AbstractThis article argues that the establishment of the National Council of the Judiciary in 1989 and the empowerment of the general assemblies of court judges gave rise to the idea of judicial self-government in Poland. This very idea of self-government, implying that judges hold important decision-making or veto powers on matters concerning the judiciary, was regarded as a precondition of the separation of powers and judicial independence, neither of which existed under Communist rule. However, the package of laws introduced in 2017 marks the end of judicial self-government as we know it. Not only did it undermine the independence of the National Council of the Judiciary by altering the mode of electing its judicial members, but it also concentrated the power over the judiciary in the hands of the executive branch, allowing for, inter alia, the exchange of key positions in court administration and the reconfiguration of the Supreme Court. This article examines the impact of this “reform” on such values as independence, accountability, and transparency. Investigating the role of judicial self-government in ensuring the principle of separation of powers and democracy, the article concludes with an assessment of the early consequences of the introduced changes for the Polish judiciary.

This article discusses the judiciary and the role of law. It talks about the implications of the approach for issues in statutory interpretation, and then examines the relationship between the legal and political controls of bureaucracy. The last section in the article focuses on the implications for judicial independence within the larger separation-of-powers system. The emerging literature on Positive Political Theory (PPT) further stresses the political nature of legal decision-making and the dynamic relationship among the legislative, judicial, and executive branches.

Judicial independence is a cornerstone of contemporary constitutional systems within European legal orders that Poland, among many other European States, codified the principle at a constitutional level through Article 173 of the Constitution of the Republic of Poland. Nonetheless, the concrete implementation of the theoretical framework remains a bone of contention between the national States and the main international actors. The latter faction, based on the acknowledgement that no single political model could ideally comply with the principle of the separation of powers and secure complete independence of the judiciary, has developed an impressive number of legal tools that are part of a more diffuse European trend of interpretation, which should be labelled as European standard or European corpus aiming at preserving the judiciary order from outward interferences by the legislative and executive powers. In Poland, after the extensive victory earned by the Law and Justice (PIS) party in the Parliamentary election of 2015, the executive branch propelled a series of interlock reforms with the aim of reshuffling the whole judicial asset of the country. In the first place, the way forward was marked by a compound diatribe concerning the Constitutional Tribunal, and the essence of the dispute concerned the mandate’s legitimacy of three sitting judges after the Court’s reinterpretation of the K 34/15 ruling that ended up on 2.12.2015 with the election of five new judges appointed ex novo by the ruling party. Afterwards, the attention shifted towards the rethinking of the National Council of Judiciary (KRS), a mixed judicial body guardian of the independence of the judiciary, asserting, firstly, the unconstitutionality of its statute and, subsequently, planning a new method of appointment for the judicial members previously elected by the judiciary itself. Ultimately, as a closing step, the spotlight turned in the direction of the Supreme Courts judges, where the most spectacular sweep was the provision aimed at lowering the retirement age for the sitting judges on a scheme similar to the proposal made by the Hungarian government in 2011, where voices were raised, respectively, by the Hungarian Constitutional Court, the European Court of Justice and the European Court of Human Rights, and where, regretfully, the judicial independence standard played a minor role in the Courts’ reasoning. This concluding phase convinced the Commission to launch an expedited procedure against Poland before the Court of Justice, thus forcing the Polish government to retracts previous law through the adoption of a repealing law on 17.12.2018; in any event, as predicted earlier by the Opinion delivered by the AG Tanchev in Case C-619/18, the ECJ epilogue released on 24.6.2019, dissimilar to the one reached in the Hungarian case, was the heaviest ‘contrariness to EU law’.

