China’s IP Regulation and Omniscient Intermediaries: Oscillating from Safe Harbour to Liability

There are multiple forces that influence intermediary liability regulation in the People’s Republic of China (China). This chapter applies a holistic approach by analysing these individual forces to assess their influence on intermediary liability regulation in China. On the one hand, China’s draft E-Commerce Law raises the standard for knowledge before infringing information can be removed, while the many laws and regulations involved in censorship exclude the possibility of ignorance. On the other hand, there is case law, recently codified in guidelines for Beijing courts, which reinforces the duties of care. Moreover, this chapter connects discussions about the desirability of safe harbours and the degree of filtering requirements with the ongoing technological development of big data and artificial intelligence in China. In this context, the chapter also discusses self-regulation and pressure for online service providers to take on more responsibility in China.

Reverend John Leighton Stuart (1876–1962) served as U.S. ambassador to China from July 1946 until August 1949. In the many discussions of his ambassadorship the one diplomatic mission that has aroused the most speculation and debate was his abortive trip to Beijing, contemplated in June–July 1949, to meet with Mao Zedong and Zhou Enlai. Some students of Sino-American relations have claimed that had this trip been made the misunderstanding and subsequent hostility between the United States and the People's Republic of China in the post-1949 period could have been avoided; therefore, the unmaking of this trip constituted another “lost chance in China” in establishing a working relationship between the two countries. But others have thought that given the realities of the Cold War in 1949 and the internal political constraints existing in each country, no substantial result could have been gained from such a trip. Therefore, the thesis of a “lost chance in China” was more an unfounded speculation than a credible affirmation.

Mapping intermediary liability online is a high call impelled by the fragmentation of intermediary liability legislation, regulation, and case law that, nonetheless, apply to globalized online service providers operating across the world in an interdependent digital environment. The Oxford Handbook of Online Intermediary Liability endeavours to substantially contribute to this mapping exercise, both from a subject-specific and jurisdictional perspective, while highlighting emerging trends in a field of research that has been fast-evolving and is today in a constant, quite unpredictable, flux. This chapter contextualizes the mapping exercise undertaken by the contributors to the Handbook. It introduces the findings of subsequent chapters and sews them together in an organic discourse to provide a blueprint for the consistent development of those chapters as it sets out in advance the most relevant trends according to which the structure of the Handbook has been generated.

The paper presents outcomes and perspectives of the research on the development of will and self-regulation in childhood. The authors implement an interdisciplinary approach that combines psychological, pedagogical, physiological, and neurophysiological exploration of the problem. Will and self-regulation are considered not only as the phenomena of different phenomenology, but also as differing in their genesis. Priority is given to the line of will development associated with the formation of internal movements, corporeality, individuality. It is on this path that self-regulation of behavior is successfully formed. ‘Premature self-regulation’, on the contrary, makes it difficult for free will to develop. At the focus of the interdisciplinary research is the pedagogical technology “School for Developing Individuality” (“Rostok”), which is currently being implemented at an experimental site in Novosibirsk. The psychological views of the authors are in the mainstream of the cultural-historical tradition founded by L.S. Vygotsky, the approaches to the problem of will and self-regulation development of L.I. Bozhovich, A.V. Zaporozhets, A.N. Leontiev. The article, on the one hand, summarizes the results of the many years of work, and on the other hand, outlines the prospects that are associated, in particular, with the continuation of neurophysiological studies carried out on the experimental site. Even the first results obtained make it possible not only to capture objectively the various developmental mechanisms in children learning by different pedagogical technologies, but also to identify new neurophysiological phenomena and to reveal the psychological background of neurophysiological phenomena that have been discovered recently and are still mysterious for science, for example, the default mode network.

