National minimum wages could gain more ground in EU

Subject The relationship between minimum wages and employment in the EU. Significance The introduction of a national statutory minimum wage in Germany this year took the number of EU states without one to just six out of 28. The German move raised opposition from business groups which warned that companies would shift production to countries with lower labour costs. The UK government's recent announcement of a statutory national 'living wage', higher than the minimum wage, has similarly triggered a debate about the implications for employment. Impacts In Austria and Nordic states without a statutory national minimum wage, collectively negotiated sector minimum wages fulfil the same role. The opening of such labour markets to foreign workers, not typically covered by collective agreements, is challenging the current system. Italy is considering the introduction of a national minimum wage but trade unions are opposed.

AbstractSocial partners have played a privileged role in German social security administration since Bismarckian times. In 2014, a new legislation empowered the social partners to set the level of the statutory minimum wage and to demand the extension of collective agreements. This article examines the interdependence of the trade unions’ and employer organisations’ membership numbers and their involvement in state regulation of labour and social security law. In case the interest in autonomous regulations is not going to increase, the state will have to step in with more heteronomous regulation. This would incrementally lead to a system change.

PurposeThe purpose is to analyze the spatially varying impacts of corruption and public debt as % of GDP (proxies of government failures) on non-performing loans (NPLs) in European countries; comparing two periods: one prior to the crisis of 2007 and another one after that. The authors first modeled the NPLs with an ordinary lest square (OLS) regression and found clear evidence of spatial instability in the distribution of the residuals. As a second step, the authors utilized the geographically weighted regression (GWR) to explore regional variations in the relationship between NPLs and the proxies of “Government failures”.Design/methodology/approachThe authors first modeled the NPL with an OLS regression and found clear evidence of spatial instability in the distribution of the residuals. As a second step, the author utilized the Geographically Weighted Regression (GWR) (Fotheringham et al., 2002) to explore regional variations in the relationship between NPLs and proxies of “Government failures” (corruption and public debt as % of GDP).FindingsThe results confirm that corruption and public debt as % of GDP, after the crisis of 2007, have affected significantly on NPLs of the EU countries and the following countries neighboring the EU: Switzerland, Iceland, Norway, Montenegro, and Turkey.Originality/valueIn a spatial prospective, unprecedented in the literature, this research focused on the impact of corruption and public debt as % of GDP on NPLs in European countries. The positive correlation, as expected, between public debt and NPLs highlights that fiscal problems in Eurozone countries have led to an important rise of problem loans. The impact of institutional corruption on NPLs reports that the higher the corruption, the higher is the level of NPLs.

Задачей данной статьи является рассмотрение лингвопрагматических особенностей комментариев пользователей социальной сети «Твиттер» на выход Великобритании из ЕС. Анализ данных комментариев с лингвопрагматической точки зрения представляет интерес, так как показывает наиболее актуальную картину отношения пользователей социальных сетей к произошедшему событию. Приоритетными методами анализа лингвопрагматического потенциала Интернет-комментариев для нас являются: описательный метод, метод прагматического анализа, т.е. рассмотрение языкового материала в его непосредственном контексте в функциональном аспекте, метод частичной выборки, метод контекстологического описания. Контекстуальный метод был использован с целью установления особенностей комментариев в среде социальной сети «Твиттер»; описательный метод - для выявления непосредственного отношения пользователей социальных сетей к выходу Великобритании из ЕС; частичной выборки - для отбора наиболее эффективных и целостных комментариев с позиции прагматики и их реализации в данном контексте. Проведённое исследование позволило установить, что большинство людей удовлетворено результатами выхода Великобритании из ЕС и положительно отзывается об этом событии. Об этом свидетельствует как большое количество экспрессивов, использованных в интернет-комментариях в отношении данного события, так и активное употребление в них оценочной лексики. Результаты проведённого исследования могут быть применены в теоретических работах по описанию характеристик речевых актов, в курсе теоретической грамматики, стилистики, прагмалингвистики. The purpose of this article is to review the linguo-pragmatic features of Brexit represented in the comments in Twitter. Their analysis from a linguistic-pragmatic point of view may be of interest, since it shows the most relevant picture of the relationship of social network users for the event. The priority methods for analyzing the linguo-pragmatic potential of Internet comments for us are: a descriptive method, a pragmatic analysis method, i.e. consideration of linguistic material in its immediate context in the functional aspect, partial sampling method, contextual description method. The contextual method was used to establish the characteristics of comments on the Twitter social network; descriptive method was used to identify the direct relationship of social network users to the UK exit from the EU; partial sampling was used to select the most effective and holistic comments from the position of pragmatics and their implementation in this context. The study found that most people are satisfied with the results of the UK exit from the EU and respond positively to this event. The results of the study can be applied in theoretical works on the description of the characteristics of speech acts, in the course of theoretical grammar, stylistics, pragmalinguistics.