Resumen: En las últimas décadas, las audiencias públicas realizadas en foros judiciales han sido señaladas como una de las innovaciones más importantes en las prácticas de los tribunales de altas instancias latinoamericanos. Estas audiencias prometen una renovación en los modos de pensar las tensas relaciones entre el poder judicial –especialmente su facultad de revisión de constitucionalidad– y la democracia a partir de la apertura del espacio judicial al diálogo y la participación de la ciudadanía, de las modalidades de intervención judicial para la protección de derechos, y de los aspectos simbólicos y políticos de herramientas que usualmente se reconocen como meramente procesales. A la luz de esos objetivos de renovación dialógica, pragmática y simbólica de las prácticas judiciales que abrieron las audiencias, este trabajo testea su grado de concreción a través de un estudio de los efectos de las audiencias públicas realizadas por la Corte Suprema de Justicia argentina en sus decisiones desde finales de 2004 hasta el 2017 inclusive.Palabras clave: Corte Suprema, audiencias públicas, participación ciudadana, deliberación, decisión judicialAbstract: The implementation of public hearings in judicial fora in the last decades has been considered from different perspectives one of the most important innovations in the practices of Latin American Courts. They promise a renovation in the ways of accommodating the tension between the role of Courts (especially their function of judicial review) and democracy; in the models of judicial decision making, and they point to the symbolic dimension of procedural rules and practices. This paper presents a study that tests the accomplishment of these promises tracing the impact of public hearings in the decisions of the Supreme Court of Argentina in the period between 2004 and 2017.Keywords: Supreme Court, public hearings, public participation, deliberation, judicial decision making.

Since the Revolution of Dignity in 2014, Ukraine has been carrying out revision and bringing to conformity with international standards of legislation in terms of judicial system and legal procedure. On 2 June, 2016 the law amending the Constitution of Ukraine in the part of justice, as well as the Law of Ukraine ‘On Judicial System and Status of Judges’ was adopted. On 13 July, 2017 a new Law of Ukraine ‘On the Constitutional Court of Ukraine’ was adopted. In the middle of December 2017, the election to the Supreme Court finished and its new composition was formed, at the same time the revision of all procedural codes took place. However, one on the main problems of the judiciary in Ukraine has been the problem of the judicial independence as a whole and in the part of independence of judges. The subject of this research is the question of judicial independence in the context of respective international standards. Similarly, the aim of part of the paper about the judicial system of Poland is to show the legislative changes regarding the judiciary which took place in Poland recently, i.e. within the last 3 years. As the ongoing changes of functioning, competence and organization of the Constitutional Tribunal, common courts, the Supreme Court and the National Council of Judiciary have been observed and commented upon by various European institutions, they will be shown in relation to the common European standards regarding the judicial independence presented in opinions and reports of Venice Commission, European Network of Councils of Judiciary and Consultative Council of European Judges.

When studying the impact of online reviews on product sales, previous scholars have usually assumed that every review for a product has the same probability of being viewed by consumers. However, decision-making and information processing theories underline that the accessibility of information plays a role in consumer decision-making. We incorporate the notion of review visibility to study the relationship between online reviews and product sales, which is proxied by sales rank information, studying three different cases: (1) when every online review is assumed to have the same probability of being viewed; (2) when we assume that consumers sort online reviews by the most helpful mechanism; and (3) when we assume that consumers sort online reviews by the most recent mechanism. Review non-textual and textual variables are analyzed. The empirical analysis is conducted using a panel of 119 cosmetic products over a period of nine weeks. Using the system generalized method of moments (system GMM) method for dynamic models of panel data, our findings reveal that review variables influence product sales, but the magnitude, and even the direction of the effect, vary amongst visibility cases. Overall, the characteristics of the most helpful reviews have a higher impact on sales.

In this article, the authors develop and empirically evaluate a general model of the linkages between domestic and international conflict behavior. Much of the literature on domestic international interactions has focused on the structural constraints of the international and domestic systems on leaders' foreign policy decisions. Rather than focusing on structural constraints, the present authors model the influence of the behavior of domestic and international rivals on leader decision making. The impact of rivals' behavior on conflict across the domestic-international nexus has been neglected relative to the role of structural factors. This study helps redress that imbalance. The authors test their model with a statistical analysis of Zaire during the period 1975 to 1992 and find substantial support for the model.