Анотація. Стаття присвячена аналізу особливостей формування соціальної компетентності дітей дошкільного віку. Проблема соціальної компетентності дошкільнят – одна з найактуальніших. Розв’язання її, з одного боку, допоможе здійснити системний, цілісний підхід до розвитку дитини, з другого – співвіднести цей розвиток з життям. Сучасна система освіти та виховання намагається втілити гуманістичні ідеали виховання досконалої людини, вільної особистості, здатної жити і творчо діяти в умовах змінного соціуму. Виховання такої людини виступає на перший план. Загальні підходи до формування соціальної компетентності дитини визначаються принципами гуманізації виховання – олюдненні виховних стосунків, визнанні цінності дитини як особистості, її значущості в суспільстві, заснованої на усвідомленні своїх зв’язків з оточуючими людьми і в цілому – місця у людстві. Такий підхід відповідає загальній меті виховання – формуванню цілісної, гуманної особистості, орієнтованої на відтворення цінностей національної та загальнолюдської культури у творчій життєдіяльності, саморозвиток і моральну саморегуляцію поведінки. З огляду на це особливої значущості набуває проблема становлення соціальної компетентності старших дошкільників. Оскільки на сучасному етапі розвитку освіти мають місце суперечності між процесом формування соціально-активної особистості та умовами її соціалізації, то перш за все доцільно посилити увагу до підготовки майбутніх вихователів. Зосереджена увага автора на необхідності підготовки майбутніх вихователів до успішної реалізації процесу соціалізації особистості дошкільного віку. Розкрито компоненти готовності майбутніх вихователів до формування соціальної компетентності старших дошкільників, виокремлено педагогічні умови для покращення стану готовності майбутніх вихователів до формування соціальної компетентності старших дошкільників. Abstract. The article is devoted to the analysis of features social competence formation of the preschool age children. The problem of social competence of preschool children is one of the most topical. On the one hand, the solving of it will help to implement a systematic, holistic approach to child development, on the other - will help to correlate this development with life. The modern system of education and upbringing tries to embody the humanistic ideals of the education of a perfect person, a free personality, to be able to live and act creatively in a changing society. The upbringing of such a person is the main task. General approaches to the formation of social competence of the child are determined by the principles of humanization education - the humanization in education relations, the recognizing the value of the child as a person, its importance in society, based on awareness of their relationships with the other people and in general - its place in humanity. This approach corresponds to the general purpose of the education - the formation of a holistic, humane personality, who is focused on the reproduction of the values of the national and universal culture in the creative life, self-development and moral self-regulation of behavior. In this case, the problem of the social competence formation of the older preschoolers becomes especially important. As at the present stage of the development of the education there are the contradictions between the process of the formation of the socially active personality and the conditions of its socialization, so, first of all, it is necessary to pay more attention to the training of the future educators. The author payed more attention to the necessarity to prepare future educators for their successful implementation to the process of the preschool personality's socialization. The components of readiness of future educators for the formation of social competence of senior preschoolers are revealed, pedagogical conditions for improving the state of readiness of future educators for the formation of social competence of senior preschoolers are singled out. It was discloced the components of future educators readiness for the formation of the social competence in the senior preschoolers , it was separated the pedagogical conditions how to improve the readiness of future educators for the formation of social competence in senior preschoolers.

This paper examines a principle of particular relevance for administrative action and the concept of good administration, namely the principle of reasonableness, at the EU level, from the point of view of the Italian administrative doctrine, and jurisprudence of the Council of State. Specific attention will be paid to the many faces and functions of reasonableness, in administrative proceeding as well as in judicial review of discretion, and its connection with the idea of proportionality. Moreover, this article will discuss the influence and effects of the application of general principles of EU law on the Italian legal order. Finally, it will describe the EU principle of reasonableness has influenced the Italian administrative (case) law. This article aims to show that on the one hand the European principles of reasonableness and proportionality seem to be smoothly absorbed in the Italian administrative case law; on the other, the Europeanisation process still encounters resistance from a part of the Italian doctrine that persists in categorizing reasonableness as a principle different from proportionality.

The Viennese modern choreographer Gertrud Bodenwieser's black coat leads to an analysis of her choreography in four main phases – the early European career; the rise of Nazism; war's brutality; and postwar attempts at reconciliation. Utilising archival and embodied research, the article focuses on a selection of Bodenwieser costumes that survived her journey from Vienna, or were remade in Australia, and their role in the dramaturgy of works such as Swinging Bells (1926), The Masks of Lucifer (1936, 1944), Cain and Abel (1940) and The One and the Many (1946). In addition to dance history, costume studies provides a distinctive way to engage with the question of what remains of performance, and what survives of the historical conditions and experience of modern dance-drama. Throughout, Hannah Arendt's book The Human Condition (1958) provides a critical guide to the acts of reconstruction undertaken by Bodenwieser as an émigré choreographer in the practice of her craft, and its ‘materializing reification’ of creative thought. As a study in affective memory, information regarding Bodenwieser's personal life becomes interwoven with the author's response to the material evidence of costumes, oral histories and documents located in various Australian archives. By resurrecting the ‘dead letters’ of this choreography, the article therefore considers how dance costumes offer the trace of an artistic resistance to totalitarianism.

