Conservative Liberalism, Ordo-liberalism, and the State

This book uses extensive original archival and elite interview research to examine the attempt to rejuvenate liberalism as a means of disciplining democracy and the market through a new rule-based economic and political order. This rebirth took the form of conservative liberalism and, in its most developed form, Ordo-liberalism. It occurred against the historical background of the great transformational crisis of liberalism in the first part of the twentieth century. Conservative liberalism evolved as a cross-national phenomenon. It included such eminent and cultured liberal economists as James Buchanan, Frank Knight, Henry Simons, Ralph Hawtrey, Jacques Rueff, Luigi Einaudi, Walter Eucken, Friedrich Hayek, Alfred Müller-Armack, Wilhelm Röpke, Alexander Rüstow, and Paul van Zeeland, as well as leading lawyers like Louis Brandeis, Franz Böhm, and Maurice Hauriou. It also played a formative role in establishing new international networks, notably the Mont Pèlerin Society. The book investigates the rich intellectual inheritance of this variant of new liberalism from aristocratic liberalism, ethical philosophy, and religious thought. It also locates the social basis of conservative liberalism and Ordo-liberalism in the cultivated bourgeois intelligentsia. The book goes on to examine the attempts to embed this new disciplinary form of liberalism in Britain, France, Germany, Italy, and the United States, and to consider the determinants of its varying significance across space and over time. It concludes by assessing the historical significance and contemporary relevance of conservative liberalism and Ordo-liberalism as liberalism confronts a new transformational crisis at the beginning of the new millennium. Is their promise of disciplining democracy and the market a hollow one?

Even before its hundredth year anniversary on 16 May 2016, the Sykes-Picot agreement had become a widely cited historical analogy both in the region itself and in Europe and the United States. In the Middle East, it is frequently deployed as an infamous example of European imperial betrayal and Western attempts more generally to keep the region divided, in conflict, and easy to dominate. In Europe and the United States, however, its role as a historical analogy is more complex—a shorthand for understanding the Middle East as irrevocably divided into mutually hostile sects and clans, destined to be mired in conflict until another external intervention imposes a new, more authentic, set of political units on the region to replace the postcolonial states left in the wake of WWI. What is notable about both these uses of the Sykes-Picot agreement is that they fundamentally misread, and thus overstate, its historical significance. The agreement reached by the British diplomat Mark Sykes and his French counterpart, François Georges-Picot, in May 1916, quickly became irrelevant as the realities on the ground in the Middle East, U.S. intervention into the war, a resurgent Turkey and the comparative weakness of the French and British states transformed international relations at the end of the First World War. Against this historical background, explaining the contemporary power of the narrative surrounding the use of the Sykes-Picot agreement becomes more intellectually interesting than its minor role in the history of European imperial interventions in the Middle East.

This chapter examines economic and monetary discipline. It notes that conservative liberals accorded great importance to law as the source of discipline, as exemplified by Franz Böhm, Louis Brandeis, and Maurice Hauriou. The chapter considers discipline in the history of liberalism, noting that it is not the exclusive property of conservative liberalism—though it is its predominant characteristic. It considers the social, economic, and political functions of rules, notably the work of Friedrich Hayek; the Currency and Banking Schools; the difficulties that arise in the choice, design, and use of rules; the reinforcement provided by credibility and time-consistency literature since the 1970s; the legitimacy and accountability problems of unelected power; the question of when discipline becomes the enemy of democracy and liberty; and the respective roles of the state and the market as sources of destabilizing shocks. The chapter stresses the rich and revealing use of metaphor by conservative liberals: their rejection of engineering metaphors for those of gardening, architecture, health and medicine, and religion. Ordo-liberalism is characterized as an open-ended tradition, with internal fragmentation and porous boundaries, its membership including migrants as well as natives. The notion of a mainstream is defined by a social process of selecting key texts as essential references and citations.