Purpose The outbreak of the severe acute respiratory syndrome coronavirus 2 virus and subsequent COVID-19 illness has had a major impact on all levels of society internationally. The extent of the impact of COVID-19 on prison staff and prisoners in England and Wales is unknown. Testing for COVID-19 both asymptomatic and symptomatic, as well as for antibodies, to date, has been minimal. The purpose of this paper is to explore the widespread testing of COVID-19 in prisons poses philosophical and ethical questions around trust, efficacy and ethicacy. Design/methodology/approach This paper is both descriptive, providing an overview of the widespread testing of COVID-19 in prisoners in England and Wales, and conceptual in that it discusses and argues the issues associated with large-scale testing. This paper provides a discussion, using comparative studies, of the issues associated with large-scale testing of prisoners across the prison estate in England and Wales (120 prisons). The issues identified in this paper are contextualised through the lens of COVID-19, but they are equally transferrable to epidemiological studies of any pandemic. Given the prevalence of COVID-19 globally and the lack of information about its spread in prisons, at the time of writing this paper, there is a programme of asymptomatic testing of prisoners. However, there remains a paucity of data on the spread of COVID-19 in prisons because of the progress with the ongoing testing programme. Findings The authors argue that the widespread testing of prisoners requires careful consideration of the details regarding who is included in testing, how consent is gained and how tests are administered. This paper outlines and argues the importance of considering the complex nuance of power relationships within the prison system, among prisoner officers, medical staff and prisoners and the detrimental consequences. Practical implications The widespread testing of COVID-19 presents ethical and practical challenges. Careful planning is required when considering the ethics of who should be included in COVID-19 testing, how consent will be gained, who and how tests will be administered and very practical challenges around the recording and assigning of COVID-19 test kits inside the prison. The current system for the general population requires scanning of barcodes and registration using a mobile number; these facilities are not permitted inside a prison. Originality/value This paper looks at the issues associated with mass testing of prisoners for COVID-19. According to the authors’ knowledge, there has not been any research that looks at the issues of testing either in the UK or internationally. The literature available details countries’ responses to the pandemic rather and scientific papers on the development of vaccines. Therefore, this paper is an original review of some of the practicalities that need to be addressed to ensure that testing can be as successful as possible.

Purpose – The purpose of this paper is to explore the contours of fairness by showing how different facets of fairness impact three important employee outcomes (job satisfaction, turnover intention and employer advocacy) and examining the mediating role of quality of management and leadership (through perceptions of both senior management and the quality of exchange with immediate supervisors) in attenuating negative impacts of unfairness on these outcomes. The study extends the concept of fairness beyond the traditional focus on organizational justice and models the mediating role of leadership on the relationship between (un)fairness and the three employee-level outcomes in a sample of employees representative of the UK workforce. Design/methodology/approach – Data were obtained from a nationally representative sample of 2,067 employees in the UK. Exploratory factor analysis and then confirmatory factor analysis is used to refine three unfairness factors and address their dimensionality of the unfairness scale and then multiple regression analysis is used to test a fairness-leadership-employee performance outcome model. Findings – Results of multiple regression analysis revealed that both trust in leadership and leader-member exchange partially mediate the relationship between organizational (un)fairness and job satisfaction, advocacy and turnover intention, respectively. Practical implications – The findings highlight the important role that leaders play in influencing the relationship between perception of unfairness and employee outcomes. This has implications for both theory and practice as it suggests that the pattern of inclusion that leaders create through the relationships that they develop with their followers has a significant impact on the relationship between unfairness and the work outcomes. They not only must manage traditional perceptions of justice, but also the assessments employees make about trust in management judgements and the perceived consequences of such judgements. Originality/value – In an environment where perceptions of unfairness are becoming both more endemic but also more complex, the study shows that both senior leaders and immediate supervisors have important agency in managing negative consequences. Through the measurement of satisfaction, turnover intention and employer advocacy it also provides potential links to link fairness into the engagement literature.