‘Accountability’ is one of the democratic values entrenched in the Constitution of South Africa, 1996. It is a value recognised throughout the Constitution and imposed upon the law-making organs of state, the Executive, the Judiciary and all public functionaries. This constitutional imperative is given pride of place among the other founding values: equality before the law, the rule of law and the supremacy of the Constitution. This study therefore sets out to investigate how the courts have grappled with the interpretation and application of the principle of accountability, the starting point being the relationship between accountability and judicial review. Therefore, in the exercise of its judicial review power, a court may enquire whether the failure of a public functionary to comply with a constitutional duty of accountability renders the decision made illegal, irrational or unreasonable. One of the many facets of the principle of accountability upon which this article dwells is to ascertain how the courts have deployed that expression in making the state and its agencies liable for the delictual wrongs committed against an individual in vindication of a breach of the individual’s constitutional right in the course of performing a public duty. Here, accountability and breach of public duty; the liability of the state for detaining illegal immigrants contrary to the prescripts of the law; the vicarious liability of the state for the criminal acts of the police and other law-enforcement officers (as in police rape cases and misuse of official firearms by police officers), and the liability of the state for delictual conduct in the context of public procurement are discussed. Having carefully analysed the available case law, this article concludes that no public functionary can brush aside the duty of accountability wherever it is imposed without being in breach of a vital constitutional mandate. Further, it is the constitutional duty of the courts, when called upon, to declare such act or conduct an infringement of the Constitution.

This article examines how female conditioning and sexual repression affect the woman’s sense of self, womanhood, identity and her place in society. It argues that the woman’s body is at the core of the many sites of gender struggles/ politics. Accordingly, the woman’s body must be decolonised for her to attain true emancipation. On the one hand, this study identifies the grave consequences of sexual repression, how it robs women of their freedom to choose whom to love or marry, the freedom to seek legal redress against sexual abuse and terror, and how it hinders their quest for self-determination. On the other hand, it underscores the need to give women sexual freedom that must be respected and enforced by law for the overall good of society.

Las TIC median las interacciones y la comunicación de los estudiantes a diario. Se conciben como mediado-ras de la reflexión y la autorregulación de la actividad del estudiante, resultante de la interacción consciente de la percepción que tiene el estudiante sobre si con la que negocia con el resto de los estudiantes, los ase-sores y la sociedad en general. En este contexto el aprovechamiento de las TIC debe promover una influen-cia formativa en los espacios formales y no formales. Las condicionantes de complementariedad de espa-cios y de unidad en la diversidad de recursos tecnológicos y didácticos deben guiar la actividad que tenga al estudiante como centro de la misma.Ya no se trata de integrar las TIC en el proceso de formación, haciéndolo formal y estandarizado. El reto está en que sean las características personales de los estudiantes, sus estilos de aprendizaje, sus conoci-mientos y experiencias previas, y sus esquemas afectivos los que marquen el aprovechamiento de las TIC en la evaluación del aprendizaje autónomo de inglés.En el presente trabajo se estructura el aprovechamiento de las TIC mediante un EPA base para la evalua-ción del aprendizaje autónomo de inglés. El EPA base constituye un andamiaje de personas, procedimien-tos, espacios de interacción, y de recursos tecnológicos y didácticos. Los componentes que lo conforman se encuentran débilmente acoplados por la tecnología y altamente cohesionados por la significatividad de las conexiones que el estudiante establece entre ellos. Palabras Clave: Aprendizaje, Autonomía, Entorno, Evaluación, Personal. ABSTRACT There is no doubt about the key role of ICT in the interaction and communication processes among students. ICT are thought as a mean for the reflection and self-regulation of students´ activity, which is in a permanent conscientious comparison between the perception a student has about him/herself and the one he/she nego-tiates with the rest of students, advisors and society in general terms. In this context, ICT should promote a positive influence on student formation in formal and non-formal spaces. The conditionals related to spaces combined support and union in the diversity of technological and didactical resources should guide every activity having students at the center of its conception.It is no longer about integrating ICT to the formation process making it formal and standardized. The chal-lenge on autonomous language learning evaluation with ICT has to do with making the differences through personal characteristics of students, their learning styles, previous experiences and affective schemas.In this paper the use of ICT is structured by means of a PLE frame for the evaluation of English autonomous language learning. It is a scaffolding of people, procedures, interaction spaces, and technological and didac-tical resources.