<p>Specialist law clinics now operate both in the developed and developing world. The historical background of these specialist law clinics can be traced to the United States. They also abound in South Africa, Europe and are fast emerging in several African countries. It is however outside the scope of this paper to describe the wide variety of specialist law clinic models that exist in other countries.</p><p><br />At present in Nigeria, there are seven Nigerian Universities with law clinics. These law clinics in enhancing the social justice frontier have developed projects addressing specific problems; making them specialists in service delivery, but the Women’s Law Clinic, is the only gender specialist law clinic.</p>

Sustaining extreme material inequality is neither easy nor automatic. It requires constant and active strategies of wealth defense by the rich, including using their money to hire protective services (which in the twentieth century took the form of a specialized wealth defense industry). An important transformation over the centuries was the movement of violence out of the hands of the rich in exchange for their support for impersonal institutions of coercion whose first priority has been the defense of property rights that make great fortunes viable politically. This chapter focuses on the changing politics and power that undergird wealth stratification. The analysis takes a deep historical view of the social tensions inherent in wealth concentration, starting with the origins of wealth inequality, and continuing with a discussion of the strategies and politics of wealth defense as personal fortunes grew in scale and as threats and predations multiplied. The second half of the chapter focuses on the modern era through an examination of the United States from the 1780s to the present. The US case demonstrates that for democracy and extreme wealth stratification to be compatible, democracy must first be structurally impaired and ideologically reframed to hinder egalitarian impulses from becoming government policy.

How did the affliction we now know as insanity move from a religious phenomenon to a medical one? How did social class, gender, and ethnicity affect the experience of mental trauma and the way psychiatrists diagnosed and treated patients? In answering these questions, this important volume mines the rich and unusually detailed records of one of Germany's first modern insane asylums, the Eberbach Asylum in the duchy of Nassau. It is a book on the historical relationship between madness and modernity that both builds upon and challenges Michel Foucault's landmark work on this topic, a bold study that gives generous consideration to madness from the patient's perspective while also shedding new light on sexuality, politics, and antisemitism in nineteenth-century Germany. Drawing on the case records of several hundred asylum patients, Sex, Religion, and the Making of Modern Madness reconstructs the encounters of state officials and medical practitioners with peasant madness and deviancy during a transitional period in the history of both Germany and psychiatry. As author Ann Goldberg explains, this era witnessed the establishment of psychiatry as a legitimate medical specialty during a time of social upheaval, as Germany underwent the shift toward a capitalist order and the modern state. Focusing on such "illnesses" as religious madness, nymphomania, and masturbatory insanity, as well as the construct of Jewishness, she probes the daily encounters in which psychiatric categories were applied, experienced, and resisted within the settings of family, village, and insane asylum. The book is a model of microhistory, breaking new ground in the historiography of psychiatry as it synthetically applies approaches from "the history of everyday life," anthropology, poststructuralism, and feminist studies. In contrast to earlier, anecdotal studies of "the asylum patient," Goldberg employs diagnostic patterns to illuminate the ways in which madness--both in psychiatric practice and in the experience of patients--was structured by gender, class, and "race." She thus examines both the social basis of rural mental trauma in the Vormärz and the political and medical practices that sought to refashion this experience. This study sheds light on a range of issues concerning gender, religion, class relations, ethnicity, and state-building. It will appeal to students and scholars of a number of disciplines.

Abstract: Harvey J. Sindima observed Liberation Theology as it flourished in Latin America, Africa, Asia, and the United States. The social situation in that society has some similarities in Luke's community. According to Philip Francis Esler's research, Luke's theology seeks to answer the social situation in Luke's community, especially regarding the relationship between the rich and the poor. This study aims to review Sindima's review of Liberation Theology based on Philip Francis Esler's thoughts on the relationship between rich and poor in Luke's Gospel. In Sindima's writings, the involvement of the rich has not been found as an effort to minimize the suffering of the poor. In this study, the author uses an analytical method. The result is that the good news for the poor in Liberation Theology is in line with the good news in Luke's Gospel. Moreover, in Luke's Gospel the liberation of the poor is not only the responsibility of the poor themselves as in the Theology of Liberation in Sindima's description, but also the responsibility of the rich as part of a sharing community.  Abstrak: Harvey J. Sindima mengamati Teologi Pembebasan yang berkembang di Amerika Latin, Afrika, Asia, dan Amerika Serikat. Situasi sosial dalam masyarakat tersebut memiliki beberapa kesamaan dalam komunitas Lukas. Menurut penelitian Philip Francis Esler, teologi Lukas berupaya menjawab situasi sosial dalam komunitas Lukas, terutama menyangkut hubungan orang kaya dan orang miskin. Penelitian ini bertujuan untuk meninjau uraian Sindima tentang Teologi Pembebasan berdasarkan pemikiran Philip Francis Esler berkenaan dengan hubungan orang miskin dan kaya dalam Injil Lukas. Dalam tulisan Sindima masih belum ditemukan keterlibatan orang kaya sebagai upaya meminimalisir penderitaan orang miskin. Dalam penelitian ini, penulis menggunakan metode analitis. Hasil tinjauan ini adalah bahwa kabar baik bagi orang miskin dalam Teologi Pembebasan sejalan dengan pemberitaan kabar baik dalam Injil Lukas. Lebih dari itu, dalam Injil Lukas pembebasan terhadap orang miskin bukan hanya menjadi tanggung jawab orang miskin itu sendiri sebagaimana dalam Teologi Pembebasan dalam uraian Sindima, tetapi juga merupakan tanggung jawab orang kaya sebagai bagian dari komunitas yang saling berbagi.