PurposeThe relationship between interlocking directorates and firm performance has been increasingly debated, with a focus on whether firm's centrality in interlock networks is associated with performance. The purpose of this study is to examine not only how a firm's position in this network is associated with performance but also how the performance of network partners can impact a firm's performance. This study examines how firms effectively utilise the interlock network to achieve the goal of higher market capitalisation – termed market capitalisation rank (MCR).Design/methodology/approachThe premise of the study is the UK FTSE 350 firms from 2014 to 2018. The paper makes use of a temporal network autocorrelation model to examine how firm characteristics, the structural position in the interlock network and the performance of network partners affect MCR over time.FindingsThe analysis indicates that firms with ties (via the interlock network) to firms with high market capitalisation are more likely to enhance their own MCR, highlighting network partners have the opportunity to play a critical role in a firm's dominance strategy to optimise firm value.Originality/valueThe value of this research is that it does not only look at the impact of a firm's position in the network on performance, but the impact of the performance of network partners on a firm's market performance as well.

Purpose Recent research shows that because of money-laundering risks, there has been an increase in the off-boarding of certain types of corporate clients in the financial sector. This phenomenon known as “de-risking” has been argued to have a negative impact on society, because it increases the possible risk of money laundering. The purpose of this paper is to analyze whether the de-risking strategy of financial institutions results in an expansion of the regulatory framework concerning anti-money laundering focusing on off-boarding of clients and, if so, is there a way to avoid further regulation by changing present behavior. Design/methodology/approach This paper applies functional methods to law and economics to achieve higher efficiency in combating money laundering. Findings In this paper, it is found that the continuing of de-risking by financial institutions because of the avoidance strategy of money-laundering risks will inevitably result in further regulatory demands regarding the off-boarding process of clients. The legal basis for the introduction of further regulatory intervention is that some of the de-risking constitutes a direct contradiction to the aim of the present regulatory framework, making the behavior non-compliant to the regulation. Originality/value There has been very little research concerning de-risking related to money laundering. The present research has focused on the effect on society and not the relationship between the financial institutions and the regulator. This paper raises an important and present problem, as the behavior of the financial institutions constitute a response from the regulator that is contradicting the thoughts behind the behavior of the financial institutions. It is found that the paper is highly relevant if an expansion of regulation is to be hindered.

The literature on minimum wages in Mexico has focused largely on their impact on poverty, and poverty reduction, while their relationship with inequality has not been fully explored. The purpose of this chapter is to examine the status and dynamics of the minimum wage in Mexico and its relation with income inequality from a Latin American comparative perspective. In this context, we are mostly interested in juxtaposing the Mexican experience with the cases of Brazil, Argentina, and Chile, as three countries of roughly comparable economic development in the region pursuing labour policies diametrically opposing those of Mexico. In light of this Mexican exceptionality, we analyse the relationship between minimum wages and inequality in the country, and what Mexico could learn from the diverging experience of the other countries, with the aim of providing some recommendations to policymakers.

This chapter explores the modern minimum wage framework in detail. The first section begins by exploring the background to the National Minimum Wage Act through the lens of the relationship between minimum wages and wage supplementation. The second section then explores the conceptual structure of the Act in more detail. In particular, it explores how an individual’s minimum wage entitlement is assessed; the types of ‘work’ that are either implicitly or expressly, excluded from the Act; and the content of the concept of the ‘wage’. It concludes with some remarks about what the Act’s structure implies about the legal system’s understanding of the role of minimum ‘wage’ regulation today.

This chapter focuses on the current interaction between European Union and UK law. EU law is currently a source of UK law. However, the relationship between the two regimes is expected to change in the future as a consequence of the UK’s decision to withdraw from the EU. The European Union (Withdrawal) Act 2018 stipulates that the European Communities Act 1972 will be ‘repealed on exit day’, which would be 29 March 2019 provided that the two-year period since Article 50 TEU was triggered is not extended. Once the European Communities Act 1972 has been repealed, EU law will cease to be a source of UK law. No major immediate changes to the national competition legislation are to be expected, but future reforms could distance the UK system from the EU rules.
