Russian Legal Culture: An Analysis of Adaptive Response to an Institutional Transplant

This article is an inquiry into Russian legal culture and is based on the assumption that any institution transplanted from one social environment to another will be reinterpreted and reshaped, so that it can be accepted into the receiving society. The process of adaptation creates an opportunity to examine the receiving society's established practices and way of thinking. To demonstrate their effects, this article explores the author's research findings carried out in two Russian towns where institutions of media self‐regulation were set up. The findings are analyzed comparatively in order to identify how the key players in the two towns interpreted the initial ideas, established procedures and rules for the newly set up institutions, and defined the roles that were attributed to them. The results of the two‐city case study are then used to interpret some specifics of the internal logic of the local legal culture.

Organisations have started to adopt open innovation processes to supplement their internal competencies and resources. Adoption of these processes assist them in keeping up with the pace of technology and protecting their competitive advantage in the market. Despite the significance of open innovation processes, there are few studies focusing on them. The purpose of this study is mapping coupled open innovation processes to contribute to the field of open innovation. The case study research was set up to explore how organisations undertake coupled open innovation processes from the perspective of employees working in a small-medium sized enterprise. The Activity Theory was used as a research framework. The research findings revealed how the importing and exporting mechanisms of coupled processes. The findings are discussed to fill the knowledge gaps in the existing literature and help design management academia and practice identify future work areas.

This paper aims to understand the Pragmatism way of thinking in the practice of education. As a case study, Riri Reza's Laskar Pelangi is used to find out how Pragmatism practices in education in Indonesia. By using descriptive-critical method of interpretation and interpretation, it is revealed that the main characters in the film Laskar Pelangi experience a dilemma situation that leads them to choose a way of life based on internal logic and actual experience. As for the criticisms, as well as the implications of, pragmatism thinking refers its potentiality to the individualistic way of thinking, especially in the axiological sphere, namely by believing that there is no universal value in social life.

Although teaching reflection diaries (TRDs) are prevalent tools for teacher training, TRDs are rarely used in Japanese secondary educational settings. In order to delve into the effects of TRDs on teaching development, this illustrative case study was conducted with two female teachers (one novice, and one experienced) at a Japanese private senior high school. The research findings demonstrated that both in-service teachers perceived TRDs as beneficial tools for understanding their strengths and weaknesses. TRDs and class observations illustrated that the novice teacher raised their self-confidence in teaching and gradually changed their teaching activities. On the other hand, the experienced teacher held firm teaching beliefs based on their successful teaching experiences and were sometimes less willing to experiment with different approaches. However, they changed their teaching approaches when they lost balance between their class preparation and other duties. Accordingly, although teachers’ firm beliefs and successful experiences may sometimes become possible hindrances from using TRDs effectively, TRDs can be useful tools to train and help teachers realise their strengths and weaknesses.

This paper adopted a case study approach to investigate the sustainability practices of a Scottish university in order to understand if sustainability forms part of its central policy agenda. As such, the paper focuses on the levels of awareness and disclosure of their sustainable practices, measuring the impacts and effectiveness of those initiatives. This paper introduces signaling theory to explore the idea that appropriate communication via integrated thinking can close the gap between the organization and its stakeholders. We believe that the provision of this relevant information will lead to better communication between the organization and its stakeholders, supporting a signaling theory interpretation. Therefore, we are suggesting that integrated thinking is an internal process that organizations can follow to increase the level of disclosure as a communication tool with stakeholders. From the literature reviewed, four themes were identified (definition of university sustainability, sustainability awareness, disclosure framework within universities, and level of accountability). The research adopted a pragmatic view and conducted individual interviews with participants belonging to three stakeholder groups (members of the university’s senior management, the governing council, and the student union executive). Although this study focused on just one Scottish university, it should still provide some insight for the better understanding of the underpinning issues surrounding the sustainability accountability practices of Scottish universities in general. The research findings indicated that the university prioritized only two sustainability dimensions—economic and environmental—and that the university still perceived sustainability as a voluntary exercise. Additionally, it is evident that the university had no framework in place for measuring its sustainability delivery—and therefore had no established medium of communicating these activities to its stakeholders. Moreover, research findings showed that the social and educational context of sustainability was lacking at the university. The university has done little or nothing to educate its stakeholders on sustainability.