This chapter examines the rise of the welfare state in the United States following the Great Depression. It begins with a historical background on the welfare state, tracing its origins to Germany under Count Otto von Bismarck and discussing Britain's social welfare legislation that was passed in 1911. It then considers the views of Arthur C. Pigou, who published his basic work on economics, The Economics of Welfare, in 1920, and a host of factors that sparked the movement toward the welfare state. In particular, it looks at the role of the institutionalists, led by John R. Commons, and the University of Wisconsin as the source of both the ideas and the practical initiative basic to the welfare legislation. Finally, it describes the Social Security Act of 1935 and the business reaction to it.

A crise econômica que atinge os Estados Unidos e a Europa e a visibilidade mundial dos movimentos “Ocupem” nos Estados Unidos colocaram novamente o tema da desigualdade social em destaque. Geralmente, nas Igrejas e na teologia, esse assunto é objeto de crítica ética utilizando-se o conceito de classes sociais em termos de renda, ricos e pobres. Este artigo defende a tese de que, para superamos o cinismo frente ao sofrimento dos pobres, é preciso ir além: é preciso uma crítica teológica que se liberte do cinismo e trabalhe com a noção de classes sociais, associada ao lugar nas relações sociais de produção, de idolatria e de pecado estrutural.Abstract: The economic crisis affecting the United States and Europe and the worldwide visibility of the movement “Occupy” in the United States brought the issue of social inequality once more to the fore. Generally, in the Churches and in theology, this matter is the target of ethical criticism where the concept of social classes - in terms of income, the rich and the poor - is used. This article defends the thesis that, in order to overcome cynicism in face of the suffering of the poor, we must go further: we need a theological critique that can free itself from cynicism and work with the notion of social classes associated with the place in the social relations of production and with the notion of idolatry and structural sin.Keywords: Economics. Since the outbreak of the novel coronavirus (covid-19) pandemic from China in 2019, it has left the world leaders in great confusing due to its fast-paced propagation and spread that has left infected a world population of over Eleven Million persons with over five hundred and thirty four thousand deaths and counting with the United States of America, Brazil, Russia, India and Peru in the lead on these death toll. The pandemic whose increased mortality rate is targeted at ‘aged’ citizens, patients with low immunology as well as patients with chronic diseases and underlying health conditions. Study models covid-19 pandemic via a susceptible-infect-remove actor-based graph, with covid-19 virus as the innovation diffused within the social graph. We measure the rich connective patterns of the actor-based graph, and explore personal feats as they influence other nodes to adopt or reject an innovation. Results shows current triggers (lifting of inter-intra state migration bans) and shocks (exposure to covid-19 by migrants) will lead to late widespread majority adoption of 23.8-percent. At this, the death toll will climb from between 4.43-to-5.61-percent to over 12%.

Health disparities have once again moved to the forefront of America's consciousness with the recent significant observation of dramatically higher death rates among African Americans with COVID-19 when compared to White Americans. Health disparities have a long history in the United States, yet little consideration has been given to their impact on the clinical outcomes in the rehabilitative health professions such as speech-language pathology/audiology (SLP/A). Consequently, it is unclear how the absence of a careful examination of health disparities in fields like SLP/A impacts the clinical outcomes desired or achieved. The purpose of this tutorial is to examine the issue of health disparities in relationship to SLP/A. This tutorial includes operational definitions related to health disparities and a review of the social determinants of health that are the underlying cause of such disparities. The tutorial concludes with a discussion of potential directions for the study of health disparities in SLP/A to identify strategies to close the disparity gap in health-related outcomes that currently exists.
