Japan-EU Relations

Japan and the European Union have recently made several agreements aiming to deepen their cooperation. An example of this is the “Partnership on Sustainable Connectivity and Quality Infrastructure between the European Union and Japan,” by which both EU and Japan agreed to “promote free, open, rules-based, fair, non-discriminatory and predictable regional and international trade and investment, transparent procurement practices, the ensuring of debt sustainability and the high standards of economic, fiscal, financial, social and environmental sustainability.” This is just the latest part in an effort by both to revive multilateral cooperation in the face of US withdrawal from international agreements and the rise of a more assertive China. Japan and EUs Strategic Partnership Agreement provides a legally binding framework for further cooperation in the field of politics, security, and development. Underpinning it are shared values and principles of democracy, the rule of law, human rights, and fundamental freedoms. For the protection of democracy and the liberal world order, Japan and the EU seem like ideal partners. The question is whether ongoing shifts in the power balance, geopolitics, crises of liberalism, domestic politics, and legal and technological changes will lead to broader and deeper cooperation. This chapter provides a historical background to Japan-European relations from WWII until today. The relation started with a heavy emphasis on trade and business. It is only recently that the two have broadened their cooperation and now stand up as two of the strongest defenders of a liberal rule-based world order.

This chapter examines how the European Union is challenged by the BRICS (Brazil, Russia, India, China, and South Africa) and other emerging powers, along with its implications for the world order. It first provides an overview of the nature of the BRICS phenomenon before discussing the EU's contractual and political relations, as well as ‘strategic partnership’, with the BRICS countries and other emerging powers. It then considers the EU–BRICS relationship on the basis of three key perspectives: the EU as a subsystem of international relations, the EU as a power in international relations, and the EU as part of the wider processes of international relations. In particular, it explores the EU's capacity to generate external collective action towards the BRICS countries and other emerging powers. It also analyses EU–BRICS relations within the context of shifts in multilateralism and in the global governance architecture.

Japan and the European Union have historically developed relations, from trade conflicts to mutual cooperation between global actors. Japan’s prewar attitude and postwar rapid reconstruction caused misunderstandings and frictions, but these were gradually overcome thanks to the efforts made by Japan, the European Commission and member state governments. After the Cold War ended, policy fields of cooperation expanded from “mutual” market liberalization to foreign direct investments, aid, security, and environment. Japan and the EU jointly aided the newly liberalized countries in Central Eastern Europe, while the EU sought to strengthen its relations with countries in the Asia-Pacific. The Japan–EU Economic Partnership Agreement and the Strategic Partnership Agreement of 2018 were signed on the 50th anniversary of the customs union. The Agreements are jointly aimed by both parties to foster global free trade and shared values. For the first time in postwar history, Japan and the EU had reached an agreement before achieving one with the United States. Japan–EU relations are the strongest they have been since 1959 when the Japanese Mission to the European Communities and the European Commission Delegation to Japan were established. But the security threats in the Pacific indicate that bilateral relations between Japan and member states—the United Kingdom and France at the forefront—are still in play. The impact of Brexit, estimated to be felt more on the Japanese side, is also an issue requiring close study.

Poland accepted the alien and asylum policy of the European Union. But what does it mean, in the face of the fact that most of the refugees don´t want to sojourn a lot of time in Poland, but want to join their families or friends in Western Europe? How the transfer of policies does work, if the local conditions are quite different than in Germany or France? The answer seems to be the dramatization of the refugee situation in Poland, especially the adoption of emergency measures towards refugees of Chechnya.

The essence of international business, its active development and expansion, that influence the integration of economic systems and intensification of business relations between countries, are considered. The attention is paid to the international market of the European Union, first of all to Polish-Ukrainian cooperation due to the modern development of international business. The importance of the development of trade and business between Ukraine and Poland is determined, taking into account close relations in the field of economy, politics, culture and historical connections. The legal framework between Ukraine and Poland is substantiated, which ensures the proper development of bilateral cooperation at the level of strategic partnership and emphasizes the presence of an active dialogue between countries. The main agreements between Ukraine and the European Union, which influence the economic cooperation between Ukraine and Poland, are considered, taking into account Polish membership in the EU. The implementation of special projects by the European Union to support the development of Polish-Ukrainian cooperation is determined. The increase of the intensity of economic exchange between Ukraine and Poland, the active development of trade and investment in various spheres of business and the growth of economic indicators are determined. The peculiarities of the development of the small business sector and its influence on the stabilization of socio-economic processes between European countries are substantiated, emphasizing Poland's experience in development of the small business as a driving force on the way to economic integration. The main aspects and characteristics of international business between Poland and Ukraine are determined and the main differences in doing business in these countries are revealed, emphasizing the perspectives of development.

AbstractAccording to the aim of the Treaty of Rome from 1957 which postulated the free movement of workers throughout the European Union, the European Board of Psychiatry in the UEMS (European Union of Medical Specialists) carried out a comprehensive survey of training in psychiatry, including all member countries in order to evaluate the present state of training in psychiatry in each. We gathered 22 questionnaires from 31 national representatives involved and 424 questionnaires completed by the chief of training and the representative of trainees at the responding training centres from 22 countries. The results give an overview about the practice of training in psychiatry in many European countries. While there are great differences between the training centres in different countries, apparent progress towards developing high standards in training in psychiatry has been made.

AbstractModern constitutionalism is based on the paradigm that courts are inherently entitled and obliged to enforce the constitution of the respective polity. This responsibility of courts also applies in the context of the European Union to both the CJEU and national constitutional courts. The present chapter argues that in the face of constitutional crises the CJEU and the Hungarian Constitutional Court shy away from applying the law as it is to the full. The reasons behind this unwarranted judicial self-restraint are most different: the CJEU aims to avoid conflicts with national constitutional courts whereas the Hungarian Constitutional Court has been facing a legislative power also acting as constitution making power willing to amend the constitution to achieve specific legislative purposes or to undo previous constitutional court decisions. Yet both courts respond to expediencies that do not follow from the law they are called upon to apply. It is argued that rule of law backsliding requires these courts to abandon the unnecessary self-restraint and exploit the means already available.
