economic and political dimension – big task and responsibility. Pope Francis reminded about this in a special letter to president of the Russian Federation Vladimir Putin on September 14, 2014 year. In the letter he wrote: «it is clear that, for the world’s peoples, armed conflicts are always a deliberate negation of international harmony, and create profound divisions and deep wounds which require many years to heal. Wars are a concrete refusal to pursue the great economic and social goals that the international community has set itself, as seen, for example, in the Millennium Development Goals. Unfortunately, the many armed conflicts which continue to afflict the world today present us daily with dramatic images of misery, hunger, illness and death. Without peace, there can be no form of economic development. Violence never begets peace, the necessary condition for development». On thebasis of the current teaching of PopeFrancisthe following conclusion can be drawn, thatthe key topeace in the worldin many dimensions- evenbetweenreligions–isadialoguedeveloped under «cultureof encounter».