RESUMO:O objetivo deste artigo foi refletir sobre o atual papel do Poder Judiciário como porta-voz do texto constitucional e ator político em constante relação conflituosa com o legislativo. Discutiu-se sobre o ativismo judicial e a atuação do Supremo Tribunal Federal como legislador moral (superego da sociedade), a ideia do juiz herói e seus desdobramentos democráticos, principalmente quanto ao sistema de freios e contrapesos. Observou-se a existência de um movimento de hiperjudicialização de questões éticas e políticas, que acarreta o desequilíbrio da dinâmica institucional do modelo democrático. Conclui-se que a atuação do Poder Judiciário não deve ser marcada pelo decisionismo disfarçado de ordem de valores, nem tampouco deve atuar como legislador moral e nem permitir a ausência de vinculação ao padrão normativo. Foi sugerido, para tanto, o aperfeiçoamento da dinâmica institucional brasileira através da interação permanente entre o judiciário e o legislativo, em busca da formação de uma teoria normativa da separação de poderes que promova um debate qualitativo consubstanciado na razão pública, que resguarde direitos e tonifique a dimensão deliberativa do modelo político em vigor. Utilizou-se, para tal reflexão, do método de pesquisa bibliográfico.ABSTRACT:The purpose of this article was to reflect on the current role of the judiciary as a spokesperson for the constitutional text and political actor in constant conflicting relationship with the legislative. It was discussed about judicial activism and the performance of the Supreme Court as moral legislator (society’s superego), the idea of the judge hero and its democratic repercussions, especially regarding the system of checks and balances. The existence of a movement of hyperjudicialization of ethical and political issues was observed, which causes the imbalance of the institutional dynamics of the democratic model. It is concluded that the performance of the judiciary should not be marked by decisionism disguised as an order of values, nor should it act as a moral legislator or allow the absence of binding to the normative standard. To this end, it was suggested that the Brazilian institutional dynamics be improved through the permanent interaction between the judiciary and the legislature, seeking the formation of a normative theory of the separation of powers that promotes a qualitative debate embodied in public reason that safeguards rights and tones the deliberative dimension of the current political model. For such reflection, the bibliographic research method was used