It is commonly thought that the promotion of faculty members is affected by their research performance. The current study is unique in examining how academic faculty members perceive the harm or damage to academic appointment and promotion processes, as a direct effect of student evaluations as manifested in teaching surveys. One hundred eighty two questionnaires were collected from senior faculty members at academic institutions. Most respondents were from three institutions: Ariel University, Ben Gurion University, and the Jezreel Valley College. Qualitative and statistical research tools were utilized, with the goal of forming a model reflecting the effect of the harm to academic appointment and promotion processes, as perceived by faculty members. The research findings show that the lecturers find an association that causes harm to their promotion processes as a result of student evaluations. Assuming that students' voices and their opinion of teaching are important – the question is how should these evaluations be treated within promotion and appointment processes: what and whom do they indicate? Do they constitute a reliable managerial tool with which it is possible to work as a foundation for promotion and appointment processes – or should other tools be developed, unrelated to students' opinions?

This paper reports on a case study of the community group Zero Emissions Noosa, whose goal is for 100% renewable electricity in the Noosa Shire (Queensland, Australia) by 2026. Described within this paper are the processes used by Zero Emissions Noosa to set up their zero emissions plan, involving community engagement and the use of an external consultant. The external consultant was employed to produce a detailed report outlining how to successfully achieve zero emissions from electricity in the Noosa Shire by 2026. This paper explains how and why the community engagement process used to produce the report was just as important as the outcomes of the report itself. Modeling was undertaken, and both detailed and contextual information was provided. Inclusion of the community in developing the scenario parameters for the modeling had a number of benefits including establishing the context within which their actions would occur and focusing their efforts on options that were technically feasible, financially viable and within their capabilities to implement. This provided a focal point for the community in calling meetings and contacting stakeholders. Rather than prescribing a particular course of action, it also resulted in a toolbox of options, a range of possible solutions that is flexible enough to fit into whatever actions are preferred by the community. The approach and outcomes discussed in this paper should, therefore, be useful to other communities with similar carbon emission reduction goals.

In 2015 the Truth and Reconciliation Commission of Canada concluded a six-year process of listening to the stories of Canada’s First Nations, Inuit and Métis peoples. More than 6000 witnesses came forth to share their personal experiences in listening sessions set up all across the country. These stories primarily revolved around their experience of abuse and cultural genocide through more than 100 years of Residential Schools, which were operated in a cooperative effort between churches and the government of Canada. The Commission’s Final Report includes 94 calls to action with paragraph #60 directed specifically to seminaries. This paper is a case study of how Taylor Seminary, in Edmonton, is seeking to engage with this directive. It explores the changes made in the curriculum, particularly in the teaching of missiology, and highlights some of the ways the seminary community is learning about aboriginal spirituality and the history and legacy of the missionary methods that have created conflict and pain in Canadian society.

It is commonplace to observe that the history of thought reveals certain recurring patterns whose mode of expression changes according to context. It is equally apparent that to chart the salient characteristics of an influential way of thinking – to give concrete, clearly defined shape to the usually tangled fundamental impulses informing a cast of mind – is a complex, difficult task which calls for attention from (at least) the historian, the psychologist, the philosopher and, in the case of religious figures and movements, the theologian alike. With regard to the manner of thinking embodied in the theological doctrines of Martin Luther such a task is fraught with more than the usual number of pitfalls. In the first place, following recent Luther scholarship, we must be wary of assuming that the great Reformer held fast to a single set of theological opinions throughout his long career. We shall not, therefore, attempt to reach conclusions applicable to Luther's thought as a whole, but rather shall focus exclusively on a number of key early expositions of the Theologia Crucis. Here, between about 1514 and 1520, we find, according to our argument, enough thematic unity to warrant the search for underlying principles. A second, less easily disposed of difficulty is the lack of a working consensus as to how and with what aims in mind one should even begin an historical analysis of Luther's texts. For example, to the believer who regards Luther's basic tenets as in a straightforward sense divinely inspired, the attempt to extract from his writings the ingredients of a certain thoroughly human way of thinking will seem doomed to inadequacy from the start. Both law and medicine rely on self-regulation and codes of professionalism to ensure duties are performed in a competent, ethical manner. Unlike physicians, however, judges are lawyers themselves, so judicial oversight is also self-regulation. As previous literature has highlighted, the hesitation to report a cognitively-compromised judge has resulted in an “opensecret” amongst lawyers who face numerous conflicts of interest.Through a case study involving a senior judge with severe cognitive impairment, this article considers the unique ethical dilemmas that cognitive specialists may encounter when navigating duties to patient, society, and the medical profession, without clear legal guidance.Systemic self-regulatory inadequacies in the legal profession are addressed, as well as challenges that arise when trying to preserve the trust and dignity of an incapacitated patient who must fulfill special duties to society.Ultimately, because of their unique neurological expertise and impartial assessments, we submit that allowing cognitive specialists to submit their assessments to an internal judiciary board may act as an additional check and balance to ensure the fair and competent administration of justice.