Resumen:La presente contribución adopta como hipótesis de partida la relativa influencia de los estándares internacionales en la redacción de la Constitución de 1978 y la absoluta necesidad de adaptación a la realidad del Estado supranacional e internacionalmente integrado. En este sentido, un primer enfoque permite comprobar que, a pesar del juego potencial de las disposiciones constitucionales de apertura internacional, y tras cuatro décadas de vigencia de la Carta Magna Española de 1978, la justicia constitucional y la doctrina constitucionalista no han mostrado una actitud clara y abierta hacia las exigencias jurídicas internacionales, con la excepción de un relativo entusiasmo hacia los parámetros europeos. En efecto, en la parte central del artículo, el análisis de los cuarenta años constitucionalismo democrático bajo la Constitución de 1978 revela, primeramente, un déficit de interpretación basado en soluciones internacionales más favorables, así como una incorrecta e inexplorada concepción del impacto de los tratados internacionales en el sistema constitucional de fuentes.En segundo término, se examina la proyección positiva de los estándares internacionales tanto en la «parte dogmática» (valores, principios y derechos constitucionales) como en la «parte orgánica» de la Constitución (separación de poderes y organización territorial del poder), sin olvidar el peso de los instrumentos internacionales en la defensa del orden constitucional (mecanismos ordinario —tribunal constitucional— y extraordinario —reforma constitucional—). En tercer lugar, se somete a escrutinio la responsabilidad social de la Universidad en sus tareas de enseñanza y de investigación (especialmente en situaciones domésticas conflictivas), con objeto de transferir un conocimiento avanzado a la sociedad sin banalizar o trivializar la importancia del Derecho internacional y del Derecho constitucional en la defensa democrática del orden constitucional. Por último, se completa el análisis propuesto a través de la toma en consideración del lugar que también ocupan las normas constitucionales en los tratados internacionales y el impacto de nociones como margen de apreciación nacional, identidad constitucional y otras.La conclusión principal del trabajo consiste en sostener la necesaria retroalimentación de los estándares internacionales y constitucionales, puesto que esas sinergias positivas (incluido un diálogo judicial global) seguirán propiciando el fortalecimiento del sentimiento constitucional bajo una Carta Magna Española de 1978 inserta en un contexto cada vez más globalizado.Abstract:This papers adopts as a starting hypothesis the relative degree of influence of international standards in the drafting of the 1978 Spanish Constitution and the absolute need to accommodate to the reality of an integrated State at supranational and international levels. In this sense, a first approach shows that, despite the potential role of constitutional clauses opening to international standards, and after four decades since the entry into force of the Spanish Magna Carta of 1978, constitutional justice and constitutional doctrine have not shown clear nor open behaviour towards international legal requirements, with the exception of its relative enthusiasm towards European parameters.Indeed, in the main part of this paper, the analysis of the past forty yearsof democratic constitutionalism under the 1978 Constitution reveals, first and foremost, an interpretative deficit based on more favourable international solutions, as well as an incorrect and unexplored view of the impact of international treaties within the constitutional system of sources of law.Secondly, the positive impact of international standards is examined in  connection with both the «dogmatic part» (constitutional values, principlesand rights) and the «organic part» of the Constitution (separation of powers and territorial organization of the State), without forgetting the weight of international instruments in defending the constitutional order (ordinary —constitutional court— and extraordinary —constitutional amendment— mechanisms). Thirdly, the social responsibility of Universities in their teaching and research (especially in conflicting domestic situations) is submitted to scrutiny, in order to show its key role in transferring advanced knowledge to society without trivializing the importance of both international law and constitutional law in the democratic defense of the constitutional order. Finally, the place that constitutional norms occupy in international treaties, as well as the impact of notions such as (national) margin of appreciation, constitutional identity and others, are proposed so as to complete the analysis.The main conclusion of this paper holds the necessary feedback of internationaland constitutional standards, since these positive synergies (including a global judicial dialogue) will continue to promote the strengthening of a «constitutional feeling» under the 1978 Spanish Magna Carta, which is inserted in an increasingly globalized context.Summary:1. Preliminary issues: the influence of international standards in the drafting of the 1978 Constitution and the need for consistency with the reality of an integrated State at supranational and international levels. 2. Subsequent issues: the weight of constitutional jurisdiction confinement in light of international parameters. 3. Further questions: the presence of a self-absorbed constitutionalism with respect to international sources in general and relatively enthusiastic about European sources in particular. 4. Constitutional clauses on the open acceptance of international standards: particular focus on human rights instruments. 5. The objective of this study is to examine the Impact of Overconfidence bias and Herding bias on Investment Decision Making with Moderating Role of Financial Literacy. The population was Investor, Employee and Graduate Student. A sample of 200 was selected using convenience technique. Data were collected through structure questionnaire adopted from different papers. Correlation and Regression analysis were performed to examine the result. The Results show that overconfidence bias and herding bias have a positive impact on investment decision making and Financial Literacy has positive impact on investment decision making. Based on the results and discussions of the study findings as well as the limitations, theoretical and practical implications of the study have been provided.

Objective: This research aims to explain the impact of social media on the migration decision-making process of Indonesian student migrants in University of Groningen who used a social media account. In detail, this research will consider the role of social media in the migration decision-making process of students who emigrated from Indonesia and how they uses social media in the context of the migration decision-making process. Methods: The data collected included qualitative data from in-depth interviews and supported by study literatures. An interview guide was formulated to facilitate the indepth interviews and generate a better understanding of migration behavior. Expectation: Social media help Indonesian student migrants on migration decision making process and they use social media for searching information about destination area. Result: Student migrant in University of Groningen use their social media to gain information before they choose that university for study. They use Facebook to making contact with their friends and collagues in the destination country. Student group on Facebook help Indonesian student to get information about school and daily life.
